The ordinances were read, considered, designated ordinances No. 334; 335. 336 and 337, and referred to the City Attorney to be put in shape for final passage. The matter of the fire truck on Balboa Island being stored in a private garage without expense to the City was considered, and on motion of Councilman Young seconded by Councilman Williamson and carried, the Clerk was instructed to write Mr. Richardson thanking him for his generosity in storing the truck free of charge. ' The matter of the refund asked for by Smith & Mc Farland was considered, and on motion of Councilman Young seconded by Councilman Modjeska and carried, the Clerk was instructed to notify them that their request for refund was denied, and that the Board expects to receive future settlements on that basis. There being no further business on motion of Councilman Young seconded by Councilman Modjeska and carried, the meeting adjourned Sine Die. 1__� Mayor, :City Approved March 5, 1928. City Rall, Newport Beach, Mar 5, 1928 ' The City Council of the City of Newport Beach met in regular session at 7:30 o'.clock P. M. on above date. The meet- ing was called to order by Mayor Richter. The roll was called showing the full Council present. The minutes of the previous meeting were read and approved as read. The reports of the heads of departments were read and on motion of Councilman Modjeska seconded by Councilman Young and carried, the reports were accepted and filed. The regular order of business was dispensed with and the matter of protests against the building of a foot bridge on Goldenrod Avenue, Corona Del Mar was taken up at this time. IN THE MATTER OF THE PROPOSEB) IMPROVEMENT OF CERTAIN PORTIONS OF GOLDENROD AVENUE, CORONA DEL MAR. This being the time fixed by Resolution of Intention No. 450, passed on the 14th day of February, 1928) for hearing protests in the matter of the improvement therein described, and certain written protests having been filed with the City Clerk in said matter, all of said protests were presented to and considered by , the City Council, and all persons desiring to be heard in the matter of said protests were heard by said Council, whereupon Councilman rred W. Young moved that Resolution No. 452 entitled, "A Resolution overrulling protests in the matter of the improvement of certain portions of Goldenrod Avenue within the City of Newport Beach" be adopted, which motion was seconded by Councilman F. B. Modjeska and carried by the following vote: AYES, Councilman Wilkinson, Modjeska, Young, Williamson, Richter. NOES, Councilman None ABSENT, Councilman None. Councilman Harry H. Williamson introduced a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ORDERING THE IMPROVEMENT OF CERTAIN PORTIONS OF GOLDENROD AVENUE WITHIN SAID CITY. The Resolution was read, considered, designated RESOLUTION NO. 453 and upon call of the roll passed by the following vote: AYES, Councilmen Wilkinson, Modjeska, Young, Williamson, Richter. ' NOES, Councilmen None ABSENT, Councilmen None. Councilman F. B. Modjeska introduced a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DIRECTING CERTAIN WORK OR IMPROVEMENT TO BE DONE UNDER THE DIRECTION OF THE CITY ENGINEER OF SAID CITY. The Resolution was read, considered, designated RESOLUTION NO. 454 and upon call of the roll passed by the following vote: AYES, Councilmen Wilkinson, Modjeska, Young, Williamson, Richter. NOES, Councilmen None. ABSENT, Councilmen None. This being the time set for opening bids for a one to three - year garbage contract for the City of Newport Beach, the Board in open session publicly opened, examined and declared all sealed bids received for said contract, which bid was as follows: Price & Pomeroy of Santa Ana, lst year $500.00, 2nd and 3rd years $600.00. Inasmuch as there was only one bid the matter was discussed but as the old contract had expired and the garbage had to be taken care of, on motion of Councilman Young seconded by Councilman Modjeska and carried, the bid was accepted and the City Attorney instructed to draw up the contract and which was to be protected by a $1,700.00 bond. ' The report of the Planning Commission was read, and on motion of Councilman Modjeska seconded by Councilman Young and carried, the report was accepted and filed for future reference. The communications were read and acted upon as follows: The request of Capt. D. G. Dare for permission to build a landing pier and Marine Ways on the Storey property at 26th and Bay front, was considered, and on motion of Councilman Williamson seconded by Councilman Modjeska and carried, the communication was referred to the City Engineer for report and recommendation at the next meeting. The communication for the Newport Harbor Chamber of Commerce asking the transfer of funds from several accounts to other accounts and an appropriation of $1,515.00 for advertising from March 15th to April 15th was considered, and on motion of Councilman Williamson seconded by Councilman Young and carried, the transfers and expenditures were allowed. On motion of Councilman Williamson seconded by Councilman Young and carried, the communication from Capt. J. A. Winn in regard to shooting of firearms in the City, was referred to the City Attorney to draw up an ordinance covering same, and repealing any other ordin- ances regarding the shooting of firearms. On motion of Councilman Wilkinson seconded by Councilman William son and carried, the request of R. S. Briggs for transfer of $121.50 from account No. 337 Music to account No. 330 Insurance, was allowed. On motion of Councilman Modjeska seconded by Councilman Wilkin- son and carried, the request of S. A. Cundiff for transfer of $300.00 from account No. 482 -B to account No.480 -B office and collections, was allowed. On motion of Councilman Williamson seconded by Councilman Modjeska and carried, the request of F. W. Crocker for transfer of $200.00 from account 460 -C to account 461 auto maintenance, was allowed. On motion of Councilman Modjeska seconded by Councilman Young and carried, the communication from the Boulder Dam Assn- was referred to the Chairman of the Planning Commission. On motion of Councilman Williamson seconded by Councilman Modjeska and carried, the communication 8om the Western Construction Equipment Distributors in regard to the Exposition to be held March 7 to 11th was referred to the Street Supt. to attend if he desires. On motion of Councilman Wilkinson seconded by Councilman Williamson and carried, $1,000.00 was transferred from account 332 Misc. to account 449 General Engineering. -i r UNFINISHED BUSINESS ORDINANCE NO. 332, entitled: AN ORDINANCE OF THE CITY OF NEWPORT BEACH BY ITS CITY COUNCIL AS THE LEGISLATIVE BODY THEREOF, CALLING A SPECIAL ELECTION IN CERTAIN INHABITED TERRITORY CONTIGUOUS TO SAID CITY FOR THE PURPOSE OF SUBMITTING TO THE ELECTORS OF SAID TERRITORY THE QUESTION OF WHETHER OR NOTE THAT CERTAIN INHABITED TERRITORY DESCRIBED SHALL BE ANNEXED TO, INCORPO- RATED IN AND MADE A PART OF THE CITY OF NEWPORT BEACH: DESIGNATING THE SAID TERRITORY AS THE "BOULEVARD ADDITION TO NEWPORT HEIGHTS" AND FIXING A DATE ON WHICH SUCH ELECTION SHALL BE HELD, DETERMINING THE MANNER OF HOLDING SUCH ELEC- TION, DESIGNATING A SPECIAL ELECTION PRECINCT INCLUDING ALL OF SAID TERRITORY, NAMING ELECTION OFFICERS THEREFOR AND FIXING THEIR COMPENSATION, DIRECTING NOTICE TO BE GIVEN AS REQUIRED BY LAW AND PROVIDING THAT IN ALL PARTICULARS NOT SET FORTH IN THIS ORDINANCE, SUCH ELECTION SHALL BE HELD IN THE MANNER PROVIDED BY LAW FOR HOLDING MUNICIPAL ELECTIONS IN THE CITY OF NEWPORT BEACH, came up for final passage, was read, considered and upon call of the roll passed by the following vote: Richter. The matter of a minimum salary to be paid for a City Manager to be included in the ordinance was discussed, and on motion of Councilman Young seconded by Councilman Modjeska and carried, the minimum salary was set at $500.00 per month. ORDINANCE NO. 337, entitled: AN ORDINANCE OF THE CITY OF NEWPORT BEACH BY THE CITY COUNCIL AS THE LEGISLATIVE BODY THEREOF PROVIDING FOR THE ESTABLISHMENT OF THE CITY MANAGER FORM OF GOVERNMENT.AND PROVIDING FOR THE SUBMISSION OF THIS ORDINANCE TO THE ELECTORS AT THE NEXT REGULAR MUNICIPAL ELECTION OF THE CITY OF NEWPORT BEACH AND PROVIDING FOR THE GIVING OF NOTICE, came up for final passage, was read, considered, and'upon call of the roll passed by the following