Johnson, Jr, for a, pllu.gbing license was granted, same bein- accompanied by a Surety Bond which was approved.. On motion of Trustee Geo. P. tlilson seconded by Trustee H. C. Sloan and carried, the Surety Bond of Charles F. Fickas was approved r -nd plumbin; license granted. On motion of Trustee L. S. Wilkinson seconded by Trustee Geo.P. Uilson and carried, the cpplication of Joel Uillson for three weeks vacation from October 4th was granted, two .-reeks of the tine only on pay. On motion of Trustee Geo. P. 1'lilson seconded by Trustee T1. C. Sloan and carried, the request of i.Ir. Porter for appointment of A. G. Schilling as Police Officer during; Joel Wilson's absence, was granted and the appointment approved on c, salary of ,;5.00 per night. On motion of Trustee H. C. Sloan seconded by Trustee Geo. P. On motion of Trustee Geo, P. Uilson seconded by Trustee T. C. Sloan and carried, the City Clerk was instructed to advertise for bids for a purap house for the new pvi. ?p at the pumping plant. City Clerk. City hall, Newport Beach, October 16, 1922. The Board of Trustees of the City of Newport Beach met in regular adjourned session at 7:30 o'clock P. I:-,. on above date. The meeting was called to order by President J. J. Schnitker. The roll was called showing the full Board present. The minutes of the previous meeting were read, corrected and approved. The communications were read and referred to the proper order of business. This being the day and hour set for opening bids on ?35,000 of T.Sunicipal Improvement District No. 2 bonds, the President called for the bids to be opened but the Clerk reported that no bids had been received. Trustee L. S. l";ilkir_son introduced a Resolution amending Section 4 of Resolution No. 203 authorizing the Board of Trustees to sell the whole or any part of the 360,000.00 par value bonds of Municipal Improve- ment District No. 2 of the City of Newport Beach, at private sale and without further advertisement for bids but for not less than their par value and accrued interest. The Resolution was ordered filed, read, considered, designated Resolution No. 205, the roll was called and the resolution passed and adopted by the following named members of the Board of Trustees: Ayes, Trustees J. J. Schnitker, H. C. Sloan, Geo. P. Wilson, Conrad Richter, L. S. Wilkinson. Noes, Trustees I ?one. Absent, Trustees None. ..] 0 55 The First National Bank of Newport Beach through its President Low H. Wallace, presented a written bid for the bonds in multiples of 5 bonds at par and accrued interest, and on motion of Trustee H. C. Sloan seconded by Trustee Goo. P. Wilson, the bid was accepted by the following vote: Ayes, Trustees J. J. Schnitker, II. C. Sloan, Goo. P. I'Jilson, Conrad Richter, L. S. Wilkinson. Hoes, Trustees None. Absent, Trustees None. UNFINISHED BUSIFESS . The Clerk stated that this is the time to which the hearing of objections to the Street Superintendent's list of unpaid assessments upon the assessment made to defray the costs and expenses for the improve- ment of PORTIO -NS OF OI•:NTRAL AVENUE AMID OTH1?R STREETS, ALLEYS, AND RIGHTS - OF -WAY AIQD PROPERTY O'.T•IIED BY THL' CITY OF NE6'JPORT BEACH, by the construction therein of severs and appurtenances as contemplated by, and described in, Resolution of Intention No. 133 of the City of Newport Beach adopted July 6, 1920; and that notice of said hearing had been again given of said hearing, in'the manner and for the time required by law, and by the order of the Board of Trustees, made at the meeting held on the 2d day of October, 1922. The President then asked if any objections had been received. WHEREUPON the Clerk presented an objection filed on the 2d day of October, 1922, signed by Jonathan Tibbet by ii. C. Head as his Attorney in fact; and an objection by Edna R. Ferguson as executrix of the estate of Joseph Ferguson, deceased, filed September 30, 1922; and another by IMirs. Janette A. Woods, filed on the 2d day of October, 1922. The President then asked if there were any persons present who objected to said list or who desired to be heard thereon; and it appearing that there were no persons present who objected to said list or ;aho desired to be heard thereon, it was moved by Trustee Ueo. P. IiJilson seconded by Trustee H. C. Sloan, that the objections of Jonathan - Tibbet, .Edna R. Ferguson and Ers. Janette A. Woods be overruled and denied; which motion was carried by the following vote: Ayes, Trustees J. J. Schnitker, H. C. Sloan, Goo. P. Viilson, Conrad Richter, L. S. Vlilkinson. Noes, Trustees None. Absent, Trustees None. The President