City Hall, Newport Beach, Sept. 7, 1920.
The Board of Trustees of the City of Newport Beach met in
adjourned session at 7:30 P. M. on above date. The meeting was called
to order by President Greeley.
The roll was called as follows: Present, Trustees J. P. Greeley,
J. J. Schnitker, Art L. Heard., Conrad Richter, L. S. Wilkinson:
Absent, Trustees, none.
The minutes of the previous meeting were read and approved.
The reports of the heads of the various departments were read
and on motion of Trustee L. S. 1.7ilkinson seconded by Trustee J. J.
Schnitker and carried, the reports were accepted and ordered filed.
APECIAL COIRIIITTEES.
Trustee Richter reported for the lighting committee in regard
to making application to the Edison Company to furnish electric lights
for Newport Heights. T.ir. Finnegan thought there would be about 20
applications for lights there, but as they had not completed their
investigations the committee asked for more time, which was granted,
Fire Chief Jackson reported in regard to the ring buoys for the'
beach, that he was unable to buy any and could not get any ground cork
to make them.
There was some discussion in regard to the pipe line from the j
pumping plant to Santiago and also the water line to Balboa Island,
both of which will have to be replaced soon, but no definite action
was taken.
The communications were read and referred to the proper order
of business.
UNFINISHED BUSII?ESS.
City Attorney Bishop presented a written report in regard to
forming a district upon which a legal assessment could be imposed to
pay the expense and cost of redredging the so- called canal and
cleaning out the so- called bathing pool located at 'Jest Newport, in
which he gave it as his opinion it could not be done.
This being the first regular meeting after the special election
held in the City of Newport Beach on the 30th day of August, 1920, an

the Board of Trustees of said City having met and being now in sessio$,
and the returns of said special election having been duly made and no
in the possession of the Clerk of the City of Newport Beach, the Board
of Trustees proceeded to and did canvas the said returns and upon the
canvas thereof, the Board of Trustees find an order to be established
of record as follows:
1. The special election held at and in the City of Newport Beach
on the 30th day of August, 1920, was held in two special election
precincts; designated special election precinct No. 1, and special I
election precinct No. 2. The proposition submitted to the qualified
electors of the City of Newport Beach at said special election was:
"Shall the City of Newport Beach incur a bonded indebtedness
for the completion of the rubble mound jetty at the entrance to Newport
Bay, in the sum of 90,000.00 ?"
In s,Decial election precinct Fo. 1, the votes cast for and
against the proposition were as follows:
Votes cast yes, - - -'118
Votes cast no, - - - 15
Total votes cast, - 133
In special election precinct No. 2, the votes cast for and
against the proposition were as follows:
Votes cast yes, - - - 156
Votes cast no, - - - 50
Total votes cast, 206
Total votes cast for and against the proposition in the City
of Newport Beach was:
Votes cast yes, - - - 274
Votes cast no, - - - 65
Total votes cast, 339
It appearing that the votes of two- thirds and more of all the
voters voting at the special election.were cast yes, and in favor of
the issuance and the sale of the bonds of the City of iieviport Beach,
in the sum of ",550,000.00 for the purpose of the completion of the jet y
as provided for in Ordinance i ?o. 170, the same was declared carried
and t:ie bonds therein specified authorized.
The Cit;r Clerk then re-.�orted that the follo,�•ring protests to the
sever proceedings had been filed with him, name1j: One filed July 20;

