Councilman Williamson seconded by Councilman Hilmer and carried, the
report was accepted and turned over to the Finance Committee for con-
sideration.
There being no further business on motion of Councilman
Claire seconded by Council Williamson and carried, the meeting adjourned.

City Hall, Newport Beach, July 2, 1928
The City Council of the City of Newport Beach met,-in-regular
session at 7:30 o'clock P. M. on above date. The meeting was called
to order by Mayor Johnson.
The roll was called showing the full Council present.
The minutes of the previous regular meeting were read and
approved.
The minutes of the special meeting of June 25, 1928 were
read and approved.
The reports of the heads of departments were read, and on
motion of Councilman Claire seconded by Councilman Ellsworth and
carried, the reports were accepted and filed.
The communications were read and acted upon as follows:
The resignation of Harbor Master, Tom 0• Jay, was considered
and on motion of Councilman Claire seconded by Councilman Ellsworth
and carried, the resignation was accepted and Kr. Jay allowed two weeks
vacation from July 1st on pay as requested.
On motion of Councilman Claire seconded by Councilman Hilmer
and carried, the Chief of Police was appointed Harbor Master without
additional salary.
On motion of Councilman Claire seconded by Councilman Ells-
worth and carried, the application of N. M. Perkins and Thomas Bouchey
as Harbor Master was turned over to the Chief of Police for considera-
tion and with power to act.
The communication from Geo. C. Hiner asking that his lease
on the Newport wharf expiring in September, be renewed as he wished to
go to considerable expense installing a pipe line for cleaning the
wharf, was considered, and on motion of Councilman Ellsworth seconded
by Councilman Claire and carried, the Council declared itself favorable
to renewing the lease, and the City attorney was instructed to draw up
the lease as of date of expiration of the old lease.
The communications from W. J. Carmichael, H. M. Lane and R.
Arnold objecting to the warning signs as placed on the beach at 19th
and 15th streets was considered, and on motion of Councilman Williamson
seconded by Councilman Claire and carried, the communications were
referred to the Chief of Police and Police Committee with power to act.
On motion of Councilman Ellsworth seconded by Councilman
Claire and carried, the application of John Loth for lease on the Balboa
pier for a live bait concession was.granted,and the City Attorney
instructed to draw up the lease.
On motion of Councilman Williamson seconded by Councilman
Hilmer and carried, the application of R. F. Goings for permission to
construct a pier in front of Lot 2, Block 21, Balboa EastSide addition,
and the application of T. E. Hammond for permission to construct a pier
on community property between Lots 12 and 13 on Bay Island, were allowed
subject to the will of the Council..

on motion of Councilman Williamson seconded by Councilman
Hilmer and carried, the application of L. A. Cox for license to
operate a health trainer on bicycle was allowed subject to the approval
of the Chief of Police and Police Committee.
On motion of Councilman Williamson seconded by Councilman
Claire and carried, the application of firs. R. T. Smith for license to
conduct a restaurant at 701 East Central was granted.
The application of Milo D. Eames for permission to construct
a pier in front of Lot 26, Block 1, Section 5, Balboa Island was
considered and on motion of Councilman Williamson seconded by Councilman
' Claire and carried, the application was referred to the City Engineer
for the customary two weeks.
On motion of Councilman Williamson seconded by Councilman
Hilmer and carried, the communication from the President of the uunicipal
Traffic League in regard to their annual convention in Los Angeles from
July 18th to 20th,was filed.
The communication from E. D. Burge asking permission to build
a 14 foot extension to the Washington Street wharf at Balboa was
considered, carefully, and on motion of Councilman Williamson seconded
by Councilman Ellsworth and carried, the matter was referred to a
committee consisting of the City Engineer, Councilman Hilmer, Frank Smith
and John C. Tuffree for investigation and report.
On motion of Councilman_ Hilmer seconded by Councilman �iilliam-
son and carried, the appropriations asked for by the Secretary of the
Newport Harbor Chamber of Commerce from July 15th to August 15th, amount-
ing to X750.00, were allowed.
The communication from A. J. Lenox for more playground equip-
ment was considered, and on motion of Councilman Williamson seconded by
Councilman Claire and carried, the communication was referred to the
street committee for report.
On motion of Councilman Hilmer seconded by Councilman Claire
and carried, the request of Treasurer Gant for transfer of 4'20,000.00
from the general fund to the current expense fund was granted.
The proposition of William Howard to act as Pound- kaster
without pay and asking for a 3 year lease on the City dump ground was
' considered, and on motion of Councilman Ellsworth seconded by Councilman
Claire and carried, the City Attorney was instructed to draw up a lease
on the city dump ground in favor of Mr.Howard for one year only.
The communication from the Southern California Edison Co.
asking permission to cross the channel with a cable at 14th Street for
electric service to Lido Isle was considered, and on motion of Councilman
Hilmer seconded by Councilman Claire and carried, the communication was
referred to the Harbor Committee for consideration and report.
On motion of Councilman Hilmer seconded by Councilman William -
son and carried, the communication from Hal Will Smith thanking the
Council for the foot gridge on Balboa Island was filed.
The application of H. W. Baum Co. for permit to construct a
pier for the owners of Lido Isle on the north side of the bay was
considered, and on motion of Councilman Williamson seconded by Councilman
Claire and carried, the Clerk was instructed to notify them that as the
location is outside the city limits it will be taken care of in the lease
The application of Holloway and 'dallace for renewal of their
license tooperate their flying boat on the bay was discussed carefully
and on motion of Councilman Ellsworth seconded by Councilman Claire and
carried, the application was denied.

