HomeMy WebLinkAbout03/07/1921 - Regular Meeting416 / City Hall, Newport Beach, March 7, 1921. The Board of Trustees of the City of Newport Beach met in regular session at 7:30 P. M. on above date. The meeting was called to order by President J.' P. Greeley. The roll was called with the following.members present: Trustees, J. P. Greeley, J. J. Schnitker, Geo. P. Wilson, Conrad Richter, L. S. Wilkinson. Absent, Trustees, None. The minutes of the previous regular meeting were read and approved. " The reports from the heads of the various departments were read and on motion of Trustee J. J. Schnitker seconded by Trustee Geo. P. Wilson and carried, the reports were accepted and ordered filed. REPORTS OF COMMITTEES. City Migineer Kressly presented a letter from the Pacific- Ranch Co. to the effect that they did not care to grant the City a right -of -way for pipe line across their property, or.to..sell any land near the pumping plant. The matter was discussed and on motion of Trustee J. J. Sohnitker seconded by Trustee Geo. P. Wilson and carrie the Committtee was allowed to take up the matter again with the Ranch Co. before resorting to condemnation proceedings of the right -of -way.! The Committee on Harbor Regulations asked for more time whit was granted. The matter of the North boundary of the City was taken up and City Engineer Kressly stated he had finished the surveying and sent same to Los Angeles to be put in shape.for. presentation. The matter of the exclusion.of the..Irvine.property was discussed at length and City Attorney Bishop thought the City should make their word good by excluding it. . Mr. Wallace stated Mr. Irvine did not want the City to put a sewage disposal plant on the land, but City Attorney stated it could be done by condemnation. No definite action was taken at this time. The communications were read and referred to the proper orde of business. A map of a part of the Fairview Farms coming within the three mile limit of the City which had been replatted was presented for the approval of the Board, and on motion of Trustee Geo. P. Wilso seconded by Trustee J. J. Schnitker and carried, the map was approved and the Clerk authorized to sign the same. In Re Municipal Improvement District. On the 3d day of March, 1921, .there was filed with the C1erl of the City of Newport Beach a petition asking that a portion of saie City by formed into a municipal improvement district for the purpose. of creating an indebtedness, to be represented by bonds of said district, the proceeds from the sale of which to be used for the construction of public improvements. The said petition was presented to the Board of Trustees at the regular meeting thereof held on the 7th day of March, 1921, and said Board of Trustees proceeded to consider the same. Witnesses were sworn and testified, and documentary evident received, from which the.Clerk and the Board of Trustees- of the City of Newport Beach find: let. The petition is signed by 95 persons of which persons 92 are qualified electora,residing in the territory which is proposee to be formed into a municipal improvement district, and they constiti more than ten percent of all the qualified electors residing therein. 2d. -The petition sets forth a general description of the improvements to be constructed and they are public improvements whict the City of Newport Beach is authorized by law to construct. 3d. The petition sets forth.a general-.description of the exterior boundaries of such proposed district, and the same is a portion of the City of Newport Beach. Thereupon Trustee Geo. P. Wilson introduced an Ordinance declaring it to be the intention of the Board of Trustees of the City of Newport Beach to call an election in such proposed district or as the same may be modified for the purpose of submitting to the qualif] electors or said district the proposition of authorizing the issuance and sale of bonds of said district in the manner and for the purposes set forth in said Ordinance of Intention. CND 4.17 The Ordinance of Intention was read and considered and on motion of Trustee J. J. Schnitker seconded by Trustee Conrad Richter and on call of the roll duly carried, was ordered filed, to be Ordinance of Intention No. 178, passed to the second reading and referred to the City Attorney for consideration. The communication of Fire Chief Jackson setting forth the needs of the fire department and which was referred to a committee of the whole, was presented by Chairman Greeley with the recommenda- tion of the Committee, and on motion of Trustee.J. J. Schnitker seconded by Trustee L. S. Wilkinson and carried, the report was approved and the Clerk authorized to purchase the required items by the following vote, to -wit: Ayes, Trustees Ji P. Greeley, J. J. Schnitker, Geo. P. Wilson, Conrad Richter, L. S.,Wilkinson. Noes, Trustees None. Absent, Trustees Nolte. The communication from Health Officer J. A. Porter with signation of Dr. Bessica Raiche as a member of the Board of Health s considered, and on-motion of Trustee Conrad Richter.seconded by ustee L. S. Wilkinson and carried, the resignation was accepted d Dr. C. M. Grundy was appointed to fill the vacancy. The communications from the League of California Municipal- ities in regard to Assembly bills No. 227, 230 and 231-were read, and on motion of Trustee J. J. Schnitker seconded by Trustee Geo. P. Wilson and carried, the Clerk was instructed to notify the proper officials at Sacramento that it is the desire of this Board that they vote against these bills. An invitation from the City of Pasadena to attend a special meeting of City Park and Auto