City Hall, Newport Beach, February 20, 1926.
The City Council of the City of Newport Beach met-in regular
adjourned session at 7:30 o'clock P. 1:. on above date. The meeting
i:as called to order by Mayor Richter.
The roll was called showing the full council present.
The minutes of the previous meeting were read and approved
as read.
Councilman dilkinson reported for his committee on the
lease with Rodger Bros. and King C. Gillette,. which met with some
opposition. The matter r:as discussed thoroughly and on motion of
JAI Councilman ',7illiamson seconded by Councilman Yodjeeka and carried, the
report was filed and the committee discharged.
On motionof Councilman 'Jilliamson seconded by Councilman
Young and carried, the matter of leasing the property asked for by
Rodger Bros. and Icing C. Gillette was referred to the Planning Commis -
sion for a recommendation at the next meeting.
The communications were read and acted upon as follows:
On motion of Councilman dilliamson seconded by Councilman
Young and carried, the communication from P. F. Garnett in regard to
membership in the International Fire Chiefs Assn. was filed.
On motion of Councilman Young seconded by Councilman :odjeska
and carried, the com.unication from John W. Scott of the Boulder Dam
Assn. was filed.
The communication from Frank L• .iathews reopening his request
for lease of the 19 foot strip at the bay end of 4th Street, met % :ith a
lengthly discussion and some objections. lifter considering the matter
for so::e time on notion of Councilman '.- .illiamson seconded by Council.::a,n
�Iodjeska and carried, the communication was referred to the Planning
Commission for study and report at the next meeting.
The communication from the Secretary of the Planning Commission
asking for more time on the A. Psi. Gibbs abandonment of a portion of ,ay
Avenue was considered, and on motion of Councilman Young seconded by
Councilman Lodjeska and carried, the Planning Commission was given until
next meeting to make their report on same.
On motion of Councilman 'a:odjeska seconded by Councilman
Young and carried, the request of Virginia R. Leffingwell for permission
to construct a pier in front of Lots 1 and 2, Block 250 East Side .iddi-
tion, was alloyed subject to the will of the Board.
. On motion of Councilman Williamson seconded by Councilman
Young and carried, the application of D. T. Lloyd for license to operate
a lunch counter and restaurant on Lot 1, Block AA, Tract 3231 Corona
Del ;Aar was allowed.
The communication from the -,,'omen's Civic League in regard to
a sprinkling system for the Park was considered, and on motion of
Cnixncilman '.111kinson seconded by Councilman ziodjeska and carried, the
communication was referred to the Water Supt. with instructions to
report at the ne;ct meeting on the cost of an adequate sprinkler system
for the park.
The communication from C. E. Price and E. V. S Pomeroy for
renewal of their garbage contract was considered, and on motion of
Councilman Williamson seconded by Councilman Young and carried, the
Clerk v,as instructed to advertise for bids for the garbage contract on
basis of 1, 2 and 3 years time.
The communication from W. J. Car.nichael, Secy. of the Orange
Co. Assn. of City Councils Calling attention to the next meeting to be
held in La Habra on Feb. 26th, 1928, was considered, and on motion of
Councilman uodjeska seconded by Councilman Young and carried, the Cleric
vas instructed to acknowledge the communication and notify hi :n that ,e
rill have as many go as possible.
On motion of Councilman .idlkinson seconded by Councilman
:.illiamson and carried, the communication from the Calif. State Board
of health in regard to the Santa Ana outfall sei:er, r:as to be acknor =lec.<.--

The matter of abandonment of a portion of an alley on Corona
Del uar as.:ed for by Fred Crosier was considered, and Councilman L. S.

Councilman Fred ',;'. Young thereupon introduced an ordin-
ance calling a, special election for the purpose of submittinc- tc the
electors residing; in the territory proposed by the petition to be
a.n sexed to the City of 1'.ewport Beach, the question whether such
territory shall be annexed to, incorporated in and made a part of the
City of 1:eeaport Beach, fixing the date of the election, directing the
giving of notice of the election, designating and establishing a
voting precinct for that purpose, and the place at which the polls will
be opened for such election, appointing the officers of such election,
describing the territory sought to be annexed aild directing t? :e
electors in such territory to vote upon such question in the manner
specified in said ordinance.

The petition of Chas. H. 'Jay and others heretofore filed
in the office of the City Clerk for the creation of a municipal
improvement district in the City of 1-el,port Beach, .a.s taken up for
final action. t.itnesses were sworn and testified and froni affidavits
on file it appears and the City Council finds:
1st. The petition is in writing and is signed. by 58
persons each ofvahom is a qualified elector of the City of Yeviport
Beach and resides within_ t=ie proposed municipal improvement district,
and they collectively constitute more than 10�o of the qualified
electors residing therein.
2nd. The signatures to the petition are the genuine
sic e -tunes of the qualified electors signing the petition, and the
same : :ere signed on the date therein shoim, and the signers reside
at t,ie place designated.

