UNFINISHED BUSINESS.
City Attorney Thompsmn presented the bond of Price and Pomeroy
for the garbage contract which he had approved, and on motion of
Councilman Williamson seconded by Councilman Claire and carried, the
bond was accepted and filed.
The tentative map of Lido Isle was again-taken up for approval.
The same was discussed and on motion of Councilman Claire seconded by
Councilman Ellsworth and carried, the mapwas to be approved if the 20
ft. alleys were widened to 24 foot and paved the full width.
On motion of Councilman Williamson seconded by Councilman
Ellsworth and carried, the demands which were in property form and
approved by the Finance Committee were allowed and warrants to be
drawn for same. Those requiring transfers were to be allowed when the
property transfers are made.
There being no further business on motion of Councilman Claire
seconded by Councilman Ellsworth and carried, the meeting adjourned to
7:30 o'clock P. M. on Monday, May 142 1925. ^

The City Council of the City of Newport Beach met in regular
adjourned session at 7:30 o'clock P. M. on above date. The meeting
was called to order by Mayor Johnson.
The roll was called showing the full Council present.
The minutes of the previous meeting were read and approved
as read.
Mr. Clyde A W. Hall of the American Conservation Club was
present and wished to address the Council on the Boulder Dam matter and
soliciting funds for same. No action was taken at this time however.
Mr. Chandler and Dr. K. H. Sutherland of the County Health
Dept., were present and explained their reasons why the City of
Newport Beach should join the County Health Organization, and stating
we were the only City in the County who had not joined. The matter was
considered and on motion of Councilman Hilmer seconded by Councilman
Ellsworth and carried, the matter was referred to the City Attorney to
report on at the next meeting.
The communications were read and actedupon as follows:
On motion of Councilman Williamson seconded by Councilman Claire
and carried, the request of Treasurer Gant for transfer of $2500.00
from the General Fund to Account 401 $600.00; No. 442 $400.00; No. 443
$500.00; No. 444 -A $400.00 and No. 445 $600.00, was allowed.
On motion of Councilman Hilmer seconded by Councilman William-
son and carried, $1,500.00 was transferred from the General Fund to
Account No. 449, General Engineering.
The communication from H. D. Crenshaw & Co. quoting price on
the audit of the City Books was considered, and.on motion of Councilman
Williamson seconded by Councilman Ellsworth and carried, the action
of the Finance Committee in employing the Auditors was confirmed and
the communication filed.
On motion of Councilman Williamson seconded by Councilman
Hilmer and carried, the communication of J. J. Schnitker asking to have
Ocean Ave. in front of Block 21 finished and a bulkhead put in, was
referred to the Street Committee to investigate and report on at the
next meeting.'

