I was honored to receive a Proclamation from former Mayor Gardner on September 25, 2012 after winning gold with my team at the London Olympics. As noted in the City's minutes from that meeting, I shared what an honor it was to represent the U.S.A. and the City of Newport Beach, and presented the City with an autographed photograph from my crew. I picked up my first oar at the Newport Aquatic Center and enjoyed being part of the NAC junior rowing program over several seasons. The program's status as a club sport meant that my teammates came from several high schools throughout the area, with some commuting more than an hour each day to practice. It was a wonderful athletic, social, and character -building experience to be a part of the NAC junior rowing program, and also to experience the Newport Bay from a rowing shell. My siblings also had very positive experiences rowing as NAC juniors. Newport Aquatic Center's competitive junior rowing program was fundamental to my being recruited to several top colleges and universities, including Harvard, where I matriculated. The rowing facilities at the NAC were also an important part of my U.S. National Team training — I was able to complete my assigned workouts on land and on the water thanks to the accessible hours and equipment, even though I was only home for scattered holidays. Because I am just one of the many, many Olympic rowers and kayakers who have trained out of the NAC, I was deeply humbled when the junior program named a new rowing shell after me in 2016. Having rowed in dozens of facilities and countries around the world, I can state with authority that the Newport Aquatic Center is truly unique in many wonderful ways. Its location and facilities mean that thousands of people each year get to experience the flora, fauna, and natural beauty of Newport Beach up close, whether from a rowing shell, a kayak, a dragon boat, or a SUP. Because so many different programs and individuals, from juniors to masters, Olympic hopefuls to brand-new beginners, all share the facilities, equipment, and waterways, there is a unique sense of community. Everyone is welcome to attend and refreshments will be provided. This is your time to talk directly toCouncil in a workshop setting. General Plan Update The City Council initiated the General Plan Update process on January 22, 2019. The Council also created a five -member resident Steering Committee to assist staff and the community with the initial phase of the process. The Steering Committee will assist in the preparation of a request for proposals for consulting services, selecting the consultant, and guide the initial "listen and learn" community outreach effort. The City Clerk will accept applications for appointment to the Committee through noon on Wednesday, January 30, 2019. Confirmation of Mayor Dixon's appointments to the Committee will be considered by the full City Council on February 12, 2019. For residents interested in applying to be a part of the Committee, the applications can be obtained at the City Clerk's office. The application and Committee information can also be accessed through the City's website at: www.nPwrortbeachca_ o vacancy. It is anticipated the Steering Committee and staff will conduct the first community meeting at Marina Park, 1600 W. Balboa Blvd. on Wednesday, February 13,019 at 6 p.m. The public is encouraged to attend and participate. The purpose of this initial forum is to provide an overview of the General Plan Update process and to review a draft request for proposals for consultant services. The overall timeline for the General Plan Update is approximately 36 months. However, the City Council wants to make sure the process is not rushed. The goal is to create a community-based General Plan through an open, transparent, and inclusive process. Please visit the City's website at vww_newportbeachca c�L/g. c ate for more information. Grand Canal Dredging Phase 2 Dredging Begins On January 7, 2019, the City's contractor began assembling their equipment on the north side of the Grand Canal for Phase 2 of the dredging project. In order for the equipment to reach the canal, the contractor will begin dredging from Bay Front North towards the Park Avenue Bridge. The final grade dredging at an elevation of 4 feet will begin from the bridge and move towards Bay Front North. Normal work hours are Monday through Friday from 6 a.m. to 9 p.m., with minimal dredging after 6 p.m. The extended hours will allow the contractor to haul an additional load each day, thereby reducing the number of total working days needed for this project. Please exercise caution when boating, kayaking, swimming or paddling near any dredging equipment. Results of Residential Parking Enforcement — Pilot Program The City concluded a three-week pilot parking enforcement program to see whether increased enforcement would be an effective means to manage construction related parking impacts. The following can be concluded from the program: 1) 529 parking citations were issued along with 222 warnings to residents and contractors. 