HomeMy WebLinkAbout07/05/1926 - Regular Meeting355 City Hall, Newport Beach,.July 5, 1926. The Board of Trustees of the City of Newport Beach met in regular session at 7:30 o'clock P. M. on above date. The meeting was called to order by President Conrad Richter. The roll was called showing all members present except Trustee Fred W. Young. The minutes of the regular meeting of June 7th were read, corrected and approved. ' The minutes of the special meetings of June 15th and 21st were read and approved as read. The reports of the heads of the departments were read, and on motion of Trustee L. S Wilkinson seconded by Trustee Felix B. Modjeska and carried, the reports were accepted and filed. The report of the Street Superintendent that the road from the Balboa Island bridge up the hill belonged to the County and the Irvine Company was read, and on motion of Trustee L. S. Wilkinson seconded by Trustee Felix B. Modjeska and carried, the report was accepted, and the Clerk was instructed to take the matter up with the County authorities to see what can be done. On motion of Trustee Felix B. Modjeska seconded by Trustee. Harry H. Williamson and carried, the President of the Board and the City Clerk were instructed to sign the lease with Mr. McKay on the pavilion bath house, and the lease with Leo M. Willeford for the camp ground space for stand. Trustee L. S. Wilkinson reported in regard to the meeting with the Orange County Harbor Chamber of Commerce Committee and the Santa Ana Chamber of Commerce Committee, that it was decided to merger the Orange County Harbor Chamber of Commerce into a greater organiza- tion, and retain Harry Welch as Secretary to accomplish the results aimed at of the developement of Newport Harbor. Norman H. Robotham reported for his Committee that they would recommend condemnation of a strip approximately 80 feet wide along the north side of the Pacific Electric tracks from Alvarado to Washington Street, and the Chair appointed a Committee of the Street Superintendent and Street Committee to look the ground over and report as soon as possible. On motion of Trustee Felix B. Modjeska seconded by Trustee Harry H. Williamson and carried, the Committee was thanked and discharged. UNFINISHED BUSINESS. ORDINANCE NO. 302, entitled as follows: An ordinance of the City of Newport Beach amending Section 4 of Ordinance No. 268 of said City, came up for final passage; was read, considered, the roll was called and Ordinance No. 302 was passed by the vote of the following named members of the Board of Trustees: Ayes, Trustees L. S. Wilkinson, Felix B. Modjeska, Harry H. Williamson, Conrad Richter. Noes, Trustees None.' Absent, Trustee Fred W. Young. ORDINANCE NO. 303, entitled as follows: An'ordinanee of the City of Newport Beach amending Sections 3.4 and 5 of Ordinance No. 4 of said City, came up for final passage; was read, considered, the roll was called and Ordinance No. 303 was passed by the vote of the following named members of the Board of Trustees: Ayes, Trustees L. S. Wilkinson, Felix B. Modjeska, Harry H. Williamson, Conrad Richter. Noes, Trustees None. Absent, Trustee Fred W..Young. RESOLUTION NO. 379, entitled as follows: A Resolution of the Board of Trustees of the City of Newport Beach ordering the vacating, closing -up and abandonment of a certain portion of Bay View Avenue, a public street in the City of Newport Beach. The Resolution was read, considered, designated Resolution No. 379, and upon call of the roll passed by the vote of the following named members of the Board of Trustees: Ayes, Trustees L. S. Wilkinson, Felix B. Modjeska, Harry H. Williamson, Conrad Richter. Noes, Trustees None. Absent, Trustee Fred W. Young. 356 RESOLUTION NO. 380, entitled as follows: A Resolution of the Board of Trustees of the City of Newport teach declaring vacant for public street purposes, certain portions of Pacific Drive within said City. The Resolution was read, considered, designated Resolution No. 380, and upon call of the roll passed by the vote of the following named members of the Board of Trustees: Ayes, Trustees L. S. Wilkinson, Felix B. Modjeska, Harry H. Williamson, Conrad Richter. Noes, Tpustees None. Absent, Trustee Fred W. Young. The minutes of the last meeting of the Planning Commission were read recommending the approval of Tract No. 536 when certain conditions wAre complied with. ORDINANCE NO. 293, entitled as follows: An ordinance of the board of Trustees of the City of Newport Beach declaring vacant for public street purposes a portion of Olive Street, Sonora'Street and certain alleys within'said City, came up for final passage; was read, considered, the roll was called and Ordinance No. 293 was