HomeMy WebLinkAbout11/03/1924 - Regular Meeting217 City Hall, Newport Beach, Nov. 3, 1924, The Board of Trustees of the City of Newport Beach, met in regular session on the above date, The meeting was called to order by President Geo.P.Wilson. The roll was called showing the full Board present The minutes of Oct. 3, 20, and 24th were read and after being amended were approved. The reports of the heads of departments were read and on motion of Trustee Wilkinson, seconded by trustee Sloan and carried, were accepted ordered filed. The report of the Planning Commission was read regarding the vacation of a portion of "L" St. and the d&dication of a new street was read and referred to the paoper order of business. A report of the committee making recommendations for a site for a weather bureau and life saving station, was heard, thereupon the report was accepted and the committee discharged and a new committee consisting of L.W.Briggs, Geo.Jefferies, Fred W.Young, Alexis Frye, Antar Daraga and Goo Peabody was appointed to take steps to secure plans for the new buildings to be located as reported. AN ORDINANCE OF THE CITY OF NE,WPOLT BEACH SUBMITTING TO THE ELECTORS OF SAID ffM4ICIPALIi'Y THE QUESTION WHE''_'HER OR NOT CERTAIN UNINHABITED TERRITORY NOW A PART OF SAID CITY SHALL BE EXCLUDED THEREFRO'BIj CALLING A SPECIAL ELECTION FOR THAT PURPOSE, DIRECTING NOTICE OF SAID SPECIAL ELECTION BE BE PUBLISHED, ESTABLISHING VOTING PRECEINCTS AND PLACES AT WHICH THE POLLS WILL BE OPENED, AND APPOINTING ELECTION OFFICERS came up for final consideration, thereupon the roll was called, the trustees voting in the following order and manner; Ayew; Trustees Geo.P.Wilson, H.C.Sloan, Fred ',!.Young, Conrad Richter and L.S.Wilkinson; Noes; Trustees,None Absent; Trustees, None. 'City Attorney,Clyde Bishop, read a lease which he had drawn_ between the City of Newport Beach and Mrs. G.E.Bullfinch, thereupon on motion of trustee Wilkinson, seconded by trustee Young and cafzried, the President and Clerk of the Board were authorized to sign the Lease Trustee Sloan introduced and moved the adoption of Resolution No. 298 entitled If A resolution of the Board of Trustees, of the City of Newport Beach adopting Specifications No.35 for clay and shale surfacing of streets within the city of Newport Beach" which was seconded by Trustee Young and carried by the following vote. Ayes, Trustees Wilson, Sloan,Young Richter and Wilkinson Noes; Trustees None. Absent;Trustees, None, Trustee Young introduced and moved the adoption of Resolution No. 299 entitled "A resolution of the Board of Trustees of the City of Newport Beach" adopting plans for the improvement of certain portions of Park Avenue and certain other streets on Balboa Island, within said City" which was seconded by Trustee Richter, and adopted by the following vote; Ayes: Trustees Nilson, Sloan, Young, Richter and Wilkinson. Noes; Trustees, None. Absent;Trustees, None. Trustee Richter introduced and moved the adoption of Resolution 'No.300 entitle8 ".A Rosolution,of the Board of Trustees of the City of Newport Beach declaring its intention to order the improvement of Park Avenue and certain other streets and Avenues on Balboa Island, within said City, under the Improvement Act of 1911 and the Amendments to said Act." �rhich was seconded by trustee Wilkinson and adopted by the following vote. Ayes; Trustees, Wilson, Sloan, Young, Richter and Wilkinson. Noes; Trustees, None. Absent; Trustees None. An option to purchase Lot 21 of Block 30 of Newport Beach from Mfrs. C.E.Bullfinch, and a warrant for $500.00 was ordered drawn favor of Irs. Bullfinch. • A communication was received from Mr. E.1,1.Burris, in which a bid was submitted to do all street work ect. for the sum of $24000.00 On motion of trustee Wilkinson, seconded by trustee Richter and carried the matter was submitted to the Committee as a whole for investigation and report at the next meeting. Bequest of Ben Cope to erect a pier at Lot 2 Block 'f" Balboa Tract having been laid over for two weeks and approved by the City Engineer was granted subject to the will o f the Board. Advertising Manager Harry Welch submitted a'list of tenative expenditures for the month of October, 1924 totaling $105.29 on motion ' of Trustee Wilkinson, seconded by trustee Young, and carried, the report was approved and the amount ordered set aside from the advertising fund. The Ebell Club in a communication to the Board, expressed their appreciation of the $300 voted their for rent of their club for Library rent. The coirsaunication was ordered filed. On motion of trustee Sloan seconded by trustee Young, and carried, Officer Wilcox was granted a ten day leave of bbsence from his duties. Communication from Mrs. H.C.Garrett and E.G.Smith protesting against newsboys crying their papers and a communication from Mr. F.A.3,outh defending his position in the matter were discussed and ordered filed. A tentative report of expenditures for the month of November was submitted by Mr. Harry 79elch, City Advertising Manager and on motion of trustee Wilkinson, seconded by trustee Richter and carried, the estimate was approved and 0140.00 was ordered set aside from the advertising fund. On motion of trustee Wilkinson, seconded by trustee Young, and carried, permission was granted E.M.Burris for the construction of a bulkhead bettreen Island Avenue and Lindo Avenue An invitation was received from the Board of Trustees of Huntington Beach to attend the Armistace Day Celebration in that City. On motion of Trustee Wilkinson seconded by trustee Young and carried, the clerk was ordered to notify the committee that all mwibers' who could attend would do so and an committee was appointed of Trustees Young'Richter, and Sloan and City Marshall J.A.Porter, to attend. In a commumication to the`Board Mr. L.G.Willitts withdrew his request for franchise to operate a ferry from the mainland to the Palisades The communication having been read, was ordered filed. A petition tiaras, on the 3d day of November, 1924, filed in thr office of the Clerk asking that certain territory within and a part of the city of Newport Beach be formed into amthnicipal improvement district. The petition was presented to the Board of Trustees and taken up for consideration, witnesses were sworn and testified from which the Board of Trustees find: 1st. The Petition is in writing and is signed by qualified electors of the city of Newport Beach, residing in the territory described in the petition and proposed to be formed into a ratLnicipal improvement district, and is signed by more than 100 of all qualified electors resi'daing in the district. ' 2nd The petition contains a general description of the improvement to be acquired. 3d. The general description of the exterior boundaries of the proposed district. Trustee H.C.Sloan thereupon introduced an ordinance entitled as Follows. An Ordinance of the City of Newport beach declaring the intention of the Board of Trustees of said city ae the legislative body thereof, to call an election in a proposed municipal district in the city of Newport beach, as described in a petition for that purpose, or as said district may be hereafter modified, as provided by law, for the purpose of submitting to the qualified electors of said district the proposition of authorizing the issuance and sale of bonds in the manner and for the ' purposes set forth in the ordinance of intention, accurately describi3hg the exterior boundaries of the proposed municipal improvement to be acquired an estimate of the cost of the proposed public improvement and of the'incidertal expenses in connection therewith, fixing a date, hour and place, where protests will be heard, and a date upon which the election will be held, and referring to a map showing the exterior boundaries of said district with relation to the territory immediately contiguous thereoto, and a general description of the proposed improvement, on file in the office of the Clerk of the City of Newport Beach. The Ordinance was ordered filed, read, considered, designated Ordinance of Intention No. 267, and referred to the city Attorney. " 219 Trustee Conrad Richter introduced an ordinance requiring connections vrith public sew er in any part of the city of Newport Beach. The ordinance was ordered filed, read, considered, designated .ordinance No.268 and referred to the city Attorney. Trustee Fred C.Young introduced an ordinance fixing an annual license upon vending machines and providing a penalty for the non - payment of said lecense. The ordinance was ordered filed, read, considered, designanted ' Ordinance No.269 and referred to the city Attorney The question of creating a district or zone concerning the business of drilling for, develpping and producing oil in the city of Newport Beach was taken up -for consideration, and on motion duly made, seconded and carried, it was ordered that the question be referred to the city planning commission and the commission be required to recommend the boundaries of such district and appropriate regulations and restrictions to be enforced therein, and to make a tenative report, and be fore making said report to hold public hearings thereon at the hour of 7;30 o'clock P.M. of Thursday the 13th day of November, 1924, at the City Hall, and that it publish notice of hearing once in the NEWPORT YONS, a newspaper of general circulation published in the city of Newport Beach, hereby designated for that purpose. And that the President and Clerk of the Board of Trustees notify the planning commission of the requirements herein set forth. A reauest of J.IL.Smith CSH.McFarland and R.J.Schafer to erect and maintain a boat landing on the Newport Warfe was referred to the committee as a whole. A report was read from Deputy Harbor Master V1m. Spofford in which certain changes and recommendations were advised. On motion of trustee Richter seconded by trustee Sloan and carried, the matter was ordered referred to Harbor Master J.A.Beek. Trustee Sloan introduced a resolution to vacate, close up and abandon for public street purposes certain portions of "L" Street in said city. The resolution was ordered filed, read, considered, designated Resolution N0.301. The roll was called and the resolution passed by the following vote: Ayes; Trustees Wilson, Sloan, Young, Richter and Wilkinson. Noes; Trustees None, Absent; Trustees, None. Fire Chief A.W.Jackson submitted a report to the Board in which he asked for additional fire hose. Thereupon on motion of Trustee Wilkinson, seconded by trustee Sloan and carried, the city clerk was ordered to advertise for bids on 400 ft. of 121 inch standard thread fire hose bids to be opened at 7;30 o'clock P.M. at the council chamber of the city hall, City of Newport Beach, Monday, Nov.17,1924, the city council reserving the right to reject any or all bids. On motion of Trustee Wilkinson seconded by trustee Sloan and carried, the demands were allowed and warrants ordered drawn. There, being no fruther business, the meeting was adjourned to 7;3o P.M.
