HomeMy WebLinkAbout08/23/1926 - Regular Meeting363 City Hall, Newport Beach, Aug. 23, 1926. The Board of Trustees of the City of Newport Beach met in regular session at 7 :30 o'clock P. M. on above date. The meeting was called to order by President Conrad Richter. The roll was called showing all members present except Trustee L. S. Wilkinson who is away on his vacation. On motion of Trustee Harry H. Williamson seconded by Trustee Felix B. Modjeska and carried, expressions of sorrow and sympathy were extended to J. J. Schnitker former President of the Board of Trustees in the loss of his son Heath. The minutes of the previous meeting were read and approved as read. This being the time set for opening bids for a Police Patrol and Ambulance, the Board in open session publicly opened, examined and declared all sealed bids received, which were as follows: L. D. Coffins Company, total price of - - - $1,523.75 On motion of Trustee Harry H. Williamson seconded by Trustee Felix.B. Modjeska and upon'-call of the roll the bid was accepted by the following vote, to -wit: Ayes, Trustees Felix B. Modjeska, Fred W. Young, Harry H. Williamson, Conrad Richter. Noes, Trustees None. Absent, Trustee L. S. Wilkinson. This being the time set for opening bids on a Ford Truck for the Sewer Department, the Board in open session publicly opened, examined and declared all sealed bids received, which bids were as follows: Theodore Robins, at a net price of - - - - $479.14 Oh motion of Trustee Felix t5. Modjeska seconded by Trustee Harry H. Williamson and upon call of the roll the bid was accepted by the following vote, to -wit: Ayes, Trustees Felix B. Modjesta, Fred W. Young, Harry H. Williamson, Conrad Richter. Noes, Trustees None. Absent, Trustee L. S. Wilkinson. The communications were read and acted on as follows: The protests from Balboa Island residents and W. M. Barr of the Los Angeles Herald against the operation of the Hydroplane on the bay were discussed, and on motion of Trustee Fred W. Young seconded by Trustee Harry H. Williamson and carried, the permit .granted for the operation of the Hydroplane was revoked. On motion of Trustee Harry H. Williamson seconded by Trustee Felix B. Modjeska and carried, the requests of Ben Cope for permission to build piers for Dr. F. F. Barham in front of Lot 2, Block 11, Section 1, Balboa Island; one for Dr. Seagar in front of Lot 12, Block 1, Section 1, Balboa island, and one for Grace B. Evans and Joseph Cornish in front of Lot 2, Block 80 Section 1, Balboa Island, were allowed subject to the will of the Board. On motion of Trustee Harry H. Williamson seconded by Trustee Felix B. Modjeska and carried, the petition from Balboa Island residents for some police and fire protection, was referred to the Police Committee for report at the next meeting. The request of John C. Tuffree for remodeling and extending his pier was referred to the City Engineer for two weeks. On motion of Trustee Harry H. Williamson seconded by Trustee Fred W. Young and carried, the request of J. A. Geissinger and others asking that the manhole in the alley in Block 10 Section 1 between Collins and Agate Avenues, be lowered to grade so that the alley can be shaled, was referred to the Street Superintendent with power to act. The communication of Byron Hall asking a donation from the advertising fund for the entertainment of the Nova Scotia Society was read, but the City Attorney ruled that this could not be done. A private subscription was taken for that purpose amounting to $55.05. On motion of Trustee Harry H. Williamson seconded by Trustee Felix B. Modjeska and carried, the communication from Gertrude A. Waldron complaining of a shipyard in Section 5, Balboa Island, was referred to the City Marshal for investigation and report. 364 �. Y On motion of Trustee Fred W. Young seconded by Trustee Harry H. Williamson and carried, the Clerk was instructed to notify Dr. T. J. Ruddy that he could continue the use of his pier at the foot of Montero Street for some time to come as far as the City is concerned. The letter of the Marbellite Company was filed. On motion of Trustee Harry H. Williamson seconded by Trustee Felix B. Modjeska and carried, the request of Paul E. Klise for permission to build a runway and spring board in front of his property -on Grand Canal, was referred to the City Engineer for approval. Trustee Fred W. Young introduced an ordinance entitled: An ordinance creating a.subordinate office of Inspector of