A number of demands were presented which had not been approved by the Auditor, and on motion of Councilman Williamson seconded by Councilman Claire and carried, the demands having been approved by the Finance Committee, were allowed subject to the approval of the Auditor. ORDINANCE N0. 346, entitled:* AN ORDINANCE OF THE CITY OF NEWPORT BEACH REPEALING ORDINANCE NO. 260 OF THE CITY OF NEWPORT BEACH AND ABANDON- ING ALL PROCEEDINGS HAD THEREUNDER. ' came up for final passage, was read, considered, and upon call of the roll passed bythe following vote: AYES, Councilmen Hilmer, Claire, Ellsworth, Williamson, Johnson NOES, Councilman None. City Hall, Newport Beach, May 7, 1928 ' The City Council of the City of Newport Beach met in regular session at 7:30 o'clock P. M. on above date. The meeting was called to order by Mayor Johnson. The roll was called showing the full Council present. The minutes of the previous meeting were read and approved as read. The reports of the heads of the departments were read, and on motion of Councilman Hilmer seconded by Councilman Claire and carried, the reports were accepted and filed. Councilman Hilmer reported that he had.investigated the matter of a Fire Hall and Comfort Station on Balboa Island, and.would not recommend the expenditure at this time, therefore no action was taken. Councilman Hilmer also reported that he had procured an Auditor to check up the books and expected to have a letter from him by this time but had not received it, so he would delay the report until next meeting. The communication from Water Supt. Cundiff in regard to the odor from the septic tank was considered, and on motion of Councilman Hilmer seconded by Councilman Ellsworth and carried, the communication was referred to the City Engineer for consideration with the Water Supt. and report at the next meeting. On motion of Councilman Hilmer seconded by Councilman Claire and carried, the communication from Water Supt. Cundiff in regard to the Hartford Insurance Co., was referred to the City Engineer for report. ' The cgmmunications were read and acted upon as follows: The communication from the Newport Harbor Chamber of Commerce in regard to licensing pedlers was considered, and on motion of Councilman Claire seconded by Councilman Hilmer and carried, the matter was referred to the Chief of Police to report on. On motion of Councilman Claire seconded by Councilman Ellsworth and carried, the request of E. H. Fairfield for transfer of his business license at 103 Main Street to I. A. Smith was granted. The communication from Antar Deraga asking for two week's vacation and two weeks leave of absence was considered, and on motion of Councilman Claire seconded by Councilman Hilmer and carried, Mr. Deraga was allowed two week's vacation on pay and two week's leave of absence from his duties. 25 The communication from the Newport Harbor Chamber of commerce asking that $1,000.00 be appropriated for the annual California to Honolulu Yacht Races was considered, and on motion of Councilman Hilmer seconded by Councilman Williamson and carried, the appropriation was allowed and the transfers made as recommended in the communication for same; also the other appropriations were allowed for expenditures from May 15th to June 15th. The communication from K. I. Fulton in regard to Indemnity Insurance on contract work being done for the City was considered, and on motion of Councilman Williamson seconded by Councilman Claire and ' carried, the matter was referred to the Contractor for the Foot Bridge on Corona Del Mar for consideration, and the City would expect him to protect them from liability tothe public. On motion of Oouncilman Hilmer seconded by Councilman Claire and carried, the telegram from Burdette Moody in regard to the Boulder Dam roject and the telegram from Geo.Whitlock asking an appropriation of 200.00 towards the expense of the delagation at Washington, were filed. On motion of Ooupjbilman Claire seconded by Councilman Williamson and carried, the request of Elbert B.Griffith for permission to construct a pier, was referred to the City Engineer for report. The communication from T. W. Sheffield in regard to indecencies on the beach on Corona Del Max was considered, and on motion of Councilman Williamson seconded by Councilman Ellsworth and carried, the matter was referred to the Police Committee and Chief of Police with power to act. On motion of Councilman Claire seconded by Councilman Hilmer and carried, the communication from C. W. Strayer asking that his property be placed in the industrial zone, was referred to the Planning Commission and zoning experts for attention. On motion of Councilman Ellsworth seconded by Councilman Claire and carried, the communication from the City Clerk of Long Beach in regard to the Pacific Southwest Exposition Dedication Ceremonies, was filed. On motion of Councilman Claire seconded by Councilman Ellsworth and carried, the request of B. England for license to run a Restaurant ' at. 501 Bay Front was granted. On motion of Countilman Ellsworth seconded by Councilman Claire and carried, the Clerk was instructed to post the Notice of Hearing in the case of the Pacific Coast Motor Coach Co. and the Pickwick Stages before the Railroad Commission,.on.the bulletin Board in the City Hall. On motion of Councilman Claire seconded by Councilman Hilmer and carried, the application of Marguerite Stevens for a position as stenographer was referred to Auditor Gant for attention. On motion of Councilman Hilmer seconded by Councilman Williamson and carried, the Notice of Hearing from the War Department on the appli- cation of the Pacific Telephone & Telegraph Co.to lay a cable under the bay was filed. The request of Wm. Simmons for transfer of his business license on Corona Del Mar to Mrs. Anna B.Davis was considered, and on motion of Councilman Claire seconded by Councilman Ellsworth and carried, the request was allowed. On motion of Councilman Ellsworth seconded by Councilman William- son and carried, the application of John P. Elsbach for permission to construct a pier on Lido Isla was aliowed.subject to the will of the Council. The communication from Fire Chief Crocker asking for a leave of absence to attend the Fire Chief's Convention at Coronado May 18, 19 and 20th was considered, and on motion of Councilman Hilmer seconded by Councilman Claire and carried the request was granted. On motion of Councilman Hilmer seconded by Councilman Ellsworth ' and carried, the communication from J. A. Beek Chairman of the Harbor Committee reporting on the harbor work and soliciting funds to complete certain work, was considered but laid over for action to next meeting to check up on the city funds. On motion of Councilman Hilmer seconded by Councilman Claire and carried, the reports of former Auditor Briggs of April 18th were placed on file. The communication from City Engineer Patterson recommending the appointment of J. A. Siegel as Assistant Engineer at a salary of $200.00 per month and mileage for auto wasconsidered, and on motion of Councilman Claire seconded by Councilman Hilmer and carried, the appointment was approved at the salary stated, to take effect May 8, 1928. 26 UNFINISHED BUSINESS. City Attorney Thompsmn presented the bond of Price and Pomeroy for the garbage contract which he had approved, and on motion of Councilman Williamson seconded by Councilman Claire and carried, the bond was accepted and filed. The tentative map of Lido Isle was again-taken up for approval. The same was discussed and on motion of Councilman Claire seconded by Councilman Ellsworth and carried, the mapwas to be approved if the 20 ft. alleys were widened to 24 foot and paved the full width. On motion of Councilman Williamson seconded by Councilman Ellsworth and carried, the demands which were in property form and approved by the Finance Committee were allowed and warrants to be drawn for same. Those requiring transfers were to be allowed when the property transfers are made. There being no further business on motion of Councilman Claire seconded by Councilman Ellsworth and carried, the meeting adjourned to 7:30 o'clock P. ' The City Council of the City of Newport Beach met in regular adjourned session at 7:30 o'clock P. M. on above date. The meeting was called to order by Mayor Johnson. The roll was called showing the full Council present. The minutes of the previous meeting were read and approved as read. Mr. Clyde A W. Hall of the American Conservation Club was present and wished to address the Council on the Boulder Dam matter and soliciting funds for same. No action was taken at this time however. Mr. Chandler and Dr. K. H. Sutherland of the County Health Dept., were present and explained their reasons why the City of Newport Beach should join the County Health Organization, and stating we were the only City in the County who had not joined. The matter was considered and on motion of Councilman Hilmer seconded by Councilman Ellsworth and carried, the matter was referred to the City Attorney to report on at the next meeting. The communications were read and actedupon as follows: On motion of Councilman Williamson seconded by Councilman Claire and carried, the request of Treasurer Gant for transfer of $2500.00 from the General Fund to Account 401 $600.00; No. 442 $400.00; No. 443 $500.00; No. 444-A $400.00 and No. 445 $600.00, was allowed. On motion of Councilman Hilmar seconded by Councilman William- son and carried, $1,500.00 was transferred from the General Fund to ' Account No. 449, General Engineering. The communication from R. D. Crenshaw & Co. quoting price on the audit of the City Books was considered, and-on motion of ouncilman Williamson seconded by Councilman Ellsworth and carried, the action of the Finance Committee in employing the Auditors was confirmed and the communication filed. On motion of Councilman Williamson seconded by Councilman Hilmar and carried, the communication of J. J. Schnitker asking to have Ocean Ave. in front of Block 21 finished and a bulkhead put in, was referred to the Street Committee to investigate and report on at the next meeting.'
