RECOMMENDATION 1) Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15303 under Class 3 (New Construction or Conversion of Small Structures), because it has no potential to have a significant effect on the environment; 2) Waive City Council Policy L-6, Encroachments in Public Rights -of -Way, to allow the construction of nine sets of permanent below -grade structural tie -backs that encroach into the Ocean Boulevard/CdM Main Beach Ramp public right-of-way contingent upon all conditions of the Encroachment Permit process being met; and 3) Adopt Resolution No. PC2019-007 waiving City Council Policy L-6 and approving Encroachment Permit No. N2017-0642 (Attachment No. PC 1). 1 9 Arvielo Residence Encroachments (PA2019-013) Planning Commission, March 7, 2019 Page 2 I i SUBJECT '- •' PROPERTY P p f PA I 4 �'' Arvielo Residence Encroachments (PA2019-013) Planning Commission, March 7, 2019 Page 3 The property owners ("Owners") of 3100 Breakers Drive are redeveloping the property. The project consists of demolition of the existing three-story duplex and the construction of a new three-level, 6,150 -square -foot duplex with a basement game room, carport and garage (Attachment No. PC 2). After an administrative review of the project plans, staff determined the project to be in full compliance with all regulations and issued an approval - in -concept allowing the Owners to file for a coastal development permit with the California Coastal Commission (CCC). On January 1, 2019, the CCC issued coastal development permit (CDP) 5-16-0298 for the proposed development (Attachment No. PC 3). To construct the building as designed and approved, a shoring system consisting of a shot- crete retaining wall with permanent soldier piles and structural tie -backs into the slope is necessary. The wall and piles would be on private property. The required length of the tie -backs would mostly be on private property; however, a portion would encroach into the public right-of-way below grade. City Council Policy L-6 prohibits the proposed encroachment and the Owners are requesting a waiver of the policy to specifically construct nine sets of permanent below -grade structural tie -backs under the Ocean Boulevard/CdM Main Beach Ramp public right-of-way (Attachment No. PC 4). City Council Policy L-6, Encroachments in Public Rights -of -Way ('Policy"), explains and describes how the public rights-of-way are to be reserved for public use or open space; and that the rights of the public, present and future, are not to be diminished by the installation of private improvements within the public rights-of-way. The Policy specifies allowable and prohibited encroachments and describes the required permits and encroachment agreements (Attachment No. PC 5). Section A of Policy L-6 outlines private encroachment prohibitions including "...structural encroachments including, but not limited to, fences, walls, patios, raised planters, landscaping, etc., which encroach in excess of one (1) -foot into the public right-of-way or exceed three (3) -feet in height." The Owners are requesting a waiver of this policy to allow the construction of nine sets of permanent below -grade structural tie -backs that encroach in excess of 1 -foot into the slope of Ocean Boulevard/CdM Main Beach Ramp. Each set of tie -backs consists of four tie -backs aligned vertically. The proposed tie -back encroachments vary from 12 feet to 33 feet into the public right-of-way and do not project past the curb face of the CdM Main Beach Ramp. The proposed tie -backs are at a minimum depth of approximately 52 feet below the existing grade of the CdM Main Beach Ramp. At the proposed depths of the structural tie -back system, existing and future improvement, including but not limited to utilities, would not be impacted. Similar permanent structural tie -back encroachments have been approved at 3431 Ocean Boulevard (Encroachment Permit No. N2011-0190) and 3619 Ocean Boulevard (Encroachment Permit No. N2006-0300) along the Ocean Boulevard public right-of-way (Attachment No. PC 6). In both previous approvals, the encroachment did not project Arvielo Residence Encroachments (PA2019-013) Planning Commission, March 7, 2019 Page 4 past the Ocean Boulevard curb face consistent with the proposed project at 3100 Breakers Drive. Based on the information provided by the applicant, the use of the permanent tie -back system will provide the following public benefit: • The retaining wall and permanent tie -back system will stabilize the coastal bluff which is subject to erosion under natural conditions; • The system will limit the disruption of the hillside preserving the bluff and avoid the disruption of the soil and vegetation on the slope because the improvements are completely below grade; The project slope mainly consists of dirt and will be landscaped as part of the proposed project consistent with the City's landscape requirements (e.g., drought tolerance, water efficiency, and no invasive species). The proposed landscaping will be subject to the review and approval of the Community Development and Public Works Departments and will be limited to preserve and maximize public views; • The proposed design will support the hillside and access roadway to CdM Main Beach; • The permanent structural tie -backs are well below any existing utilities within the encroachment area; • The permanent tie -backs would not impact any future improvements including utilities since they are well below the existing street grade; and • Approval would require the Owners to enter into an Encroachment Agreement and any liability associated with the proposed private improvement would be transferred to the Owners. The Public Works Director and staff have reviewed this request and support this policy waiver. In staffs review of the existing site conditions, the proposed improvements do not hinder the use of the public right-of-way, including existing and future utilities. The proposed private improvement will not be a detriment to the health, safety and welfare of the public. Lastly, the proposed improvements will not diminish the rights of the public, present and future, at this location provided an encroachment agreement between the City and the Owners is executed. Should the Planning Commission elect to approve the waiver and allow the construction of the private improvements and appurtenances, staff recommends the requirement of an encroachment agreement consistent with Policy L-6. The encroachment agreement specifies the rights of the City and any liability associated with the proposed private 5 Arvielo Residence Encroachments (PA2019-013) Planning Commission, March 7, 2019 Page 5 improvement would be transferred to the Owners. The encroachment agreement will be recorded onto the property's title, provides important notice for the current and future property owners, and protects the City. ENVIRONMENTAL REVIEW This project is categorically exempt pursuant to Title 14 of the California Code of Regulations Section 15303, Article 19 of Chapter 3, Guidelines for Implementation of the California Environmental Quality Act (CEQA) under Class 3 (New Construction or Conversion of Small Structures), because it has no potential to have a significant effect on the environment. Class 3 exempts the construction of a duplex and multi -family residential structures totaling