E. on above date. The meeting was.called to order by President Conrad Richter. The roll was called showing the full Board present. The minutes of the previous meeting were read and approved as read. As Mr. E. J. Miner of Mr. Kressl,y's Los Angeles Office had some new business to bring up and he was anxious to get back to the City, the order of business was changed and his matters taken up at this time. ' Trustee L. S. Wilkinson introduced a resolution entitled: A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NE "PORT BEACH DECLARING THEIR IITTMTTION TO VACATE, CLOSE —UP AND ABANDON FOR PUBLIC .STREET PURPOSES CERTAIN PORTIONS OF SANTA A1TA AVENUE WITHIN SAID CITY. The Resolution was read, considered, designated RESOLUTION N0. 404, and upon call of the roll passed by the following vote: Ayes, Trustees L. S. Wilkinson, Felix B. Modjeska, Fred W. Young, Harry H. Williamson, Conrad Richter. Noes, Trustees NONE. Absent, Trustees NONE. .Trustee Fred 77. Young introduced a resolution entitled: A RESOLUTION OF TIE BOARD OF TRUSTEES OF THE CITY OF NE: ::PORT BEACH ADOPTING CERTAIN PLANS FOR THE IMPROVEMMYT OF CERTAIN PORTIONS OF 22D STREET, THE ARCADE AND CERTAIN OTHER STREETS i7ITHIN SAID CITY. .The Resolution was read, considered, designated RESOLUTION N0. 405, and. upon call of the roll passed by the following vote: Ayes, Trustees L. S. Wilkinson, Felix B. Modjeska, Fred W. Young, Harry H. Williamson, Conrad Richter. Noes, Trustees NONE. Absent, Trustees NOITE. Trustee Felix B. Modjeska .introduced a resolution entitled: A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NETPORT BEACH ' DECLARING THEIR INTENTION TO ORE-ER THE ILPROVEMENT OF CERTAIN PORTIONS OF 22D STREET, THE ARCADE AND OTHER STREETS WITHIN SAID CITY, UNDER THE IBPROVEME:17 ACT OF 1911, AN-L THE AMENDMENTS TO SAID ACT. The Resolution was read, considered, designated RESOLUTION N0. 406, and upon call of the roll passed by the following vote: Ayes, Trustees L. S. Wilkinson, Felix B. Modjeska, Fred W. Young, Harry H. Williamson, Conrad Richter. Noes, Trustees NONE. Absent, Trustees NONTE. The regular order of business was resumed and the reports of the heads of departments were read, and on motion of Trustee L. S. Wilkinson seconded by Trustee Fred W. Young and carried, the reports were accepted and filed. The communications were read and acted upon as follows: The request of the Southland Sailing Club for permission to cross the sidewalk with a marine railway in Section 5, Balboa Island, was discussed, and City Attorney Bishop stated that if they did all the work themselves it would be p@rmissable, but as they, of necessity, could have to hire more or less of the work done, according to the ordinance it would have to be classed as a, prohibited trade. On motion of Trustee L. S. Wilkinson seconded b;; Trustee Fred W. Young and carried, the request of the Southland Sailing Club for permission to cross the sidewalk with the marine railway, was denied. On motion of Trustee L. S. Wilkinson seconded by Trustee Felix B. Modjeska and carried, the bond of F. F. Thorpe as Housemover, was accepted and filed. The request of Ben Cope for removal of a light post in front of the doorway ' to his new building was discussed, and on motion of Trustee Felix B. 11od7jeska seconded by Trustee Harry H. Williamson and carried, the lamp post was to be moved up to the, property line, and also a water hydrant which is in the way, the Clerk to notify the Water Superintendent in regard. to moving the hydrant. The comn.unication from 19c Farlanc' and Smith asking permission to allow other boats to use their lan-ing besides the barge boats and the lease changed accordingly, was taken up, and on motion of Trustee L. S. Wilkinson seconded by Trustee Felix B. 1.:odjesk2 and carried, the Clerk was instructed to send the lease and commanication up to the city Attorney. Application for 'a franchise to maintain and operate a ferry boat or boats for the transportation of persons, express packages and freight, including vehicles, from the northerly end of Pali.