The communication fron Shinn-Holtz-Lyon Co. in regard to an engine -fas referred to the City Engineer. The float at the end of the i7ashin ton Street pier was reported as not working properly, and on motion of Trustee L. S. Wilkinson seconded by Trustee Goo. P. Wilson and carried., the ' Street Superintendent was instructed to have the defect remedied.. On notion of Trustee Goo. P. Wilson seconded by Trustee L.S. This being; the time fixed for hearinf; protests in regard to the widening of alleys in East Ilewport, all those desirin- to be heard in the matter -were heard, and on motion of Trustee H. C. Sloan seconded by Trustee Goo. P. Wilson the objections were sustained and all proceedings under Resolutions TIo. 177, 178, 179 and 184 were abandoned by the following; vote: Ayes, Trustees J. J. Schnitker, H. C. Sloan, Goo. P. Wilson, Conrad Richter, L. S. Wilkinson. Hoes, Trustees hone. Absent, Trustees hone. BUST- �3S Trustee H. C. Sloan introduced the following, Resolution: RESOLVED that the diagram of the assessment district for the construction of cement pipe sanitary sevfors, sop septic tank, and other appurtenances in Central Avenue and other streets and alleys, ri`hts -of- -fay and property o-med by said City ,:s contemplated by Resolution of Intention Iio. 133 of the Board of Trustees of said City, be and the same is hereby adopted. Trustee Conrad Richter introduced a Resolution entitled as follows. "A Resolution by the Board of Trustees of the City of Newoort Beach, as the legislative branch thereof, deter- :ninin- that the public interest and also the public necessity demands the acquisition by and for said City of a. Yi=icipal improvement t'ia-rcin, which is necessary and convenient -to carry out the objects, purposes and po -rers of the ^ity of I?e?rport Beech, the cost of which -fill be too great to be paid out of the ordinary annual income anu revenue thereof." Mc The Resolution was ordered filed, read, considered, and designated Resolution No. 192, the roll was called and the Resolution passed by the following named members of the Board. of Trustees: Ayes, Trustees J. J. Sc hnitker, H. C. Sloan, Geo. P. Wilson, Conrad Richter, L. S. Wilkinson. Noes, Trustees None. Absent, Trustees none. Resolution No. 192 havinE; been passed by the affirmative vote of more than tyro- thirds of all the members of the Board of Trustees, the same was signed by the President thereof and attested by the Clerk. E. T. Grua was present and brought up the matter of a bullhead along the bay front at East Newport and Newport Bay Tract, and on motion of Trustee Conrad Richter seconded by Trustee Geo. P. 1.7ilson and carried, the City Engineer was instructed to give the necessary data as to the cost of a -retaining wall- for the property owners, and the amount of land necessary for them to deed to the city for that purpose. On motion of Trustee Geo. P. Vilson seconded by Trustee H. C. Sloan and carried, the application of Phil Brunn .for transfer of his confectionery license to I:rs. Nancy E. Carpenter, was granted. The application of the Ne.rport Harbor I.Tarine Corp. for a permit to build a pier for Alonzo E. Bell was referred to the City Engineer.for approval. The Clerk was instructed to send, a. copy of the cour ittees report in regard to the cost of extending the water and gas lines to Corona Del Mar to the Sims - Guedel Company as per their request. On motion of Trustee L. S. Wilkinson seconhlec. by Trustee Conrad Richter and carried, the matter of cleaning up the beach and the public property was referred to the Street Committee with power to act. On motion of Trustee Geo. P. Wilson seconded by Trustee H. C. Sloan the matter of incinerators or trash burners for the beach was referred to the Fire and *later Co=aittee with power to act, by the unanimous vote of the Board. On motion of Trustee H. C. Sloan seconded by Trustee Geo. P. Wilson L�nd carried, the City Attorney was instructed to dram up an ordinance prohibitin„ tents or houses of paper construction any place in the city except on city property. On motion of Trustee Geo. P. Wilson seconded by Trustee H. C. Sloan and carried, the firemen were, allowed pay when goin- to the rescue of drovming persons the same as when going to fires. On motion of Trustee L. S. Wilkinson seconded by Trustee Geo. P. o7ilson and carried, the matter of placing a bell on the beach to signal for help in case of dro,,'nings was referred to the Fire and Mater Committee in consultation with the Fire Chief for report at the next meeting. A petition Navin, -I been filed in the office of 'the Clerk of the City of Newport Beach on the 21st day of June, 1922, askin; that a portion of said City be formed into a .mtnicipal improvement district for the purpose of creating an indebtedness to be represented by bonds of said district, the proceeds frora the sale of which to be used in the acquisition of a public improvement, havi?r; been presented to the Boards, of Trustees was taken up for consideration. 'itnes- -os were sworn and testified, evidence received, fro-:r which it appeared and the Board of Trustees of the City of Newport Beach and the Clerk thereof find: 1. The petition is signed by qualified electors residing in the territory :which is proposed to be formed into a municipal improvement district, and the sicners thereof constitute more than 10 ;i of the qualified electors residing in the proposed district. Ti. The petition sets forth a general description of the improve - nrent to be acquired, and is a public improvement which the City of h;ewmort :,each is authorizecl b;; law la to acquire. 4M .1) 2'7 III. The petition sets forth a general description of the exterior boundaries of such proposed district, and the same is and constitutes a portion of the City of Newport Beac -,.I, and not a part of any other municipal improvement district. IV. It is ordered that the Board of Trustees proceed under and in pursuance of an act of the Legislature of the State of California, entitled: "An Act to provide for the formation of districts thin municipalities for the acquisition or construc- t tion of public improvements, works and public utilities; for the issuance, sale- and pay;:ient of bonds of such districts to meet the costs of such improvements; and for the acquisition or constructs -on of such iriprove;:ients." (approved April 20, 1915 and acts amendatory thereof.) Trustee L. S. Wilkinson then introduced an ordinance entitled as follows: "An Ordinance of the City of PJewport Beach by the Board of Trustees thereof, declaring its intention to call an election in a proposed mm- iicipal improvement district, for the purpose of submitting to the qualified electors thereof the proposition of authorizing the issuance and sale of bonds of such district, describing the exterior boundaries of the proposed district, the improvement to be acquired, and statin-1 an estivnate of the cost thereof and of the incidental expenses in connection there•ith; fixin;; the date upon '.ihich an election .-✓ill be called for that purpose; that a map shot:ing the exterior boundaries of said district and a general description of the proposed improvement are on file in the office of the Clerk of the City of Newpoa °t Beach, which said map shall_ govern for all details as to the extent of said district, and fixing a day, hour, and place for the hea =;nr- of protests. The ordinance rras ordered filed, read, considered, and desig- nated Ordinance No. 210, and submitted to the City Attorney./ Trtsteo H. C. Sloan introduced an ordinance prohibiting the parking or standing of vehicles upon the public alleys and por''ions of certain public streets :-.nd prescribing the met hod of parkins, on other streets in the City of Newport Leach. The Ordinance was ordered filed, read, considered, and designated Ordinance ido. 211 and referred to the City lttorney. On motion of Trustee L. S. Wilkinson seconded by Trustee E.C. Sloan and carried, the City Clerk was authorized to employ a Clerk to assist in getting out the assessment roll. On motion of Trustee Geo. P. Wilson seconded by Trustee H.C. Sloan and carried, the re- connoct-inE, foe to the new sewer was fixed at w1.00 each. The matter of application cards 'for sewer connections we_s referred to the City Attorney for a proper form. On motion of Trustee Conrad Richter seconded by Trustee H.C.