then stated that it was in order for the Board to take some action upon said list of unpaid assessments. :IIEZZUPON Trustee L. S. Wilkinson offered the following Resolution, which ,;aas duly seconded by Trustee Conrad Richter. THAT WHEREAS on the 18th day of September, 1922, the Superinten -. dent of Streets filed his list of assessments, unpaid, upon the assessment made to defray the costs and expenses for the construction of sewers and appurtenances in CERTAIN PORTIONS OF CENTRAL AVENUE AND OTHiR STMi,ETS, ALLEYS, AND RIGHTS -OF -WAY AND PROPERTY 017NED BY THn CITY OF NET.iPORT BEACH, as described in Resolution of Intention No. 133 of said City, adopted July 6, 1920; and the Clerk of said City had fixed October 2, 1922, at the Council Chamber of the City Hall, as the time and place for hearing objections to said list, and had given due notice thereof in the manner and for the time required by law; and at said time the Board of Trustees had proceeded to said hearing, and it appearing that there were many persons present 'who claimed that property belonging to them was contained on said list, but that they had failed to produce receipts, releases or other evidence of such payment, and in consequence thereof it had been decided by the Board of Trustees that said hearing should be continued to the 16th day of October, 1922, at the hour of 7:30 o'clock P. and that, additional notice of said hearing should be given in the manner and for the time required by lava, and that in addition thereto the said notices should contain a statement to the effect that persons who owned land which appeared upon said list and who had paid their assessments thereon should produce or cause to be produced their receipts or other evidences of payment of the same. AND 7JIEREAS it appears, that said notices have been duly given and that the Board has considered all objections filed or made to said list, N07t7 THEREFORE Be It Resolved by the Board of Trustees 6f the City of Newport Beach that the said Board finds and determines that all of said objections filed and:made to said list are groundless, and that all of the assessments appearing upon said list, consisting of.pages 1 to 47 inclusive, are unpaid; and that bonds should be issued upon the security of the unpaid assessments shown thereon; that the aggregate amount thereof is the sum of ;.261,939.58. 56 Which Resolution Was carried by the Ayes, Trustees J. The President then stated that it Was then in order to prescribe the denomination of the said bonds and provide for the issuance of the same in annual series. VIHEREUPON it was moved by Trustee Geo. P. Wilson seconded by Trustee H. C Sloan, that the said bonds should be issued in the denomi- nations of 9j . 00.00 and }1,000.00 as near as may be; that 13 bonds in each annual series shall be issued in the denomination of zil,000.00; 8 bonds of each annual series shall be issued in the denomination of X500.00; and 1 bond in each annual series shall be issued in the denomination of approximately X462.638; that there shall be 15 annual series of said bonds and that the principal sum of each annual series shall aggregate the su.i of P'17,462.638; and that said bonds shall issue forthwith, and that the coupons affixed to said bonds may bear the printed signature of the Treasurer of said City in the place and stead of his signature by hand, and that the Treasurer and Clerk of said City be and they are herebir authorized and directed to sign said bonds, and that the Clerk be and he is hereby authorized and directed to affix the seal of the City thereto. Which motion was carried by the following vote: Ayes, Trustees J. J. Schnitker, H. C. Sloan, Geo. P. Wilson, Conrad Richter, L. S. Wilkinson. Noes, Trustees None. Absent, Trustees None. The President then stated that it Was in order for the Board of Trustees to fix a time for the sale of said bonds. t'JHEREUPON it Was moved by Trustee Conrad Richter seconded by Trustee Geo. P. Wilson that Monday the 30th day of October, 1922 at the hour of 8 o'clock P.Ii. in the Council Chamber of the City Hall of said City, be and is hereby fixed as the time and place for the sale of said bonds; that the City Clerk be, and he is hereby authorized and directed to publish notice of the said time and place of the sale of said bonds and inviting bids therefor, by publication of said notice once a week for two •,weeks in the Newport News, a newspaper of general circulation published in the said City of Newport Beach; and that the said Clerk shall be and he is hereby authorized to receive bids for said bonds up to the said hour of 8 