*: Street on the mainland across portions of Newport Bay 392 to points on Balboa Island all within the City of Newport Beach, Orange County, California, having been filed, upon motion of Trustee Felix B. Modjeska seconded by Trustee Fred W. Young and upon call of the roll carried by the following vote: Ayes, Trustees L. S. Wilkinson, Felix B. Modjeska, Fred W. Young, Harry H. Williamson, Conrad Richter. Noes, Trustees NONE. Absent, Trustees NONE. It was ordered that the Board of Trustees of the City of Newport Beach as the legislative body of said City, propose to grant said franchise, and that the same be advertised for sale in the manner provided by law, provided that the term of said franchise shall be fifteen years. On motion of Trustee Felix B. Modjeska seconded by Trustee Fred IV. Young and carried, the request of Henry Starck and others to not allow B. K. Stone to build farther north than his present building, was denied. On motion of Trustee Fred W. Young seconded by Trustee L. S. Wilkinson and carried, the•application of Lee R. Weber for 60 days extension of time on his contract No. 30 for paving certain portions of Central Avenue, was granted. On motion of Trustee Harry H. Williamson seconded by Trustee Fred. ^n. Young and carried, the communication from J. C. Graves refusing to give the corner of his Lot No. 13, Block 8, East Newport on a 10 foot radius, was filed. On motion of Trustee L. S. Wilkinson seconded by Trustee Felix B. 11odjeska and carried, the communication of fire Chief Jackson asking for a new battery, recharger and hydraulic jack was referred to the Fire & Water Committee for a recom- mendation. On motion of Trustee L. S. Wilkinson seconded by Trustee Harry H. Williamson and carried, the request of City Auditor Briggs for approval of securities for an inactive deposit; was granted end the bonds referred to the City Attorney to pass on. On motion of Trustee L. S. Wilkinson seconded by Trustee Harry H. Williamson and carried., the request of the Masonic Homes Co. of California for permission to erect at their own expense a redwood bulkhead in front of their property on Section 5, Balboa Island, was granted, and they were instructed to get the approval of the City Engineer so that he can report to the Board. .On motion of Trustee Harry H. Williamson seconded. by Trustee Felix E. Modjeska and carried, the resignation of David L. Adams as Health Offioer, was accepted. Dr. Gordon M. Grundy was nominated, and on motion of Trustee Harry H. Williamson seconded by Trustee Fred W. Young and carried, Dr. Grundy was appointed to fill the office of Health Officer of the City of Newport Beach in place of David L. Adams resigned, at a salary of $50.00 per month. Bids for 600 feet of railing for Newport wharf and lc benches were read as follows: Ellsworth Bros. & Son, - - - - - - - - - - - - $600.00 A. D. Tracy, - - - - -- - - - - - - - - - - - 543.00 JohnRoehe - - - - - - - - - - - - - - - - - - 520.32 On motion of Trustee L. S. Wilkinson seconded by Trustee Harry H. Williamson and carried, the bids were referred to the Cit.,,, Engineer for a. recommendation; and also a recommendation as to the style of railing he would. suggest. The Clerk reported that Leo M. Willeford had not responded to the notice snnt him to pay his rent, and on motion of Trustee L. S. Wilkinson seconded by Trustee Fred W. Young and carried, the lease was declared forfeited for non - payment of rent, and the Clerk was instructed to notify him to remove his belongings from the camp ground or the Car_:o Custodian would remove them. This being the first regular meeting of the Board of Trustees-of the City of Newport Beach next after filing with the Clerk of said City of the returns of the election held in said City on the 28th day of December, 15261 and said Board of Trustees opened and proceeded to canvass said returns, and upon -the canvass thereof found and ordered the following report to be made and entered upon its minutes of said meeting: The election was held. as provided by law for the purpose of determining whether or not certain new and uninhabited territory contiguous to the City of Newport Beach, and which territory at the time of the filing of the petition for its annexation formed no part of any incorporated city or town, should be annexed to the City of Newport Beach. For the purpose of said election the City of Newport Beach was divided into five (5) voting precincts•and at the election votes for annexation and against annexation were cast as follows: For annexation. Against annexation. 