Councilman Paul d. Ellsworth introduced a resolution entitled:
' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH RECOGNIZING THAT A CERTAIN RIGHT -oF -WAY BET17EEN THE
PACIFIC ELECTRIC RAILWAY COMPANY TRACKS AND PRESENT PAVEKENT
OF CENTRAL AVENUE BETWEEN ALVARADO STREET AND "B" STREET, IS
A PART OF THE RIGHT -OF -WAY OF THE PACIFIC ELECTRIC RAILWAY
COMPANY, A CORPORATION.
The Resolution was read, considered, designated RESOLUTIOI,i NO.
464 and upon call of the roll passed by the following vote:
AYES, Councilmen Hilmer, Claire, Ellsworth, Williamson, Johnson
NOES, Councilmen None.
ABSENT, Councilmen None.

A deed dated the 1st day of November, 1923, from the Pacific
Southwest Trust and Savings Bank, (formerly Los Angeles Trust and
Savings Bank), a corporation, tothe City of Newport Beach, a municipal
corporation, covering certain easements to construct, lay, operate,
maintain and repair a twelve inch diameter water pipe line, in, along,
over and across that certain piece, or parcel of land situated and be-
ing in the County of Orange, State of California, and more particularly
described as follows, to -wit:
Beginning at a point in the Northerly line of the aforesaid
Block B, which point is 4241.95 feet Westerly of the center
line of Whittier Avenue as said Whittier Avenue is laid out
and shown upon a map of the First'Addition to Newport Mesa
Tract as recorded in kiscellaneous Maps Book 5, Page 61,
Records of Orange County, California, said distance being
measured along the Northerly line of the aforesaid Block B
of the Banning Tract; thence South 46o 46' East 5751.30 feet
to a point, which point is at the intersection of the south-
erly prolongation of the Westerly line of the aforesaid
Whittier Avenue and the 4esterlyprolongation of the center
line of Sixteenth Street, as said Sixteenth Street is laid
out and shown upon a map of the Newport hiesa Tract, as
recorded in iiiscellaneous !a,aps Book 5, page 1, Records of
Orange County, California;tltence Easterly along the Westerly
prolongation of the center line of the aforesaid Sixteenth
Street a distance of 350.59 feet to a point in the Southwest-
erly line of the property conveyed by the Banning Company to
Stephen Townsend et ux, by deed recorded in Book 139, page
351, of Deeds, Records of Orange County, California,
was presented to the City Council of the City of Newport Beach, Calif.
WHEREUPON, Trustee Paul B.Ellsworth made a motion, duly
seconded by Trustee Williamson, and carried, that said deed be accepted
by said City of Newport Beach, and the Clark instructed to record the
same forthwith with the County Recorder ofthe County of Orange, State of
California. That said motion was carried by the following vote:
AYES, Councilmen Hilmer, Claire, Ellsworth, Williamson, Johnson
NOES, Councilmen None.
ABSENT, Councilmen None.
The communications from different parties in regard tothe ocean
frontage in front of Newport Bay Tract, being Lots A and B, received
recently, were considered, and on motion of Councilman Claire seconded
by Councilman Ellsworth and carried, the City Attorney was instructed to
communicate with the property oriners that an exchange of property as
they suggest is not desired or advisable.
The completed budget for the coming year as made up by the -
heads of the departments and gone over by the Finance Committee, was
presented, and on motion of Councilman Hilmer seconded by Councilman
Ellsworth and carried, the budget was acdepted as presented with $20,000
additional budgeted for harbor and jetty maintenance.
NEW BUSINESS
On motion of Councilman villiamson seconded by Council ran
Claire and carried, the demands having been signed and approved by the
Finance Committee, were allowed and warrants to be drawn for same.
On motion of Councilman Ellsworth seconded by Councilman Claire
and carried, Yd. A. Leonard was reappointed city PoliceJudge of the City
of Newport Beach at his present salary.
On motion of Councilman Ellsworth seconded by Councilman
Claire and carried, Eugene Fenelon was reappointed Building and Plumbing
I.spector for the coming year.
H. L. Sherman brought up the matter of Antar Derage leaving
the employ of the city and thought we should try and arrance to keep his
weather instruments here, as the weather station was good advertisement
for the city. The matter was discussed and on motion of Councilman
Williamson seconded by Councilman Hilmer and carried, Councilman Paul B
Ellsworth was appointed a committee of one to take up the matter with the
Chamber of Commerce and report at the next meeting.
There being no further business on motion of Councilman Claire
seconded by Councilman Williamson and carried, the meeting adjourned
to 7:30 o'clock P. M. on Monday, July 16th, 1928.