o'clock P. M. of said 30th day of October, 1922; and that the said notice shall contain a statement to that effect. FJhich motion was adopted by the following vote: Ayes, Trustees J. J. Schnitker, H. C. Sloan and carried, the request of I;trs. N. E. Carpenter for transfer of her business license to D. r,. Noore Was granted. The communication from the PJomen's Civic League Was taken up and on motion of Trustee H. C. Sloan seconded by Trustee Geo. P. Wilson and carried, the City Clerk was instructed to notify the Pacific Electric Co. of the ordinance recently passed prohibitint throwing papers on the streets. The communication from City Recorder Hall in regard to a vacation was tabled. On motion of Trustee L. S. Wilkinson seconded by Trustee Geo.P. Wilson and carried, the communication from Simons Brick Co. in regard to the house boat of E. D. Burge was referred to the harbor Master with instructions to report on same at the next meeting. The report of City Engineer Kressly on the cost of a concrete bridge across the Rivo Alto on 36th Street of ,;j10,200. was discussed, and on motion of Trustee H. C. Sloan seconded by Trustee Geo. P. Wilson and carried, the matter was referred back to the City Engineer for an estimate on a wooden bridge with concrete piling and also on a wooden bridge with creosote piling to report on at the next meeting. The communication from C. K. Burnett of the Pacific Electric Co. in regard to the strip along their right -of -way covered. by the condemnation proceedings, was filed. On motion of Trustee Geo. P. ;ilson seconded by Trustee H. C. Sloan and carried, the plumbing; bond of Buell & Estus was approved and accepted. M The matter of abandonment of the alley along the Tibbets property in Block 119 was discussed, and on motion of Trustee L. S. Wilkinson seconded by Trustee H. C. Sloan and carried, the necessary proceedings for the abandonment of the alley were to be started. On motion of Trustee H. C. Sloan seconded by Trustee Goo. P. Wilson and carried, the Clerk was instructed to advertise for bids on the dredging for which the bonds were sold in Municipal Improvement District No. 1, the copy for same to be furnished by the City Engineer. On motion of Trustee L. S. Wilkinson seconded by Trustee H. C. Sloan and carried, the City Attorney was instructed to proceed with the necessary steps to have the condemnation proceedings under way for the ' Southern Pacific 'Wharf and right -of -way. On motion of Trustee L. S. Fdilkinson seconded by Trustee Geo.P. Wilson and carried, the President was asked to appoint a committee consisting of the City Treasurer and one member of the Board to get an appraisement of the land of the Pacific Ranch Co. across which our pipe line goes, and to make them an offer on same. The Committee appointed is Lew H. Wallace and H. C. Sloan. The City Attorney reported that 1,1r. Naughton stated the Contractor putting in the pipe line was driving across the ranchers crops, and on motion of Trustee Goo. P. 11ilson seconded by Trustee H.C. Sloan and carried, the City Engineer was instructed to investigate the statements made and report at the next meeting. On motion of Trustee Geo. P. Wilson seconded by Trustee ii. C. Sloan and carried, the request of Mr. Porter for 350.00 clerk hire in getting out the tax bills was allowed. On motion of Trustee L. S. Wilkinson seconded by Trustee H. C. The meeting was called to order by President J. J. Schnitker. The roll was called shoeing the full Board present. The pinutes of the previous meeting were read and approved. On motion of Trustee Geo. P. Wilson seconded.by Trustee L.S. Wilkinson and carried, the report of Harbor I:iaster Beek was referred back to him to see that the house boat of TrTr. Burge is anchored far enough out to float at all times. This being the time fixed for opening bids for the construction of a pump house at the pumping plant, the Board_ in open session publicly opened, examined and declared all sealed bids received for said work, to -exit: J. Simon Fluor, for complete job, - - - - - - - - (22,230.00 Ellsworth Bros. & Son, 1! 11 - - - - - - - - 2,622.00 Frank H. Greene, Incomplete " - - - - - - - - 1,647.00 And thereupon the bids were referred to the City Engineer for report. The City Engineer reported favorable on the bid of J. Simon Fluor and on motion of Trustee H. C. Sloan seconded by Trustee Geo. P. ':Jilson, all bids were rejected except the one from J. Simon Fluor and he was awarded the contract for building the pw.in house, and all checks of unsuccessful bidders to be returned, the sa;ae being carried by the follo,,aing vote:
