HomeMy WebLinkAbout06-20-1927 - Special MeetingMW ,1 President Conrad Richter then stated it was the intention of the Jetty Construction Committee to use the Hauser Construction Co. strusture for the speakers platform at the celebration Sunday, June 19, 1927, but that the Hauser Construction Co. wanted to be released from any public liability for aocidents. The matter was considered and on motion of Trustee H. H. Williamson seconded by.Trustee F. B. Modjeska and carried, the President and Clerk of the Board were authorized to sign such a release, and arrangements were to be made for the City-to carry public liability insurance for that day. There being no-�.further business on motion of Trustee F. B. Modjeska seconded by Trustee Fred W. Young and oarr , e meeting adjourned. A Approved June 27, 1927- President Board-of Trustees. / /Gi�i�,iL��.I/ / City Hall, Newport Beach, June 20, 1927- Pursuant to a call thereof by the President of the Board of Trustees of the City of Newport Beach and notice delivered to each member at least three hours before the time specified`for the meeting, the Board met at the place and on the date above mentioned at 5:15 o'clock P.'M. The meeting -was called to order by President Conrad Richter. The roll was called showing Trustees F. B. Modjeska, Fred W. Young'an3 Conrad Richter present. The call was read and the Board proceeded to consider the subjects for which the meeting was called. City Engineer $reasly referred to -the matter of labor agitators interfering with the men working on the.jetty, and also stated that our contract with the Hauser Construction Co. would not allow the men to work more than S hours a day. He therefore presented the following resolution for consideration: WHEREAS, the City of Newport Beach a Municipal Corporation, organized and existing under and by virtue of the laws of the State of California, did on the 11th day of May, 1927s eater into a contract with the Hauser Construction Company, a Corporation existing under and by virtue of the laws of the State of Oregon, with its principal plaee•of business in the City of Portland, State of Oregon, and duly licensed and authorized to -do business and doing business in the State of California, for the construction and repair of the present west jetty and the construction of revetments along the westerly side of the entrance channel to Newport Bay and along the shore line of the Pacific Ocean westerly of and adjacent to the present west jetty; and WHEREAS, said contract contains a clause which provides that the Contractor, the said Hauser Construction Company, shall forfeit, as a penalty to the City of Newport Beach, ten dollars for each laborer workman or mechanic employed, in the execution of said contraot, by it, or by any subcontractor under it, upon any of the work provided in said contract, for each calendar day during which such laborer, workman or mechanic is required or permitted to labor more than eight hours, as required in Section 653c of the Penal Code of the State of California; -and WHEREAS, the function of the present west jetty is the protection of the entrance channel to'Ne;uport Bay and -to render said channel safe to all persons using said channel for boating, yachting and navigation purposes; and WHEREAS, the said west jetty has during some time past been in a condition that it did not afford proper and - adequate protection to those using said channel, and as a consequence thereof many lives have been endangered amd some lives have been lost; and WHEREAS, the lack of protection along the west Bide of the channel and along the shore line of the Pacific Ocean westerly of and adjacent to the present west jetty, has been the cause of damaging thousands of dollars worth of private property, as well as street pavements, sewers, water pipes, boardwalks and other public property; and II "17 445 WHEREAS; said contract provides for the repair and construc- tion of said present west jetty and the construction of revetments along the west side of the entrance channel and along the shore line of the Pacific. Ocean westerly of and adjacent to said west jetty; and WHEREAS, the construction of said work as provided in said contract will protect said channel, making it safe for navigation and protect private and public property: NOW, THEREFORD, BE IT RESOLVED, that the work provided in said.contract is of an-extraordinary emergency and that in order to safeguard the lives of those using said entrance channel and to proteot private and public property, it is necessary that said Contractor, the Hauser Construction Company, be permitted to employ any laborer, workman or mechanic more than eight hours and he is hereby permitted to employ said laborers, workmen and mechanics as many hours in any calendar day as may be necessary and required to prosecute and complete said work as the supply of materials and equipment will-permit)-to the end that said work will be completed as speedily as possible. I,1O City Clerk of the City of Newport Beach, do hereby certify that the foregoing Resolution was passed at a special called meeting of the Board of Trustees of said City held on the 20th day of June, 1927s and that the same was adopted by the following vote, to -wit: AYES, Trustees F.B.Modjeska, Fred W.Young, Conrad Richter. NOES, Trustees None. ABSENT, Trustees L-8-Wilkinson and H. H. Williamson. City Clerk. City Marshal Winn presented a request to have a section of the parking ordinance No. 322 amended and to add one new section to the ordinance, The same was discussed and on motion of Trustee F. Be Modjeska seconded by Trustee Fred W. Young and carried, the changes were authorized. ' There being no-further business on motion of Trustee Fred W. Young seconded by Trustee F. City Hall, Newport Beach, June 27, 1927- The Board of Trustees of the City of Newport Beach met in regular adjourned session at 7:30 o'clock P. M. on above date. The meeting was called to order by President Conrad Richter. The roll was called showing the full Board present. The minutes of the regular meeting of June 6th were read and approved. The minutes of the-special meetings of June 10, 17 and 20th were read and approved as read. • This being the time fixed for opening•bide for certain work on certain portions of Coast Boulevard and certain other streets within said City of Newport Beach, as contemplated by Resolution of Intention No. 427 of this Board, the Board in open session publicly opened, examined and declared all sealed bids received for said work, to -wit:
