Wilkinson moved the adoption of Plan No. 348 presented by the City Engineer for the extension of the present west jetty, which provides for the extension of the present west jetty and to be constructed by the Hauser Construction Company, under its contract with the City, and which motion was seconded by Councilman H. H. Williamson and carried by the following vote: AYES, Councilmen L.S.Wilkinson, F.B:.Modjeska, Fred W.Young, H.H.Williameon, Mayor Conrad Richter. NOES, Councilmen None. ABSENT, Councilmen None. ' City Engineer Kresely referred to the assessment diagram for the work done by the Griffith Company in Corona Del Mar under Resolution of Intention No. 396, and after due consideration it was moved by Councilman Fred W. Young seconded by Councilman F.B.Modjeska that the assessment diagram presented by the City Engineer showing the lots and parcels of land to be assessed for the costs and expenses of the improvements contemplated under Resolution of Intention No. 396 of the Board of Trustees, be adopted and confirmed by the following vote: AYES, Councilmen L.S.Wilkinson, F.B.Modjeska, Fred W.Young, H.H.Williamson, Mayor Conrad Richter. NOES, Councilmen None. ABSENT, Councilmen None. • The matter of a Life Guard for nenport beach was considered, aid on motion of Councilman H. H. Williamson seconded by Councilman Fred W. Young and carried, one additional Life Guard was authorized for the remainder of the season but, not to.exceed one month, at a salary of $100.00 per month, he to be located between 19th and 23d Streets. The matter of a Life Guard operating at the Camp Ground which was not authorized by the Council was considered, and on motion of Councilman Fred W. Young seconded by Councilman F. B. Modjeska and carried, the Chief of Police was authorized to hire a man for the Camp Ground by the day for such time as he considers necessary but not to exceed one month, and to be paid at the rate of $100.00 per . month. City Engineer Kressly.presented copies of an Average Agreement Contract with the Pacific Electric Railway Co. covering demurrage on rock for the jetty and which were to be signed by the City. The matter was considered and on motion of Councilman L. S. Wilkinson seconded by Councilman F. B. Modjeska and carried, Mayor Conrad Richter was authorized to sign the Average Agreement Contract No. 3212 with the Pacific Electric Railway-Co. on behalf of the City of Newport Beach. City Clerk. 1 City Hall, Newport Beach, Sept. 5, 1927- The City Council of the City of Newport Beach met in regular session at 7:30 o'clock P. M. on above date.. The meeting was called to order by Mayor Conrad Richter. The roll was called showing all members present except Councilman Fred W. Young. The minutes of the regular meeting of August 1st were read and approved. The minutes of the special meetings of August 3d, 22d and 26th were read-and approved as read. On motion of Councilman H. H. Williamson seconded by Councilman F. B. Modjeskd and carried, the Clerk was instructed to write the State Compensation Insurance Fund and ask if our insurance 462 Pioneer Theodore on Volunteer firemen would cover injuries sustained while attending a fire outside the city. Modjeska and carried, the matter was 4 ,836.80 referred to the Committee of the Whole for.contideration. 4, as above, This being the time set for opening bids for furnishing, 2,796.00 planting and the maintenance of trees, shrubs, plants and grass in , as above, - Corona Del Mar as contemplated by Resolution of Intention No. 429 ' of the Board of Trustees, the Council in open session publicly opened, as above, examined and declared all sealed bids received for said work, which 2,796.00 bids were as follows: thereupon said Peterson (last for checking Bros. S. Wilkinson seconded by Councilman H. H. Williamson and carried, the matter was referred to the Street Committee and Street Superintendent to report on at the next meeting. The communication from the Newport Harbor Chamber of Commerce in regard to the $1,500.00 requested for newspaper advertising was considered, and on motion of Councilman H. H.•Williamson seconded by Councilman F. B. Modjeska and carried, the same was allowed and to be spread over.a period from now until January 11 1928. ' The communication from S. Mosby White in regard to communica- tions sent out by Lee Pfau was filed. On motion of Councilman L. S. Wilkinson seconded by Councilman F. B. Modjeskaand carried, the two communications from Lee Pfau and one from G. W. Kitzmiller were tabled until such-time as the Council wishes to take them up. On motion of Councilman L. S. Wilkinson seconded by Councilman F. B. Modjeska and carried, the Clerk was instructed to acknowledge receipt of the request for donation from the Newport Centenary Memorial Fund of Barnstable, England. On motion of Councilman H. H. Williamson seconded by Councilman L.-S. Wilkinson and carried, the communication of Ernest Grill, Chairman of the Harbor Developement Committee in regard to developement of Parkinson Island, was filed. On motion of Councilman H.H.Williamson,seconded by Councilman F. B. Modjeska and carried, the request of the Newport Harbor Chamber of Commerce for an appropriation of.