1920, by Joseph Ferguson and Edna R. Ferguson objecting to the
proposed improvement, claiming that the proceedings are irregular,
and objectin- to the extent of the proposed district; One filed Jul;
24, 1920 by joseph Ferguson and Edna R. Ferguson objecting to the
improvement and to the form of improvement proposed; One filed July
21, 1920 by Bertha I. Schroeder objecting to the improvement and to
the extent of the proposed. district, and one filed August 7, 1920 by
the Southern Pacific Company objecting to the improvement, claiming
' that the rroceedings are illegal, and also objecting to -the extent o:
the proposed assessment district.
Thereupon on motion of Trustee J. J. Schnitker seconded by
Trustee L. S. .lilkinson and carried, the said protests were referred
to the City Engineer for a report as to the amount of property wi-hi
the assessment district owned by the protestants.
The City Engineer t ?'en reported with rof ^raace '..o the objectic
which have been filed against the improvement contemplated under
Resolution of Intention No. 133 as follows,:
That the total frontage of all lots fronting on streets ,.ithi;
the district is 270,875 feet;
That the total frontage of all lots fronting on the improve.ie
within the district is 109,505 feet;
That the total area of all lots =within the district is
16,470,888 square feet;
That the property within the assessment district owned by the
protestant Bertha iS. Schroeder is the following:
Lot 13, Block 141 of CL:nal Section; That the total frontage of
said lot upon the proposed improvement is none; That the total
frontage of the said lot on streets within the limits of the assesse(
district is 57 feet; That the area of said lot is 2488.5 square fee -
That the property within the assessment district owned by the
protestant Southern Pacific Company is the following:
A11 of the railroad right -of -way; That the total frontage of
' said right -of -way upon the proposed improvement is 1830 feet; That
the total frontage of said right -of -way on streets within the limits
of the assessment district is 9750 feet; That the area of the said
right -of -way is 1,056,900 square feet.
That the property within the assessment district owned by
Joseph Ferguson and Edna R: Ferguson protestants, is the following:
Lot.11, Block 220, Section A; Lots 2, 3, 4 and 5 in Block 223,
Section A; Lots 1, 2, 3 and 4, Block 331, Lancasters Addition;
Lots 1, 2 and 3, Block 425, Lancasters Addition; Easterly 15 feet o:
norhhe-rly 60 feet of Lot 2, Block 11, Balboa Tract; Northerly 60 fe
of Lot 3, Block 11, Balboa Tract; Lot 7, Block 11 Balboa Tract;
Lots 15 and 16,-Block 12, Balboa Tract; Lot 4, Block 13, Balboa
Tract; Lots 10, 11, 12 and 13_, Block 15 East Side Addition to B_lbo+
Tract; Lots 10, 11, 12 and 13, Block 16 East Side Addition to Balbo;
Tract; Lot 3, Block 21, East Side Addition to Balboa Tract; Lots 7
8 and 9, Block 22, East Side Addition to Balboa Tract; Easterly 60
feet of Lot 8, Block 25 East Side Addition to Balboa Tract; Easterly
60 feet of Lots 9 and 10, Block 25 East Side Addition to Balboa Trac,
Lot 11, Block 25 East Side Addition to Balboa Tract; Lots 1 and 2,
Block 26 East Side Addition to Balboa Tract; Acreage in Section 1
and 2, Township 7 South, Range 10 west.
That the total frontage of said lots upon the proposed improve•
ment is 2558 feet; That the total frontage of said lots on streets
within the limits of the assessment district is 3847 feet; That the
area of said lots is 1,633,500 square feet;
that the total frontage of all lots owned br the protestants _
upon the proposed improvement is 4388 feet, or 4 0 of all lots
fronting on the improvement;
That the total frontage of all lots owned by the protestants o:
streets within the limits of the assessment district is 13,654 feet
or 5 % of the total frontage of the streets within the district;
That the total area of all lots owned by the protestants is
2,692,828.50 square feet, or 16 % of the total area of the district.
It appearing that the owners of a majority of the frontage of
the property fronting on the said proposed work or improvement have
not made written objections to the same, and that the objections on
file are not by the o,mers of such majority of frontage, and it also

appears that the objections on file are not signed by the owners_of a
majority of the frontage liable to be assessed for the expense of said
work, or of a majority of the area of the property liable to be assessed.
for the expense of said work, but it appearing that the said objectors
do each object to the extent of the district of lands to be affected 1
or benefited'-by said work or improvement, and to be assessed to pay the
costs and expenses thereof,
NOW, THEREFORE, BE IT RESOLVED, that ;7ednesday, the 15th day of
September, 1920, at the hour of 7:30 o'clock P. PS, be fixed as the
time for hearing the said objections, and that the same shall be heard
by this council at the Council Chamber in the City Hall in the City ok
Newport Beach at said time, and that the City Clerk shall proceed to
notify the persons making the objections on file by depositing a
notice thereof in the Post Office iII the CitT of Yeexoort Beech, posta•e
prepaid, addressed to each objector.

