There being no further business on motion of Councilman Williamson seconded by Councilman Wilkinson and carried, the meeting adjourned to 7 :30 o'clock P. M. of Friday, April 13, 1928, and Mayor Richter was to invite the three newly elected members of the Council to sit in at the Council for instructions on unfinished matters of the City. Mayor, City of Newport Beach Approved April 13, 1928 City Clerk City Hall, Newport Beach, April 13, 1928 The City Council of the City of Newport Beach met in regular adjourned session at 7:30 o'clock P.M. on above date. The meeting was called to order by Mayor Richter. The roll was called showing all members present except Councilman Modjeski. The minutes of the previous meeting were read and approved. The communications were read and acted upon as follows: The communication from the Pacific Highway Association asking that an appropriation of $500.00 be budgeted this year as the City's quota of the Assn. advertising for the coming year, was considered, and on motion of Councilman Wilkinson seconded by Councilman Williamson and carried, the communication was filed and the Clerk instructed to later call the attention of the Council to the wisdom of appropriating the $500.00 for this purpose. On motion of Councilman Wilkinson seconded by Councilman Young and carried, the communication fromthe Universal Traffic Control Co. in regard to traffic signals was filed. The communication from the Fire Chief of Coronado, calling atten- tion to the Convention of Southern California Fire Chiefs in May, and t'hle communication from the League of California Municipalities in regard to a conference of city officials April 25th, were considered, and on motion of Councilman Wilkinson seconded by Councilman Young and carried, the communications were to be acknowledged and filed, and the Clerk instructed to call the Council's attention to them before the dates arrive. On motion of Councilman Wilkinson seconded by Councilman Young and carried, the application of John Peterson for license to sell waffles, potato chips, soft drinks, etc. on Lot 12, Block 10, Balboa Tract, was allowed. On motion of Councilman Young seconded by Councilman Wilkinson and carried, the application of Mrs. Sutherland for a license to conduct the business of Palmistry reading on yearly basis, was allowed providing she pays the daily license fee provided for in the ordinance. ' On motion of Councilman Young seconded by Councilman Williamson and carried, the request of F. P. McConnelly for transfer of his business license No. 492 to J. K. Bruner was allowed. On motion of Councilman Young seconded by Councilman Williamson and carried, theiequest of Harry Welch for lease of 150 feet of frontage on the County Channel was referred to the Planning Commission for consi- deration and recommendation at the earliest possible moment. The communication from Paul E. Kressly resigning as City Engineer and asking that his contract with the City be rescinded, was considered, and on motion of Councilman Wilkinson seconded by Councilman Young and carried', the resignation was accepted as of date April 16, 1928) and the conditions of the communication be complied with, and all plans, etc. already made for any work started to be turned over to his successor and all work in connection with the jobs be paid for on a per diem rate. 16 The Grant Deed of Harry 0. and Emma C. Thompson was presented and on motion of Councilman Williamson seconded by Councilman Young and upon call of the roll duly carried, it was resolved by the City Council of the City of Newport Beach that the hereto annexed grant and the real property therein described be and is accepted by the City of Newport Beach the grantee therein, and that a certified copy of this resolution be recorded with said deed. City Attorney West presented a deed from the City of Newport Beach to a portion of a street vacated in Seashore Colony Tract which was considered, and Councilman L. S. Wilkinson introduced a Resolu- tion entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DETERMINING THAT CERTAIN PROPERTY PARTICULARLY DESCRIBED IN A DEED DATED NOVEMBER 30, 19172 RECORDED IN BOOK 285 AT PAGE 368 OF DEEDS IN THE OFFICE OF THE COUNTY RECORDER OF THE COUNTY OF ORANGE, STATE OF CALIFORNIA IS NO LONGER REQUIRED FOR ANY PUBLIC USE BY THE SAID CITY OF NEWPORT BEACH EXCEPTING, HOWEVER, SUCH PORTIONS THEREOF AS ARE NOW INCLUDED IN PUBLIC STREETS WHICH HAVE BEEN DE- DICATED TO PUBLIC USE BY THE OWNERS OF ADJOINING PROPERTY AS SHOWN ON VARIOUS SUBDIVISION MAPS OF RECORDS AND AUTHOR- IZING AND DIRECTING THE MAYOR AND CITY CLERK OF SAID CITY TO EXECUTE AND DELIVER TO THE FRESENT LEGAL AND EQUITABLE OWNERS OF SAID STRIP OF LAND ALL THE RIGHT, TITLE AND INTEREST OF SAID CITY IN AND TO SAID STRIP BY QUITCLAIM DEED SUBJECT TO AND RESERVING EASEMENTS FOR THE PURPOSES OF PUBLIC STREETS OVER THOSE PORTIONS THEREOF AS ARE NOW INCLUDED IN PUBLIC STREETS OVER THOSE PORTIONS THEREOF AS ARE NOW INCLUDED IN PUBLIC STREETS WHICH HAVE BEEN DEDICATED TO PUBLIC USE BY THE"OWNERS OF ADJOINING PROPERTY AS SHOWN ON VARIOUS SUBDIVISION MAPS OF RECORD. The resolution was read, considered, designated RESOLUTION NO. 458 and upon call of the roll passed by the following vote: AYES, Councilman Wilkinson, Young, Williamson, Richter. NOES, Councilmen None. ABSENT, Councilman Modjeski. City Attorney West reported recommending the cancellation of the Second Installment of Taxes on Lot 43, Block A, East Newport which property now stands in the name of the State, and on motion of Councilman Young seconded by Councilman Williamson and carried, the recommendation was allowed. Ordinance No. 339 creating a department of electricity and creating the office of City Electrician, came up for final passage. The ordinance was considered and on motion of Councilman Wilkinson seconded by Councilman Young and carried, the ordinance was referred to the present City Electrician with instructions to study it and return at the next meeting with his comments. The City Attorney presented the agreements for sewer connec- tions on Tract 802 Beek's Island, and on motion of Councilman Young seconded by Councilman Wilkinson and carried, the connection fee was placed at $5.00 for each house connection. The Agreement was read, considered, and upon call of the roll accepted, the Mayor and City Clerk being authorized to sign the same by the following vote: AYES, Councilmen Wilkinson, Young, Williamson, Richter. NOES, Councilmen None. ABSENT, Councilmen Modjeski. Mayor Richter called a recess for the Committee of the Whole to meet with the newly elected Councilmen. After the recess Mayor Richter again called the meeting to order in regular session. The matter of retaining City Attorney West and City Engineer Kressly to complete the tideland suits which had been started or would be started, was considered,and on motion of Councilman Wilkinson seconded by Councilman Young an agreement was to be entered into with City Attorney West and City Engineer Kressly as presented, and the Mayor and City Clerk were authorized to sign the same by the following vote: Ayes, Councilmen Wilkinson, Noes, Councilmen None. Absent, Councilman Modjeski Young, Williamson, Richter. An agreement with the Irvine Company was presented granting to a �v ne L 7 r 17 the City an easement for road purposes to a strip of land 60 feet wide to connect tidelands with a public highway, which was discussed, and on motion of Councilman Wilkinson seconded by Councilman Young, the Mayor and City Clerk were authorized to sign the agreement after the same was signed by the Irvine Co. by the following vote: AYES, Councilmen 6dilkinson,Young, Williamson, Richter. NOES, Councilmen None. ABSENT, Councilman Modjeski. An agreement with the Irvine Company was presented giving them ' the right to enter upon certain tidelands for dredging purposes. The same was discussed and on motion of Councilman Wilkinson seconded by Councilman Young and Mayor and City Clerk were authorized to execute the agreement for the City by the following vote: AYES, Councilmen Wilkinson, Young, Williamson, Richter, NOES, Councilman None, ABSENT, Councilman Modjeski. Mayor Richter again declared a recess for the Committee of the whole to meet with newly elected councilmen on another matter. After the recess Mayor Richter again called the members together in regular session. A number of demands were presented and on motion of Councilman Wilkinson seconded by Councilman Williamson and carried, the demands having been signed and approved by the Finance Committee were allowed _ warrants to be drawn for same. There being no further business on motion of Councilman Young seconded by Councilman Williamson and carried, the meeting adjourned to 7 :30 o'clock P. The meeting was called to order by Mayor Richter. The roll was called showing the full Council present. The minutes of the previous meeting were read and approved. The communication from C- G. Rodger asking an extension of time to check over the new ordinance No. 339 which was referred to him, was considered, and on motion of Councilman Modjeski seconded by Councilman Williamson and carried, the communication was referred to the new Council for consideration. The communication from Gordon Whitnall in regard to payments due ' on his contract with the City, was considered, and on motion of Council- man Modjeski seconded by Councilman Williamson and carried, the communi- cation was referred to the new council for attention. The resignation of City Attorney West was read and on motion of Councilman Young seconded by Councilman Modjeski and carried, the resignation was accepted to take effect at the commencement of new business. The resignation of Street Supt. Rinehart was considered, and on motion of Councilman Modjeski seconded by Councilman Young and carried, the resignation was accepted effective at the commencement of new business.