Public Ntisances, and fixing a compensation therefor. ' The ordinance was read, considered, designated Ordinance No. 307, and referred to the City Attorney. The communication from City Engineer Kressly giving an estimate of the cost of the bulkhead around Section 5, Balboa Island was considered, and on motion of Trustee Harry H. Williamson seconded by Trustee Fred W. Young and carried, the City Engineer was instructed to prepare plans, specifications and estimated cost of the work. On motion of Trustee Fred W. Young seconded by Trustee Harry H. Williamson and carried, the request of the Zeolite Co. for an analysis of the City Water was referred to the Water Superintendent. UNFINISHED BUSINESS. ORDINANCE NO. 305, entitled as follows: An Ordinance of the Board of Trustees of the City of Newport Beach as the legislative branch thereof, declaring its intention to call an election in a proposed district as described in the petition there- for, or as the .same may be hereafter mddified, for the purpose of- submitting to the qualified electors of said district, the proposition of authorizing the issuance and sale of bonds of such district in the manner and for the purposes set forth in this ordinance of Intention; was taken up for final action, was read, considered, the roll was called and the ordinance passed by the following vote: Ayes, Trustees Felix B. Modjeska, Fred W. Young, Harry H. Williamson, Conrad Richter. Noes, Trustees None. Absent, Trustee L. S. Wilkinson. IN THE MATTER OF THE PROPOSED IMPROVEMENT OF CERTAIN PORTIONS OF CENTRAL AVENUE. This being the time fixed by Resolution of Intention No. 383 passed on the 2d day of August, 1926, for hearing protests in the matter of the improvement therein described, and certain written protests having been filed with the City Clerk in said matter, all of said protests were presented to and considered by the Board of Trustees, and all persons desiring to be heard in the matter of said protests were heard by said Board, whereupon Trustee Fred W. Young moved that Resolution No. 384, entitled: A Resolution overruling protests in the matter of the Improvement of certain portions of Central Avenue in the City of Newport Beach, be adopted, which motion was seconded by Trustee Felix B. Modjeska and carried by the following vote: Ayes, Trustees Felix B. Modjeska, Fred W. Young, Harry H. , Williamson, Conrad Richter. Noes, Trustees None. Absent, Trustee L. S. Wilkinson. RESOLUTION NO. 385, entitled as follows: A Resolution of the Board of Trustees of the City of Newport Beach ordering the improvement of certain portions of Central Avenue within said City. The Resolution was read, considered, designated Resolution No. 385 and upon call of the roll passed by the following vote: Ayes, Trustees Felix B. Modjeska, Fred W. Young, Harry H. Williamson, Conrad Richter. Noes, Trustees None. Absent, Trustee L. S. Wilkinson. 365 RESOLUTION NO. 386, entitled as follows: A Resolution of the Board of Trustees of the City of Newport Beach directing certain work or improvement to be done under the direction of the City Engineer of said City. The Resolution was read, considered, designated Resolution No. 386 and upon call of the roll passed by the following vote: Ayes, Trustees Felix B. Modjeska, Fred W. Young, Harry HY Williamson, Conrad Richter. Noes, Trustees None. ' Absent, Trustee L. S. Wilkinson. J. P. Greeley brought up the matter of trying to get a swimming meet for Saturday and Sunday, Sept. 11 and 12th, and Trustee "Harry H. Williamson moved that there be appropriated out of the Advertising fund $500.00 for the purpose of procuring the swimming event of the Ameteur Athletic Union, the same waa seconded by Trustee Fred W. Young and duly carried. A petition signed by seven property owners of Corona Del Mar in Block 35, asking a change in street paving in that Block was brought up, but City Engineer Kressly stated he would not recommend doing so, and on motion of Trustee Fred W. Young seconded by Trustee Harry H. Williamson and carried, the recommendation of the City Engineer was sustained and the request denied. ORDINANCE NO. 293, entitled as follows: An Ordinance of the Board of Trustees of the City of Newport Beach declaring vacant for public street purposes certain portions of Olive Street, Sonora Street and certain alleys in said City, was taken up for final action, was read, considered, the roll was called and Ordinance No. 293 was passed by the following vote: Ayes, Trustees