Camp Ground officials to be held at Pasadena on March 17, 1921 was brought up, and on motion of Trustee L. S. Wilkinson seconded by Trustee J. J. Schnitker and carried, the President of the Board and Superintendent.of Streets were elected delegates to that meeting and their expenses allowed by the City. A communication from E. D. Epperly objecting to the "For Sale signs posted on nearly all.the vacant lots in town, was considered and on motion of Trustee Geo. P. Wilson seconded by Trustee L. S. Wilkinson and carried, that this Board go on recerd.as being opposed to these advertising signs.and that the Clerk so instruct the real ,estate dealers. There was no action taken on the communication from the Secretary of the Chamber of Commerce in regard to a building ordinan as we have one under construction and will.probably.have a report on lit at the next meeting. ORDINANCE NO. 176. "An Ordinance of the City of Newport Beach prohibiting the laving or keeping of certain live stock or poultry in the City of Jewport Beach within a certain distance .of any dwelling house or )ther structure used for human habitation, and prescribing a penalty 'or all violations thereof," was placed on final passage; the roll was called and the Ordinance adopted by the following vote, to -wit: Ayes, Trustees, J. P. Greeley, Geo. P. Wilson, Conrad Richte L. S. Wilkinson. Noes, Trustees, J. J. Schnitker. Absent, Trustees, None. ORDINANCE NO. 170: �(1I, "An Ordinance"of the City of Newport Beach authorizing the *mmon council thereof to petition the legislattre of the State of :alifornia to enact a change in the boundaries of said City," was Em placed on final passage; the roll was by the following vote, to -wit: Ayes, Trustees J. P. Greeley, Conrad Richter, Noes, Trustees Noise. Absent, Trustees None. called and the Ordinance adopts J. J.-Schnitker, Geo. P. Wilson, L. S. Wilkinson. RESOLUTION NO. 138. "A Resolution of the Board of Trustees of the City of Newport Beach declaring their intention to vacate, close-up and abandon for public street purposes, a certain portion of 24th Street within said City." On motion of Trustee J. J. Schnitker seconded by Trustee Geo. P. Wilson. thecfor6going Resolution was.. adopted. by the followi.l-4 vote, to -wit: Ayes, Trustees J. P. Greeley, J..J. Schnitker, Geo. P. Wilson Conrad Richter, L. S. Wilkinson. Noes, Trustees None. Absent, Trustees None. As there were several important bills before the Legislature on motion of Trustee J. J. Schnitker seconded by Trustee L. S. Wilkinson and carried, City Attorney. Bishop was authorized to go to Sacramento to look after the bills if he thought it necessary, his expenses to be allowed by the City. Trustee Richter introduced the following Resolution being Resolution No. 139: WHEREAS the Board of Trustees did on the 15th day of'Septembes 1920 adopt Resolution No. 136 entitled "A Resolution.of the Board of Trustees of the City of Newport Beach ordering the construction of` certain cement pipe sanitary sewers, a reinforced concrete septic tank, reinforced concrete pumping stations, a sludge bed and appurte- nances in the City of Newport Beach, determining that bonds shall be issued to represent the cost thereof, and declaring the work or improvement to be of more than local or ordinanary public benefit, and that the expense of said work or improvement shall be assessed upon a district." AND WHEREAS, said resolution fixed the time for receiving bid( on said work at the hour of 7:30 o'clock P. M. of Monday the 11th dai of October, 1920, and in responds to the advertisement inviting seal( proposals or bids for doing said work, bids were received by the Cle3 od said City, which bids were publicly opened, examined and declared at a regular meeting of said Board held on the 11th day of October, 1920, which, after due consideration of said Board were deemed excessive in cost and were therefore rejected; NOW THEREFORE, the City Clerk is hereby directed to readvert: for proposals or bids for the performance of the work as in the first instance provided for under Resolution No. 136, which was the Resolui ordering the work. Said proposals.or bids to be received up to 7:3( o'clock P. M. of Monday the 28th day of March, 1921. I hereby certify that the foregoing Resolution was regulars; introduced and duly adopted by the Board of Trustees of said City by the following vote, to -wit: Ayes, Trustees, J.P. Greeley, J. J. Wilson and carried, the bids were referred to the water Superin- ;endent for a recommendation at the next meeting. Trustee L. S. Wilkinson referred to the request of the Fire ,Chief for a siren which met with some discussion, and it was the prevailing opinion that we should have it so constructed that the telephone operators can sound it at the first call of fire. The matter was referred to the Fire and Water Committee and Fire Chief to make a recommendation at the next meeting with the probable cost of !same. The matter of the completion of the jetty was taken up and 'discussed, and as the Committee could get no satisfaction out of Mr. !Ledbetter, on motion of Trustee J. J. Schnitker seconded by Trustee Conrad Richter and.carried, the Clerk was instructed to readvertise for bids on the work of completing the jetty. On motion of Trustee Geo. P. Wilson seconded by Trustee L. S Wilkinson and carried, demands No. 631 to 700 inclusive having been signed and approved by the Finance Committee, be allowed and warrants drawn for same. On motion of Trustee L. S. Wilkinson seconded by Trustee Conrad Richter and carried, the meeting adjourned to 7:30 o'clock P.M. on,Monday, March 28, 1921. r ard o rus ee .