$725.00 for advertising expenses from Sept. 15th to October 15th, was allowed. On motion of Councilman L.S.Wilkinson seconded by Councilman H. H. Williamson and carried, the communication from the Newport Beach Exchange Club in regard to widening the Santa Ana River Bridge, was referred to the Street Committee and Street Superintendent for consideration and report. On motion of Councilman L.S.Wilkinson seconded by Councilman H. H. Williamson and oarried, the communication from G. W. Kitzmiller in regard to parking on Balboa Island was referred to the Chief of Police for report. The request of the Griffith Company for an extension of 60 days time on their contract for.paving on Corona Del Mar was considered, and on motion of Councilman F. B. Modjeska seconded by Councilman H. H. Williamson and carried, the extension was allowed. The receipt of J. Duman to J. K. Smith for his interest in the Newport Pier landing was filed. On motion of Councilman H.H.Williamson seconded by Councilman F. B. Modjeska and carried, the communication from the Newport Harbor Chamber of Commerce in regard to upkeep of traffic signals at the intersection of Newport Boulevard and Coast Highway was filed. The notice of meeting of the League of California Munici- palities to be held in Sacramento Sept. 19th to 22d was read, and on motion of Councilman H. H. Williamson seconded by Councilman L. S. Wilkinson and carried, the City Auditor and Street Superintendent were instructed to attend the meeting with their carfare and $5.00 per day each allowed by the City. On motion of Councilman L. S. Wilkinson seconded by Councilman F. B. Modjeska and carried, the communication from J. S. Armstrong in regard to insurance on our street light standards was referred to the City Auditor to check up on and report. The communication from Alice B. Lewis in regard to a uniform traffic ordinance was considered, and on motion of Councilman L. S. Wilkinson seconded by Councilman H. H. Williamson and carried, the ' Clerk was instructed to take up the matter.with the Automobile Club of California and ask what action they would advise us to take, The communication from the Beverly Hills Nursery was filed. On motion of Councilman H.H.Williamson seconded by Councilman F. B. Modjeska and carried, the communication from the Newport Beach Exchange Club endorsing the stand.taken by the Council on the jetty matter, was filed. The communication from L. K. Suan in regard to the damage done by a skyrocket at the celebration of the Tournament of Lights, was referred to the Chamber of Commerce and J. A. Beek for attention. On motion of Councilman H.H.Williamson seconded by Councilman F. B. Modjeska and carried, the communication from Gertrude G. Brainerd In regard to the tree planting program on Corona Del Mar not covering all she expected on portions of the district, was referred to the City Engineer for report. 464 On motion of Councilman L.S. Wilkinson seconded by Councilman `71 H. H. Williamson and carried, the request of C. 09 Nordenson to have R. E. Rogers move his mooring from the foot of Fernando Street, was referred to the Harbor Master for attention. I • On motion of Councilman H.H.Williamson seconded by Councilman F. B.-Modjeska and carried, the communication from the Pacific Electric Railway Co. withdrawing their offer to grant a 10 foot easement along their right -of -way from 30th Street to the west end of,town, was filed for future consideration.. . On motion of Councilman F.B. Modjeska seconded by Councilman H. H. Villiamson and carried, the application of Mrs. W. A. Osgood for license to sell sandwiches, soft drinks, candy and cigars in the new dance hall at Newport Beach, was allowed. I UNFINISHED BUSINESS. Councilman L. S. Wilkinson introduced a resolution fixing the rate per centum and levying a tax upon the taxable property within the City of Newport Beach.and taxable therein for municipal purposes, and also upon the taxable property within the several . assessment districts for the purposes of said districts; the Resolution was ordered filed, read, considered, designated RESOLUTION NO. 438, the-roll was called and the Resolution passed by the following vote: AYES,, Councilman L.S.Wilkinson, F.B.Modjeska, H.H.Williameon, Mayor Conrad Richter. NOES, Councilmen None. ABSENT, Councilman Fred W#-Young. On motion of Councilman L.S.Wilkinson seconded by Councilman F. B. Modjeska and carried, the grant of easement for 30 foot Strip for highway purposes parallel to the Southern Pacific tracks from 46th to 59th Streets, was accepted. The matter of rental for the booths on the Newport wharf was considered, and on motion of Councilman H. H. Williamson seconded by Councilman L. S. Wilkinson and carried, the rental price of the booths was placed at $15.00 each per annum. J. K. Smith stated that the one booth which the City had- - allowed him the free use of to the end of his contract, was too small ' and wanted the partition removed so he could have the use of two booths. The matter was discussed and on motion of Councilman H. H. Williamson seconded by Councilman F. B. Modjeska and carried, he was given the use of another booth at the-regular price of $15.00 per year, which he paid. City Auditor Briggs made a verbal request for the balance of his vacation, and on motion of Councilman L. S. Wilkinson seconded by Councilman H. H. Williamson and carried, he was allowed the vacation not exceeding two weeks on pay. • On motion of Councilman H.H.Williamson seconded by Councilman L. S. Wilkinson and upon call of the roll duly carried, it was ordered that whenever real property has been deeded to the City of Newport Beach under sale for nonpayment•of taxes, then upon payment of all taxes, interest, penalties and costs which have accrued and prior to the sale of said property to any other person, the City of Newport.Beach quit- claim to the owner or owners of the fee at the time the sale was made, all such property and that the Mayor of the City of Newport Beach together with the Clerk thereof be authorized to execute and deliver to such person, quit -claim deeds for said property. I • The matter of the life guard at the Camp Ground was discussed, and on motion of Councilman•H.H.;Williamson seconded by Councilman F. B. Modjeska and carried, the demand of Bob Mac Whorter for life guard service at the Camp Ground without authorization of the Board, was denied by the following vote: - AYES, Councilmen L.S.Wilkinson, F.B.Modjeska, H.H.Williamson, , Mayor Oonrad Richter. NOES, Councilmen None. ABSENT, Councilman Fred W.-Young. On motion of Councilman L.S.Wilkinson seconded byi Councilman H. H. Williamson and carried, the demands which are in proper form and approved by the Finance Committee, were allowed and warrants to be drawn for same. On motion of-Councilman L.S.Wilkinson seconded by Councilman F. B. Modjeska and carried, the head of the Life Saving Department was authorized to purchase a life saving boat at a price not exceeding $ 75900. ma The City Engineer reported that Peterson Brothers were the lowest bidders for the work to be done on Corona Del Mar under' Resolution of Intention No. 429 within said City,.and thereupon Councilman F. B. Modjeska presented RESOLUTION N0. 439, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AWARDING THE CONTRACT FOR CERTAIN WORK ON CERTAIN PORTIONS OF OCEAN BOULEVARD AND OTHER STREETS IN CORONA DEL MAR, AS CONTEMPLATED BY RESOLUTION OF INTENTION NO. 429, and on his motion duly seconded said Resolution was adopted by the following voter AYEST,Counoilmen L.S.Wilkinson, F.B.Modjeska, H.H.Williamson, . Mayor Conrad Richter. NOES, Councilmen None. ABSENT, Councilman Fred W. Young. The matter of employing some one to supervise the tree planting on Corona Del Mar was considered, and on motion of Councilman L. S. Wilkinson seconded by Councilman F. B. Modjeska and carried, the Mayor was instructed to appoint a committee to confer with W. T. Miller, Landscape Artist in regard to supervising the work, and also to consider the appointment of a Supervisor of Parks: . The Committee appointed is City Engineer Kressly, Councilman F. B. Modjeska and Superintendent of 'Streets, Frank L. Rinehart. There being no further business on motion of Councilman F.B. Modjeska seconded by Councilman H. H. City Hall, Newport Beach, Sept. 12, 1927- The City Council of the City of Newport Beach met in regular adjourned session at 7:30 o'clock P. M. on above date. The meeting was called to order by Mayor Conrad Richter. The roll was called showing all-members present except Councilman Fred W. Young who came in later. The minutes of the previous meeting were read and approved as read. City Engineer Kressly reported for the Committee that they had interviewed W. T. Miller in regard to supervising the tree lanting on Corona Del Mar but he wanted an amount approximating 3,784.00 which they thought excessive. The matter was discussed and on motion of Councilman L..S. Wilkinson seconded by Councilman H. H. Williamson and carried, the report was accepted and filed, and the Committee continued and instructed to get in touch with the Copnty Horticultural Commissioner and-ask him to recommend a man qualified to look after this work. The report from the Chief of Police in regard to sewers on Corona Del Mar and Collins-Isle was read and discussed, and on motion 1 of Councilman L. S. Wilkinson seconded by Councilman F. B. Modjeska and carried, the report was accepted and filed, and the Clerk was instructed to notify the parties in writing that they must provide a cess pool or attach to a sewer if within 200 feet of same. The communication from 0. 0. Nordenson in regard to asking R. E. Rogers to wove his mooring at the foot of Fernando Street to allow motor boats to land at the pier was considered, and the Harbor Master stated the pier was not built and was not safe for motor boats to land there. On motion of Councilman L. S. Wilkinson seconded by Councilman F. B. Modjeska' and carried, the Clerk was instructed to notify Mr. Nordenson that-the pier not being built or in shape to allow motor boats to land with safety, and the Council cannot see its way clear to expend the money necessary to strengthen it at this time, therefore they do not think it wise to allow it.