2) 75 percent of parking citations issued were to residents, and 25 percent were issued to contractors. 3) Most people cited were cooperative when educated on the nature of the parking violation. 4) Most violations occurred in two specific areas; a. Parking in red zones b. Parking in the alley 5) Contractor parking violations dropped as the word of additional parking enforcement spread. Harbor Pointe Senior Living Project at Airport Land Use Commission (ALUC) Community Development Department staff attended the January ALUC meeting on behalf of the City for the proposed Harbor Pointe Senior Living Project Harbor Pointe is a proposed 85,000 square -foot, three-story senior convalescent and congregate care facility (i.e., memory care and assisted living) as a State -licensed Residential Care Facility for the elderly with 120 beds. The project site is located on the corner of Bayview Place and Bristol Street where the Kitayama Restaurant is currently located. When originally adopted, ALUC determined that the City's general plan and zoning code were consistent with the land use policies of the Airport Environs Land Use Plan (AELUP) for John Wayne Airport. Since the Harbor Pointe project includes both a general plan amendment and planned community development plan (zoning) amendment, it was required to be heard by the ALUC to determine if the proposed amendments are consistent with the AELUP. After conducting a public meeting, the ALUC concluded the project was consistent with the inclusion of two minor edits, one to proposed CEQA mitigation/conditions of approval, both related to aircraft noise. Boys and Girls Club Renovation The Recreation & Senior Services staff met with the Boys & Girls Club of Newport Beach (Eastbluff) to discuss their progress on renovating the club this summer. As part of a successful fundraising effort, the Newport Beach club will be getting updated facilities, STEAM based learning equipment, and a brand new gymnasium by September 2019! This boost in technology and building upgrades will enhance their programming at the club to serve generations of children to come. Emergency Storm Drain Repair in Mariners Mile The week of January 27th will see the Utilities and Public Works Departments beginning the emergency repair of a storm drain which runs underneath West Coast Highway, Mariners Mile. Traffic control for the necessary lane closures will be staggered to minimize the impacts for the morning and evening commutes. I hope that you are finding my periodic blogs to be "newsy" and informative. I am trying to stick to a schedule of a once a month publication, but as the 2020 election season approaches, you may find me communicating with you in different formats and venues. Just this past week I held my first campaign committee meeting for it is my intent to soon launch my 2020 Campaign for re-election to the Newport Beach City Council. You can update your preferences or unsubscribe from this list Subject: Saying Farewell to 2018 Date: Wednesday; December 19; 2018 at 8:59:25 AM Pacific Standard Time From: Jeff Herdman One Last Note for 2018 General Pian Evaluation and Update Begins On January 8, 2019, the City Council will conduct an afternoon study session to discuss the City's General Plan. At the very beginning of 2017, then Mayor Muldoon attempted to kick off the General Plan Update process by appointing me as one of the co-chairs of the Steering Committee. Then the General Plan Update was put on hold until now. I have expressed to our current Mayor, Diane Dixon, my sincere desire to serve out my initial assignment as co-chair of this Update. I campaigned on insuring that the General Plan be a continual reflection of what the citizen's of Newport Beach envision for our future. It would be an honor for me to help lead this process to completion_ It has been 12 years since the last comprehensive update and it is time to evaluate it to see if there needs to be a course correction. Additionally, changes to State Law requires the General Plan to address new topics. The dousing Element also must be updated by the end of 2021. Community Development staff will provide a summary of the process envisioned, the planned outreach efforts, the community -driven scope, a potential steering committee, Page 1 of 4 estimated costs, and the overall timeline. A draft Request for Proposals (RFP) for a planning consultant will be available and the City seeks feedback. Coastal Commission Approves LCP Clean-up Amendment On December 12, the California Coastal Commission approved the final part of the City's Local Coast Program (LCP) "Clean-up" Amendment. This amendment would amend the certified LCP Implementation Plan to add a new provision recognizing locally approved modifications and