Mr. Mc Cormack asked for a refund on his taxes erroneously
assessed in 1925 and 1926 and the matter was referred to the City
Attorney upon information furnished by the City Assessor.
On motion of Councilman H. H. Williamson seconded by
Councilman Fred W. Young and carried, a recess was taken for an
executive session.
After the recess Mayor Richter again called the meeting•to
order.
There being no further business on motion of Councilman H.
' H. Williamson seconded by Councilman Fred W. Young and carried, the
meeting adjourned Sine Die.

The City Council of the City of Newport Beach met in regular
session at 7 :30 o'clock P. M. on above.date. The meeting was called
to order by Mayor Conrad Richter.
The roll was called showing the full Council present.
The minutes of the previous meeting were read, corrected
and approved.
' The.reports of the heads of departmrnts were read, and on
motion of Councilman F. B. Modjeska seconded by Councilman Fred W.
Young and carried, the reports were accepted and filed.
The report of the Committee appointed to look into the matter
of the outfall sewer line was considered, and on motion of Councilman
Fred W. Young seconded by Councilman F. B. Modjeska and carried, the
report was accepted and the recommendations to be carried out, except
that no appeal is to be made to the Grand Jury at this time, but to
be taken up with the Sanitation District first. The Committee was
continued.
The communications were read and acted upon as follows:
The application of C. G. Vam Hook of Long Beach for permission
to anchor a'boat 1000 feet east of the County wharf to be equipped
as a tea -room was considered, and on motion of Councilman L. S.
Wilkinson seconded by Councilman H. H. Williamson and'earried, the
Clerk was instructed to reply informing Mr. Van Hook that the Harbor
Master will probably assign him an anchoring place, but that he will
have to take out a business license.On motion of Councilman L. S.
Wilkinson seconded by Councilman Fred W. Young and carried, the
communication from the California Conference on City Planning was
referred to the City Attorney for a recommendation.
The communication from Chief of Police Winn in regard to the
Police force and suggesting transfer of funds from the salary fund to
various other accounts was considered, and on motion of Councilman
L. S. Wilkinson seconded by Councilman Fred W. Young and carried,
' the Aransfers were allowed and $1,900.00 was placed in the Planning
Commission account toward the expense of zoning the City.
The communication from the League of California Municipalities
in regard to a uniform traffic ordinance, copy of proposed ordinance
being attached, was considered, and on motion of Councilman H. H.
Williamson seconded by Councilman Fred W. Young and carried, the same
was referred to the Parking Committee, Police Committee and Street
Superintendent for study and a recommendation.
The communication from Le Moyne Ellis, Park Superintendent
and one from Burns- McDonnell -Smith Engineering Co. were filed.
The communication of Paul F. Johnson of Altadena to the
Newport Harbor Chamber of Commerce in regard to the entrance to the
bay, was discussed, and on motion of Councilman L. S. Wilkinson
seconded by Councilman H. H. Williamson and carried, the Clerk was
instructed to reply that the Council has under consideration the
improvement of the channel, and on account of the channel bed and the
currents shifting so rapidly of_late it was not considered safe and the
channel markers were allowed to be removed. The Clerk was also to
give him the tax rate asked for.
On motion of Councilman L. S. Wilkinson seconded by Councilman
F. B. Modjeska and carried, the Clerk was instructed to notify Capt.
0. Eliason to apply to the Harbor Master for anchoring ground for the
boat Muriel if floated.
On motion of Councilman H. H. Williamson seconded by
Councilman F. B. Modjeska. and carried, the offer of MrB. A. Ramon of
Balboa to sell the City 165 feet of bay frontage, was referred to the
Committee of the Whole for consideration.
On motion of Councilman H. H. Williamson seconded by
Councilman Fred W. Young and carried,, the request of Mrs. Edna Swanson
for transfer of her business license to Mrs. Della Erquhart, was
granted.
On motion of Councilman H. H. Williamson seconded by
Councilman F. B. Modjeska and carried,,the request of J. P. Hormen
for permission to construct a pier in front of Lot S, Block 223, Section
A, Newport Beach, was allowed subject to the will of the Council.
On motion of Councilman Fred W. Young seconded by Councilman
H. H. Williamson and carried, the advertising expenditures of the
Newport Harbor Chamber of Commerce of $465.00 from December 15th to
January 15th 1925, were allowed.
Mayor Richter reported for the Committee of the Whole on the
communication from the Women's Civic League with the resolution adopting
plans and the notice for advertising for bids for improvement of the
park, and on motion of Councilman L. S. Wilkinson seconded by Councilman
F. B. Modjeska and carried, the report was accepted and the Clerk
instructed to write them that while the Council would life to see the
Park improved as they planned, there would be no funds available out
of this years income for its but they were doing some planting around
the Comfort Station so that it would not be so conspicuous to the
public. Also to suggest to them that the best way to get the Park
improved would be to vote a tax for park improvement of 50 or 100 on
each $100.00 of assessed valuation.
Mayor'Conrad Richter also reported for the Committee of the
Whole on the communication from D. W. Pontius.in regard to widening
Central Avenue; that the Council would agree to the exceptions contained
in his letter, and on motion of Councilman L. S. Wilkinson seconded by
Councilman Fred W. Young and carried, the report was accepted and the
communication referred to the City Engineer to so notify them.
On motion of Councilman H. H. Williamson seconded by
Councilman Fred W. Young and carried, the Clerk was insouo$ed to
acknowledge receipt of the communication from the Newport Harbor Chamber
of Commerce for more adequate pilotage service in the bay, and inform
them that the matter will be taken up and acted upon before the next
season opens up.
ORDINANCE NO. 327, entitled:
AN ORDINANCE OF THE CITY OF NEWPORT BEACH BY THE CITY
COUNCIL AS THE LEGISLATIVE BODY THEREOF, DECLARING ITS
INTENTION TO CALL At ELECTION WITHIN A PROPOSED MUNICIPAL
IMPROVEMENT DISTRICT IN SAID CITY, AS DESCRIBED IN A PETITION
FILED FOR THAT PURPOSE, OR AS SAID DISTRICT MAY BE HEREAFTER
MODIFIED, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED
ELECTORS OF SAID DISTRICT, THE PROPOSITION OF AUTHORIZING
THE ISSUANCE AND SALE OF BONDS OF SUCH DISTRICT IN THE MANNER
AND FOR THE PURPOSES SET FORTH IN THIS ORDINANCE OF INTENTION:
ACCURATELY DESCRIBING THE EXTERIOR BOUNDARIES OF THE PROPOSED
MUNICIPAL IMPROVEMENT DISTRICT, SETTING FORTH A GENERAL
DESCRIPTION OF THE PUBLIC IMPROVEMENTS PROPOSED TO BE
ACQUIRED AND CONSTRUCTED THEREIN, THE ESTIMATED COST OF THE
PROPOSED PUBLIC IMPROVEMENTS AND OF THE INCIDENTAL EXPENSES
IN CONNECTION THEREWITH, FIXING A DATE, HOUR AND PLACE FOR
THE HEARING OF PROTESTS, AND THE DATE ON WHICH THE ELECTION
WILL BE CALLED AND HELD IN SAID DISTRICT, REFERRING TO A MAP
SHOWING THE EXTERIOR BOUNDARIES OF SAID DISTRICT WITH RELATION
TO THE TERRITORY IMMEDIATELY CONTIGUOUS THERETO, AND A GENERAL

CAME UP FOR FINAL PASSAGE., WAS READ, CONSIDERED, AND UPON
call of the roll passed by the following vote; to -wit:
AYES, Councilmen L.S. Wilkinson, F.B. Modjeska, Fred W.Young,
H. H. Williamson, Mayor Conrad Richter.
NOES, Councilmen None.
ABSENT, Councilmen None.
On motion of Councilman L. S. Wilkinson seconded by Councilman
H. H. Williamson and carried, the demand of Peterson Brothers
approved by Le Moyne Ellis, Park Superintendent, was allowed, and the
demands which were in proper form and signed and approved by the
' Finance Committee, were allowed and warrants to be drawn for same. .
On motion of Councilman H. H. Williamson seconded by
Councilman Fred W. Young and carried, a recess was called for the
Committee of the Whole to meet.
After the recess Mayor Richter again called the meeting to
order.
A question in regard to the tidelands on the north side of
the bay at Balboa with the Irvine Company was considered, and on
motion of Councilman L. S. Wilkinson seconded by Councilman H. H.
Williamson and carried, Lew H. Wallace was appointed a Committee.of.one
to confer with James Irvine Sr. and Jr. in the tidelands controversy,
and if necessary for him to go to San Francisco to do so his expenses
to be paid by the City.
On motion of Councilman L. S. Wilkinson seconded by Councilman
Fred W. Young and carried the City Engineer was instructed to include
in the maps he is checking in the tidelands suits, a 40 foot road as
described by Attorney J. J. Wilson along the Santa Ana River bed from
the Coast Highway at Bitter Point easterly to the bridge across the.
bay on Central Avenue, to definitely locate the property lines in
that district.
On motion of Councilman F. B. Modjeska seconded by Councilman
Fred W. Young and carried, Mr. Gordon Whitnall was to be era toqed as
zoning expert for the City of Newport Beach at a salary of 12,400.00
for the complete work, and covering approximately six months time.
On motion of Councilman L.. S. Wilkinson seconded by
' Councilman F. B. Modjeska and carried, the bond of Peterson Brothers
in the sum of $500.00 covering the maintenance of trees on Corona Del
Mar, was to be approved by the Council when approved by the City
Engineer. I .
There being no further business on motion of Councilman F..B.
Modjeska seconded by Councilman Fred W. Young and carried, the
meeting adjourned to 7:30 o'clock P. M. on Tues , cember 27, 1927-

The editorial .which appeared in the Harbor Herald recently
was gone into very thoroughly by Mayor Richter and City Engineer
Kresely,.and by reading Section 43 of the specifications-and a letter
Yrom the Hauser Construction Co. it was shown that the City w as
thoroughly protected from any damage done to the paving by reason of
hauling material over it.
