City Hall, Newport Beach, February 21, 1927-
The Board of Trustees of the City of Newport Beach met in regular
adjourned session at 7 :30 61clock P. M. on above date. The meeting was called to
order by President Conrad Richter.
The roll was called showing the full Board present.
The minutes of the previous meeting were read and approved as read.
Trustee Fred W. Young stated the.committee on parking were not ready to
report and they were given until.next meeting to make their report.
The report of City Engineer Kressly was read stating that it would cost
$2930.00 to move the 16" water line along Block 6 of East Newport, and recommending '
that the property owners who are benefitted thereby should pay for it. The matter
was discussed and on motion of Trustee Harry H. Williamson seconded by Trustee Fred
W. Young and carried, the report was accepted and SdDpted. .
Trustee Felix B. Modjeska reported for the Street.Committee that the sign
at the intersection of Coast Boulevard and the State Highway had been ordered
changed as desired.
Trustee Harry H. Williamson reported for the Fire and Water Committee that
they would recommend the purchase of an engine pumper with one or two paid men to
operate it, and on motion of Trustee L. S. Wilkinson seconded by Trustee Fred W. Young
and.carried, the report was referred to the Committee of the Whole to report on at
the.next meeting.
President Conrad Richter read a report of the Advisory Committee recommending
that our City Engineer be put.in charge of the jetty construction, and on motion of
Trustee Fred W. Young seconded by Trustee Felix B. Modjeska and carried, City
Engineer Kressly.was employed.to supervise the harbor work as contemplated by the
recent harbor bond election..
The communications were read and acted upon as follows:
The communication from Ben Cope in regard to the County taxing boats in
our harbor was discussed, and on motion of Trustee Harry H. Williamson seconded by
Trustee Felix B..Modjeska and carried, City Auditor Briggs was instructed to take
the matter up with the County Assessor's office and ascertain in regard to their
taking boats in this harbor.
' On motion of Trustee Harry H. Williamson seconded. by Trustee Fred W. Young
and carried,, the.application of Ben Cope for permission to build a pier for the
Pasadena Presbyterian Church on Balboa Island, was referred to the City Engineer for `
the customary two weeks.
On motion of Trustee Felix B. Modjeska seconded by Trustee Harry H.
Williamson and carried, the communication from the Newport Harbor Publishing Co.
in regard to advertising in their illustrated harbor edition, was referred to the
Advertising Committee with power to act.
On motion of Trustee Harry H. Williamson seconded by Trustee Fred W.
Young.and carried, the invitation of the City of Oakland was to be acknowledged
and filed.
On motion of Trustee L. S. Wilkinson seconded by Trustee Felix.B.
Modjeska and carried, the request of Messrs. Harvey, Gardner and Beek of Balboa
Island to have the manhole in the speedway lowered, was referred to the City
Engineer with poser to act.
On motion of Trustee Harry H. Williamson seconded by Trustee L. S.
Wilkinson and carried, the business licenses of Chas. A. Stender Nos. 288 and 289
were transferred to Chas. F. Clark.
On motion of Trustee Harry H. Williamson seconded by Trustee Felix B.
Modjeska and carried, the application of R. Koritos for license to run a shoeshine
stand at Central Avenue and Main Street, Balboa, was referred to the Chief of Police
for a recommendation.
On motion of Trustee Harry H. Williamson seconded by Trustee Fred W.
Young and carried, the communications from R. F. Goudey, Resident Engineer of the
California State Board of Health in regard. to sewage disposal from our septic tank,
' were referred to -the City Health Officer for investigation and report.
The communication from Dr. Herman Hilmer in regard to the continuance of
the marine railway on Section 5, Balboa Island was discussed, and on motion of
Trustee Fred W. Young seconded by Trustee L. S. Wilkinson and carried, the City
Marshal was instructed to serve notice on the Southland Sailing Club to discontinue
the nuisance at once.
On motion of Trustee Harry H. Williamson seconded by Trustee Felix B.
Modjeska and carried, the real estate license of W. C. Burris was transferred from
2122 Ocean.Front to 107 - 22d Street.
On motion of Trustee Felix B. Modjeska seconded by Trustee Harry H.
Williamson and carried, the request of the newspaper agencies of town to have the
bicycle riding ordinance.changed to allow the boys to ride on the sidewalk from 5
to 9 A. M., was granted.