no more than six units and appurtenant structures. The proposed project consists of the installation of tie -backs that are appurtenant to the construction of a new duplex. The exceptions to this categorical exemption under Section 15300.2 of Title 14 of the California Code of Regulations Section 15303, Article 19 of Chapter 3 are not applicable. The project location does not impact an environmental resource of hazardous or critical concern, does not result in cumulative impacts, does not have a significant effect on the environment due to unusual circumstances, does not damage scenic resources within a state scenic highway, is not a hazardous waste site, and is not identified as a historical resource. PUBLIC NOTICE The agenda item has been noticed according to the Brown Act. Additionally, notice has been provided in accordance with City Council Policy L-6 requiring a mailed notice to property owners within 300 feet of the project site and a notice posted on site at least 10 days in advance of this meeting. PC2019-007 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF NEWPORT BEACH, CALIFORNIA, WAIVING CITY COUNCIL POLICY L-6 AND APPROVING ENCROACHMENT PERMIT NO. N2017-0642 FOR A REQUEST TO CONSTRUCT PERMANENT IMPROVEMENTS WITHIN THE PUBLIC RIGHT-OF-WAY LOCATED AT 3100 BREAKERS DRIVE (PA2019-013) THE PLANNING COMMISSION OF THE CITY OF NEWPORT BEACH HEREBY FINDS AS FOLLOWS: SECTION 1. STATEMENT OF FACTS. An application was filed by Geoff Sumich, Geoff Sumich Design, on behalf of the property owners Enrico Arvielo and Patricia Arvielo (collectively, "Owner'), with respect to property located at 3100 Breakers Drive, Newport Beach, California requesting a waiver of City Council Policy L-6 and approval of an encroachment permit. 2. The Applicant requests to construct nine (9) sets of permanent structural tie -back improvements within the Ocean Boulevard/Corona del Mar Main Beach Ramp public right- of-way encroaching between twelve (12) feet and thirty three (33) feet into the public right- of-way and a minimum of fifty three (53) feet below the existing street grade. 3. The requested encroachments are not specifically provided within City Council Policy L-6, thus, the requested encroachments are prohibited under Section A(1) of said policy. Due to this prohibition, the requested encroachment may only be approved upon the waiver of City Council Policy and approval of the encroachment permit by Planning Commission. 4. A public meeting was held on March 7, 2019, in the City Council Chambers located at 100 Civic Center Drive, Newport Beach. A notice of time, place and purpose of the hearing was given in accordance with the Newport Beach Municipal Code. Evidence, both written and oral, was presented to, and considered by, the Planning Commission at this hearing. 5. The subject property is located within the coastal zone. The proposed project obtained and Coastal Development Permit (CDP No.5-16-0298) from the California Coastal Commission. SECTION 2. CALIFORNIA ENVIRONMENTAL QUALITY ACT DETERMINATION. This project is categorically exempt pursuant to Title 14 of the California Code of Regulations Section 15303, Article 19 of Chapter 3, Guidelines for Implementation of the California Environmental Quality Act (CEQA) under Class 3 (New Construction or Conversion of Small Structures), because it has no potential to have a significant effect on the environment. The project location does not impact an environmental resource of hazardous or critical concern, does not result in cumulative impacts, does not have a significant effect on the environment due to unusual circumstances, does not damage scenic resources within a state scenic highway, is not a hazardous waste site, and is not identified as a historical resource. SECTION 3. REQUIRED FINDINGS. In accordance with City Council Policy L-6, Encroachments in the Public Rights -of -Way, the following findings and facts in support of such findings are set forth: Finding: A. The proposed permanent improvements will not be a detriment to the health, safety and welfare of the public. Facts in Support of Finding: The proposed permanent private improvements do not hinder the present or future use of the public right-of-way, including utilities, and the existing utilities located within the encroachment area are mot impacted. 2. The proposed permanent private improvements do not impede coastal public access, degrade visual quality of public coastal view, or have any potential impact to sensitive habitat in the Coastal Zone for the following reasons: a. The proposed tie -backs are at a minimum depth of approximately fifty three (53) feet below the existing street grade and therefore, would not impede public vehicular or pedestrian access. b. At the proposed depths of the structural tie -back system, existing and future improvement, including but not limited to, utilities would not be impacted. The proposed permanent improvements do not impede access to public utilities. c. The proposed permanent improvements do not diminish the right of the public, present and future. Findinq: B. The individual circumstances applicable to this application and the proposed encroachment are consistent with the public interest. Facts in Support of Finding: 12 Planning Commission Resolution No. PC2018-030 Paqe 3 of 4 The proposed permanent private improvements would help in supporting and stabilizing the adjacent coastal bluff. 2. The proposed permanent private improvements minimize the disruption to the hillside, preserving the coastal bluff. 3. The proposed landscape improvements within the hillside would enhance the views from the Ocean Boulevard/Corona del Mar Main Beach Ramp public right-of-way. 4. Maintains pedestrian access to the Ocean Boulevard/Corona del Mar Main Ramp sidewalk and parkway area. SECTION 4. DECISION. NOW, THEREFORE, BE IT RESOLVED: The Planning Commission of the City of Newport Beach hereby waives City Council Policy L-6 and approves Encroachment Permit N2017-0642, subject to the conditions set forth in Exhibit A, which is attached hereto and incorporated by reference. 2. This action shall become final and effective fourteen (14) days following the date this Resolution was adopted unless within such time an appeal or call for review is filed with the City Clerk in accordance with the provisions of Title 20 Planning and Zoning, of the Newport Beach Municipal Code. The Owner shall comply with all federal, state, and local laws. Material violation of any of those laws in connection with the use may be cause for revocation of this Encroachment Permit and any associated Encroachment Agreements. 4. The Owner shall enter into an Encroachment Agreement within one (1) calendar year upon receipt of approval, otherwise this approval shall automatically expire. 5. The hillside behind the subject property shall be landscaped. The landscape plans shall be reviewed and approved by the Community Development and Public Works Departments and shall maintain public views from the public right-of-way. 6. The retaining wall, soldier piles and permanent structural tie -back system shall be designed to support the hillside and roadways above. 