18 votes, Precinct No. 1. 0 votes. 24 votes, Precinct No. 2 0 votes. 26 votes, Precinct No. 3• 1 vote. 34 votes, Precinct No. 4. 0 votes. 26 votes. Precinct Yo- 5. 1 vote. C 393 . Total votes cast "For annexation," - - - - 128 votes, Total votes cast "Against annexation," - 2 votes, Whole number of votes cast, - - - - - -- - 130 votes. The election was held on the 28th day of December, 1926; the canvass of the returns was made by the Board of Trustees of the City of Newport Beach at the City Hall thereof in said City at the hour of 7:30. o'clock P. 74. of Yonday, the 34 day of Jani"'y, 15f7.. The result of the canvass was "For annexation" 125 votes, "Against annexation" 2 votes. The Clerk of the City of Newport Beach was ordered to certify under the seal of the City of Newport Beach and transmit to the Secretary of State and to the ' Board of Supervisors of the County of Orange, a copy of said report together with the foregoing statement, and that from and after the date of the filing of said document in the office of the Secretary of State, the annexation of said territory should be deemed and be complete, and thenceforth such annexed territory should be a part of the City of Newport Beach for all intents and purposes, except only that no part of such annexed territory shall ever be taxed to pay any portion of any indebtedness or liability of the City of Newport Beach prior to or existing at the time of such annexation. The territory proposed to be annexed to the City of Newport Beach is described as follows: "Located in the County of Orange, State of California and beginning at an angle point in the present northeasterly boundary line of the City of Newport Beach, California, said point being South 65 degrees 43 minutes 40 seconds East 222.55 feet from United States Bulkhead Station 'do. 104 in the Bulkhead. line as said Bulkhead line and Bulkhead Stations are laid out and shown upon the map of Newport Bay, California, showing harbor lines, approved by the War Department January 15, 1917; thence from said point of beginning south 45 degrees 45 :minutes East 990 feet; thence south 29 degrees 00 minutes East 330 feet; thence south 64 degrees 30 minutes East to an intersection with the southwesterly extension of the northwesterly 1- ine -6f Avocado Avenue, as shown on a map of Tract No. 652, recorded in Book 20 page 19, of Miscellaneous Maps, records of Orange County, California; thence southwesterly along the southwesterly extension of the northwesterly line of said Avocado Avenue to an angle ' point in the present northeasterly boundary line of said City of Newport Beach; thence northwesterly along said present northeasterly boundary line of said City to a point south 17 degrees 30 minutes East 200 feet distant from the southeasterly corner of Balboa Island, said point being the same point.so designated in the description of the tract of land annexed to said City contained in the order of the Board of Trustees of said City, dated July 3, 1916; thence in a straight line to the point of beginning." Whereas, on'the 11th day of December; 1522, the Board'of Trustees of the City of Newport Beach passed, adopted and approved Resolution No. 210 of said City, determining the unpaid assessments for the construction Af the 19th Street serer, r pusuant to Resolution of Intention No. 155, findin;- said unpaid assessments to be $3591.17, and directed the issuance of bonds upon the security of mnpaid assessments in the payment of said work, said bonds to be thirty in number, fifteen thereof to be each in the denomination of $250.00, thirteen thereof to be each in the denom- ination of $9.41, and two thereof to be each in the denomination of $9.42. All of said bonds to be dated the 12th day of December, 1922, and there- after one bond in the denomination of $250.00 and one bond in the denomination of $9.41 to be paid annually on the 2d day of July, commencing with the 2d day of July, 1924, until:. all of said. bonds were paid, excepting the last two years when one bond in the denomination of $250.00 and one bond in the denomination of $9.42 should be paid each year. Whereas, through and on account of inadvertence and mistake the bonds so ' authorized and directed to be paid were printed, signed and issued providing that two bonds in the sum of $250.00 and two bonds in the sum of $5.41 should be paid each year, excepting the last year when two bonds in the sum of $250.00 and tvio bonds in the denomination of $9.42 should be.-paid. Now therefore, it is resolved, that the Treasurer of the City of 'Newport Beach obtain all of said bonds payable in any year in excess of one bond in the arum of $250.00 and one bond in the denomination of $9.41 or $9.42 and that there be printed, signed and issued to the owner of said bonds in lieu thereof bonds as authorized by sLd d Resolution No. 210, and that the Treasurer make with the owner of said bonds necessary reconcilments of payments, if any, heretofore made, and that the said bonds shall be paid in the amounts and at the times herein specified, and be secured by the unpaid assessments so found for the work and improvement ordered and pursuant to Resolution of Intention No.. 158.' 394 .The above and foregoing Resolution was introduced, passed and approved at a meeting of the Board of Trustees of the City of Newport Beach held the 3d day of January, 1527, by the following vote: Ayes, Trustees L. S. Wilkinson, Felix B. Modjeska, Fred W. Young, Harry H. Williamson, Conrad Richter. Noes, Trustees NONE. Absent, Trustees NONE. Approved this 3d day of January, 1527. Signed, CONRAD RICHTER. Noes, Trustees NONE- Absent, Trustees NOME. it was proposed that for the public interest, health, comfort, convenience, preservation of the public peace, safety, morals, order and public welfare, the Board of Trustees, in the manner provided by law,.regulate, restrict and segregate the location of the industries, the several classes of business, trades or callings, the location of apartments or tenement houses, club houses, group residences, two - family dwellings, single family dwellings', and the several classes of public and semi - public buildings, and the location of buildings or property designed for specific use, and for that purpose divide the City of Newport Beach into districts of such number, shape and area as the Board of Trustees may deem best suited to cafry out the purposes herein. It was further ordered that the Planning Commission of the City of Newport Beach be required to recommend the boundaries of such districts and appropriate regulations and restrictions to be enforced therein. That the City of PTewport Beach and_ the Planning Commission thereof, in carrying out the above, be governed by an ' act of the legislature of the State of California, entitled: "AY ACT TO PROVIDE FOR THE ESTABLIST.11ENT TITHI7 MUNICIPALITIES OF DISTRICTS OR ZONES WITHIN WHICH THE USE OF PROPERTY, HEIGHT OF I ILPROVEI ETTS AND REyUISITE OPEN SPACES FOR LIGHT AND VAMILATION OF SUCH BUILDINGS hiAY BE REGULATED BY OP.DINANCE." Harry H. Williamsons time having expired as a member of the Planning Commission, President Conrad Richter reappointed him on the Commission, and on motion of Trustee L. S. Wilkinson seconded by Trustee Felix B. Modjeska and carried, the reappointment was approved. Trustee ;tarry H. The resolution was ordered filed, read and considered, designated RESOLUTION pro. 407 and was referred to the eity Attorney. City Attorney Bishop stated a prominent citizen of Southern California' wished to know if the Board would sanction an advisory committee of 5 members, 1 each from Pasadena, Los Angeles, San Pedro, Santa Ana and ;Newport Beach, with e view to interesting outside capital and as an aid in harbor work, and on motion of I Trustee L. S. Wilkinson seconded by Trustee Felix B. Modjeska and. carried, it was ' declared to be the sense of this Board that they would welcome any advice or suggestions given them from such a committee, which were for the good of the community. Trustee Harr,, H. Williamson reported on the site for an Air- :ay Beacon that Jaynes Irvine could sell the City 200 x 300 feet above the septic tank on terms agreed,upon after appraisal. The matter was discussed in regard to putting it on ground already under lease by the City, and on motion of Trustee Fred W. Young seconded by Trustee Feliic B. Modjeska and carried, the Clerk wa.s instructed'to as'-- Antar Deraga to furnish plans and specifications for a tower to be erected on leased ground by next i:onday night. The matter of exercising our option on the ocean frontage in Balboa Tract owned by .Le Newport Bay Investment Co. was considered, and on motion of Trustee L. S. '"ilkinson seconded by Trustee Fred W. Young and carried, the property was to be purchased at $5.00 per front foot, and Vie Finance Committee was instructed to arrange with ;,:r. Greeley for the terms of purchase. 