n Resolution of the Board of Trustees of the City of 1'e,---port
Beach fixing the rate per centum and levying a tax upon all of the
taxable property within the City of Newport Beach which is taxable
therein for municipal purposes. The Board of Trustees of the City of!
Newport Beach do -resolve and declare as follows:
1st. Resolved that there be and is hereby levied upon all of the �
taxable property within the City of Newport Beach, which is taxable
therein for municipal purposes, a tax for the purpose of raising the
necessary money with which to carry on the various departments of the
City of Plecrpo,rt Beach for the current fiscal year.
2d. Resolved that the rate per centum of the tax hereinafter
levied s .shall be and is hereby fixed at the sum of 100 cents on
each One Hundred Dollars ($100.00) of value designated for each fund
as follows:
For the Street Fund, - - - - - - 40 Cents _
For the Salary Fund, _ - - - - - 20 Cents I
For the Current Expense Fund, - - - 40 Cents
Total tax levy, - - - -- - 100 Cents
3d. Resolved that in addition to all other`taxe's herein levied fog
municipal purposes, there is hereby levied on all of the taxable
property within the.City of Newport Beach, a tax for the purpose o£
raising the necessary and sufficient money to pay the annual interest
on all issued outstanding and unpaid municipal bonds of the City of
Newport Beach, and also such part of the principal thereof as shall
become due before-the time for fixing the next general tax levy in
and for said City: the rate of the-tax hereby levied for said purpose
is fixed at 64 on each One Hundred Dollars of value, and the same
shall be collected at*the same time and in the same manner as all
other municipal taxes are collected.
4th. Resolved-that in:addition to all other taxes herein levied,
there is hereby levied on all the taxable property within the City of
i4ewport Beach, a tax of 15� on each one hundred dollars for advertising
purposes, pursuant to the provision of Ordinance No. 144, submitted to,
and carried by a majority of the votes of all the voters voting at an
election held for the purpose of voting for or against said Ordinances
on the 24th day of September,.1918.
The above and foregoing Resolution was passed, adopted and i
approved by the Board of Trustees of the City of Newport Beach at a
regular meeting thereof held on the 7th day of September, 1920, by the
following vote to -wit:
Ayes, Trustees J. P. Greeley, J. J. Schnitker, Art L. Heard,
Conrad Richter, L. S. Wilkinson.
Noes, Trustees, none.
Absent, Trustees, none.
The above and foregoing Resolution Ho. 134 is approved by me
this 7th day of September, 1920.

Trustee Art L. Heard presented for consideration a proposed
Resolution entitled as follows:

"A Resolution of the City of I?ewport Beach by the legislative
branch thereof, to -wit: the Board of Trustees, providing for the
issuance and sale of the bonds of the City of Newport Beach for the
completion of the rubble mound jetty constructed at the entrance to
Newport Bay in the sum of 550,000.00."
"Prescribing the form of such bonds, fixing the rate of interes
to be paid thereon, the date and place for the payment of said bonds,
principal and interest, and further providing a sinking fund for the
payment and redemption of the bonds, principal and interest."
The said Resolution was read and considered and on motion of
Trustee Conrad Richter seconded by Trustee L. S. .7ilkinson and
carried, it was ordered filed and assigned No. 135 and referred to
the City Attorney to be put in formal condition for final action by
the Board of Trustees.
I,Ir. Barnard, of the Engineering firm of Leeds & Barnard,was
present and stated that the work at the mouth of the Santa Ana River
was practically completed and in order to avoid laying off their
quarry force by stopping the shipment of rock, the Harbor Commission
suggested that they fill the hole washed out at the shore end of the
rubble mound jetty, and that the City and Harbor Commission could
adjust the matter of proportionate charge later.
A petition signed by a majority of the property owners on the
alley in Block C of East Newport from Alvarado Place to Fernando
Street, asking for an assessment district to dirt the alley, was
presented, and on motion of Trustee J. J. Schnitker seconded by
Trustee L. S. .7ilkinson and carried, the matter was referred to the
City Engineer.
The communication from the Otate Commission of Immigration and
Housing in regard to changes in building regulations, and the comiiu-
nication from C. L. Lancaster in regard to the highway boulevard
through the west end of Newport Beach were laid on the table.
A communication from A. C. Grant desiring to rent the filled
land in front of Lots 8 and 9 and 12 and 13 in Block 6 of East Nev.por
from the City, and on motion of Trustee J. J. Schnitker seconded by
Trustee Art L. Heard and carried, the City Clerk was instructed to
write to A4r. Grant that it was not the policy of the City to rent its
water front.
The communication from 'Irs. Emma Banks asking that 14th Street
on the Heights be fixed up for safer travel was discussed, and on
motion of Trustee L. S. .7ilkinson seconded by Trustee J. J. Schnitker
and carried, the City Clerk was instructed to v,irite to I:Irs. Banks
that on account of our inability to get water to sprinkle it was
impossible to fix the road. If the property owners were willing to
form an assessment district to pay for it the City would fix it up.
On motion of Trustee J. J. Schnitker seconded by Trustee Art
L. Heard and carried, the application of Clarence G. Alves for transf
of business license No. 145 to H. Cordoza Sloan was granted.
On motion of Trustee Art L. Heard seconded by Trustee J. J.
Schnitker and carried, the application of John K. Suckow for a permit
to build a pier in front of his property on Balboa Island accompanied
by a sketch, was referred to the City Engineer.
On motio:a of Trustee L. S. ;Yilkinson seconded by Trustee J. J.
Schnitker anal carried, the communication from Fire Chief Jackson in
regard to the construction of a fire hall for truck No. 1 v,,.-..s
referred to the Fire and ',7ater Committee.
On motion of Trustee Art L. Heard seconded by Trustee J. J.
Schnitker and carried, the request of F. J. Knight, Street Superin-
tend.ent, an8 F. L. Rinehart, Gas ?Manager for a. raise in salary of
`"15.00 each rer month was granted to take effect Sept, 1, 1920.
On motion of Trustee L. S. 'Wilkinson seconded by Trustee Art
L. Heard and cl-rried, the request of A. :I. Jackson head of the Frost
Life Saving Co. for an allowance of X2.50 each for six men when
cclleC to the rescue of drowminz persons be made, was referred to .
the City Attorney for legal authority, he to report at next meeting.
On motion of Trustee Art L. Heard seconded by Trustee Conrad
Richter and carried, the matter of raise in salary for the Fire Chief
and Assistrnt Pire Chief was referred to the Fire and 'later Com.-.iittee