7. To the fullest extent permitted by law, Applicant shall indemnify, defend and hold harmless City, its City Council, its boards and commissions, officials, officers, employees, and agents from and against any and all claims, demands, obligations, damages, actions, causes of action, suits, losses, judgments, fines, penalties, liabilities, costs and expenses (including without limitation, attorney's fees, disbursements and court costs) of every kind and nature whatsoever which may arise from or in any manner relate (directly or indirectly) to City's approval of the Encroachment Permit for the property located at 3100 Breakers Drive, Newport Beach, California, including, but not limited to, Encroachment Permit No. N2017- 0642. This indemnification shall include, but not be limited to, damages awarded against the City, if any, costs of suit, attorneys' fees, and other expenses incurred in connection with such claim, action, causes of action, suit or proceeding whether incurred by Applicant, City, and/or the parties initiating or bringing such proceeding. The Applicant shall indemnify the City for all of City's costs, attorneys' fees, and damages which City incurs in enforcing the indemnification provisions set forth in this condition. The Applicant shall pay to the City upon demand any amount owed to the City pursuant to the indemnification requirements prescribed in this condition. By acceptance of this Permit, the applicants further agree, on behalf of themselves and all successors and assigns, that the landowner shall remove the development authorized by this Permit, including the residence, garage, and driveway, if any government agency has ordered that the structures are not to be occupied due to any of the hazards identified above, or if any public agency requires the structures to be removed. The approved project may be constructed and used consistent with the terms and conditions of this permit for only as long as it remains safe for occupancy and on private property. If any portion of the development at any time encroaches onto public property, the permittee shall remove the encroaching portion of the development. The permittee shall obtain a coastal development permit for removal of approved development unless the Executive Director provides a written determination that no coastal development permit is legally required 2. Assumption of Risk, Waiver of Liability and Indemnity. By acceptance of this permit, the applicants acknowledge and agree (i) that the site may be subject to hazards, including but not limited to [modify following list as necessary to address specific case] waves, storms, flooding, landslide, bluff retreat, erosion, and earth movement, many of which will worsen with future sea level rise; (ii) to assume the risks to the permittee and the property that is.the subject -of this permit of injury and damage from such hazards in connection with this permitted development; (iii) to unconditionally waive any claim of damage or liability against, the Commission, its officers, agents; and employees for injury or damagefrom.such hazards; and (iv) to indemnify and hold harmless the Commission, its officers, agents, and employees with respect to the Commission's approval of the project against any and all liability, claims, demands, damages, costs (including costs,and fees incurred in defense of"such claims), expenses, and amounts paid in settlement arising from any injury or damage due to such hazards. 3. Future Development. This permit is only for the development described in coastal development permit (CDP) 5-16-0298. Pursuant to Title 14 California Code of Regulations (CCR) Section 13250(b)(6), the exemptions that would otherwise be provided in Public Resources Code (PRC) Section 30610(a) shall not apply to the development governed by CDP 5-16-0298. Accordingly, any future improvements to this structure authorized by this permit shall require an amendment to CDP 5-16-0298 from the Commission or shall require an additional CDP from the Commission or from the applicable certified local government. In addition thereto, an amendment to CDP 5-16-0298 from the Commission or an additional CDP from the Commission I or from the applicable certified local government shall berequired for any repair or maintenance identified as requiring a permit pursuant to PRC Section 30610(d) and Title 14 CCR Sections 13252(a) -(b). 4. Storage of Construction Materials, Mechanized Equipment and Removal of Construction Debris. The permittee shall comply with the following construction -related requirements: A. No demolition or constriction materials, debris, or waste shall be placed or stored where it may enter sensitive habitat, receiving waters or a storm drain, or be subject to wave, wind, rain, or tidal erosion and dispersion; B. No demolition or construction equipment, materials, or activity shall be placed in or occur in any location that would result in impacts to environmentally sensitive habitat areas, streams, wetlands or their buffers; 31 Page 4 December 21. 2018 Permit Application No.: 5-16-0298 COASTAL DEVELOPMENT -PERMIT C. Any and all debris resulting from demolition or construction activities shall be removed from the project site within 24 hours of completion of the project; D. Demolition or construction debris and sediment shall be removed from work areas each day that demolition or construction occurs to prevent the accumulation of sediment and other debris that may be discharged into coastal waters; E. All trash and debris shall be disposed in the proper trash and recycling receptacles at the end of every construction day; F. The applicants shall provide adequate disposal facilities for solid waste, including excess concrete, produced during demolition or construction; G. Debris shall be disposed of at a Iegal disposal site or recycled at a recycling facility. 1f the disposal site is located in the Coastal Zone, a coastal development permit or an amendment to this permit shall be required before disposal can take place unless the Executive Director determines that no amendment or new permit is legally required; H. All stock piles and construction materials shall be covered, enclosed on all, sides, shall be located as far away as possible from drain inlets and any waterway, and shall not be stored in contact with the soil; 1. Machinery and equipment shall be maintained and washed in confined areas specifically designed to control runoff. Thinners or solvents shall not be discharged into sanitary or storm sewer systems; J. The discharge of any hazardous materials into any receiving waters shall be prohibited; K. Spill prevention and control measures shall be implemented to ensure the proper handling and storage of petroleum products and other construction materials. Measures shall include a designated fueling and vehicle maintenance area with appropriate berms and protection to prevent any spillage of gasoline or related petroleum products or contact with runoff. The area shall be located as far away from the receiving waters and storm drain inlets as possible; L. Best Management Practices (BMPs) and Good Housekeeping Practices (GHPs) designed to prevent spillage and/or runoff of demolition or construction -related materials, and to contain sediment or contaminants associated with demolition or construction activity, shall be implemented prior to the on -set of such activity; and M. All BMPs shall be maintained in a functional condition throughout the duration of construction activity. N. During construction of the project, no runoff, site drainage or dewatering shall be directed from the site into any street, alley or stormdrain, unless specifically authorized by the California Regional Water Quality Control Board. 