Sloan and carried, demands No. 1432 to 1578 inclusive, having been signed and approved by the Finance Committee, were allowed and warrants to be drawn for same. There being no further business on motion of Trustee H. C. Sloan seconded by Trustee Cohrad Richter and carried, the meeting adjourned to 7 :30 o'clock p.m. on Yonday, April 9, 1923. The Board of Trustees of the City of Newport Beach met in regular adjourned session at 7:30 o'clock p.m. on above date. The meeting was called to 6rder by President J. J. Schnitker. The roll was called showing the full Board present. The minutes of the previous meeting were read and approved. The Street Committee asked for further instructions in regard to the Crown Stage Company, and on motion of Trustee Conrad Richter seconded by Trustee H. C. Sloan and carried, the Committee were instructed to make a tentative offer to the Crown Stage Company of a ten year lease with the right to terminate it at any time after five years, upon taking the buildings off the hands of the Crown Stage Company at the cost of its construction less a depreciation of 20 %, with an adjustment of rent at the expiration of five years if the City does not terminate the lease. The annual rental for the first five years to be .; ?800.00 per year or 5j3,000.00 cash in advance for the five year period; the final lease to be approved by the Board. Treasurer Lew H. Wallace reported that he saw Geo. V1. Angle and he was willing to negotiate with the Board in regard to the assessing. On motion of Trustee Geo. P. Wilson seconded by Trustee Conrad Richter and carried, the report was accepted and Committee discharged, and the Clerk' was instructed to write to PIr. Angle to meet with the Board next i;ionday night. The communications were read and referred to the proper order of business. U17INISM."D BUSINESS. ORDINANCE NO. 229, entitled as follows: "An ordinance of the City of Necrp6rt Beach defining and establishing the boundaries of a municipal improvement district in said City, designating the name-by which it shall be known, and calling an election to be held within the district, and providing for the submission to the electors thereof four (4) propositions of incurring a debt ' by the issuance of'the bonds of such district for the purposes set forth in Ordinance of Intention No.'227, reciting the objects and purposes for which the proposed indebtedness is to be incurred, the nature of the improve- ment work contemplated, the estimated cost thereof, the amount of the'principal of the indebtedness to be incurred therefor, and the rate of interest to be paid on said indebtedness; fixing the date on which such election shall be held, the manner of holding the same, and the manner of voting'for or against said propositions," Was taken up for final action; was read, considered, the rmll was called and Ordinance No. 229 passed by the vote of the following named two- thirds and more of all the members of the Board of Trustees; signed and approved by the President thereof and attested by the Clerk; the same bean.1, passed by the following vote: 98 � Ayes, Trustees J. On the 3d day of April, 1923, there was held at and within the City of Newport Beach a special election called and ordered to be held by Ordinance I ?o. 225 of said City,,at which special election there was submitted to and voted for and against by the electIrs of the City of Newport Beach, by marking their ballots FOR ANNEXATION or AGAINST ' ANNEXATION, the question whether or not the boundaries of the City of Newport Beach should be altered and new uninhabited territory annexed thereto, incorporated and included therein; the new and uninhabited territory being a part of what is commonly called Corona del Liar, and located in the County of Orange, State of California, and generally described as: Beginning at the most Southerly corner of Corona Del i.:ar, as shown on a map thereof, recorded in Eiscellaneous Liap Book s, pages 41 and 42, Records of Orange County, California, and running thence North- easterly along the Southeasterly line of said Corona del Isar to an intersection with the Southeasterly prolongation of the Southwesterly line of Lot 5, Block "BB" of Tract No. 323, recorded in Miscellaneous Eap Book 14, pages 40 and 41, Records of Orange County, California; thence IT. 50 deg. 22 min. The described new and uninhabited territory forms no part of any incorporated city or town. For the purpose of said special election the City of Newport Beach was divided into two (2) special election precincts, designated Special Election Precinct No. 1 and Special Election Precinct No. 2. The returns of the special election having been filed with and now in the possession of the Clerk of the City of Newport Beach and this, the 9th day of April, 1923, at the hour of-7:30 o'clock p.m. of that day, being the time provided for the regular meeting of