The communication from K. I. Fulton asking that an ordinance be
passed for the protection of the trees, shrubs, etc. planted in the
parks, was considered, and on motion of Councilman Hilmer seconded by
Councilman Williamson and carried, the communication was referred to
the City Attorney to prepare an ordinance on same.
The communication from K. I. Fulton asking that additional tree
planting be done on Corona Del Mar to use the money remaining in the
tree planting fund, was considered, and on motion of Councilman Claire
seconded by Councilman Williamson and carried, the matter was referred
to the City Engineer and the Chairman of the Finance Committee for
' investigation and report.
On motion of Councilman Claire seconded by Councilman Williamson
and carried, the request of Katherine Webb for transfer of her apart-
ment house license to Harry Newton was granted.
The communication from Raleigh Arnold asking to lease a space in
the triangel North of the entrance to Newport pier for an ice cream
house, was considered, and on motion of Councilman Claire seconded by
Councilman Ellsworth and carried, the request was denied.
On motion of Councilman Hilmer seconded by Councilman Claire and
carried, the resignation of Stuart A. Cundiff as Water and Sewer Supt.
was accepted to take effect June lst, he to be allowed two weeks vaca-
tion from May 17th.
The two communications from the American Conservation Club of
E1 Centro in regard to the matter already presented by Mr. Clyde A.
Hall at the opening of the meeting was considered, and on motion of
Councilman Hilmer seconded by Councilman Ellsworth and carried, the
Clerk was instructed to notify them that inasmuch as we had sent in a
donation recently of $50.00 to the Boulder Dam Association the Council
felt that they had done all that we could.
On motion of Councilman Claire seconded by Councilman Ellsworth
and carried, the communication from John Elsbach in regard to work to
be commenced on Lido Isle was filed.
On motion of Councilman Williamson seconded by Councilman Ellsworth
and carried, the communication from Palos Verdes Homes Association in
regard to care of ocean frontage was filed
' On motion of Councilman Williamson seconded by Councilman Claire
and carried, the communication from John Conzelman confirming the changes
in the map desired by the Council, was referred to the City Attorney for
reply.
On motion of Councilman Claire seconded by Councilman Hilmer and
carried, the communication from Acting Chief of Police Hodgkinson re-
porting on the Sheffield complaint was filed.
'On motion of Councilman Ellsworth seconded by Councilman Claire
and carried, the communication from Acting Chief of Police Hodgkinson
reporting on the peddlers on the peninsula was filed.
The application of W. Baffa for license to conduct a live poultry
and bird store at 301 Palm Ave., Balboa, was considered, and on motion
of Councilman Claire seconded by Councilman Hilmer and carried, the
matter was referred to the Health Officer for investigation and report.
On motion of Councilman Claire seconded by Councilman Ellsworth and
carried, the application of W. E. Lindsay for license to run a lunch
stand near the shore end of Newport Pier was denied.
The City Clerk was instructed to notify the hoard of Education of
Santa Ana that wayor Johnson and Councilman Hilmer would be at the
dinner conference May 15th, 1928.
On motion of Councilman Ellsworth seconded by Councilman Claire
and carried,'the Clerk was instructed to notify Lambert, Ma Kee and
Turner that the matter of odor from the septic tank is being taken care of
On motion of Councilman Claire seconded by Councilman Ellsworth and
carried, the application of Edwin H. Porter for Chief of Police was
referred to the Police Committee.
The communication from J. K. Smith in regard to his lease on the
Newport pier was considered, and on motion of Councilman Ellsworth
by Councilman Hilmer and carried, the communication was referred to the '
City Attorney for investigation and a recommendation.
'The communication from R R. Hodgkinson asking that a resolution
be adopted allowing angle parking on the South side of Central Avenue
below B Street was considered, and'on motion of Councilman Ellsworth
seconded by Councilman Claire and carried, the communication was referred
to the City Attorney to prepare a resolution as asked for.
On motion of Councilman Williamson seconded by Councilman Claire
and carried,the communication in regard to a uniform building code was
referred to the Building Inspector and Councilman Ellsworth for investi-
gation and report.

The communication from J. A. Beek referring to the request of
the Assn. of Pacific and Far East Ports that we retain our membership
in the Assn. was considered, and on motion of Councilman Hilmer
seconded by Councilman Claire and carried, the renewal of membership
was authorized, and the Chairman of the Harbor Committee be instructed
to appoint some one to represent us at their meetings if he can find
some one willing to pay their own expenses.
On motion of Councilman Claire seconded by Councilman William-
son and carried, the communication from J. A. Beek laid over from last
meeting asking an appropriation for dredging, was filed as no funds
were available at this time.
On motion of Councilman Hilmer seconded by Councilman Claire
and carried, the demand of Frank Truman and the Chamber of Commerce
having been signed and approved by the Finance Committee, were allowed
and warrants to be issued for same.
ORDIiANCE N0. 342, entitled:
AN ORDINANCE OF THE CITY OF NEWPORT BEACH BY THE CITY
COUNCIL AS THE LEGISLATIVE BODY THEREOF, DEFINING AND
ESTABLISHING THE BOUNDARIES OF A MUNICIPAL IMPROVEMENT
DISTRICT IN SAID CITY, DESIGNATING THE NAME BY WHICH IT
SHALL BE KNOWN AND CALLING AN ELECTION TO BE HELD WITHIN
THE DISTRICT AND PROVIDING FOR THE SUBMISSION TO THE
QUALIFIED VOTERS THEREOF THE PROPOSITION OF INCURRING A
DEBT BY THE ISSUANCE OF THE BONDS OF SUCH DISTRICT FOR
THE PURPOSES SET FORTH IN ORDINANCE OF INTENTION NO. 3331
RECITING THE OBJECTS AND PURPOSES FOR WHICH THE PROPOSED
INDEBTEDNESS IS TO BE INCURRED, THE - MATURE OF THE IMPROVE=
MENT TO BE ACQUIRED AND CONSTRUCTED, THE ESTIMATED COST
THEREOF, THE AMOUNT OF THE PRINCIPAL OF THE INDEBTEDNESS

The matter of cancelling the lease of A.-R. Russell for furnish-
ing live bait on the Balboa pier and later transferred by him to Pl. G.
Wilkens, as they had failed to live up to the conditions of the lease,
was considered, and Councilman Paul B. Ellsworth introduced a resolu-
tion, entitled.:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH, CALIFORNIA, RELATING TO THE CANCELLATION OF A CERTAIN
LEASE MADE AND ENTERED INTO BY THE CITY OF NEWPORT BEACH AS
PARTY OF THE FIRST PART, TO A. R. RUSSELL AS PARTY OF THE
SECOND PART, FOR NON - PERFORMANCE OF THE TERMS AND CONDITIONS
OF SAID LEASE BY SAID PARTY OF THE SECOND PART A. R. RUSSELL,
SAID LEASE BEARING DATE THE DAY OF 1925, SAID LEASE
HAVING BEEN TRANSFERRED TO W. G. WILKENS, MAY 23, 1927, BY
AUTHORITY OF SAID CITY OF NEWPORT BEACH.
The Resolution was read, considered, designated RESOLUTION NO.
460 and upon call of the roll passed by the following vote:
AYES, Councilmen Hilmer, Claire, Ellsworth, Williamson, Johnson
NOES, Councilmen None

The matter of a vacancy in the head of the Water and Sewer
departments through the resignation of Mr. Cundiff, and also the matter
of a permanent Street Superintendent were considered, and on motion of
Councilman Hilmer seconded by Councilman Ellsworth and carried, R. L.
Patterson was appointed Supt. of Streets and Water and Sewer Supts. at
his present salary, and a proportionate amount of his salary to be
charged to each of these departments.
Mr. E. M. Burrist brought up the matter of again asking the
Pacific rlectric Railway Co to give the City an easement to a 10 foot
strip from 30th Street westerly to 45th Street, to be dirted so that the
property owners could have access to their property with a vehicle. The
matter was discussed and on motion of Councilman Hilmer seconded by
Councilman Williamson and carried, the matter was referred to the City
Engineer and Street Committee for investigation and report.

Councilman Hermann Hilmer introduced an ordinance fixing the
compensation of certain officers of the City of Newport Beach. The
ordinance was read, considered, designated Ordinance No. 347 and on
motion of Councilman Williamson seconded by Councilman Claire and
carried, the ordinance was passed to the second reading the referred
to the City Attorney.
Councilman Lloyd Claire introduced a Resolution determining
that angle parking be allowed on the south side of Central Avenue below
B, Street and also determining that same will not diminish the travel
to less than 20 feet. The Resolution was read, considered, designated
RESOLUTION NO. 461, and upon call of the roll passed by the following
vote:
AYES, Councilman Hilmer, Claire, Ellsworth, Williamson, Johnson
NOES, Councilmen None
ABSENT, Councilmen None.
City Attorney Thompson referred to the fact that a number of
City records were scattered in the offices of former City Attorneys and
thought he should be allowed to procure a fire proof cabinet for his
office and have the records all in one place. The matter was considered
and on motion of Councilman Hilmer seconded by Councilman Williamson
and carried, the expense of the cabinet was authorized at not to exceed
$50.00 and the City Attorney instructed to collect the papers and keep
in same.
There being no further business on motion of Councilman Claire
seconded by Councilman Ellsworth and carried, the ;meeting adjourned to
7:30 o'clock P. M. on Monday, May 28th, 1925.

City Hall, Newport Beach, May 15, 1928
Pursuant to call thereof by the Mayor of the City of Newport
Beach and notice delivered*to each member at least three hours before
the time specified for the meeting, the City Council met at the place
and on the date above mentioned at 7:30 o'clock P.M.
, The meeting was called to order by Mayor Johnson.
The roll was called showing the full Council present.
The call was read and the Council proceeded to consider the
subject for which the meeting was called.
Mayor Johnson explained that the meeting was called to consider
complaints in regard to the way the tree - planting and maintenance on
Corona Del Mar was being handled, and he called upon Councilman Hilmer
to explain his findings upon investigation of the matter. Councilman
Hilmer explained the conditions as he found them very thoroughly and wn,?i
recommend that the services of the Park Supt. and his assistant be
dispensed with and the matter handled through the engineering department
of the City, thereupon on his motion seconded by Councilman Claire and
carried, the report was accepted and the services of LeMoyne Ellis and
Frank D. Lewis to be terminated tonight, May 18th, and the Clerk instruc-
ted to deliver written notice to the Chief of Police for serving on them
the first thing tomorrow morning.
On motion of Councilman Hilmer seconded by Councilman Ellsworth
and carried, the City Engineer was instructed to serve written notice on
Peterson Brothers that the City Would expect them to comply strictly with
the contract and not to make any improvements or changes not included in
the specifications.
