Hamon to sell the City some bay frontage was considered, and on motion of Councilman H. H. Williamson seconded by Councilman L. Be Wilkinson and carried, the Clerk was instructed to notify her that the City of Newport Beach does not care to purchase any bay frontage at this time, and to express-to her the thanks of the Board for her offer. There being no further business on motion of Councilman H. H. Williamson seconded by Councilman L. Be Wilkinson and ed, the meeting adjourned Sine Die. M. on above date. The meeting was called to order by Mayor Conrad Richter.. The roll was called showing the following members present: Mayor Conrad Richter, Councilmen L. Be Wilkinson and Fred W. Young. The minutes of the previous meeting were read and approved as read. As.Councilman H. H. Williamson was not present, Mayor Richter appointed Councilman Fred W. Young to act on the Finance Committee for the evening. As there was no funds budgeted for a relief fireman, on motion of Councilman L. S. Wilkinson seconded by Councilman Fred W. Young and carried, $360.00 was transferred from the unappropriated current expense fund to account No. 360-A relief fireman* On motion of Councilman L* S. Wilkinson seconded by Councilman Fred We Young and carried, the demands which were in proper form and approved by the Finance Committee were allowed and warrants to be drawn for same. As this was a legal holiday, on motion of Councilman L. Be Wilkinson seconded by Councilman Fred W. Young and carried, the meeting adjourned to 7:30 o'clock P. M. on Tuesday, January 3, 1928. The City Council of the City of Newport Beach -met in regular adjourned session at 7:30 o'clock P. M. on above date. The meeting was called to order by Mayor Conrad Richter. The roll was called showing the full Council present. The minutes of the previous meeting of Jan. 2, 1928 were read and approved as read. The reports of the heads of the departments were read and on motion of Councilman F. B. Modjeska seconded by Councilman Fred We Young and carried, the reports were accepted and filed. - The report from F.. L. Rinehart, Street Supt. stating it would cost about $660.00 to move the pavilion and widen Ocean Avenue two blocks, was considered, and on motion of Councilman H. H. Williamson seconded by Councilman F. B. Modjeska and carried, the report was accepted and approved, and the proper transfer of funds to be made covering the cost of same. The report of City Engineer Kressly recommending that the operation of the street care be left entirely with the Pacific Electric Railway Cb ; that a perpetual franchise be granted them for the poles, etc. in the new location, and the passenger landings be granted conditionally, was considered, and on motion of Councilman H. H. Williamson seconded by Councilman F. B. Modjeska and carried, the report was accepted and approved, and referred to the City Engineer ' to be carried out. The report of Capt. J. A. Winn ieaommending that the Police force'be out down one man for the present, was considered, and on motion of Councilman L. Be Wilkinson seconded by Councilman F. B. Modjeska and carried, the recommendation was approved and Capt. Winn was authorized to make the change. City Attorney lest reported that Mr. Scoville stated his clients in entering into a lease with the City for the property the rock is on, did not desire the City to waive any rights they might have in the land, but no action was taken at this time. The communications were read and acted upon as follows: The communication from Park Supt. Ellis ecplaining in regard to why pepper trees were planted in a portion of Pacific Drive in place of Washington Robustus, and stating they were willing to take opt the pepper trees and plant the Washingtons if the property owners wanted it, was considered, and on motion of C -juncilman H. H. Williamson seconded by Councilman Fred W. Young and carried, the Clerk was instructed to acknowledge the communication stating that the property owner's desired to have the trees planted as specified in the contract, and the letter was filed. The report from Street Superintendent Rihehart in regard to exchanging a team of worn out horses for a young team was considered, and on motion of Councilman H. H Williamson seconded by Councilman F. B. Modjeska and carried, the report was accepted and the Street Superintendent instructed to make the exchange. On motion of Councilman H. H. Williamson seconded by Councilman F. B. Modjeska and carried, the request of the Newport Harbor Chamber of Commerce for advertising expenditures of $460.00 from January 15th to February 15, 1925 was allowed. On motion of Councilman F. B. Modjeska seconded by Councilman H. H. Williamson and carried, the requesy of the Newport Harbor Chamber of Commerce for use of the City Hall on Friday evening, Jan. 6th for a meeting of a joint High School Committee was granted. The joint communication from the Women's Civic League and the Newport Harbor Chamber of Commerce asking that a Park board be appointed was considered, and on motion of Councilman L. S. Wilkinson seconded by Councilman Fred W. Young and carried, the matter was referred to the City Attorney to report at the next meeting as to the legal right of a city of the sixth class to appoint such a Board. The communication from Capt. T. 117. Sheffield in regard to the beach washing out from Rocky Point to the Palisades Club, and asking for a meeting with W. S. Sparr to talk the matter of protection over, was considered, and on motion of Councilman H. H. Williamson seconded by Councilman Fred W. Young and carried, the Clerk was instructed to acknowledge the communication and tell him that he and Mr. Sparr will be notified of the next meeting of the Committee of the Whole to take the matter up. On motion of Councilman T. B. Modjeska 'seconded by Councilman Fred W. Young and carried, the communication from B. T. Baker of Santa Ana offering to sell the City some Crimson Flame Trees, was to be acknowledged and referred to the Park Superintendent. UNFINISHED BUSINESS. ORDINANCE N0. 325, entitled: AN ORDINANCE OF THE CITY OF NEWPORT BEACH BY THE CITY COUNCIL AS THE LEGISLATIVE BODY THEREOF, DEFINING AND ESTABLISHING THE BOUNDARIES OF A MUNICIPAL IMPROVEMENT DISTRICT IN SAID CITY, DESIGNATING THE NAME BY WHICH IT SHALL BE KNOWN AND CALLING AN ELECTION TO BE HELD WITHIN THE DISTRICT, AND PROVIDING FOR THE SUBMISSION TO THE QUALIFIED VOTERS THEREOF, THE PROPOSITION OF INCURRING A DEBT BY THE ISSUANCE OF THE BONDS OF SUCH DISTRICT FOR THE PURPOSES SET FORTH IN ORDINANCE OF INTENTION NO. 327, RECITING THE OBJECTS AND PURPOSES FOR WHICH THE PROPOSED INDEBTEDNESS IS TO BE'INCURRED, THE NATURE OF THE IMPROVEMENTS TO BE ACQUIRED AND CONSTRUCTED, THE ESTIMATED COST THEREOF, THE AMOUNT OF THE PRINCIPAL OF THE INDEBTEDNESS TO BE INCURRED THEREFOR AND THE RATE OF INTEREST TO BE PAID ON SAID INDEBTEDNESS, FIXING THE DATE ON WHICH SUCH ELECTION SHALL BE HELD, THE MANNER OF FOLDING THE SAME AND THE MANNER OF VOTING FOR OR AGAINST SAID PROPOSITION, came up for final passage, was read, considered, and upon call of the roll passed by the following vote, to -wit: AYES, Councilmen L ;S. Wilkinson, F.B. Modjeska, Fred W.Young, H: H. Williamson; Mayor Conrad Richter. NOES, Councilmen None. 'ABSENT, Councilmen None. This being the time set for'hearing protests on assessments made covering the work done by CJalker & Martin on Corona Del Mar under Resolution of Intention No. 427, and no protests having been filed and no one present wishing to be heard in the matter, thereupon Councilman F. B. Modjeska introduced a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH CONFIRMING THE ASSESSMENTS FOR THE IMPROVEMENT OF CERTAIN PORTIONS OF COAST BOULEVARD AND OTHER STREETS IN CORONA DEL MAR WITHIN SAID CITY. The resolution was read, considered, designated RESOLUTION N0. 444, and 'upon call of the roll passed.by the following vote, tp -wit: AYES, Councilmen L.S.Wllkinson,'F.B. M®djeska, Fred W.Young, H. H. Williamson, Mayor Conrad Richter. NOES, Councilmen None. ABSENT, Councilmen None. On motion of Councilman F. B. Modjeska seconded by Councilman H. H. Williamson and upon call of the roll duly carried, it was resolved' by the City Council of the City of Newport Beach that the hereto annexed @rant Deed from Mrs. G. E. Bulfinch, dated December 27, 19271 and the real property therein described, be and is accepted by the City of Newport Beach the grantee therein, and that a certified copy of this resolution be recorded with said deed. Councilman Fred W. Young introduced an ordinance entitled: An ordinance of the City of Newport Beach amendink Section 5 of Ordinance No. 322 which is an Ordinance prescribing certain rules for the parking of vehicles in the City of Newport Beach, prescribing the penalty for all violations and repealing portions of any ordinances of the Ctty of Newport Beach in conflict with said Ordinance. The Ordinance was read, considered, designated Ordinance No. 329 and referred to the City Attorney. The matter of the fishing boat license ordinance was brought up and the City Attorney stated he had not heard from J. K. Smith in regard to the matter, and on motion of Councilman F. B. Modjeska seconded by Councilman Fred W. Young and oarried, Harry H. Williamson was instructed to interview Mr. Smith in regard to the fishing boat license. NEW BUSINESS. Councilman H. H. Williamson stated that the term of office of Louis W. Briggs and Eugene Fenelbn on the Planning Commission had expired, and would' recommend their reappointment. Mayor Conrad Richter reappointed them as members of the Planning Commission to succeed themselves, and on motion of Councilman H. H. Williamson seconded by Councilman F. B. Modjeska and carried, the appointments were approved by the Council. Mayor Richter stated that the flag pole in front of the City Hall had blown down and thought a galvanized iron one should be put up with a police signal on top, which would cost about $150.00. The matter was discussed and on motion of Councilman H. H. Williamson seconded by Councilman Fred W. Young and carried, the pole was allowed and the necessary funds to be transferred to pay for same. Harbor Master Jay stated he thought he could get the kelp removed from the harbor entrance for approximately $50.00, and on motion of Councilman F. B. Modjeska seconded by Councilman Fred W. Young and carried, the Harbor Master was authorized to have the kelp removed at an expense not exceeding $50.00. C.� 1 L-A4i On-motion of Councilman L. S.-Wilkinson seconded by Councilman F. B. Modjeska and carried, demands No. 1790 and 1791, having been signed and approved by the Finance Committee, were alloyed and warrants to be drawn for same. Councilman F. B. Hodjeska was granted four weeks leave of absence as he was compelled to go to the Hospital for treatment. There being no further business on motion of Councilman Fred W. City Clerk. , Olty City Hall, Newport Beach, January 9, 1928. The City Council of the City of Newport Beach met in.regular session at 7:30 o'clock P. M. on above date. The meeting was called to order by Mayor Conrad Richter. The roll was called showing all members present except Councilman F. B. Modjeska. The minutes of the previous meeting were read and approved as read. Councilman H. H. Williamson was granted more time to adjust the fishing boat license with J. K. Smith. The communications were read and acted upon as follows: On motion of Councilman H. H. Williamson seconded by Councilman Fred W. Young and carried, the request of D. L. Scott for permission to construct a pier in front of Lot 6, Block 2, Section 5, Balboa Island, was allowed subject to the will of the Board. Petitions were presented signed by 258 residents and the officers of two Ladies Societies asking that Officer 0. E. Mitchell be� retained on the Police force, and on motion of Councilman L. S. Wilkinson seconded by Councilman H. H. Williamson and carried, the petitions were filed without action. On motion of Councilman H. H. Williamson seconded by Councilman Fred W. Young and carried, the communication from Hauser Construction Co. thanking the Council for their letter of appreciation .was filed. On motion of Councilman H. H. Williamson seconded by Councilman Fred W. Young and carried, the communication from the Standard Traffic Marker Co. was referred to the Chief of Police for his information. On motion of Councilman Fred W. Young seconded by Councilman H. H. Williamson and carried, the communication from Peterson Brothers in regard to authority for substituting trees on Corona Del Mar, was filed. The bond from the Hauser Construction Co. in the sum of $1,000.00 for one year to protect the City against any damage that might deyelope to the streets through their operations, was presented, and on motion of Councilman H. H. Williamson seconded by Councilman Fred W. Young and carried, the bond was accepted and filed. NE17 BUSINESS. Councilman H. H. Williamson introduced a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DECLARING THAT THE PUBLIC NECESSITY AND CONVENIENCE REQUIRES THE RECONSTRUCTION OF THE BRIDGE ALONG MARINE AVENUE CONNECTING THE MAINLAND WITH BALBOA ISLAND, AND AUTHORIZING THE CITY ENGINEER TO MAKE APPLICATION TO THE U. S. DISTRICT ENGINEER FOR A PERMIT TO CONSTRUCT THE SAME. The Resolution was read, considered, designated RESOLUTION N0. 445 and upon call of the roll passed by the following vote, to -wit:
