City Hall, Newport Beach, January.4, -1926
The Board of Trustees of the City of Newport Beach met in regular session
on the above date at 7;30 o'clock P. M. The meeting was called to order
by President Goo. P. Wilson. The roll was called showing the full Board
present. The minutes of the previous meeting were read and approved.
_Reports of heads of departments were read and on motion
of Trustee Wilkinson, seconded by Trustee Sloan, and carried, the reports
were accepted and ordered filed.
Under reports of heads of departments, President Wilson
reported in the matter of the construction of a pier, the sinking of
tanks and containers for hydro- carbon substances on Balboa Island. Mr.
Wilson reported that the Planning Committee was in favor of allowing
the Union Oil Company to construct the improvements mentioned in their
petition and plan which was submitted to the Board of Trustees at an
earlier date, thereupon, on motion of Trustee Wilkinson, seconded by
Trustee Young, and carried, it was ordered that the Union Oil Company
be allowed to construct the improvement mentioned in their communication
to the Board, provided, however, that the work should be approved by the
City Engineer Paul E. Kressly.
Communications were read and referred to the. proper order
of business.
City Attorney Bishop presented the Board of Trustees with
an abstract of the Cannery Ordinance which he had been instructed to
prepare.
On motion of Trustee Wilkinson, seconded by Trustee Richter,
and carried, the draft was referred to the committee as a whole for
investigation.
The time within which protests might be made or filed for
the widening of Central Avenue, pursuant to Ordinance of Intention No.
283, passed on the 23rd day of November, 1925, having expired, and no
protest or objection having been made or filed, and no person appearing
to object or did object; the Board of Trustees of the City of Newport
Beach deemed and declared and ordered it to be here established of record
that it had acquired and now had jurisdiction to order the improvement
described in Ordinance of Intention No. 283, to -wit: the widening in
part of Central Avenue, by the following vote.
AYES -- Trustees Wilson, Young, Richter, Sloan, Wilkinson,
NOES -- Trustees none.
ABSENTEES -- Trustees none.
A plat for the resubdivision for vacating Olive Street,
Senora Street, and certain alleys within the City of Newport, was refer-
red to the City Engineer.
On motion of Trustee Wilkinson.-seconded by Trustee Young,
' and carried, the request of the City Advertising Manager, Harry Welch, for
$144.00 for expenses during the month of January.-and $100.00 as prizes
for the 151 Hydro -plane Association races, the two amounts totalling
$244.00 was allowed and the amount asked for ordered set aside out of the
advertising fund.
Application of Ben Cope to construct a Marine ways and
Craddle on the property of P. B. Plum on Lot 4, Block 21, East side.ad-
dition to Balboa tract was referred to the City Engineer for the usual
two weeks.

weeks.
Application Of Nick Suttora to operate a fish market on
Lots 9 and 10, Block 12, Balboa tract was referred to the committee as
a whole for investigation.
A complaint was received from F. P. Brakett of Claremont
California, regarding the assessed valuation on his lot described as
being Lot 1, Block 1, Section 11 Balboa Island. His contention being
that the property was assessed too high. Mr. Brakett also complained
that there were two or three faults in.engineering on the Island which
needed early attention.
There being no objections, the complaint as to the assess-
ed valuation wa'a referred to the City Assessor for investigation and
report, and the complaint as to the engineering was referred to the
Street Committee.
A communication was read from the Newport Beach Lumber
Company in which they stated that they had paid a water bill of $143.80
under protest. City Attorney Clyde Bishop was asked to give his opinion
in the matter of refund, and he advised the Board that they could not
collect this amount as it was not a lien against the property at the
time the water was used and advised the Board to make refund on the
amount paid.