variances, restore existing Zoning Code height limit exceptions in the Shoreline Height Limit Area, allow larger additions to nonconforming structures, and revise language relating to the waiver of future protection in shoreline hazardous areas. In a separate action, the Coastal Commission also concurred with the Executive Director's determination that the City's action on the previous part of the clean-up amendment was legally adequate. The Coastal Commission meeting (December 12-14) was held in the Council Chambers at City Hail. Mayor Diane Dixon welcomed the Coastal Commission back to the City. Her presentation included a video that highlighted City projects to protect coastal access, recreation .and resources. Newport Beach Library named as a Star Library The Board of Library Trustees is pleased to announce that Newport Beach Public Library was once again named as a Star Library in a national ranking compiled by "Library Journal" in its eleventh edition of the Library Journal of Public Library Service. A Winning Project The technically complex and logistically challenging Park Avenue Bridge Replacement Project was selected as a 2018 winner of the American Public Works Associations Southern California. Chapter's Pa,ga 2 of 4 B.E.S.T. Awards in the $5-10 million Transportation category. City project staff along with Councilman Herdman received the Award plague at the Award Luncheon in Lakewood on December 12. Many thanks to the Liitle Balboa Island and Balboa Island residents and merchants for their cooperation and understanding in making this project a success. Aviation Update JINA is proposing to modernize its general aviation (GA) facilities and has taken the f irst step with the release of a Draft Environmental Impact Report (DEIR). Many of you have questions and concerns about this project one of which is, "Has the City responded to the airport in any way regarding this project?" Be assured that the City has been aware of, and has taken several actions. The City began tracking this proposal as early as Marcy, 2017, attended the initial scoping meeting and provided a detailed comment letter. Moreover, this has been a subject of discussion at the City's Aviation Committee Meetings. Also, when the DEIR was released the City began a detailed review of the document, attended public briefings, and briefed community groups. The City has provided detailed comments on the DEIR which you can access on the city website. With this past vveekend's Daily Pilot Newspaper announcement of Duffy Duffield win in the Duffield vs. Stoaks race for city council, it will probably not be a surprise to learn that as of this morning, an official vote recount effort has begun. I received an e-mail from supporter Susan Skinner this morning who is representing the recount effort. Susan asked me to inform as many people as possible and to ask for a donation towards this effort. The cost of a recount is $25,000, however, there are variables within the recount process that could greatly reduce the cost. For example, the initiator of the recount is required to pay a deposit each day that the recount is taking place in order to cover the costs for that day. The length of the recount then determines the actual cost. Also, if the initiator's candidate is the actual winner, all funds paid are refunded. l was most hopeful for a. new day in Nlsvntport Beach when the initial results were the first broadcast on election night. I held on to that hope through the week following the election, but when I sake that Tim's lead was beginning to erode, my hopes started to Make the same direction! So, 1(his final eiiort being launched this morning with less than a I% vote difference between Duffy and Tim is warranted and justified. Read below for some of the details. Residential Parking Enforcement — Pilot Program On November 1, the City began a three-week pilot parking enforcement program (ending November 21) to see whether increased enforcement would be an effective means to manage construction related parking impacts on Lido Isle and Balboa Island, Balboa Peninsula, ;Nest Newport, and Corona dei fear. The City's parking contractor, AmeriPark, has added five personnel specifically to enforce the above areas. Among other items, enforcement will focus on red curb violations, alley violations, and other residential parking restrictions. They will also be observing and reporting to the City's Community Development on non -parking related violations. While the pilot program is being implemented to analyze Page 1 of 5 construction related parking behavior. ALL vehicles that violate the California Vehicle Code and/or the Newport Beach Municipal Code will be cited. At the end of the pilot program, staff will return to Council with the data, input, and analysis from the increased enforcement. Newport Pier Restaurant Staff from the Community Development Department met with the owners of BlueWater Grill