Councilman Claire introduced a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DIRECTING CERTAIN WORK OR IMPROVEMENT TO BE DONE UNDER THE DIRECTION OF THE CITY ENGINEER OF SAID CITY. The Resolution was read, considered, designated RESOLUTION NO. 481 and upon call of the roll passed by the following vote: AYES, Councilmen Hilmer, Claire, Ellsworth, Williamson, Johnson. ' NOES, Councilmen None. ABSENT, Councilmen None. NEW BUSINESS. 1 The demand of Peterson Brothers for the first years mainte- nanoe of trees on Corona Del Mar was considered, and on motion of Councilman Claire seconded by Councilman Ellsworth and carried, the demand was allowed and warrant to be drawn for same. On motion of Councilman Hilmer seconded by Councilman Ellsworth and.carried, the demand of the City Tax Collector for assessments against City owned property, was allowed and warrant to be drawn for same. There being no further business on motion of Cpuncilman Claire seconded by Councilman Ellsworth and carried, the meeting adjourned to 7:30 o'clock P. M. on Monday, December 171 1928. The City Council of the City of Newport Beach met in regular adjourned session at 7 :30 o'clock P. M. on above date. The meeting was called to order by Mayor Johnson. The roll was called showing the full Council present. The - minutes of the previous meeting were read and approved as read. Councilman Ellsworth presented a report of the Committee appointed to meet with the Lido Isle people, that a proposition had been made and which was under consideration by the Lido Isle owners for a settlement of the differences in regard to the improvements. On motion of Councilman Claire seconded by Councilman Hilmer and carried, the report was accepted and ordered filed. On motion of Councilman Ellsworth seconded by Councilman Claire and carried, the petition for the improvement of Lido Isle was tabled for future consideration. Councilman Claire reported that the iron signal mast would cost about $125.00 and $50.00 more for installing, and he was granted more time to investigate the cost of a wooden mast. ' A number of demands for tax refunds which were left with the City Attorney to check over, were presented, and on motion of Councilman Claire seconded by Councilman Ellsworth and carried, the demands were allowed and warrants to be drawn for same. The application of aces Davis for permission to construct a pier at the bay end of 29th Street was discussed, but as the City could not allow private parties to construct piers on public property, on motion of Councilman Claire seconded by Councilman Ellsworth and -carried, the application was denied. The communications were read and acted upon as follows: The-communication from J. A. Siegel, Assistant Street Supt. in regard to shortage of shale, clay and gravel for use on the streets, -was considered, and on motion of'.Councilman Ellsworth seconded by Councilman Williamson and carried, the matter was turned over to the 66 City Attorney and Street Superintendent to take up with the Irvine Company and see if arrangements cannot be made for obtaining these materials along the bluff near the city limits. The communication from M. E. Jaffa and Robert G. Wray of the State Division of Sanitation in regard to the sale of fish on the beach, were considered, but inasmuch as there is to be a meeting of the fishermen called for tomorrow night to discuss this matter, on motion of Councilman Claire seconded by Councilman Ellsworth and carried, the communications were filed. On motion of Councilman Hilmer seconded by Councilman Claire and carried, the request of Fire Chief Crocker for two weeks vacation was granted. On motion of Councilman Williamson seconded by Councilman Hilmer and carried, 8 number of demands which were left over from last month, were allowed and warrants to be drawn for same. This being the time fixed for opening bids for certain work on certain portions of Marine Avenue and Park Avenue within said city of Newport Beach as contemplated by Resolution of Intention No. 477 of this Council, the Council in open session publicly opened, examined and declared all sealed bids received for said work, to -wit: 'J. A Contract with the Pacific Electric Railway Co. for widening the roadways in Central Avenue in Municipal Improvement District No. 6 was presented, and Councilman Paul B. Ellsworth introduced a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH APPROVING A CERTAIN AGREEMENT DATED THE 17TH DAY OF ` DECEMBER, 1928, BETWEEN THE CITY OF NEWPORT BEACH, A MUNICIPAL CORPORATION, PARTY OF THE FIRST PART AND IN SAID AGREEMENT REFERRED TO AS THE "CITY ", AND THE PACIFIC ELECTRIC RAILWAY COMPANY, A CORPORATION, PARTY OF THE SECOND PART AND IN SAID AGREEMENT REFERRED TO AS THE "RAILWAY ", AND DIRECTING AND AUTHORIZING THE MAYOR OF THE CITY OF NEWPORT BEACH TO SIGN SAID AGREEMENT ON BEHALF OF THE CITY OF NEWPORT BEACH, AND FURTHER DIRECTING AND AUTHORIZING THE CLERK OF SAID CITY OF NEWPORT BEACH TO ATTEST THE SAME. The Resolution was read, considered, designated RESOLUTION NO. 482 and upon call of the roll passed by the following vote: AYES, Councilmen Hilmer, Claire, Ellsworth, Williamson, Johnson. Councilman Lloyd Claire introduced a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DIRECTING THE ISSUANCE AND SALE OF BONDS OF MUNICIPAL 68 IMPROVEMENT DISTRICT N0. 6 OF THE CITY OF NEWPORT BEACH, DIRECTING THE GIVING OF NOTICE OF SALE, CREATING A FUND FOR THE RECEPTION OF THE PROCEEDS DERIVED FROM THE SALE OF SAID BONDS, AND PRESCRIBING THE FORM OF SAID BONDS AND INTEREST COUPONS. The Resolution was read, considered, designated RESOLUTION NO. 453 and upon call of the roll passed by the following vote: AYES, Councilmen Hilmer, Claire, Ellsworth, Williamson, Johnson. M. There being no further business on motion of Councilman Williamson seconded by Councilman Hilmer and carried, the meeting adjourned to 7 :30 o'clock P. The City Council of the City of Newport Beach met in regular session at 7:30 o'clock P. M. on above date. The meeting was called to order by Mayor Johnson. The roll was called showing the full Council present. The minutes of the previous meeting were read and approved as read. The reports of the heads of the departments were read and on motion of Councilman Williamson seconded by Councilman Claire and carried, the reports were accepted and filed. Councilman Claire reported that the signal mast for the jetty would cost $50.00 and "the Committee had secured it and was having it erected. Councilman Ellsworth reported in regard to the fishing stands on the beach, that the Committee found there was a City Ordinance pro- hibiting the construction of anything but a Class A building on the beach which would be prohibitive, therefore they could not recommend any relief from the present situation. On motion of Councilman William- son seconded by Councilman Claire and carried,the report was accepted. The communications were read but action on same was deferred to take up matters pertaining to Lido Isle. Attorney John J. Wilson asked permission to withdrav the petition filed with the Board some time ago for the improvement work on Lido Isle to make om or two changes and then refile it, and on motion of Councilman Williamson seconded by Councilman Claire and carried, the request was granted. The petition having been refiled was read and considered, and on motion of Councilman Williamson seconded by Councilman Claire and carried, the petition was accepted as amended, and the City Engineer instructed to prepare plans and specifications for the work in accordance with same upon the filing of a•bond by them in the sum of $18,000.00 to indemnify the City Engineer for said work. The License Agreement of the Warren Brothers Co. for the Warrenite Paving mixture, was presented, and on motion of COuncilman Claire seconded by Councilman Williamson and carried, the License Agreement was accepted and filed. r\D r -s LJ'