On motion of Trustee Harry H. Williamson seconded,'by Trustee Felix B.
Modjeska and carried, the Chair was instructed to appoint a committee of three to
appraise Lot 1, Block 32, Newport Beach Tract as requested by Lew H. Wallace in his
communication. The committee appointed is Trustees Harry H. Williamson and Fred
W. Young, and City Clerk Alfred Smith.
On motion of Trustee Felix B. Modjeska seconded by Trustee Fred W. Young
and carried, the Notice of Hearing before the Railroad Commission in regard to
raise in rates of the-Pacific Electric Railway Co. was referred to the City Attorney
to attend the hearing on March 10, 1927•
On motion of Trustee Felix B. Modjeska seconded by Trustee Fred W. Young
and carried, the offer of H. 0. Thompson through L. W. Briggs, to sell the City
81.6 feet of ocean frontage in Block "F" Balboa Tract at the established price of
$5.00 per front foot, was accepted.
On motion of Trustee Harry H. Williamson seconded by Trustee Fred W.
Young and carried, the notice of withdrawal of offer to dedicate The Hudson by the
Newport Bay Dredging Co. was referred to the City Attorney to see what is the legal
status of the property.

January 24, 1927, for hearing protests in the matter of the improvement therein
described, and no written protests having been filed with the City Clerk in said
matter, and no persons desiring to be heard in the matter of said protests, where-
upon Trustee Felix B. Modjeska introduced a resolution entitled:
A RESOLUTION OF THE BOARD OF TRUSTEES OF THE-CITY OF NEWPORT
BEACH ORDERING THE IMPROVEMENT OF CERTAIN PORTIONS OF BAY AVENUE
WITHIN SAID CITY.'

there was submitted to the qualified venters of said City, the proposition of
incurring a debt by the City of Newport Beach in the sum of $500,000.00; all of
the returns of said election being duly made, returned to and filed with the
Clerk of said City, and the Board of Trustees thereof, being now duly convened
in regular session, proceeded to canvass said returns and from the returns and
the canvass thereof', the Board of Trustees of the City of Newport Beach finds "
and orders to be here established of record as follows:
let. The special election was called and ordered to be held by
Ordinance No. 311 and in pursuance of said Ordinance was held on the 14th day
of February, 1927-

Shall the City of Newport Beach incur a bonded debt in the sum
of $500,000.00 to pay the cost of the construction of jetties, one
jetty to commence on the shore of the Pacific Ocean at the westerly
side o£ the entrance to Newport Bay, and extending southerly into
the waters of the Pacific Ocean a distance of approximately two
thousand one hundred (2100) feet, dnd one jetty to commence on the
shore of the Pacific Ocean on the easterly side of the entrance to
Newport Bay, and extending southerly into the waters of the Pacific
Ocean a distance of approximately one thousand five hundred (1500)
Trustee Fred W. Young introduced a resolution entitled:
A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NEWPORT
BEACH DIRECTING CERTAIN WORK OR IMPROWNENT TO BE DONE UNDER
THE DIRECTION OF THE CITY ENGINEER OF SAID CITY.
The resolution was read, considered, designated RESOLUTION N0. 415,
and upon call of the roll passed by the following vote:
AYES, Trustees L. S. Wilkinson, Felix B. Modjeska, Fred W. Young,
Harry H. Williamson, Conrad Richter.
NOES, Trustees None.
ABSENT, Trustees None.
This being the time fixed for opening bids for furnishing and
installing 600 feet of guard rail for the Newport Wharf and 12 benches, the
Board in open session publicly opened, examined and declared all sealed bids
received for said work, to -wit:

whereupon said bids were referred to the City Engineer for checking

On motion of Trustee Fred W. Young seconded by Trustee Felix B.
Modjeska and upon call of the roll duly carried, it was resolved by the Board
of Trustees of the City of Newport Beach that the hereunto annexed grant and
the real property therein described be and is accepted by the City of Newport
Beach, the grantee therein, and that a certified copy of this resolution be
recorded with said deed.
The City Attorney filed a report of his findings in regard to peddlers

license of the City, and same was referred to Trustee Harry H. Williamson to
look into and report.
NEW BUSINESS.
Trustee Harry H. Williamson introduced an ordinance entitled as
follows:
AN ORDINANCE PERMITTING THE RIDING OF BICYCLES ON PUBLIC
SIDEWALKS IN THE CITY OF NEWPORT BEACH BETWEEN THE HOURS OF
5 AND 8 A. M. AND REPEALING THAT PORTION OF ANY OTHER ORDINANCE
IN CONFLICT THEREWITH.
The Ordinance was ordered filed, read and considered, designated