Restaurant to discuss ongoing lease negotiations for a new restaurant at the Newport Pier. An application to demolish the existing restaurant has been submitted to the California Coastal Commission and will allow the City to move forward withthe design of the new building. City Awarded $1.68M Grant for the Newport Bay Water Wheel Project The California Ocean Protection Council has awarded the City a. $1.68 million grant to fund the Newport Bay Water Wheel Project. The grant money comes from funding generated by the Water Quality, Supply, and Infrastructure Improvement Act of 2014 (Proposition 1). Mayor Duffield traveled to Santa Cruz to address the Ocean Protection Council during its October 25 meeting and explain the importance of the project to Newport Beach. Once in place in the Upper Newport Bay, the water wheel will help the City to capture up to 80 percent of the floatable trash and debris that enters the bay from the San Diego Creek. The project will help prevent the trash from ending up on lower bay beaches and in the ocean. It is also expected to significantly improve bay water quality. The City will now work to obtain the necessary regulatory permits. Baltimore was the first city in the United States to use the water wheel and Newport Beach is expected to be the first West Coast city to use the device. Sincere appreciation is extended tocity engineer, Jahn Kappler for securing the grant for this project. West Coast Highway Median Landscaping Page 2 of 5 The landscape maintenance project on West Coast Highway is nearly complete. All the plants are in, and the contractor will apply stain to the existing concrete in the medians. Along awaited completion for the folks in West Newport, and a terrific enhancement to the West entrance to our city! Police Department Remodel Update Updates to parts of the Police Department are now complete. The detectives' area was revitalized to provide new workstations, meeting and interview rooms, fresh paint, and new LED lighting. The project also modernized the squad room by renovating an old mail delivery area into a small kitchen area. Tables in the squad room now can be retracted and stored, allowing the room to convert to a training area. The Annual Newport Beach Holiday Boat Parade This year's Holiday Boat Parade will begin on the evening of Wednesday, Dec. 19th. Look for a schedule that will be published in the Daily Pilot showing the route of the parade, and times it will hit particular viewing locations, -or-a place in the harbor where -you -typically view this annual spectacular. The parade will run for 5 nights ending on Sunday, December 23rd. Our city is greatly impacted by traffic and spectators for this event. I have requested the assistance of the control of vehicular and pedestrian traffic for each night of the end of the Boat Parade on Balboa Island. I have been assured that police personnel will be on - hand to keep the traffic flowing oil the Island each evening. Jeff's Take .......... Proposition T passed, despite my advice to vote NO. Time will only tell in terms of how our city's infrastructure will be affected by the passage of this measure. I predict the day will come when a future city council will be faced with a major capital improvement project (CIP) that whose cost will be at or above the S50M threshold which will trigger a community vote on the project. And Page, 3 of 5 remember, what costs $50M today will not be the same as 20 years into the future due to inflation and overall increased costs. Additionally, more and more CIP work will begin to fall into the $50M ; cost category, and it is going to be tough to get projects approved as they line up for a vote. We are now the only city in the nation requiring such a vote! Good luck, folks! You've given our children and grandchildren, as well as future city councils, quite a challenge. Just don't let things fall apart, please! On a brighter note, a new day has dawned in the City of Newport Beach as a result of the recent City Council election. I have renewed energy and motivation knowing that we have a new council majority whose only interest is serving the citizens of Newport Beach to the very best of their ability. The "agenda" (don't like to use that word because of its negative connotation) will be aggressive, and speaks to many action items that have been needed in this city for a long time .... .items like election reform, General Pian Update, Municipal Code changes, ensure that the selection results for committees, boards, and commissions represent the best -qualified candidates, evaluation of our new Harbor Department, continued emphasis and work with John Wayne Airport in relation to flight takeoff procedures, and a renewed emphasis on transparency and trust. As one of our new council members states, we are going to open all of the doors and windows, and direct all of our energy toward positive outcomes for the city! I've