Sloan and carried, preliminary steps were to be taken in the matter of paving 36th Street from the Ocean Front to the Rivo Alto and from the Rivo Alto to the connection with Newport Boulevard; Also the paving of 29th Street from Coast Boulevard to the Southern Pacific Right -of -way, and the dirting of the alley parallel with the ocean in Blocks 30 to 38 inclusive. On motion of Trustee Geo. P. Wilson seconded by Trustee H. C. Sloan and carried, the meeting adjourned to 7:30 o'clock p.m. on Monday, January 29, 1923. Approved -2AZ� 3 �Pres ent Board of Trustees. Attest: city er . City Hall, Newport Beach, Jan. 29, 1923. The Board of Trustees of the City of Newport Beach met in regular adjourned session at 7:30 o'clock p.m. on above date. The meeting was called to order by President J..J. S'chnitker. The roll was called showing the full Board present. The minutes of the previous meeting were read.and apprmved. The commtnications were read and referred to the proper order of business. This being the day and hour set for opening bids for the reconstruction of the old Southern Pacific Wharf at Newport Beach, the Board in open session opened, examined and declared all sealed bids for said work, which bids were as follows: Emil F. Cykler, for the complete job, - - - - - $542807.00 Frank H. Greene, do. - - - - - 362460.00 James L. Frazer, do. - - - - - 340995.00 The Wheeler Company, do. - - - - - 312750.00 Mercereau B. & Const. Wilson seconded by Trustee Conrad Richter and carried, the bids were referred to the City Engineer for report. This being the day and hour set for opening bids for the old electric light wire the City has to dispose of, the Board in open session opened, examined and declared all sealed bids for same, which were as follows: Orange Co. Sloan and carried, the bids were referred to the City Electrician to report on at the next meeting. This being the day and hour set for opening bids for a Franchise covering the gas distributing system, the Board in open session opened, examined and declared all sealed bids received for same, which were as follows: Southern Counties Gas Company, - - - - - - - - $50.00 Trustee L. S. Wilkinson introduced an ordinance. granting to the Southern Counties Gas Company of California, a corporation, a 40 year franchise to lay, construct and maintain pipe lines in the streets and alleys of the City. The Ordinance was ordered filed, read, considered, designated Ordinance No. 222 and referred to the City Attorney. The deed of the Pacific Electric Railway Co. dated the 19th day of January, 1923, was presented, ordered filed and accepted and W Directed to be placed on record. The partial release of the United States Mortgage and Trust Co. referring to property deeded by the Pacific Electric Electric Railway Co. to the City of Newport Beach from the lien of the mortgage held by the United States Mortgage and Trust Co. therein, is ordered filed and directed to be placed on record and when recorded to be returned to C. H. Burnett, Manager of Real Estate, Taxes and Resort Department of the Pacific Electric Railway Co. The City Attorney is hereby authorized to procure a Certificate of Title covering the described land. The-above resolution was passed by the following vote: Ayes, Trustees J. J. Schnitker, H. C. Sloan, Geo. P. Wilson, Conrad Richter, L. S. Wilkinson. Noes, Trustees None. Absent, Trustees None. A petition was presented asking that the boundaries of the City of Newport Beach be altered and new uninhabited territory annexed thereto, incorporated and included therein, and that proceedings be taken as provided by law. The petition was received, witnesses were sworn and testified, from which it appears and the Board of-Trustees find as follows: (1.) The petition is signed by qualified electors of the City of Newport Beach, one -tenth and more in number, of the qualified electors of the City of Newport Beach computed upon the number of votes cast at the last eneral municipal election held in the City of Newport Beach. f2.) That the described territory is contiguous to the City of Newport Beach, wholly uninhabited and forms no part of any incorporated city or town. Pursuant to the foregoing findings, the petition, and as required by law, it was ordered, that the Clerk notify the Board of Supervisors of the County of Orange, being the County in which the City of Newport Beach is located, of the fact of the filing of such petition. City Attorney Clyde Bishop reported that Lot 9 in Block 9 of Balboa Tract could be bought for $3,750.00, and on motion of Trustee Geo. P. Wilson seconded by Trustee H. C. Sloan, a warrant was ordered drawn in favor of the Orange County Title Co. for $3,750.00 for the Lot by the following vote: Ayes, Trustees J. J. Schnitker, H. C. Sloan, Geo. P. Wilson, Conrad Richter, L. S. Wilkinson. Noes, Trustees None. Absent, Trustees None. On motion of Trustee L. S•. Wilkinson seconded by Trustee Conrad Richter and carried, the City Clerk was instructed to advertise for bids on the 19th Street sewer bonds in the sum of $3,891.17 and the "F" Street sewer bonds in the sum of $1,684.47. Trustee Conrad Richter - introduced an ordinance declaring certain land conveyed to the City to be a part of Central Avenue and establishing curb lines and grades. The Ordinance was ordered filed, read, considered, designated Ordinance No. 223 and referred to the City Engineer. City Engineer Paul E. Kressly reported that W. M. Ledbetter was the lowest bidder for the extension and reconstruction of the wharf and would recommend that he be given the contract. On motion of Trustee L. S. Wilkinson seconded by Trustee H. C. Sloan all bids were rejected except the one from W. M. Ledbetter and he was awarded the contract for the wharf; all checks or bonds from the unsuccessful bidders to be returned by the following vote: Ayes, Trustees J. J. Schnitker, H. C. Sloan, Geo. P. Wilson, Conrad Richter, L. S. Wilkinson. Noes, Trustees None. Absent, Trustees None. On motion of Trustee L. S. Wilkinson seconded by Trustee H. C. Sloan and carried, the City Treasurer was instructed to purchase sewer bonds to offset the sewer assessments against the four lots transferred to the Southern Counties Gas Co., and also the gas system bonds now in possession of the First National Bank of Newport at the price on day of sale furnished by Blyth, Witter & Co., Cyrus Peirce & Co. and the California Company. EIKE Trustee H. C. Sloan introduced a resolution determining that the public interest and also the public necessity demands the construction by the City of Newport Beach of certain buildings for municipal uses, the cost of which will be too great to be paid out of the ordinary annual income and revenue of the City of Newport Beach. The resolution was ordered filed, read, considered, designated Resolution No. 217 and referred to the City Attorney. This being the day and hour set for hearing protests in the matter of vacating the alley in Block 119 of First Addition to Newport, Beach described in Resolution No. 207; Attorney H. C. Head of Santa Ana was present and took up the matter for Mr. Jonathan Tibbets. The matter was discussed and continued to February 5, 1923. On motion of Trustee H. C. Sloan seconded by Trustee Geo. P. Wilson and carried, the City Clerk was instructed to advertise for bids for changing the sewer in that portion of the alley in Block 119 First Addition which is to be abandoned, on data furnished by the City Engineer. On motion of Trustee Geo. P. Wilson seconded by Trustee H. C. Sloan and carried, the offer of the Los Angeles Dredging Co, of 16� per cubic yard for dredging at Balboa, was accepted providing that we can get permission to go under the Pacific Electric tracks. On motion of Trustee H. C. Sloan seconded.by Trustee Geo. P. Wilson and carried, the application of F. H. Rohrs for permission to cross the sidewalk in front of garageon Lot'-l'.in Block 26 Newport Beach, was granted under the supervision of the Street Superintendent. On motion of Trustee H. C. Sloan seconded by Trustee L. S. Wilkinson and carried, the matter of the new jail, fire hall; etc. was put in the hands of the Street Committee, Fire Chief and City Marshal. On motion of Trustee L. S. Wilkinson seconded by Trustee H. C. Sloan and carried, the matter of a more serviceable car for the Police Department was referred to the Police Committee and if necessary to purchase a new car to advertise for bids on same. The communication from Frederic W. Potter in regard to street work on 4th Street East Newport, was referred to the City Engineer. On motion of Trustee Geo..P. Wilson seconded by Trustee Conrad Richter and carried, the request of A. C. Rice for an extension of 30 3 days on his street lighting contract was granted. The communication from the Balboa Chamber of Commerce in regard' to additional drinking fountains was referred to the Water Superintendent with power to act. The twos. petitions asking to have the corners of the lots in two alleys in East Newport cut, were laid on the table for the present. On motion of Trustee L. S. Wilkinson seconded by Trustee Conrad Richter and carried, a Map of Tract No. 389 of Newport Heights coming within the three mile limit of the City, was approved. On motion of.Trustee Conrad Richter seconded by Trustee H. C. Sloan and carried, a Map of Tract.No. 371 being a subdivision of Lot 63 of Newport Heights, and a Map of Tract No. 377 being a subdivision of Lots 142, 152 and 162 of Newport Heights coming within the three mile limit of the City, was approved.