passed by the vote of the following named members of the Board of Trustees: Ayes, Trustees L. S. Wilkinson, Felix B. Modjeska, Harry H. Williamson, Conrad Richter. Noes, Trustees None. Absent, Trustee Fred W. Young. The map of Tract No. 536 was discussed, and on motion of Trustee L. S. Wilkinson seconded by Trustee Harry H. Williamson and carried, the Clerk was instructed to notify J. H. Macklin that the two streets north of the Coast Highway would have to be widened to 60 feet before the map could be approved. On motion of Trustee L. S. Wilkinson seconded by Trustee Felix B. Modjeska and carried, the map of Tract No. 555 presented by Mr. Conger, was referred to the Planning Commission for report. On motion of Trustee L. S. Wilkinson seconded by Trustee H,. H,_ WS.11,iameonand carried, the passage of Ordinance No. 293 was brought up for reconsideration. On motion of Trustee L. S. Wilkinson seconded by Trustee Harry H. Williamson the vote whereby Ordinance No. 293 was passed was reconsidered by the following vote: Ayes, Trustees L. S. Wilkinson, Felix B. Modjeska, Harry H. Williamson, Conrad Richter. Noes, Trustees None. Absent, Trustee Fred W. Young. On motion of Trustee L. S. Wilkinson seconded by Trustee Harry H. Williamson and carried, Ordinance No. 293 was laid on the table. On motion of Trustee Felix B. Modjeska,seconded by Trustee L. S. Wilkinson and carried, the map of Tract No. 710 having been reported on by the Planning Commission, was approved. On motion of Trustee Harry H. Williamson seconded by Trustee Felix B. Modjeska and carried, the map of Tract No. 802 of Williams Island belonging to J. A. Beek, was approved. On motion of Trustee L. S. Wilkinson seconded by Trustee Felix B. Modjeska and carried, the views of City Engineer Kressly in not allowing W. S. Sparr to make certain changes in the ramp on Corona Del Mar, were adopted. City Engineer Kressly stated there were 12 fire hydrants in the State Highway on Corona Del Mar, and he would recommend having them moved back two feet which would cost approximately $22.00 each, and on motion of Trustee Harry H. Williamson seconded by Trustee L. S. Wilkinson and carried, the recommendation was approved. On motion of Trustee L. S. Wilkinson seconded by Trustee Felix B. Modjeska and carried, the Water Superintendent was instructed to remove all dead.water hydrants in the City. On motion of Trustee Harry H. Williamson seconded by Trustee Felix B. Modjeska and carried, the Street Department was instructed to notify all house owners that we insist on having the houses numbered and to see that the numbers are correct. 35 Trustee Felix b. Modjeska introduced an ordinance fixing the license to be collected for motor busses operated in the gity of Newport Beach, and repealing that portion of any other ordinance fixing a different license. The ordinance was ordered filed, read, considered, designated Ordinance No. 301, and referred to the City Attorney. On motion of Trustee L. S. Wilkinson seconded by Trustee Felix B. Modjeska and carried, the ordinance was passed to the second reading. READING OF 0014 0NICATIONS. On motion of Trustee Harry H. Williamson seconded by Trustee Felix B. Modjeska and carried, the bond of R. S. Briggs as principal and American Surety Company of New York as surety in the sum of $100,000. as Treasurer of the City of Newport Beach, was approved and ordered filed with the Clerk. On motion of Trustee Harry H. Williamson seconded by Trustee L. S. Wilkinson and carried, the protest of Dr. H. Hilmer against vacating a portion of Pacific Drive was referred to the Planning Commission. On motion of Trustee L. S. Wilkinson seconded by Trustee Felix B. Modjeska and carried, the letter of Ben Cope in regard to City truck refusing to take rubbish from his place, was referred to the Street Superintendent with the request that he make a report on same. The requests of Ben Cope for permission to build piers for W. S. Kersey in front of Lot 9, Block 21, East Side Addition; Mrs. H. C. Torrence in front of Lot 3, Block 25, Bay Front Section and Estates Investment Co. in front of Lot 10, Block 3, Section 1, Balboa Island, were referred to the City Engineer for the customary two weeks. On motion of Trustee L. S. Wilkinson seconded by Trustee Harry H. Williamson.and carried, City Auditor Briggs was authorized to purchase the Monroe Calculator if he can keep it within the budget. On motion of Trustee L. S. Wilkinson seconded by Trustee Harry H. Williamson and carried, the letter of cdmplaint of R. J. Briscoe was referred to the Water Superintendent with the request that he make a report on same. The letter of the Realty Investigation Syndicate stating that 2 acres had been taken from their 20 acres of tideland in the bay and wanting to come before a special meeting of the Board, was read, and the Clerk was instructed to write them that the meetings of the Board are the first Monday of each month, and the Board will listen to them at any of these meetings. A protest with 9 signers against allowing Leo Willeford the camp ground concession was discussed, and on motion of Trustee Harry H. Williamson seconded by Trustee Felix B. Modjeska and carried, the Clerk was instructed to notify them that the hoard felt justified in their decision and have ordered the contract signed. On motion of Trustee Harry H. Williamson seconded by Trustee Felix B. Modjeska and carried, J. A. Beek was appointed Deputy Harbor Master without pay, upon request of Harbor Master Tom 0. Jay. As per request of Auditor Briggs the Chair appointed the Finance Committee to meet with the department heads in regard to expenditures for the new budget. On motion of Trustee L. S. Wilkinson seconded by Trustee Harry H. Williamson and carried, the matter of refund of taxes asked for by Mrs, A. B. Miller on part-of Lot 8 and Lot 9, Block 22, East ' Side Addition, was referred to the Tax Collector for report and recommendation. The application of Clifton J. Platt for permit to run three real estate offices under one license was presented, and on motion of Trustee L. S. Wilkinson seconded by Trustee Felix B. Modjeska and carried, the license was approved if the ordinance allowed it. On motion of Trustee Felix B. Modjeska seconded by Trustee Harry H. Williamson and carried, the application of N. Elledge for license to sell the Rawleigh products consisting of cosmetics, spices, extracts, etc. from a wagon, was referred to the City Marshal and to be allowed if it meets with his approval. On motion of Trustee Harry H. Williamson seconded by Trustee Felix B. Modjeska and carried, the application of Ben Cope for permit to build a pier for Geo. P. Edwards in front of Lot 4, Block 1, Section 2, Balboa Island, was allowed subject to the will of the Board. 354 On motion of Trustee L. S. Wilkinson seconded by Trustee Harry H. Williamson and carried, the request of Antar Deraga for increase in salary of $75.00 per month, was referred to the Clerk to write him that if possible the allowance will be made in.next years budget. On motion of Trustee Felix B. Modjeska seconded by Trustee Harry H. Williamson and carried, the application of Ben Cope for permission to build a pier for N. M. Smith in front of Lot 9; Block 2, Section 1, Balboa Island, was allowed subject to the will of the Board. Mr. Grant of Foster & Kleiser Co. brought up the matter of the change in the bill board ordinance, and Trustee L. S. Wilkinson introducetf an ordinance amending Ordinance No. 294 of the City of Newport Beach and repealing that portion of any other ordinance in conflict therewith. The ordinance was ordered filed, read, con- sidered, designated Ordinance No. 304 and referred to the City Attorney. In regard to the demand of Mrs. Marie A. Hanson for refund of taxes, the Clerk was instructed to notify her that as the value was on the premises the refund could not be allowed. The demand of Jordan & Roehe for $261.51 was discussed, and on motion of Trustee Harry H. Williamson seconded by Trustee Felix B. Modjeska and carried, the bill was allowed. The demand of Wm. H. Galliene for $100.00 for band for Fourth of July out of the advertising fund, and the demand of Rodger w Bros. for $60.00 for use of boat July 4th out of current expense fund, were allowed. On motion of Trustee L. S. Wilkinson seconded by Trustee Harry H. Williamson and carried, the demands in proper form were allowed and warrants to be drawn for same, and those not signed by the heads of the departments to be allowed when signed. There being no further business on motion of Trustee Felix B. Modjeska seconded by Trustee Harry H. Williamson and carried, the meeting adjourned Sine Die. Pres ent Boar of Trus ees. The reports of the heads of'the departments were read, and on motion of Trustee Felix B. Modjeska seconded by Trustee L. S. Wilkinson and carried, the reports were accepted and filed. Trustee L. S. Wilkinson reported the Finance Committee meeting in the formation of a budget for the coming year, and had Mr. Briggs read the items. He also gave an overlooked report recommending the purchase of the Truax house on the camp ground on the basis proposed by Mr. Truax. The communications were read and referred to the proper order of business. A petition having, on the 27th day of July, 1926, been filed with the Clerk of the City of Newport Beach, the same was presented to the Board of Trustees for consideration.
