City Hall, Newport Beach, June 25, 1925
Pursuant to call thereof by the Mayor of the City of Newport
Beach and notice delivered to each member at least three hours before
the time specified for the meeting, the City Council met at the place
and on the date above mentioned at 7:30 o'clock P. M.
The meeting was called to order by Mayor Johnson.
The roll was called showing the full Council present.
The call was read and the Council proceeded to consider the
matters for which the meeting was called.
The matter of making a dock charge for persons using the
landings on the wharves was taken up, and City Attorney Thompson gave
it as his opinion that the lease of J. K. Smith was in full force and
effect except that he only had the exclusive right to carry passengers
to and from his barge and could collect the 20¢ fare as heretofore.
The matter was discussed thoroughly and Councilman Claire
introduced a Resolution entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NE17PORT BEACH, CALIFORNIA, DECLARING THE NECESSITY FOR
PROVIDING FOR THE REPAIR AND UPKEEP OF THE CITY PIERS
AND LANDINGS WITHIN SAID CITY, AND PROVIDING FOR THE
PAYiAENT OF CERTAIN TOLLS OR FARES FOR PERSONS USING SAID
PIERS, WHARFS OR LANDINGS, AND PROVIDING FOR THE COLLEC-
TION OF SAID TOLLS, RATES OR FARES.
The Resolution was read, considered, designated RESOLUTION
NO, 463 and upon call of the roll passed subject to all the rights
which J. K. Smith may have by virtue of a lease dated January 1, 1925,
made by and between the City of Newport Beach as lessor, and R. J.
Shafer, J. K. Smith, C. E. Mc Farland and I. C. Sparks as lessees,and
concerning the landing on the Newport pier being the old Southern
Pacific .1harf, by the following vote:
AYES, Councilman Hilmer, Claire, Ellsworth, Williamson,
Johnson.
' NOES, Councilmen None.
ABSENT, Councilmen None.
The application of the Pacific Telephone & Telegraph Co. for
permission to lay conduit in Fourth Street, East Newport, was considered
and on motion of Councilman Hilmer seconded by Councilman Claire and
carried,the permission was granted the work to be done under the
general direction and supervision of our City Engineer.
The matter of appointment of a permanent Chief of Police was
next considered, and on motion of Councilman Claire seconded by
Councilman Ellsworth and carried, the temporary appointment of R. h.
Hodgkinson as Acting Chief of Police and Tax Collector, was made perman-
ent at a salary of 4235.00 per month to take effect July 1, 1925.
The communication.from i„rs• :airiam S. Porter, Secretary of
the Board of Library Trustees,. notifying the Council that the terms of
two members of the Library Board, J. A. Beek and Mrs. H. C. Sloan,
expires July let, was considered, and on motion of Councilman Claire
seconded by Councilman ;Jilliamson and carried, the communication was
accepted and filed. mayor Johnson then appointed Mrs. nay G. Burlingame
and H. L.,Sherman on the Library Board, and the Clark instructed to
notify them of their appointment.
The Lighting Committee were not ready to take up the matter of
City Electrician at this time and no action was taken.
The communication from the Pacific Electric Raili,ay Co. in
regard to work contemplated in Lunicipal Improvement District No. b,
' giving permission to the City to put oil and rock along their tracks
between Alvarado and B Streets to lay the dust under certain conditions,
.was considered, and on motion of Councilman Williamson seconded by
Councilman Claire and carried, the communication was referred to the Cii.
Engineer and City Attorney to report on at the next meeting.
On motion of Councilman Hilmer seconded by Councilman Claire
and carried, the City Engineer was authorized to take the necessary
steps to lay the.dust, and the City Attorney was instructed to draw up
the necessary resolution as desired by the Pacific Electric Railway Co.
in regard to replacing the road bed.
The communication from the Secretary of the Nevrport Harbor
Cha.nber of Commerce giving a report of his budget for the advertising
department for the coming fiscal year, was coi_sidered,and on motion of

Councilman Williamson seconded by Councilman Hilmer and carried, the
report was accepted and turned over to the Finance Committee for con-
sideration.
There being no further business on motion of Councilman
Claire seconded by Council Williamson and carried, the meeting adjourned.

The City Council of the City of Newport Beach met-in-regular
session at 7:30 o'clock P. M. on above date. The meeting was called
to order by 1ayor Johnson.
The roll was called showing the full Council present.
The minutes of the previous regular meeting were read and
approved.
The minutes of the special meeting of June 25, 1928 were
read and approved.
The reports of the heads of departments were read, and on
motion of Councilman Claire seconded by Councilman Ellsworth and
carried, the reports were accepted and filed.
The communications were read and acted upon as follows:
The resignation of Harbor Master, Tom 0• Jay, was considered
and on motion of Councilman Claire seconded by Councilman Ellsworth
and carried, the resignation was accepted and ivr. Jay allowed two weeks
vacation from July 1st on pay as requested.
On motion of Councilman Claire seconded by Councilman Hilmer
and carried, the Chief of Police was appointed Harbor Master without
additional salary.
On motion of Councilman Claire seconded by Councilman Ells-
worth and carried, the application of N. M. Perkins and Thomas Bouchey
as Harbor waster was turned over to the Chief of Police for cansidera-
tion and with power to act.
The communication from Geo. C. Hiner asking that his lease
on the Newport wharf expiring in September, be renewed as he wished to
go to considerable expense installing a pipe line for cleaning the
wharf, was considered, and on motion of Councilman Ellsworth seconded
by Councilman Claire and carried, the Council declared itself favorable
to renewing the lease, and the City Attorney was instructed to draw up
the lease as of date of expiration of the old lease.
The communications from W. J. Carmichael, H. K. Lane and R.
Arnold objecting to the warning signs as placed on the beach at 19th
and 15th streets was considered, and on motion of Councilman Williamson
seconded by Councilman Claire and carried, the communications were
referred to the Chief of Police and Police Committee with power to act.
On motion of Councilman Ellsworth seconded by Councilman
Claire and carried, the application of John Loth for lease on the Balboa
pier for a live bait concession was.granted,and the City Attorney
instructed to draw up the lease.
On motion of Councilman Williamson seconded by Councilman
Hilmer and carried, the application of R. F. Goings for permission to
construct a pier in front of Lot 2, Block 21, Balboa EastSide Addition,
and the application of T. E. Hammond for permission to construct a pier
on community property between Lots 12 and 13 on Bay Island, were allowed
subject to the will of the Council.
