The City Clerk then swore in the new City Attorney and he
entered upon the duties of the office.
Mayor Conrad Richter appointed Councilmen L. S. Wilkinson
and H. H. Williamson a committee to draw.up Resolutions of sympathy
and present at the next meeting.

The City.Counoil,of the City of Newport Beach met in regular
session at 7:30 o'clock P. M. on above date. The meeting was called
to order by Mayor Conrad Richter.
The roll was called showing the full Council present.
The minutes of the previous regular meeting were read and
approved as read.
The minutes of the special meeting of November 5th were read
and approved as read.
Councilman L. S. Wilkinson read the following Resolution of
Sympathy•on.the death.of.our late City.Attorney, Clyde Bishop:
IMREAS, OUR FRIEND AND ADVISER, Clyde Bishop, has been called
upon to take the long journey into the Unknown Country beyond the
grave; and
WHEREAS, from the inception of the City of'Newport Beach he
was the legal guide of said City, and through the years steered the
municipality safely through the troubled waters, avoiding the rocks
of circumstances that might have caused disaster; and
WHEREAS, he was.not only adviser and councilor but also loyal
friend and advocate of all the interests of the City ;.Now therefore
be it:
RESOLVED, that the Board of Trustees of the City of Newport
Beach do most sorrowfully regret the passing out of this life of our
friend and advisor, and the stopping of his work in mid— career; and
will ever hold in.affectionate recollection his memory.
Be it further;
RESOLVED, that this word of appreciation and sorrow be
spread upon the minutes of this.meeting, and that a copy be sent to
Mrs. Bishop.

On motion of Councilman F. B. Modjeska seconded by Councilman
Fred W. Young and carried, the Resolution was accepted and the
provisions to be carried out..
The reports of the'heads of departments were read and on
motion of Councilman F. B. Modjeska seconded by Councilman Fred W.
Young and carried, the reports were accepted and filed.
Mr. Scoville representing,the Blankenhorn Realty Co. and the
First Trust & Savings Bank of Pasadena, was present and expressed the
desire for a date when they could meet the council and talk over the
controversy at the jetty. Mayor Richter appointed-Saturday, Nov. 12th
at 7:30 o'clock P. M. in the Council Chamber when they would meet and
talk the matter over.

Dr. Arthur A. Noyes presented a verbal request for authority
to put up a retaining -wall about two feet high on Ocean Boulevard along
his place. The matter was discussed and-on motion of Councilman L. S.
Wilkinson seconded by Councilman F. B. Modjeska and oarried, the City
Attorney was instructed to draw up a lease for same at $1.00 per year
revocable at any time.
C. E. Race representing some finanvial interests of Los Angeles
who were maturing plans for developing deep water gravels underlying
Santa Ana Gardens Estate, and wished to present the matter of supplying
the City with dmmestic water. He left a communication explaining same
and on motion of Councilman H. H. Williamson seconded by Councilman
L. S. Wilkinson and carried, the matter was referred to the Water
Superintendent for - comment and returned to the files.
J. A. Beek, Chairman of the Committee in regard to formation
of a harbor district, asked to be authorized to enlarge the Committee
to 15 members. The matter was discussed and on motion of Councilman
H. H. Williamson seconded by Councilman F. B. Modjeska and carried,
Mr. Beek was authorized to add 12 new members to his Committee making
15 members in all.
Councilman H. H. Williamson reported that the Fire Committee
would reportfavorably on allowing the Fire Department to put up a
drying rack for their hose and also the adoption of a chimineV and
flue ordinance, and on motion of Councilman F. B. Modjeska seconded
by Councilman Fred W. Young and carried, the expense of the drying rack
was allowed, and the City Attorney was instructed to draw up a chimney
and flue ordinance.
Councilman Fred A. Young reported for the Parking Committee
that they would recommend changing the parking ordinance to allow
parking on the south side of Ocean Avenue between 21st and 23d Streets
instead of on the north side, which was discussed and on motion of
Councilman L. S. Wilkinson seconded by Councilman F. B. Modjeska and
carried, the matter was referred to the Committee of the:Whole for
consideration.
The matter of a license ordinance for fishing boats was brought
up for consideration, and after some discussion Councilman Fred W.
Young introduced an Ordinance concerning the licensing of fishing
boats and barges. The Ordinance was read, considered, designated
Ordinance No. 3269 and passed to the second reading upon the following
roll call:

The communications were read and acted upon as follows:
The communication from the California Municipal Traffic League
asking that we be represented at their second annual convention to be
held in Alexandria Hotel, Los Angeles, Nov. 18, 19 and 20, was
considered, and on motion of Councilman L. S. Wilkinson seconded by
Councilman H. H. Williamson and carried, Chief of Police With was
requested to attend and the Clerk to notify them to that effect.
On motion of Councilman F. B. Modjeska seconded by Councilman
Fred W. Young and carried, the two communications from J. A. Ashley
in regard to his rater bill was referred to the Water Superintendent
for report.
The communication from G. K. Scoville In regard to damage
done at the jetty was considered, and on motion of Councilman L. S.
Wilkinson seconded by Councilman F. B. Modjeska and carried, the matter
was referred to the Committee of the Whole and City Attorney, and-the
Clerk instructed to notify them of the meeting Saturday night.
On motion of Councilman L. S. Wilkinson seconded by Councilman
F. B. Modjeska and carried, -the two communications from the Fire Chief
asking for atith@rization to purchase 6 pairs boots, pants and helmets
for the Fire Department, and also the employment of a relief fireman,
were referred tothe fire Committee for report.
On motion of Councilman Fred W. -Young seconded by Councilman
F. B. Modjeska and oarried, the communication from the Fire Chief
asking transfer of funds to replace money spent in furnishings for the
new fire hall,-was referred to Building Inspector Fenelon for report.
On motion of Councilman L. S. Wilkinson seconded by Councilman
F. B. Modjeska and oarried, the communication of N. Robotham in regard
to the distribution of hand bills was referred to the City Attorney
for-consideration.