the Board of Trustees of said City, next after the filing of said returns and said Board of Trustees being duly convened at said regular meeting, proceeded to and did open and canvass said returns, and finds, orders and causes a report thereof to be made and entered upon this the ' minutes of said meeting and there establish of record as follows: (1) That in special election precinct No. 1 55 votes were cast FOR ANNEXATION and 14 votes were cast AGAINST ANNEXATION., and that 69 votes were cast in all. (2) That in sprcial election precinct No. 2 126 votes were cast FOR ANNEXATION and 18 votes were cast AGAINST ANNEXATION, and that 144 votes were cast in all. (3) The whole number of votes cast in favor of annexation were 181 votes. (4) The whole number of votes cast against annexation were 32 votes. (5) The whole number of votes cast for and against annexation were 213 votes. That at the special election held on the 3d day of April, 1923, a majority and more of all the votes cast were cast POR ANNEXATION and in favor thereof. It is therefore, by the Board of Trustees of the City of Newport Beach, ordered that in pursuance of the proceedings had and taken and by authority of an Act of the Legislature of the State of California, the new and uninhabited territory hereinbefore described be and the same is annexed to, incorporated and included in the City* of Newport Beach, and that the Clerk of the City of Newport Beach be and he is hereby directed to certify under the seal of said City and to transmit to the Secretary of State of the State of California and to the ' Board of Supervisors of the County of Orange, the county in which the Citv of Newport Beach is located, a copy of this report as entered upon these minutes, together with a statement showin the date of said election, and the time and result of the canvass, and from and after the date of the filing of said document in the office of the Secretary of State the annexation of the described territory shall be deemed and shall be complete and thenceforth the annexed territory shall be a part of the City of Newport Beach for all intents and purposes, except that no part of such annexed territory shall ever be taxed to pay any portion of any indebtedness or liability of the City of Newport Beach contracted to ob existing at the time of such annexation. Nis "! BUSINESS. Trustee Conrad Richter recommended the appointment of an Assistant Fire Chief at a salary of '1 ?15.00 per month, and on his motion loo seconded by Trustee H. C. Sloan and carried, the Fire Department was *R� .authorized to elect an Assistant Fire Chief and the Board would approve it. The City Engineer presented a diagram of the assessment district showing lands to be assessed for the re- construction of the ornamental street lighting system upon certain portions of Central Avenue and other streets and avenues under Resolution of Intention No. 188. Upon motion of Trustee Geo, P. Wilson seconded by Trustee L. S. ,Rilkinson said diagram was approved by the following vote, to -wit: Ayes, Trustees J. J. Schnitker, H. C. Sloan, Geo. P. Mlson, Conrad Richter, L. S. Wilkinson. Noes, Trustees None. Absent, Trustees None. ' The communication and sketch of the roof the Balboa Boat Elorks desire to erect over the pier in front of their building at Balboa was, referred to the Street Committee and City Engineer to report on at the next meeting. A blue print of Tract No. 444 Alta Vista Terrace on Newport Heights was laid over pending receipt of the original.map. The request of the Mercereau Bridge & Construction Companyfor an extension of 60 days on their contract for building the bridge over the Santa Ana River was discussed, and on motion of Trustee Conrad Richter seconded by Trustee Geo. P. Wilson and carried, 40 days time was allowed them providing they assume all engineering and inspection. services after expiration of th, present extension The request of Mrs. E. G. ["Talker for an extension of time on their lease of the Newport pavilion to October 1, 1923 was taken up, and on motion of Trustee Conrad Richter seconded by Trustee Geo. P. Wilson and carried, the request was granted with the understanding that the Board reserves the right to request them to vacate at any time on 30 days notice. On motion of Trustee H. C. Sloan seconded by Trustee Geo. P. Wilson and carried, the application of L. B. Schaefer for transfer of General Business License No. 9 to V. N. Norden was granted. Trustee Conrad Richter made a report on the communication of the Balboa Life Saving Corps referred to him at the last meeting, recommending that some assistance be given them, and on motion of Trustee ' Geo, P. Wilson seconded by Trustee H. C. Sloan and carried, {,250.00 was set aside as an initial fund; a decision of what it will cover to be decided by the Corps in conference with a Committee appointed by the Board.