Felix B. Modjeska, Fred W. Young, Harry H. Williamson, Conrad Richter. ' Noes, Trustees None. Absent, Trustee L. S. Wilkinson. On motion of Trustee Harry H. Williamson seconded by Trustee Fred W. Young and carried, the subdivision Map of Tract 536 as reconsidered by the Planning Commission, was approved as originally presented. On motion of Trustee Felix B. Modjeska, seconded by Trustee Fred W. Young and carried, demands No. 372 to. 382 inclusive having been signed and approved by the Finance Committee, were allowed and warrants to be drawn for same. On motion of Trustee Harry H. Williamson seconded by Trustee Felix B. Modjeska and carried, the Clerk was instructed to notify the head of the Police Department to turn over the Dodge car to the Water Superintendent, and to notify the Water Superintendent to be ready to receive it. On motion of Trustee Fred W. Young seconded by Trustee Harry H. Williamson and carried, the demand of Sandy Winchester for additional salary, rent, auto repairs, etc. was denied. The drayage license was brought up by E. M. Burris and discussed, and it was decided that all teams or trucks picking up and hauling goods or material of any kind in the City, should pay the license of $20.00 per year for each truck and $10.00 per year for each team. The matter of the misunderstanding between A. R. Russell and Rodger Brothers in regard to live bait on the Balboa wharf was brought up, and Mr. Russell was informed his lease did not prohibit others from catching live bait from the wharf for their own use as long as they did not &ell it from the wharf. Antar Deraga presented an insignia for life guards, and on motion of Trustee Harry H. Williamson seconded by Trustee Felix B. Modjeska and carried, the insignia was accepted and the life guards permitted to wear it. E. M. Burris brought up the matter of electric light poles in .some of the alleys on Balboa Island interfering with street work, and as the Southern California Edison Co. had been notified some time ago to remove them, on motion of Trustee Fred IV. Young seconded by Trustee Harry H. Williamson and carried, the Clerk was instrueted to hotify them if they were not removed in five days we would instruct the Street.Superintendent to take them down. we On motion of Trustee Felix B. The minutes of the previous meeting were read and approved as read. The reports of the heads of the departments were read, and on motion of Trustee L. S. Wilkinson seconded by Trustee Felix B. Modjeska and carried, the reports were accepted and filed. Trustee Felix B. Modjeska reported for the Police Committee that Captain Adams would give Balboa Island Police protection, but the fire protection would necessitate a bond election, and on motion of Trustee L. S. Wilkinson seconded by Trustee Harry H. Williamson and carried, the report was accepted. The communications were read and referred to the proper order of business. This being the time set for opening bids for a Ford Chassis for the Street Department, the Board in open session publicly opened, examined and declared all sealed bids received, which were as follows: Theodore Robins, total equipped with gas and oil, - $457.66 On motion of Trustee Felix B. Modjeska seconded by Trustee Harry H. Williamson and upon call of the roll the bid was accepted by the following vote: Aves, Trustees L. S. Wilkinson, Felix B. Modjeska, Harry H. Williamson, Conrad Richter. Noes, Trustees None. Absent, Trustee Fred W. Young. On motion of Trustee Felix b, Modjeska seconded by Trustee Harry H. Williamson and carried, the bond of V. A. Tripp as Electrician was accepted. The communication of Ernest Grill asking for a refund of the water bill which he paid on the toilets in Tract 518, was discussed, and on motion of Trustee Harry H. Williamson seconded by Trustee Felix B. Modjeska and carried, a meter was to be installed on that part of the building not used as an office, and a refund made next month on the proportionate amount due. On motion of Trustee Harry H. Williamson seconded by Trustee Felix B. Modjeska and carried, the request of John C. Tuffree for permission to remodel and estend his pier adjoining the city pier on Washington Street, was granted subject to the will of the Board. On motion of Trustee L. S. Wilkinson seconded by Trustee Felix B. Modjeska and carried, the estimate of the Advertising Manager of expenses for the coming month was approved less the $20.00 telephone charge, or a total of 1747.00. UNFINISHED BUSINESS.