been working on this for over a year novo and must confess I had no idea how deep the roots of dysfunction had grown—into our very foundation as a city. The back room deals and secrets being kept from the public were the mere tip of the iceberg. More is being revealed all the time about the apparent conflict of interest between Duffey and Scott Peotter; who have now been shown to have a Page 1 of 3 business relationship. They are now trying to say there is nothing wrong with that but, if so, then why did they hide it from us for so long? Why dict they not disclose it to the city attorney and the rest of the council? We need to be sure the city is not held liable for any votes cast by Scott which were in the best interest of Duffy when Duffy had to recuse himself! Is our city attorney monitoring these actions and protecting us as tax paying citizens? And Scott has injected partisan politics into everything he has done since elected, including this campaign. In my 57 years in Newport Beach I have never seen this done. The point of our city council being a non-partisan position is so that we will represent ALL of our constituents. He says at forums that he is elected to represent his political philosophy and I say I will be elected to represent our citizens. He says my mission of listening to our constituents is like sticking my finger in the air to see which way the wind blows. The polar opposite is true ... knowing and understanding the thinking of the people of Newport Beach is about relationships with people I respect. The city- wide process of campaigning has allowed me the opportunity to know and understand more about the issues of citizens throughout our community. The political machine that got 6 of our 7 council members elected thinks they have the secret to controlling our council... money, money, money. The special interest money to which they have access pays for a lot of glossy flyers. But every dollar we raised. over $90,000, was from people who actually care about our city. Going in to the interview with this candidate I knew absolutely nothing about him other than what I had read on his resume. He did an outstanding job in the interview and moved to the top as one of my three most qualified candidates. Fused on his peu lorprnance during the interview I did vote to place him in the top three for a second interview. Then the name of the candidate was "leaked", and absolutely not by me.: s a result of this leak I began receiving e-mails and (ace- to -face comments from people encouraging me to not consider this Individual for the position. I even did some fact checking myself zind concluded that this individual was no longer a viable candidate. I had sa responsibility to the camG'inM1 ri ty to do this. This left me with two very qualified candidates from which to select; candidates; I was very comfortable with as finalists. At the conclusion of the interviews, we selected three finalists and set the date of August 13 for the final interviews. I questioned the city clerk as to why the clate is being moved up; I received a very evasive answer. I just want you to know that I have no idea a+✓hat is taking place here. but I am very suspect as to why the planned tim-aline for these interviews was changed from August 13 to Monday_ My fear is that what is taking place here is a repeat of what the council majority did to Dave; i believe that the council majority has identified a candidate they want in the position, and they are moving forward on this without having provided any explanation to the entire council. I have no control over what is taking place, nor what took place regarding Dave's firing by the council majority. However, I will do my best on Monday to insure that the finalist for the position is qualified. Two out of the three finalists that will be interviewed Page }.of3 on Monday are outstanding. ID#: 1381208 Little Island Bridge Update Finally, after an almost 8 month delay, the brand new Little Island Bridge will be opened on Tuesday, July 25th. A fun afternoon is planned beginning at 2:30 p.m. right at the bridge. The official ribbon cutting will take place at 3:00 p.m., so if your schedule permits, come to the Island and participate in this long awaited event. Budget Update Since my last newsletter/Slog things have certainly not slowed down. The Council just last month unanimously approved a $306.9 million budget for the 2017/18 fiscal year which focuses on the harbor, paying down the City's unfunded liability (an additional $9 million), and supports a variety of capital improvement projects. The operating portion of the budget is $281.8 million; a 13.2% decrease over the prior year's budget. As I mentioned above, a significant investment will be made in the harbor and beaches ($12 million) for projects like dredging, seawall repair and replacement, mooring administration, pier maintenance, and abandon watercraft abatement.
