HomeMy WebLinkAbout10/06/1924 - Regular Meeting2131 City Hall, Newport Beach,Oct. 60 1924 The Board of Trustees of the city of Newport Beach, met in regular session on the above date, The roll wascalled showing the full board present. The minutes of the previous meeting and the meeting of Sept. 159 1924 were read and on motion of trustee Sloan, seconded by Trustee Wilkinson and carried, were approved as read. On motion of trustee Sloan seconded by trustee Eichter and carried, the eeports of Heads of Departments having been read were approved and ordered filed. City Engineer Kressly reporting on the bids submitted on the c construction of water mains on Balboa Island stated that he had investigated the Hartley Camp Construction Co., and that they were responsible bidders and recommended that their bid be accepted. On motion of trustee Wilkinson seconded by trustee Young and carried, the report of City Engineer Kressly was accepted and all bids except that of the Hartley Camp Construction Co., were rejected. RESOLUTION # 296 A Resolution of the Board of Trustees of the city of Newport Beach confirming the assessment for the improvement of certain portions of 36th street and Finley Avenue was read and on motion of trustee Richter seconded by trustee Young was adopted. RESOLUTION #297 A resolution of the Board of 'trustees of the 0ity.of Newport Beach confirming the assessment for the improvement of certain portions of 14th Streett, Broad Street, San Bernardino Avenue and Ocean Drive in said.11ity, was read and on motion of Trustee Wilkinson seconded by trustee Young, was adopted. ' In re- exclusion of territory: The Board of Supervisors of the county of Orange having be resolution thereof duly consented to the alteration of the boundaries of the City of Newport Beach and the exclusion from that city of all that uninhabited territory, now a part thereof, and described as £ollowst Located in the City of Newport Beach,County of Orange, State of California, and beginning at the intersection of the southwesterly prolongation of the center line of Irvine Avenue, as said Irvine Avenue is laid out and . shown upon a mpp of First Addition to Newport Heights as recorded in Miscellaneous Maps Book 4, page 94, Records of Orange County, California, and a line, which line is 350 feet northeasterly of and parallel with the bulkhead line extending from U.S.Bulkhead Station No. 170 to U.S.Bulk- head Station No. 175, as said Bulkhead line and Bulkhead Stations are laid out and shown upon a Map of Newport Bay California,showing Harbor lines approved by the War Department January 18,1917; thence sou ,theasterly along a line, which line .is 350 feet northeasterly W4zth and parallel with the aforesaid .bulkhead line extending between bulkhead stations No.170 and No. 175, a distance of 5700 feet,to a point; thence, southeasterly in a direct line to a point in the westerly line of Section 35,to5lmship 6 south, range 10 west S.B'.B.& M. which point is 1850 feet southerly of of the ' northwesterly corner of said Section 35; thence south 510 east, a distance of 400 feet to a point; thence north 460 37' east to U.S.Bulkhead Station No.150 as shown and laid out on the aforesaid Map-of Newport Bay California, showing harbor lines; thence north 460 371 east along a line to its intersection vrith a line,which line is 200 feet northerly of and parallel with the bulkhead line extending from U.S. Bulkhead Station No. 151 to U.S.Bulkhead Station No.152,as said Bulkhead line and Bulkhead Stations are laid out and shown upon the aforesaid map of Negpb,rt Bay, California, showing Harbor lines; thence due east along a line, which line is 200 feet northerly of and parallel with the aforesaid bulkhead line extending from the U.S.Buikhead Station No.151 to U.S.Bul'_ -head Station No.152, a distance of 3000 feet to a poin #: thence due north, a distance of 300 feet to a point; thence due east a distance of 250 feet to a point: 214 thence due south a distance of 300 feet to a point; thence due east a distance of 350 feet to a point; thence easterly in a direct line to Station 75 of the Patent boundaries of the Rancho San Joaquin, as per map recorded in Book 1 page 147 of Patent Records of Los Angeles County,California;said Station 75 being a point in the present boundary line of the City of Newport Beach; thence northwesterly along the Rancho boundary line as laid out and shoran upon the afore- said Map of the Patent Boundaries of the Rancho San ' Joaquin, and which line is also the present boundary line of the City of Newport Beach, to station 72 of the aforesaid Patent Boundaries of the Rancho San Joaquin; thence southwesterly, northwesterly and westerly along the present boundary line of the City of Newport Beach to its intersection thereof with the southwesterly prolongation of the aforesaid center line of Irvine•Avenue; thence southwesterly along the southwesterly prolongation of the aforesaid center line of Irvine Avenue to the place of beginning. A certified cop-y of said resolution having been this day filed, Trustee Young introduced an ordinance entitled as follows: An ordinance of the city of Newport Beach calling a special eledtion for the purpose of submitting to the electors of the City of Neqport Beach be altered and certain uninhabited territory excluded therefrom, directing the giving of notice of the election, fixing the date thereof, and providing for the holding of the election. The ordinance was ordered filed, read, considered, designated Ordinance No. 266 and referred to the city attorney. A communication received from t.M.Slaughter was read regarding damaged condition of the curbing corner of Coronado and Central Ave. and the clerk instructed to answer. A communication was received from Frank A.Granger regarding the building on the Bay Front near 3rd St, being