5. Conformance with Drainage and Run -Off Control Plan. The applicants shall conform with the drainage and run-off control plan dated November 10, 2016 showing roof drainage and runoff from all impervious areas directed to bioretention planters and trench drain. Any proposed changes to the approved plan shall be reported to the Executive Director. No changes to the approved plan shalt occur without a Commission.amendment to this Coastirl Development Permit unless the Executive Director determines that no amendment is legally required. 6. Landscaping -Drought Tolerant, Non -Invasive Plants. Vegetated landscaped areas shall only consist of native drought tolerant non-invasive plant species native to coastal Orange County and appropriate to the habitat type: No plant species listed as problematic and/or invasive by the 32 Page 5 December 21, 2018 Permit Application No.: 5-16-0298 COASTAL DEVELOPMENT PERMIT California Native Plant Society (http://www.CNP§.ora the California Invasive Plant Council (formerly the California Exotic Pest PIant Council) (ham://www.cal-ipc.orgo, or as may be identified from time to time by the State of California shall be employed or allowed to naturalize or persist on the site. No plant species listed as a "noxious weed" by the State of California or the U.S. Federal Government shall be utilized within the property. All plants shall be low water use plants as identified by California Department of Water Resources (See: httn://www.water.ca.gov/water.useefficiencv/docs/wucols00.pdt). Use of reclaimed water for irrigation is encouraged. If potable water is used for irrigation only drip or micro spray irrigation systems may be used. Other water conservation measures shall also be considered, such as use of weather based irrigation controllers. Pool Protection Plans. PRIOR TO ISSUANCE OF THE COASTAL DEVELOPMENT PERMIT, the applicants shall submit, for the'Executive Director's review and approval, two (2) full size sets of a pool protection plan prepared by an appropriately licensed professional that incorporates mitigation of the potential for geologic instability caused by leakage from the proposed pool. The pool protection plans shall incorporate and identify on the plans the follow measures, at a minimum: 1) installation of a pool leak detection system such as, but not limited to, leak detection system/moisture sensor with alarm and/or a separate water meter for the pool which is separate from the water meter for the house to allow for the monitoring of water usage for the pool, and 2) use of materials and pool design features, such as but not limited to, double Iinings, plastic linings or specially treated cement, to be used to waterproof the undersides of the pool to prevent leakage, along with information regarding the past and/or anticipated success of these materials in preventing leakage; and where feasible 3) installation of a sub drain or other equivalent drainage system under the. spa that conveys any water leakage to an appropriate drainage outlet. The applicants shall comply with the pool protection plans approved by the Executive Director. The permittees shall undertake development in accordance with the approved final plans. Any proposed changes to the approved final plans shall be reported to the Executive Director. No changes to the approved final• plans shall occur without a Commission amendment unless the Executive Director determines that no amendment -is -legally required.. 8, Bird Strike Prevention. PRIOR TO ISSUANCE OF THE COASTAL DEVELOPMENT PERMIT, the applicants shall submit, for the review and approval of the Executive Director, two (2) sets of revised project plans showing the location, design, height and materials of glass railings, fences, screen walls and gates. Said plans shall reflect the requirements of this special condition. Beachfront glass railings, screen walls, fences and gates subject to this permit shall use materials designed to minimize bird -strikes with the railing, screen wall, fence, or gate. Such materials may consist, all or in part, of wood; metal; frosted or partially -frosted glass, Plexiglas or other visually permeable barriers that are designed1d prevent creation of a bird strike hazard. Clear glass or Plexiglas shall not be installed unless an ultraviolet -light reflective coating specially designed to reduce bird -strikes by reducing reflectivity, and transparency is also used. Any coating or shall be installed to provide coverage consistent with manufacturer specifications and the recommendations of the Executive Director.. Deed Restriction. PRIOR TO ISSUANCE OF THE COASTAL DEVELOPMENT PERMIT, the applicants shall submit to the Executive Director for'review and approval documentation demonstrating that the landowners have executed and recorded against the parcel(s) governed by this permit a deed restriction, in a form and content acceptable to the Executive Director: (1) indicating that, pursuant to this permit, the California Coastal Commission has authorized development on .the subject property, subject to terms and conditions that restrict the use and enjoyment of that property; and (2) imposing the Special Conditions of this permit as covenants, conditions and restrictions on the use and enjoyment of the Property. The deed restriction shall include a legal description of the entire parcel or parcels governed by this permit.. The deed, restriction shall also indicate that, in the event of an extinguishment or termination of the deed restriction for any reason, the terms and conditions of this permit shall continue to restrict the use and enjoyment of the subject property so long as either this permit or the development it authorizes, or any part, modification, or amendment thereof, remains in existence on or with respect to the subject property. L-6 ENCROACHMENTS IN PUBLIC RIGHTS-OF-WAY It is the general policy of the City that the public rights-of-way shall be reserved for public use or open space; and that the rights of the public, present and future, shall not be diminished by the installation of private improvements within the public rights-of-way. For any project located within the Coastal Zone also look to Newport Beach Municipal Code Title 21, or any successor title. Categories of encroachments and improvements are listed below, together with the permit requirement for each category. Permit and/or encroachment agreement required. A. Except as expressly set forth herein, permits and/ or encroachment agreements are required for encroachments into the public rights-of-way. B. Application for any permit, as required by this policy, shall be filed with the Public Works Department on a form to be provided by the City and shall show the proposed planting or work and the nature thereof. Drawings for encroachment permits requiring Planning Commission review shall be prepared to scale. Plan and elevation drawings shall accurately depict location, height, and extent of the proposed encroachments. C. If the application is for a permit required under private encroachments that are prohibited without a waiver, it shall be submitted to the Planning Commission for consideration. The Planning Commission is designated to grant or deny a waiver and approve, conditionally approve, or deny applications for encroachment permits, subject to the findings in subsection (a), of this Section. The Planning Commission may grant a waiver and may approve or conditionally approve an application for an encroachment permit if the Planning Commission finds the encroachment will not be a detriment to the health, safety, and welfare of the public. b. If an application for a private encroachment that is prohibited without a waiver is part of a larger approval requiring City Council approval, then the Planning Commission shall make a recommendation to the City Council regarding whether this policy should be waived and the permit granted. 