395 �n Cl NEW BUSINESS. On motion of Trustee L. S. Wilkinson. seconded by Trustee Harry H. Williamson and carried, the demands which were in proper form and approved by the Finance Committee were allowed and warrants to be drawn for same. Also the following transfers were made from the current expense unapportioned fund; To account No._. -M -C Trial Dept. - - - - - - - - $ 120.00 To account No. 341, Legal expense, - - - - - - 2,000.00 To account No. 461, Fire Dept. expense, - - - - 200.00 To account No. 491, Life Saving Corps, - - - - 75.00 ' To account No. 401, Police Dept.. expense, - - = 150.00 From Library fund to A/c No. 357, Books & Periodicals, 100.00 As the City had no further use for the old water tank on Balboa Island, Plater Superintendent Cundiff wished permission to sell. it, and he had an offer of $25.00 the party to take it down. On motion of Trustee Fred 'i7. Young seconded by Trustee Felix B. Modjeska and carried, the Prater Superintendent was empowered to dispose of it to the best advantage possible. There being no further business on motion of Trustee Felix B. Modjeska seconded. by Trustee Fred W. Yoang.and carried, the meeting adjourned to 7 :30 o'clock P. K. on Monday, January 10, 1527. The Board of Trustees of tae City of Nerroort Beach met in regular adjourned session at 7:30 o'clock P. E. on above date.- The meeting was called to order by President Conrad_ Richter. The roll was called showing the full Board present. The minutes of the previous meeting were read and approver as read. On motion of Trustee Fred Pi.. Young seconded by Trustee Harry H. Williamson and carried, the Fire & Tater Committee would recommend that the Fire Chief get the fire truck battery recharged and rent another battery while it is being done. The report of the City Engineer to the effect that it would cost $9300.00 to grade and dirt the 10 foot strip along the Pacific Electric right -of -way in the westerly end of town, but that there was not sufficient funds available to pay for same, was read and discussed, and on motion of Trustee L. S. Wilkinson seconded by Trustee Felix B. Modjeska and carried, the,matter was left in the hands of hir. Kressly `to get further data from the Pacific Electric•officials to lay before the Board. In regard to the ocean frontage in•Balboa Tract the City was to purchase from the Newport Bay Investment Co. City Engineer Kressly was asked to bring a map before the Board at the next meeting with the property to be purchased marked on same. On motion.of Trustee Fred W. Young seconded by Trustee Felix B. Modjeska. and carried, the City Engineer was instructed to prepare the specifications for the railing on Newport -wharf and the 12 benches, and the Clerk was instructed to advertise ' for bids on same. Street Superintendent Rinehart reporter, that the City of Los Angeles had some cast iron lamp posts which they had replace; with others and which they would sell for $20.00 each for the Newport wharf. The matter was discussed and on motion of Trustee Felix B. Mod,je -:a seconded by Trustee Fred W. Young and carried, the Street Superintendent was instructed to purchase 10 of the lamp posts at $20.00 each to be installed on the Newport wharf. The resignation of Advertising Lanager Harry Welch was read, and on motion of Trustee Fred W. Young seconded by Trustee Harry H. Williamson and carried, the Board of Trustees in accepting the resignation desires to thank you for your servicer, for the past three and a half years•. The associations with the Board 'nave been agreeable in every way, and the Board appreciates your services to the Community. r