erected by Dr.Albert ' Soiland. After some discussion, it was decided that Dr. Soiland was within his rights. The eoimnunication was ordered filed and the Clerk instructed to write Mr. Granger as to the action of the Board. A communication was received and read from Mr. Paul B.'Nilcox of Long Beach offering his assistance and.services to the City of Newpo-t Beach in the matter of creating a city manager. On motion of trustee Sloan seconded by trustee Yound and carried, the communication was ordered filed. On motion of trustee Wilkinson seconded by trustee Richter and carried, License No.240 was granted thansferred from Joets Grocery to the Newport Public Market. A communication was received from Ben Cope requesting permission to build a pier for John O.Reid on Lot 2 Blk. K.east side Add.,was referred to the city Engineer for the customary two weeks. The proposition of a ferry franchise to run between the mainland and the Palisades, requested granted-by Mr. Willits of Newport Beach was referred to the committee as a whole for rqport at the next meeting of the city concil. Request of Captain Wm.E Spofford to erect a pier was considered - and referred to the City Engineer for the customary two weeks. A communication to the Board signed by Mr. Lee Pfau of Balboa having been read by all members of the Board, was ordered filed. On motion of Trustee Richter, seconded by Trustee Young and carried, 5300.00 was ordered set aside for rent of the Ebell Club Building for a city library. On motion of trustee Young seconded by trustee Richter, and carried, deeds to a portion of the beach in tract 518 were accepted by the City of Newport each and the clerk ordered to ask for a certificate of title to-the property. Trustee Richter called the attention of the Board to the fact thatthe City of Newport Beach has no Ordinance preventing non - inspected meat from being sold. After some discus,,ion,on motion of trustee Richter seconded by trustee Young and.carried, the city Attorney was instructed to frame an ordinance governing the sale of meat in the city and $12.50 per month was set aside for inspection of meat in connection with the Santa Ana Board of Health. The matter of authorizing expenditures in the advertising fund were discussed and the clerk ordered to notify the Publicity Agent that an estimate of expenditures should be.made each month for the next months advertising ho . 215 The matter of oil wells having their exhausts muffled and those along public streets being boarded up on the street side to present oil from going into the streets was referred to city marshall J.A.Porter. �.. Captain W.F.Spofford read a report to the board in which certain changes in the Harbor Department were suggested and on motion of Trustee Richter seconded by trustee Sloan and.carried, the report was accepted and ordered filed. On motion of Trustee Wilkinson, seconded by trustee Young and carried,the demands were allowed and viarrants ordered drawn. Pursuant-to a call thereof by the President of the Board of Trustees and notice delivered to each member At least three hours before the time specified for the meeting, the Board of Trustees ,met of the place and „on the date above mentioned at 7;30 o'clock P.M. The meeting was called to order by President Geo. P.Wilson. The roll was called showing the full board present. The call was read and the Board proceeded to consider the subject for which the meeting was called. A recommendation,setting forth his advice to the Board of Trustees, as to the action to be taken in the case was received from the City Attorney and read by the Clerk of the Board. Thereupon the communication was considered and ordered filed for a matter of record. On.motion of trustee Sloan, seconded by Trustee Young, and upon call of the roll by a vote of the following named, Ayes, Trustees Wilson, Sloan,•Young, Richter and Wilkinson. Noes, Trustees, None.Absent Trustees, None. Resolution was made as follows: The Board of Trustees of the City of Newport Beach require Levi H. Wallace, as Treasures of said City, to account in writing to the pity of Newport Beach for all money belmnging to said city deposited by him in the name of Levi H.Wallace in any bank banks, or rather depositaries, together with any interest, income, or profit received therefrom,together with any interest paid by him to the city of Newport Beach,.or to the credit thereof, for the use of said money from the date of his first . qualification as Treasurer of the City of Newport Beach to the date hereof. The Board of Trustees of the city of Nevgport Beach request.and .,-call upon the First National Bank of Newport Beach and any other bank or banks or depositaries to account to the city of Newport Beach for all interest, income, revenue or profit received, collected, or obtained by hny such bank, banks or depositaries for the loan of any money, the property of the city of Newport Beach, deposited therin by Lew H.Wallace. City Treasurer Wallace, having been granted permission to speak - stated that the First National �ank and the City Treasurer would give every assistance towards a speedy conclusion _of the investigation. That any amount.set would be.paid to the City of Newport Beach, but asked that a certified accountant be obtained to go over all the books and finally that the City of Newport Beach.bring friendly suit against the city Treasurer to establish to the satisfaction of all concerned the final, x exact amount to be paid. City Attorney Clyde Bishop, having been given the floor, made a scathing denunciation of Mr.Lee Pfau's attack upon him. Mr. Bishop compared the'deposition made by City Treasurer Levi H.Wallace and Mr Lee Pfau's published interpretation of the same and showed and stated that Mr.Lee Pfau's statement about him (Clyde Bishop) was without foundation and based upon falsehood.