provide us with a gas holder as referred to in the Gas managers renor
was referred to the City Attorney, but he stated there was nothin ^_ ir
the contract compellin; them to do so.
On motion of 'Trustee J. J. Schnitker seconder. by Trustee L. S.
Wilkinson and carried, an allowance of ?225.00 was set aside for e;..tr
help in the ta.- collectors office getting out the tax bills.

NEB: BUSINESS.
A map of Balboa Island showing the house numbers was presented
by Harry Jumper in the absence of the City Engineer, and on motion of
Trustee J. J. Schnitker seconded by Trustee Conrad Richter and carrie�
the map was accepted and the system'o£ mouse numbering as given was
adopted as the system of house numbers on the Island. \,
President Greeley adopted his rubber stamp as his official
signature.
On motion of Trustee L. S. 'Wilkinson seconded by Trustee J. J.
Schnitker and carried, demands No. 103 to 196 inclusive h4ving been
signed and approved by the finance committee, be allowed and warrants
drawn for same.
Oh motion of Trustee J. J. Schnitker seconded by Trustee Art L.
Heard and carried, the meeting adjourned to Wednesday, September 15,
1920 at 7:30 P. Ls.

The Board of Trustees of the- City of NevTort Beach met in
adjourned session at 7:30 P. ?I. on above date. The meeting was called
to order by President J. P. Greeley.
The roll was called as follows: Present, Trustees J. P. Greeley
J. J. Schnitker, Art L. Heard, Conrad Richter, L. S. '7ilkinson.
Absent, Trustees, None.
The minutes of the regular meeting of Sept. 6th and adjourned
meeting of Sept. 7th, 1920 were read and approved.
The City Clerk announced that it being the hour of 7:30
o'clock P. I:.., which hour was the tine fixed for hearing the objectio s,
remonstrances and protests heretofore filed in the matter of the
-proposed construction of a sanitary sewer under Resolution of
Intention No. 133, adopted July 6th 1920.
The Clerk then read the protest filed July 20, 1920 by Josep
2erguson and Edna R. Ferguson.
The President of the Board then asked if either of the
protestants were present: the protestants were represented by Lars.
Edna R. Ferguson who then addressed the Board. At the conclusion of .
her remarks, the President asked if any one else present desired to be
heard on the matter of the aforesaid protest. There being none, the
hearing of the said protest was concluded and on motion of Trustee
J. J. Schnitker secondee by Trustee Conrad Richter and carried, action
upon same -aas postponed until the completion of the hearing of the
other protests, remonstrances and objections on file.
The -Clerk then read the protest filed July 21, 1920 by Berth
I.1. Schroeder.
The President of the Board then asked if the protestant was
present. The protestant or no one representing her being present,
the President asked if any one present desired to be heard on the
matter of the aforesaid protest. There being none, the hearing of
the said protest was concluded and on motion of Trustee J. J. Schnitker
seconded by Trustee Conrad Richter and carried, action upon the same I
was postponed until the completion of the hearing of the other protests,
remonstrances and objections on file.
The Clerk then read the protest filed July 24, 1920 by Joseph)
Fer,�zson and Edna R. Ferguson.
The President of the Board then asked if the protestants were
present: the protestants were represented by I:,rs. Edna R. Ferguson
who then addressee the Board.