On motion of Councilman Fred W. Young seconded by Councilman
F. B. Modjeska and carried, the request of the Newport Harbor Chamber
of Commerce for an appropriation of $985.00 for advertising expenses
from Nov. 15th to Dec. 15th was allowed.
On motion of Councilman H. H. Williamson seconded by Coun-
cilman Fred W. Young and carried, the communication from Mrs. G. E.
Bulfinch in regard to final payment due November 1st on Lot 21,
Block 30 ? Newport Beach Tract with blank deed attached, was referred
to the City Attorney to prepare the deed for her signature.
On motion of Councilman Fred W. Young seconded by Councilman
F. B. Modjeska and carried, the communication from the Abstract and
Title Insurance Co. in regard to amount necessary to redeem some lots
' in Seashore Colony Tract was referred to the City Auditor for reply.
The two communications from James A. Fitzpatrick in regard
to the claim Riggs ve Kavanagh & Twohy, which was for work done
outside the City, was referred to the City Attorney for attention.
On motion of Councilman F. B. Modjeska seconded by Councilman
Fred W. Young and carried, the request of Fred Keller for permission
to place a landing float in front of Lots 4 and 5, Block 423,
Lancaster Addition, was allowed.
On motion of Councilman Fred W. Young seconded by Councilman
H. H. Williamson and oarried, the communication from the Balboa
Angling Cfub thanking the Council for changing the fishing boat
license, was filed.
On motion of Councilman Fred W. Young seconded by Councilman
F. B. Modjeeka and oarried, the application of Frank Sharps as
caretaker of trees, shrubs and parks, was referred to Peterson Bros.
On motion of Councilman F. B. Modjeska seconded by Councilman
H. H. Williamson and carried, the communication from Major C. P. Gross
in regard to the boat Muriel was filed.
On motion of Councilman F. B. Modjeska seconded by Councilman
Fred W. Young and carried, the request of J. R. Harlow for transfer
of his business license No. 474 to Mrs. Lusile Morris, was allowed.
On motion of Councilman Fred W. Young seconded by Councilman
F. B. Modjeska and carried, the application of Chas. E. Donnelly for
permission to construct a pier in front of Lot 2, Block 3, Section
5, Balboa Island was allowed.
The matter of complb.ints having been made from residents on
Section 5, Balboa Island in regard to the length of the pier of
S. F. Catey constfucted some time ago, was considered and on motion
of Councilman L. S. Wilkinson seconded by Councilman H. H. Williamson
and carried, the City Engineer was instructed to make a survey of
the pier and if found to be too long to demand him to out it down.
A Grant Deed to property in the channel between Bay Island
and the mainland was presented, and on motion of Councilman L. S.
Wilkinson seconded by Councilman H. H. Williamson and oarried, the
Deed was referred to the City Attorney to pass on.
The matter of leasing some tidelands on the north side of
the north bay to J. A. Beek was brought up for discussion and
petitions were read for and against, and any one present was given
the opportunity to voice their sentiments in the matter. After a
lengthy discussion the Mayor called on the individual members of
the Council for their opinion in the matter, and they all expressed
themselves as being favorable to the lease, but that the conditions
of the lease would have to be gone into thoroughly with Mr. Beek.
On motion of Councilman F. B. Modjeeka seconded by Councilman Fred
W. Young and oarried, the matter was referred to the Committee of
the Whole for consideration with Mr. Beek.
The communication from the Orange County Improvement Assn.
asking about a crossing over the Pacific Electric tracks at 28th
Street was considered, and on motion of Councilman Fred W. Young
seconded by Councilman F. B. Modjeska and carried, the Clerk was
instructed to notify them that the matter had been taken up with
the Railway Co. but no reply had been received as yet.
A blank petition was presented for the formation of an
improvement district from Alvarado to B Streets for the widening
of Central Avenue, which was considered and on motion of Councilman
F. B. Modjeeka seconded by Councilman Fred W. Young and carried,
the circulation of the petition was placed in the hands of Chas. H.
Way and to be returned for the next meeting.
On motion of Councilman L. S. Wilkinson seconded by Councilman
Fred W. Young and carried, the demands requiring transfers were to
be allowed after the proper transfers are made.
On motion of Councilman Fred W. Young seconded by Councilman
F. B. Modjeska and carried, the demand of the Newport Nexus for a back
bill of printing for the Harbor Master, was allowed.
on motion of Councilman L. S. Wilkinson seconded by Councilman
F. B. Modjeska and carried, the demands which were in proper fo7rm and
approved by the Finance Committee, were allowed and warrants to be
drawn for same.
On motion of Councilmen H. H. Williamson seconded by Councilman
Fred W. Young and carried, a recess was taken for the Committee of the
Whole to meet.
After the recess Mayor Richter again called the meeting to
order.
Councilman L. S. Wilkinson introduced a Resolution entitled:
A RESOLUTION FOR LEASE OF TIDELANDS AND OTHER REAL'
PROPERTY ADJACENT THERETO OF THE CITY OF NEWPORT BEACH.
The Resolution was read, considered, designated RESOLUTION
N0. 441, and upon call of the roll passed by the following vote, to -wit:
AYES, Councilmen L. S. Wilkinson, F. B. Modjeska, Fred W.Young,
H. H. Williamson and Mayor Conrad Richter.
NOES, Councilmen None.
ABSENT, Councilmen None.
The matter of a deed to the public library property which
is paid for but no deed secured as yet, was considered and on motion
of Councilman L. S. Wilkinson seconded by Councilman H. H. Williamson
and carried, the details of the transaction were to be given to the
City Attorney to arrange for the deed.
Councilman L. S. Wilkinson, who is a member of the Library
Board, asked for an appropriation for the purpose of enlarging the
library building and on his motion seconded by Councilman F. B. Modjeska
and carried, $1600.00 was set aside out of the library fund for an
addition to the present library building.
Norman Robotham asked for an appropriation of $500.00 to be
used by the Pacific Highway Association for putting Newport Beach on
the road maps which they are getting out. The matter was considered
and on motion of Councilman F. B. Modjeska seconded by Councilman
Fred W. Young and carried, $500.00 was allowed out of the advertising
fund for this purpose, same to be paid about January 1, 1928. '
There being no further business on motion of Councilman F. B.
Modjeska seconded by Councilman Fred W: Young and carried, the meeting

•'The City Council of the City of Newport Beach met in regular
adjourned session at 7:30 o1clock P. M. on above date. The meeting
was called to order by Mayor Conrad Richter.
The roll was called showing the full Council present.
'The minutes of the previous meeting were lead and approved
as read.
Councilman H. H. Williamson stated that the Fire Committee
would report favorably on allowing the Fire Department to purchase
the boots, pants and helmets asked for, and also to allow them an extra
fireman as relief man, and on his motion seconded by-Councilman Fred
W. Young and carried, the expense of supplies and the additional
fireman as relief man were authorized.
On motion of Councilman L. S. Wilkinson seconded by Councilman
F. B. Modjeska and carried, the communication from the Planning
Commission recommending the employment of Gordon Whitnall to do the
preparatory work and draft a zoning ordinance for the City at an
approximate cost of $2,400.00,•was referred to the Committee of the
Whole for consideration.
The City Attorney was granted additional time until next
meeting to prepare the fishing boat license ordinance.