55 L-6 C. The Planning Commission shall have discretion to refer any request for a waiver or encroachment permit before the Planning Commission to the City Council for consideration. d. Any decision made by the Planning Commission may be appealed or called for review in accordance with Chapter 20.64. 2. Notice of the Planning Commission's review of a request to waive a provision of this policy shall be: a. Mailed to property owners within 300 feet of the project site at least ten (10) calendar days in advance of a meeting. The notice shall contain the address of the project site, the applicant's name, a brief description of the improvements, date, time, and place of the meeting, and a statement informing the public that they have the ability to provide comments to the Planning Commission; and b. Posted on or close to the subject property in a prominent location at least ten (10) calendar days before the scheduled hearing by the Planning Commission in the following manner: i. One or more sign(s) shall be posted as determined by the Public Works Director. ii. The size and location of the sign(s) shall be as determined by the Public Works Director. iii. The applicant for the encroachment permit/waiver shall be responsible for maintaining the sign(s) in a satisfactory condition. iv. The applicant for the encroachment permit/waiver shall remove all sign(s) at the end of the appeal period. 2 50 Lori Private encroachments that are prohibited without a waiver and approval. A. All structural encroachments including, but not limited to, fences, walls, patios, raised planters, landscaping, etc., which encroach in excess of one (1) -foot into the public right-of-way, or exceed thee (3) -feet in height, measured from the top of curb elevation/ or from sidewalk elevation where sidewalk exists. B. Driveway approaches not conforming to Council Policy L-2. C. Modifications to original design concepts approved by the City. D Private signs except as provided for in the Building Code. E. Lighting. F. Parkway walkway surfacing of loose rock, gravel, or any surfacing other than standard or colored/ textured concrete or flat stone/brick/pavers installed at grade. G. Private dwellings and appendages including raised patios decks and bay windows, except as provided for in this section and the Building Code. H. Pay telephones and private mail carriers drop boxes. General private encroachments that require an encroachment permit and if applicable, an encroachment agreement from the Public Works Department. A. Drive approaches conforming to Council Policy L-2. B. Standard sidewalks. C. Carriage walks (not to exceed twenty-five percent (25%) of the parkway area). D. Parkway surfacing (standard or colored/ textured concrete or flat stone/brick) installed at grade (not to exceed twenty-five percent (25%) of the parkway area). E. CATV and public utility facilities. 57 3 L-6 F. Structural encroachments including, but not limited to, fences, walls, patios, raised planters, etc., which encroach one (1) foot or less and do not exceed three (3) feet in height within the public right-of-way. If, however, in the opinion of the Public Works Department, the nature or location of this type of encroachment is such that Planning Commission review is warranted, the Department may forward the item to the Planning Commission for action in accordance with the procedures set forth for granting waivers for private encroachments that would otherwise be prohibited. G. Mailboxes, when required by the U.S. Postal Service. Mailboxes shall be installed per U.S. Postal Service requirements. Mailbox base construction length and width shall not exceed the length of the mailbox, or twenty-four (24) inches, whichever is less. H. The placement of utility pedestals shall be at the back of sidewalks on arterials and major pedestrian thoroughfares without zero setbacks. There shall beat least four (4) feet of clear sidewalk width and/or pedestals shall be placed in the parkway outside of walk area. I. When connecting to or relocating public utilities. J. Artificial Turf (permeable) up to 100% of the required parkway landscape area. Artificial turf grass shall be installed in accordance to manufacturers' recommendations. Material must be securely anchored and maintained so as to eliminate disrepair, fading, tearing, wrinkling and or edge curling or any other type of material performance. Material shall be replaced prior to the aforementioned conditions occur. Prohibited application: Indoor and outdoor carpet, green in color or otherwise. The Director of Public Works shall from time to time update the standards for this application. See Artificial Turf Material and Installation Standards. K. Tree and shrub planting and removal. L. Median landscaping. If, in the opinion of the Public Works Departments, the approved planting is not being maintained for view, safety clearance and sight distance, Newport Beach Municipal Code Chapter 10.50, "Public Nuisance Abatement," or any successor statute, shall be used to remove offending plant material. M 54 L-6 The permit applicant shall reimburse the City of Newport Beach for the value of any City tree removed by this process. This value shall be determined by the City Arborist using the International Society of Arboriculture's "Guide for Plant Appraisal" or a minimum forty-eight (48) inch box tree replacement value. Area specific private encroachments requiring an encroachment permit from the Public Works Department and subject to the execution of an encroachment agreement for non-standard improvements. A. Structural encroachments which do not exceed three (3) feet in height measured from the top of curb elevation/ or from sidewalk elevation where sidewalk exists, including, but not limited to fences, walls, and raised planters in public rights-of- way in areas that are more than eight (8) feet behind the face of curbs on the following streets: 1. Santa Ana Avenue from Cliff Drive to Fifteenth Street. B. Permitted Structural Encroachments on Balboa Island along South Bay Front, North Bay Front, Grand Canal, and East Bayfront are as follows: 1. Planters that do not exceed one (1) foot in height may be installed between the back of existing sidewalk and property line, planted with ground cover and shrubs not to exceed two (2) feet in height measured from sidewalk elevation; 2. Fences and walls with a minimum setback of two (2) feet six (6) inches from back of sidewalk. a. For patios constructed at grade elevation to one (1) foot above sidewalk grade elevation, fences and walls may be three (3) feet high above sidewalk grade. b. For patios constructed greater than one (1) foot above sidewalk grade elevation, fences and walls must be set back a minimum of three (3) feet from back of sidewalk, not exceed two (2) feet six (6) inches in height above the patio, have at least forty percent (40%) visibility through them, and not to exceed four (4) feet in height above existing public sidewalk grade. 