vote. AYES, Councilmen Wilkinson, Modjeska, Young, Williamson, Richter. NOES,, Councilmen None. ABSENT, Councilmen None. J. A. Beek brought up the matter of renewing the lease of the street ends at the ferry landings which was discussed, and on motion of Councilman Wilkinson seconded by Councilman Modjeska and carried, the lease was referred to the City Attorney to derive some method to satisfy Mr. Beek and the City still retain the use of the street ends. NEW BUSINESS Councilman L. S. Wilkinson introduced an ordinance entitled: AN ORDINANCE OF THE CITY OF NEWPORT BEACH BY ITS CITY COUNCIL AS THE LEGISLATIVE BODY THEREOF, CREATING THE OFFICE ' OF FIRE MARSHAL AND PRESCRIBING HIS POWERS AND DUTIES; ESTABLISHING A BUREAU OF FIRE PREVENTION AND PUBLIC SAFETY; PROVIDING FOR FIRST AID FIRE PROTECTION EQUIPMENT IN ALL PLACES OF PUBLIC HIRE AND SERVICE AND THE PROPER'MAINTENANCE THEREOF; AND REGULATING THE HANDLING AND STORAGE OF ALL HYDRO- CARBON FLUIDS, PAINTS, OILS, EXPLOSIVES AND INFLAMMABLE ARTICLES; THEREBY.PROVIDING FOR GREATER SAFETY TO LIFE AND PROPERTY. The Ordinance was read, considered, designated Ordinance No- 338 and on motion of Councilman Wilkinson seconded by Councilman Young and carried, the ordinance was passed to the second reading and referred to the City Attorney. Councilman Fred W. Young introduced anordinance entitled: On motion of Councilman Wilkinson seconded by Councilman Young and carried, the demands which were in proper form and approved by the Finance Committee, were allowed and warrants to be drawn for same. On motion of Councilman Wilkinson seconded by Councilman Young and carried, the demands of the Fire Department and Weather Station not approved-by the head of the department, were to be allowed when approved by the head of the department and the City Auditor. The demand of .Lucile Robins plc Cormack asking a refund of penalty on her taxes and assessments she allowed to.go delinquent awaiting payment of a former refund, was considered, and on motion of Councilman Wilkinson seconded by Councilman Modjeska and carried, the Clerk was instructed to notify her the refund cannot legally be made On motion.of Councilman Williamson seconded by Councilman Wilkinson and carried, $50.00 was transferred from account 332 to the planning commission fund. City Hall, Newport Beach, March 9, 1925 Pursuant to call thereof by the Mayor of the City of Newport Beach and notice delivered to each member at least three hours before the time specified for the meeting, the City Council met at the place and on the ' date above mentioned at 7:30 o'clock P. M. The meeting was called to order by Mayor Richter. The roll was called showing all members present except Councilman Modjeski. The call was read and the Council proceeded to consider the jubjects for which the meeting was called. The matter of appointment of election boards for the general municipal election to be held April 9, 192$, was considered, and it was ordered that for the purpose of holding the general municipal election in the City of Newport Beach on the 9th day of April, 1925, the five voting precincts established by the Board of Supervisors of the County of Orange and now existing in said City for holding general elections, shall be and constitute the five voting precincts for the holding of said AN ORDINANCE OF THE CITY OF NEWPORT BEACH BY ITS CITY COUNCIL AS THE LEGISLATIVE BODY THEREOF, CREATING A DEPARTMENT TO BE KNOWN AS THE DEPARTMENT OF ELECTRICITY; CREATING THE OFFICE OF CITY ELECTRICIAN AND PRESCRIBING HIS POWERS AND DUTIES; AND PROVIDING FOR-THE GREATER SAFETY TO LIFE AND PROPERTY BY GOVERNING AND REGULATING THE INSTALLATION OF ALL ELECTRICAL CONDUCTORS, APPARATUS AND MATERIAL OF ANY NATURE WHATSOEVER (EXCEPTING TELEPHONES) WHETHER INSIDE OR OUTSIDE OF ANY BUILDING OR UPON ANY STREET, ALLEY OR PUBLIC HIGHWAY WITHIN THE CITY OF NEWPORT BEACH. The ordinance was read, considered, designated Ordinance No. 339 passed to the second reading and referred to the City Attorney. ' On motion of Councilman Wilkinson seconded by Councilman Young and carried, the demands which were in proper form and approved by the Finance Committee, were allowed and warrants to be drawn for same.