ORDINANCE NO. 312 and referred to the City Attorney.
This being the first Monday after the 14th day of February, 1927, on

the top of each of said. jetties -to be approximately ten feet above
the line of ordinary high tide of the Pacific Ocean. The jetty
to be constructed on the easterly side'of the entrance co Newport;
Bay to be approximately parallel to and nine hundred (900) feet
easterly of the jetty to be constructed on the westerly side of
said entrance.
3d. For the purpose of the special election the City of Newport Beach
was subdivided into five special election precincts; and at the polling places in
the said special election precincts votes were cast YES and in favor of the propo-
sition, NO and against the proposition, as follows:
Special election precinct No. 1, votes YES 169 votes NO 17
No. 2, votes YES 200 votes NO 2
No. 3, votes YES 254 votes NO 8
" " " No. 4, votes YES 190 votes NO 3
" " " No- 5, votes YES 192 votes NO 2
Total votes YES 1005
Total votes NO 32
Total votes cast, 1037
At the special election the votes of two - thirds and more of all the
voters voting thereat were voted YES and in favor of the proposition and the issuance
and sale of.the bonds by -the City of Newport Beach in the sum of $500,000.00 is
authorized for the purposes set forth in the said proposition; and in Resolution
No. 407 and in said Ordinance No. 311.
Trustee L. S. Wilkinson thereupon introduced a Resolution entitled as
follows:
A RESOLUTION OF THE CITY Or NEWPORT BEACH BY THE LEGISLATIVE
BRANCH THER.EOF,.TO -WIT: THE BOARD OF TRUST-,S, PROVIDING FOR THE
ISSUANCE AND SALE OF THE BONDS OF SAID.CITY IN THE SUM OF $500,000.00
FOR THE CONSTRUCTION OF A MUNICIPAL IMPROVEMENT FOR THE CITY OF
NEWPORT BEACH, PRESCRIBING THE FORM OF SUCH BONDS, FIXING THE RATE.
OF INTEREST TO BE PAID THEREON, THE DATE AND PLACE OF PAYMENT OF
SAID BONDS, PRINCIPAL AND INTEREST, AND FURTHER. PROVIDING A SINKING
FUND FOR THE PAYMENT AND REDEMPTION OF THE BONDS, PRINCIPAL AND
INTEREST.
The Resolution was ordered filed, read, considered, designated
RESOLUTION NO. 416, the roll was called and the Resolution passed by the following
vote:
AYES, Trustees L. S. Wilkinson, Felix B. Modjeska, Fred W. Young,
Harry H. Williamson, Conrad Richter.
NOES, Trustees None.
ABSENT, Trustees None.
The Resolution having been passed was signed and approved by the
President of the Board of Trustees, countersigned and attested by the City Clerk.
The contracts with Smith and Mc Farland and Rodger Brothers were brought
up for discussion, and on motion of Trustee Harry H. Williamson seconded by Trustee
Fred W. Young and carried, the contracts were referred to the Committee of the Whole
for further consideration.
city Engineer Kressly reported that John Roehe was the lowest bidder
for making the 12 benches and putting 600 foot of rail on the Newport pier, and on
motion of Trustee Harry H. Williamson seconded by Trustee Felix B. Modjeska and
carried, all bids were rejected except the one from John Roehe, and. he was awarded
the contract for doing the above mentioned work; all checks of unsuccessful bidders
to be returned.
City Engineer Kressly reported that the Griffith Company were the
lowest responsible bidder for the work to be performed under R_esol +ition of Intention
No. 406, and thereupon Trustee Harry H. Williamson introduced 'a Resolution entitled:
A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NEWPORT
BEACH AWARDING THE CONTRACT FOR CERTAIN WORK ON CERTAIR PORTIONS
OF 22D STREET, THE ARCADE AND OTHER STREETS WITHIN SAID CITY.
The Resolution was read, considered, designated RESOLUTION N0. 417, and
upon call of the roll passed by the following vote:
AYES, Trustees L. S. Wilkinson, Felix B. Modjeska, Fred W. Young,
Harry H. Williamson, Conrad Richter.
NOES, Trustees None.
ABSENT, Trustees None.