3rd.
The petition contains an accurate description of
the exterior boundaries of the proposed district and
the same is a part of and within the boundaries of
the City of Newport Beach.
4th.
The petition sets forth a general description of
the public improvement to be acquired and constructed
and is such as the City of Newport Beach is authorized
by law to acquire and construct.
5th.
The said improvements to be acquired and constructed
are necessary and the district described in.the petition
is benefitted by the said improvements.
Councilman
Harry H. Williamson thereupon introduced an
ordinance of
intention, entitled:
An Ordinance of the City of Newport Beach by the City
Council as the legislative body thereof, declaring its
intention to call an election within a proposed municipal
improvement district in said City, as described in a
petition filed for that purpose, or as said district
may be hereafter modified, for the purpose of submitting
to the qualified electors of said district the proposi-
tion of authorizing the issuance and sale of bonds of
such district in the manner and for the purposes set
forth in this Ordinance of Intention; Accurately describ-
ing the exterior boundaries of the proposed municipal
improvement district, setting forth a general description
of the public improvements proposed to be acquired and
constructed therein, the estimated cost of the proposed
public improvements, and of the incidental expenses in
connection therewith, fixing a date, hour and place for
the hearing of protests, and the date on which the elec-
tion will be called and held in said district, referring
to a map showing the exterior boundaries of said district,
with relation to the territory immediately contiguous
thereto, and a general description of the proposed public
improvement on file in the office of the Clerk of the
City of Newport Beach, which map shall govern for all

details as to the extent of said district.
The
Ordinance was read, considered, designated Ordinance No. 333
and referred to the City Attorney.
On motion of Councilman Modjeska seconded by Councilman Young
and carried, the demand of the Citizens Harbor Committee for part of
the appropriation for dredging the'harbor entrance, having been approved
by the Finance Committee, was allowed and warrant to be drawn for same.
NEW BUSINESS
A plan of a pier which E. D Burge desired to construct at the
foot of Adams Street was presented, but as no request accompanied
same no action was taken.
On motion of Councilman Young seconded by Councilman Modjeska
and carried, the $1,000.00 appropriation for dredging the harbor
entrance was to be transferred from the current expense unappropriated
fund to account No. 332 Dredging.
Councilman Wilkinson stated he would like to have the follow -
ing propositions placed upon the ballot at the coming general election
April 9th:
"Shall a tax of 50 be provided and levied in each fiscal year
upon each $100.00 of assessed valuation for the improvement and mainten-
ance of a public library ?"
' "Shall the advertising fund of the City of Newport Beach voted
August 19, 1916 be reduced from 150 on each 5100.00 of assessed
valuation to 1001"
"Shall a,tax of 50 be provided and levied in each fiscal year
upon each $100.00 of assessed valuation for the improvement and main-
tenance of a public park?"
"Shall the City of Newport Beach adopt the managerial form of
government and a City Manager be appointed ? ".
The matter was discussed and on motion of Councilman Wilkinson
seconded by Councilman Williamson and carried, the City Attorney was
instructed to prepare an ordinance embodying the four propositions
stated and to be given the first reading tonight.
Mayor Richter declared a recess for the City Attorney to prepare
the Ordinance and for the Committee of the Whole to meet.

Councilman F. B. Modjeska introduced four ordinances con-
cerning the four propositions to be placed upon the ballot at
the general city election. The ordinances were read, considered,
designated ordinances No. 334: 335, 336 and 337, and referred to
the City Attorney to be put in shape for final passage.
The matter of the fire truck on Balboa Island being stored
in a private garage without expense to the City was considered, and
on motion of Councilman Young seconded by Councilman Williamson
and carried, the Clerk was instructed to write Mr. Richardson
thanking him for his generosity in storing the truck free of charge. ,
The matter of the refund asked for by Smith & Mc Farland
was considered, and on motion of Councilman Young seconded by
Councilman Modjeska and carried, the Clerk was instructed to notify
them that their request for refund was denied, and that the Board
expects to receive future settlements on that basis.
There being no further business on motion of Councilman
Young seconded by Councilman Modjeska and carried, the meeting
adjourned Sine Die.

The City Council of the City of Newport Beach met in
regular session at 7:30 o'.clock P. M. on above date. The meet-
ing was called to order by Mayor Richter.
The roll was called showing the full Council present.
The minutes of the previous meeting were read and approved
as read.
The reports of the heads of departments were read and on
motion of Councilman Modjeska seconded by Councilman Young and
carried, the reports were accepted and filed.
The regular order of business was dispensed with and the
matter of protests against the building of a foot bridge on
Goldenrod Avenue, Corona Del Mar was taken up at this time.
IN THE MATTER OF THE PROPOSEB)IMPROVEMENT OF CERTAIN
PORTIONS OF GOLDENROD AVENUE, CORONA DEL MAR.
This being the time fixed by Resolution of Intention No.
4501 passed on the 14th day of February, 19251 for hearing protests
in the matter of the improvement therein described, and certain
written protests having been filed with the City Clerk in said
matter, all of said protests were presented to and considered by ,
the City Council, and all persons desiring to be heard in the
matter of said protests were heard by said Council, whereupon
Councilman rred W. Young moved that Resolution No. 452 entitled,
"A Resolution overrulling protests in the matter of the improvement
of certain portions of Goldenrod Avenue within the City of Newport
Beach ".be adopted, wkich motion was seconded by Councilman F. B.
Modjeska and carried by the following vote:
AYES, Councilman Wilkinson, Modjeska, Young, Williamson,
Richter.
NOES, Councilman None
ABSENT, Councilman None.