Trustee Fred W. Young introducted a Resolution entitled
as follows:
A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NEW-
PORT BEACH, AS THE LEGISLATIVE BRANCH THEREOF, DETERMINING THAT THE
PUBLIC INTEREST AND ALSO THE PUBLIC NECESSITY DEMANDS THE ACQUISITIOP:
BY THE CITY OF NEWPORT BEACH OF FIRE APPARATUS AND THE CONSTRUCTION
BY THE CITY OF NEWPORT BEACH OF A FIRE ENGINE HOUSE, THE COST OF WHICH
WILL BE TOO GREAT TO BE PAID OUT OF THE ORDINARY ANNUAL IN601 1E AND
REVENUE.OF THE CITY OF NEWPORT BEACH.
The.Resolution was ordered filed, read, considered, des-
ignated Resolution No. 363, and referred to the City Attorney.
Application was received from Clifford B. Story for the
position of Harbor Master of Newport Beach. It was suggested that the
application be referred to the committee as a whole, however, it was
moved by Trustee Richter, that the matter of the appointment of Harbor
Master be referred to the Board of Trustees in open session at the
meeting of January 4, 1926, which motion was seconded by Trustee Young,
and passed by the following vote.
AYES -- Trustees Sloan, Young, Richter.
NOES -- Trustees Wilson, and Wilkinson.
ABSENTEES- - Trustees none.
On motion of Trustee Sloan, seconded by Trustee Young,
and carried, the request of Custer Hanks to operate a miniature train
on Surf Avenue, from Washington Avenue to Cypress Avenue for the season
of 1926 was rejected.
Mr. J. A. Beek addressed the Board and stated that the ,
151 Hydro -plane Association intended sending three boats to Florida
to compete in the races there this winter, and stated that they were
short about $200.00 of having enough money to carry out there proposed
programme. He suggested that the Board appropriate $200.00 toward the
expenses of the Association out of the advertising fund, stating that
be believed it would be good advertising to have the City represented'
in the Florida races. There being no objection, the matter was referred
to the Advertising Manager for recommendation.

Trustee Wilkinson introduced Mr. W. R. Osborn of the Pacific
Electric Railroad Company. Mr. Osborn addressed the Board, and briefly
described the proposition known as the Railroad Plan and requested that
the Board of Trustees pass a resolution indorsing the plan. It was moved
by Trustee Sloan that the City of Newport Beach indorse what is known as
the Railroad Plan, and that the head of the Orange County Chamber of Com-
merce will represent the City of Newport in the hearing to be held before
the Railroad Commission, with instructions to favor the plan as presented.
A communication was read from Mr. J. A. Beek, Harbor Master
requesting that the Board of Trustees accept his resignation at once as
he found it impossible to carry on the duties of Harbor Master, as he had
assumed responsibilities for the coming year which would make it impossible
for,him to give any considerable amount of time to the work of that de-
partment.
On motion of Trustee Richter, seconded by Trustee Sloan,
and carried, the resignation was acdepted and the communication ordered
filed.
Nomination being open for the position of Harbor Master,
on motion of Trustee Richter, seconded by Trustee Young, Tom 0. Jay was
nominated for the position of Harbor Master of Newport Beach.
On motion of Trustee Wilkinson, seconded by Trustee Wilson,
and carried, Antar Deraga was nominated as Harbor Master. Thereupon,
the president of the Board of Trustees ordered that a ballot should be
taken. The Clerk thereupon cast the ballot and found the following to be
the result:
For Deraga for the position of Harbor Master---- - - - - -2
For - -- -Jay for the position of Harbor Master---- - - - - -3
The President of the Board of Trustees thereupon declared
' Tom 0.. Jay to be Harbor Master of the City of Newport Beach.
On motion of Trustee Richter, seconded by Trustee Wilkinson,
and carried, it was ordered that the Harbor Master be paid a salary of
$75.00 per month.
On motion .of Trustee Sloan, seconded by Trustee Wilkinson, and
carried, the demands as approved by the Finance Committee were allowed
and the warrants ordered drawn.
On motion of Trustee Sloan, seconded by Trustee Young, and
carried, the Clerk was authorized to pay taxes on the Newport Heights
Irrigation water assessments and the County taxes on the water bearing
land.
On motion of Trustee Wilkinson, seconded by Trustee Sloan,
and carried, the meeting was adjourned to January 11, 1926 at 7 :30 o'clock
P. M.