9 �9 L-6 3. Patios with a minimum setback of two (2) feet six (6) inches from the back of sidewalk. a. Raised Patios are permitted provided they have a maximum height of two (2) feet six (6) inches above sidewalk grade, are set back a minimum of two (2) feet six (6) inches from back of sidewalk, and provided all bulkhead deadman and tiebacks supporting the Bay front bulkhead are replaced "If required by the Public Works Department' in conformance with the requirements of the Public Works Department; Stairs located a minimum of two (2) feet six (6) inches from back of sidewalk. C. Structural encroachments which do not exceed three (3) feet in height, including, but not limited to fences, walls, patios, and raised planters in public rights -of -ways in areas that are five (5) feet behind the face of curb on the following streets: 1. Southerly side of West Bay Avenue between 8th Street and 15th Street. D. Non-standard encroachments, including, but not limited to fences, walls, and raised planters within City easements as approved by the Public Works Director. E. Buena Vista Boulevard - Bay Avenue to Edgewater Avenue. The street right-of- way in this reach is ten (10) feet wide, with private property on both sides of the public way. Improvements allowed at this location shall consist of the following: 1. A minimum six (6) foot wide public sidewalk along the inland side of the right-of-way line maintained by the City. 2. Landscaping under twenty-four (24) inches in height and park -like improvements in the remaining portion of the right-of-way shall be allowed if installed and maintained by the adjoining property owners. Private improvements such as walls, fences, gates, signs and living areas such as cabanas and other roofed structures shall not be allowed. 3. Access to existing private piers and floats shall be allowed where a harbor permit has been granted, but such access structures shall not be expanded beyond the original permit dimensions. F. Edgewater Avenue - Buena Vista Boulevard to Island Avenue. The street right- of-way in this reach is forty (40) feet wide with private property on the inland side. The bay side is improved with a privately constructed bulkhead on public property. Improvements allowed at this location shall consist of the following: I 00 L-6 1. A minimum six (6) foot wide public sidewalk along the inland side of the right-of-way line maintained by the City. 2. Landscaping under twenty (24) inches in height and park -like improvements in the remaining portion of the right-of-way (between the sidewalk and the bulkhead) shall be allowed if installed and maintained by the adjoining property owner. Private improvements such as fences, gates, signs, and living areas shall not be allowed. 3. Access to private piers and floats shall be allowed where a harbor permit has been granted, but such access structures shall not be expanded beyond the permit dimensions. G. Edgewater Avenue - Island Avenue to Alvarado Street. The street right-of-way in this reach is forty (40) feet wide with private property on the inland side. The bay side is improved with a sloping beach leading to the waters of the bay. Improvements allowed at this location shall consist of the following: 1. A minimum six (6) foot wide public sidewalk along the inland side of the right-of-way maintained by the City. 2. The remaining portion of the right-of-way shall be reserved as a public beach and no private improvements, impediments or boat storage shall be allowed except for access to existing piers and floats where a harbor or a mooring permit has been granted, but such access structures shall not be expanded beyond the original permit dimensions. Any existing permits to encroach on the right-of-way shall be rescinded H. Edgewater Avenue - Alvarado Street to Fernando Street. The street right-of-way in this reach is fifty (50) feet wide. The bay side is improved with a sloping beach leading to the waters of the bay. The private lots bayward of the public right-of- way are under water and within State Tidelands. Improvements allowed at this location shall consist of the following: A minimum six (6) foot wide public sidewalk along the inland side of the right-of-way maintained by the City. 2. The remaining portion of the right-of-way shall be reserved as a public beach and no private improvements, impediments or boat storage shall be allowed except for access to existing piers and floats where a harbor permit has been granted, but such access structures shall not be expanded beyond the original permit dimensions. Bay Front Street Ends 01 L-6 1. Bay front street ends at beach level may contain two (2) foot wide planting areas bounded by redwood or concrete strips and containing hedges no more than two (2) feet in height above the adjacent surface. The planting areas may be installed: a. At each side of the prolongation of the street and extending no more than fifteen (15) feet from the end of the paved street. b. At the end of the paved street, except that a twelve (12) foot wide opening must be left for City emergency and maintenance equipment, and pedestrians to enter the beach area. 2. Bay front street ends where tidal flow prevents standard installation may be landscaped, subject to the prior approval by the City of specific plans prepared by the applicant. Access to beach areas shall be provided for in any such specific plans. 3. Improvements shall be installed at the expense of the adjacent property owners. 4. Landscape maintenance and watering shall be provided by the adjacent property owners to the satisfaction of the City. A sprinkler system connected to the adjacent property shall be installed in each planter J. Unimproved Ocean Front Street Ends 1. Improvements shall be installed at the expense of the adjacent property owners. 2. Landscape maintenance and watering shall be provided by the adjacent property owners to the satisfaction of the City. A sprinkler system connected to the adjacent property shall be installed in each planter. 3. All work shall be installed to grades established by the Public Works Department. 4. A four (4) foot wide sidewalk shall be provided on each side of the street right-of-way adjacent to the property line. 5. A minimum of twelve (12) feet of unobstructed access to the beach in the center of the right-of-way shall be surfaced with brick, asphalt, concrete or artificial turf, or an equivalent surfacing approved by the City. L 02 L-6 a. Portland Cement Concrete. A minimum six (6) inches over native compacted material. b. Asphalt Concrete. A minimum two (2) feet six (6) inches of asphalt concrete over a six (6) inch thick aggregate. C. Brick. Brick installed over four inches of imported aggregate base. A dry mix of one-to-one cement and clean plaster sand to be swept into the one-quarter (1/4) to one-half (1/2) inch space between bricks. The dry mix shall be moistened with a fine spray of water after it is in place. 6. Planters five (5) feet wide shall be provided between the side and the center access along a portion of each side of the street with a heavy emphasis on drought resistant plant materials. Plant materials shall be installed to City specifications. A six (6) inch to eighteen (18) inch high lip of concrete, brick or rock may be installed as part of the planter. 7. Special provisions shall be made in the design when garage access is required from street ends. 8. Where unusually large quantities of sand exist in a street end area, the City shall assist the adjacent owners by moving the sand to an area determined by the City. K. Unimproved Alleys that End at the Ocean Front 1. Improvements shall be installed at the expense of the adjacent property owner. 2. All work shall be installed to grades established by the Public Works Department. 3. Landscaping of potted plants shall be permitted in the portion of the alley right-of-way that terminates at the ocean front sidewalk. A six (6) foot wide inviting passageway shall be maintained for pedestrian access. 4. Where vehicles or pedestrians will travel, alleys may be surfaced with brick, asphalt, concrete or equivalent surfacing. 5. Improvements shall extend from the nearest street of alley improvement to the northerly line of the ocean front. M o3 L-6 If, in the opinion of the Public Works Department, the nature or location of this type of encroachment is such that Planning Commission review is warranted, the Department may forward the application to the Planning Commission for original action in accordance with the procedures set forth for granting waivers for private encroachments that would otherwise be prohibited. The City Manager is authorized to execute, on behalf of the City, agreements for non- standard improvements, which are entered into pursuant to this section or other authorization. Private encroachments not requiring a permit. A. Parkway lawn, ground cover and drought tolerant planting. Parkway areas with the exception of carriage walks/parkway paving/ artificial turf shall be entirely planted with lawn, ground cover and/or drought tolerant planting. B. Parkway sprinkling systems. C. Use of public streets and projections over public property, which are covered by the latest adopted edition of the California Code of Regulations Title 24 under a valid building permit issued by the City. Encroachments on public sidewalks Newport Beach sidewalks are a desirable place to walk, stroll and jog and it is, therefore, the policy of the City that public sidewalks are to provide unobstructed passage whenever possible. Sidewalks shall be reserved for public use and the rights of the public shall not be diminished by the installation of benches, planters, bicycle racks, etc., by private entities nor by the installation of facilities by public utilities or other public agencies. It is the policy of the City that encroachments on public sidewalks shall be subject to the following: A. General 1. Permitted encroachments shall not reduce the sidewalk width available for normal pedestrian movement. 2. Permitted encroachments may be located in areas between tree wells or other existing improvements as long as they do not interfere with pedestrian travel. 10 IM, L-6 3. Permitted encroachments shall be located at least eighteen (18) inches from the curb face. In areas where vehicles do not park or otherwise extend over the sidewalk, this setback may be reduced. 4. Permitted encroachments shall not be located within thirty-six (36) inches of a parking meter or street light, nor shall they be located where they will interfere with the normal use of other facilities. 5. Encroachments shall not block access from parked cars. 6. They shall not be located within ten (10) feet of a crosswalk, fire hydrant or driveway. 7. Encroachments may not be chained or otherwise anchored to any tree, streetlight, parking meter or other property. 8. Applicant shall pay all costs for City and/or the California Department of Transportation ("CalTrans") permit processing where necessary. 9. Applicant shall pay all costs associated with the installation and maintenance of the encroachments by the City or private installer. B. Public Benches 1. When applying the above requirements to benches, allowance shall be made for the space required for a person sitting on the bench. 2. Benches to be installed in an area where there is a theme or bench style shall conform to that theme or style. C. Public Bicycle Racks 1. Bicycle racks shall be located to allow bicycles to extend five (5) feet from the center of the rack and comply with the above requirements. ENCROACHMENT AGREEMENT (Encroachment Permit Number N2011-0190) THIS ENCROACHMENT AGREEMENT ("Agreement") is made and entered into this 16th day of June, 2014, by and between Lawrence Tabak and Lana Tabak, as Trustees of the Tabak Family Trust dated December 3, 1997 ("Owner"), and the City of Newport Beach, a California municipal corporation and charter city, organized and existing under and by virtue of its Charter and the Constitution, and the laws of the State of California ("City"). RECITALS WHEREAS, Owner is the vested owner of property located at 3431 Ocean Blvd, Newport Beach, California 92625 and legally described as Lot 8 of Tract 1257, as shown on a map recorded in Book 38, Page 25 inclusively of Miscellaneous Maps in the office of the County Recorder of Orange County, County Assessor's Parcel Number 052-120-64 ("Property"); WHEREAS, Owner desires to construct certain non-standard improvements as further described herein ("Permitted Improvements') within the Ocean Boulevard and Narcissus Avenue right-of-way (hereinafter "Right -of -Way") that is located adjacent to Property; WHEREAS, said Permitted Improvements may interfere in the future with City's ability to construct, operate, maintain, and replace City and other public facilities and improvements within Right -of -Way; and WHEREAS, the parties hereto desire to enter into this Agreement providing for fulfillment of the conditions required by City to permit Owner to construct and maintain said Permitted Improvements. NOW, THEREFORE, in consideration of the mutual promises, the parties hereto agree as follows: City and Owner acknowledge that the above Recitals are true and correct and are hereby incorporated by reference into this Agreement. 73 It is mutually agreed that Permitted Improvements shall be defined as: a. An existing common driveway to be constructed with eggshell -colored cut stone pavers encroaching up to 20 feet into the Ocean Boulevard public right-of-way; b. An existing retaining wall to be modified with a tan -colored stucco with varying heights up to 7 feet as measured from the driveway surface encroaching up to 21 feet into the Ocean Boulevard public right-of-way; c. An 8 -inch high planter wall constructed of tan -colored stucco encroaching up to 20 feet into the Ocean Boulevard public right-of-way; d. Various privately owned and maintained drainage lines including planter drains and French drains encroaching into the Ocean Boulevard and Narcissus Avenue public rights-of-way; e. Nine sets of below grade "tie -back" anchors and appurtenances for the private retaining wall/ building foundation adjacent to the Ocean Boulevard public right-of-way. Each "tie -back" anchor will consist of five to six 0.6 - inch steel strands, will be placed at depths from 10 feet to 45 feet below existing grade and will encroach up to 48 feet, 3 inches into the Ocean Boulevard public right-of-way; Four sets of below grade "tie -back" anchors and appurtenances for a private retaining wall/ building foundation adjacent to the Narcissus Avenue public right-of-way. Each "tie -back" anchor will consist of four to six 0.6 -inch steel standards and will encroach up to 46 -feet, 2 -inches into the Narcissus Avenue public right-of-way; Various private low -growing groundcover, landscaping, and irrigation improvements encroaching up to 37 feet into the Ocean Boulevard public right-of-way and appurtenances as approved by the Public Works Department and as shown on Exhibit A, attached hereto and incorporated herein by reference. h. In addition, if any improvements actually built or installed during the time of construction vary from Permitted Improvements approved herein, such variations or changes must be approved in advance by the Public Works Department and shall be shown on the "As Built" plans. City will permit Owner to construct, reconstruct, install, maintain, use, operate, repair and replace said Permitted Improvements and appurtenances incidental thereto, within a portion of Right -of -Way, if in substantial conformance with the plans and specifications on file in City. City will further allow Owner to take all reasonable measures necessary or convenient in accomplishing the aforesaid activities. Tabak Family Trust Encroachment Agreement 2 7 4. Rights granted under this Agreement may be terminated by City with or without cause and at any time without notice. City shall make good faith efforts to provide sixty (60) calendar days' notice in advance of termination, specifying in said notice the date of termination. City shall incur no liability whatsoever in the event of the termination of this Agreement or subsequent removal of improvements by City. 5. Owner and City further agree as follows a. Owner may construct and install Permitted Improvements and appurtenances incidental thereto in substantial conformance with the plans and specifications on file in City's Public Works Department, and as described on Exhibit A. b. Owner shall maintain Permitted Improvements in accordance with generally prevailing standards of maintenance and pay all costs and expenses-incurred—in—doing—so.—However.,_nothing_herein_shall_be_— construed to require Owner to maintain, replace or repair any Clty-owned pipeline, conduit or cable located in or under said Permitted Improvements, except as otherwise provided herein. C. If City or other public facilities or improvements are damaged by the installation or presence of Permitted Improvements, Owner shall be responsible for the cost of repairs. d. Should City be required to enter onto said Right -of -Way to exercise its primary rights associated with said Right -of -Way, including but not limited to, the maintenance, removal, repair, renewal, replacement or enlargement of existing or future public facilities or improvements, City may remove portions of Permitted Improvements, as required, and in such event: (i) City shall notify Owner in advance of its intention to accomplish such work, provided that an emergency situation does not exist. (ii) Owner shall be responsible for arranging for any renewal, replacement, or restoration of Permitted Improvements affected by such work by City. (iii) City agrees to bear only the cost of any removal of Permitted Improvements affected by such work by City. (iv) Owner agrees to pay all costs for the renewal, replacement, or restoration of Permitted Improvements. 6. Owner shall defend, indemnify and hold harmless City, its City Council, boards and commissions, officers and employees from and against any and all loss, damage, liability, claims, suits, costs and expenses whatsoever, including reasonable attorneys' fees (when outside attorneys are so utilized), regardless of the merit or outcome of any such claim or suit arisina from or in any manner connected with the design, construction, maintenance, or continued existence of Permitted Improvements. 9. Owner agrees that this Agreement shall remain in full force and effect from execution thereof; shall run with the land; shall be binding upon the heirs, successors, and assigns of Owner's interest in the land, whether fee or otherwise; and shall be recorded in the Office of the County Recorder of Orange County, California. 10. The laws of the State of California shall govern this Agreement and all matters relating to it and any action brought relating to this Agreement shall be adjudicated in a court of competent jurisdiction in the County of Orange, California. 11. The terms of this Agreement shall be construed in accordance with the meaning of the language used and shall not be construed for or against either party by reason of the authorship of the Agreement or any other rule of construction which might -otherwise -apply. 12. This Agreement represents the full and complete understanding of every kind or nature whatsoever between the parties hereto, and all preliminary negotiations and agreements of whatsoever kind or nature are merged herein. No verbal agreement or implied covenant shall be held to vary the provisions herein. 13. A waiver by either party of any breach, of any term, covenant or condition contained herein shall not be deemed to be a waiver of any subsequent breach of the same or any other term, covenant or condition contained herein, whether of the same or a different character. 14. Owner shall, at Owner's own cost and expense, comply with all statutes, ordinances, regulations and requirements of all governmental entities, including federal, state, county or municipal, whether now in force or hereinafter enacted. 15. If any term or portion of this Agreement is held to be invalid, illegal, or otherwise unenforceable by a court of competent jurisdiction, the remaining provisions of this Agreement shall continue in full force and effect. The impunity and boldness demonstrated in this application, and lack of concern by City Officials, amounts to adding and abetting the unlicensed practice of Architecture. To often, anybody can buy a cad program, call themselves a designer, submit plans to the City for approval, and with no direct supervision, "fmd" an engineer to stamp the plans. If the City audited projects that have a third floor, it would be no surprise that unlicensed activity (cheating) by individuals is common. The City and its staff study in great detail code compliance of all projects, enforce compliance in the field, and has achieved State recognition for excellence. Allowing an application like this to proceed is akin to the saying of "not seeing the forest thru the trees". Professional Contracting and Professional Architectural services have long been abused citing owner -builder status, or designer -draftsmen designations with engineer "sign -off'. I was a board member to the Laguna Beach Architects Guilds for 6 years and was on the task force that helped write the Laguna Beach Residential Guidelines. I was a founding member and eventual president of the Museum of Architecture (the first Museum of Architecture in America which provided lectures exhibits and tours throughout Southern California) I am currently a Commissioner on the City of San Juan Capistrano Design Review Board.