On motion of Trustee Fred W. Young seconded by Trustee Harry H.
Williamson and carried, the Clerk was instructed to write the State Highway
Commission and J. P. Baumgartner; the Orange County Supervisors and the Pacific
Electric Railway Co. asking for immediate action in repairing the damage done
by the recent flood to the State Highway, Talbert Road and the Pacific Electric
tracks.
Therd being no further business on motion of Trustee Fred W. Young
seconded by Trustee Felix B. Modjeska and carried, the meeting adjourned'to 7:30
o'clock P. M. on Monday, February 28, 1927-

City Hall, 'Newport Beach, February 28, 1927:
The Board of Trustees of the City of Newport Beach met in regular
adjourned session at 7:30 o ?clock P. M. on above date. The meeting was called
to order by President Conrad Richter.
The roll was called snowing all members present.
The minutes of the previous melting were read and approved as read.
Trustee Fred W. Young stated the Parking Committee wished to look up
the parking conditions on Balboa Island also, and were given until next meeting
to make their report.
Trustee Harry H. Williamson reported that the Advertising Committee
would recommend that the City take the advertisement in the illustrated harbor
edition of the Newport Harbor Publishing Co. at a cost of $213.00, and on motion
of Trustee L. S. Wilkinson seconded by Trustee Fred W. Young and carried, the
recommendation was approved and the amount set'aside out of the advertising fund
to pay for sane.
Trustee Harry H. Williamson also reported that the Committee appointed
to appraise Lot 1, Block 32 Newport Beach Tract would appraise the lot at $3500.
but would recommend that it be not offered for sale at the present time, and on
motion of Trustee L. S. Wilkinson seconded by Trustee Felix B. Modjeska and
carried, the report was accepted and filed.
Trustee Harry H. Williamson stated that the Fire and Water Committee
would recommend that the City Auditor be instructed to obtain the best prices
and terms possible from the leading manufacturers-on-an engine pumper and present
at the next meeting, and on motion of Trustee L. S. Wilkinson seconded by
Trustee Felix B. Modjeska and carried, the recommendation was accepted and the
Auditor was so instructed.
The recommendation of Health Officer Grundy that the discharge pipe
from the septic tank be extended 160 feet was read, and on motion of Trustee
Harry H. Williamson seconded by Trustee Fred W. Young and carried, the recommen-
dation was approved and the work ordered done.
The communication from R. S. Briggs reporting An his investigations
of fishing barges and live bait boats in Long Beach and Redondo Beach was read,
and on motion of Trustee L. S. Wilkinson seconded by Trustee Felix B. Modjeska.
and carried, the report was accepted and referred to the Committee of the Whole
for consideration later.
The report of P. V. Kressly giving the reason for not lowering the
manhole in the speedway on Balboa Island was read, and on motion of Trustee L. S.
Wilkinson seconded by Trustee Fred W. Young and carried, the report was accepted
and the Clerk instructed to notify the petitioners the reasons for not complying
with the request.
The communications were read and acted upon as follows:
The communication from H. A. Constantine in regard to the deed to the
Library property was considered, and on motion of Trustee Harry H. Williamson
seconded by Trustee Felix B. Modjeska and carried, the matter was referred to the
City Attorney, the City Clerk to furnish him with information in regard to
payments made and warrants issued.
On motion of Trustee Harry H. Williamson seconded by Trustee Fred W.
Young and upon call of the roll duly carried, the copy of a resolution centrali-
zing the heads of all State Departments at the State Capitol sent us by John H.
Miller, Chairman of the Legislative Committee of the Sacramento City Council, was
adopted and to be signed and turned over to the City Attorney by the following
vote:
