petition on file herein, subject to certain modifications; subject
however to the petitioners filing a bond with the City Council which
shall meet with their approval; said bond to be filed within ten days.
The matter of the two license agreements was again considered,
and on motion of Councilman Williamson seconded by Councilman Claire
and carried, the two Agreements were referred to the City Engineer,
City Attorney and the Mayor to take up with the Lido Isle people and
report back to this Board.
On motion of Councilman Williamson seconded by Councilman
Hilmer and carried, upon acceptance and approval by the City Attorney
,
of the petitioners bond given to indemnify the City for work to be
started by the City Engineer on the plans and specifications for the
improvements on Lido Isle, the bond is to be in full force and effect.
_ G. C. Macleod, Secretary of the Newport Harbor Chamber of
Commerce referred to the fact that Antar Deraga had taken the rain
gauge instruments formerly.used at the weather station, away with him
and the Chamber of Commerce thought that the City should have some of
these instruments to measure the rainfall. The matter was considered
and on motion of Councilman Williamson seconded by Councilman Ellsworth
and carried, the purchase of the instruments was authorized at not to
exceed $50.00 out of the advertising fund.
There being no further business on motion of Councilman
Ellsworth seconded by Councilman Claire and carried, theeeting
adjourned Sine Die. / )

City Hall, Newport Beach, January 28, 1929
The City Council of the City of Nevrport Beach met in regular
adjourned session at 7:30 o'clock P. M. on above date. The meeting
was called to order by MayorJohnson.
The roll was called showing the full Council present.
The minutes of the previous regular meeting of January 7th,
the adjourned meeting of January 8th, and the special meeting of January
18th were read and approved as read.
Councilman Hilmer reported his investigations in regard to
the alley from 37th to 56th streets, that he found a letter from the
Pacific Electric Railway Company that they would only consider giving•
the 10 foot easement on condition that the alley be permanently o
improved, and as this was prohibitive no further action was taken at
this time.
Councilman Williamson was granted more time to report on the
commercial airport.
Councilman Hilmer was granted more time to make, a report on
the bulkhead along the Grand Canal as the Balboa Island people had not '
appointed their Committee as yet.
The Harbor Committee reported that there would be a public
meeting in the Schoolhouse next Wednesday night at 7:30 o'clock, and
the three Engineers appointed to make a report on what they considered
necessary to be done to protect the entrance, would be present to,
explain the matter fully and answer any questions asked.
City Engineer Patterson reported that the property owners
on C' >rona Del Mar wanted more expensive trees than those to be removed
but they were willing to pay the difference in price. More time was
granted the committee to look into the matter.

City Engineer Patterson reported that the Chamber of Commerce
had a Committee looking after the moving of the sign from in front
of E. Grill's Service Station in West Newport.
City Engineer Patterson's report in regard to moving the
ebetric light and telephone poles along Coast Boulevard between 22nd
Street and 24th Street was read and considered, and on motionof
Councilman Claire seconded by Councilman Ellsworth and carried, the
City Engineer was instructed to notify the Southern California
Edison Company that the City would request them to move their line
to run along the Pacific Electric right -of -way or down the alley in

conduit.
On motion of Councilman Claire seconded by Councilman
Williamson and carried, the report of City Engineer Patterson on the
dyke at the screening plant of the Santa Ana outfall sewer, was
accepted and filed.
The communications were read and acted upon as follows:
The request of E. A. Fussell for permission to put a box
in the entrance to Newport pier for distribution of.Rosicrucian
literature was considered, and on motion of Councilman Claire seconded
by Councilman Williamson and carried, the request was granted but to
be subject to the will of the Council.
On motion of Councilman Claire seconded by Councilman Hilmer
and carried, the application of C. G. Gustafson for license to run a
penny arcade at 107 Main Street, Balboa, was referred to the Chief
of Police with power to act.
On motion of Councilman Williamson seconded by Councilman
Claire and carried, "the application of R. C. Shores for license to
run a dance hall in the Osgood building in Tract 814, was granted.
On motion of Councilman Williamson seconded by Councilman
Claire and carried, the application of Murphy & Niman for license
to run a lunch stand in the Osgood building, Tract 814, was allowed.
On motion of Councilman Claire seconded by Councilman
Ellsworth and carried, the communication of P. T. Evans in regard to
ocean frontage in front of the Newport Bay Tract, was filed.
On motion of Councilman Williamson seconded by Councilman

Claire and carried, the application of Crandall Boat Works for
permission to construct a pier in front of Lot 1123, Tract 907, Lido
Isle, was granted.
On motion of Councilman Williamson seconded by Councilman
Claire and carried, the application of F. W. Ford for permission to
installanchor piles and a float in front of Lot 4, Block 21, Section
3, Balboa Island was referred to the CityEngineer for the customary
two weeks.
The communication from Mrs. Anna G. Bodman in regard to a
building purported to be moved in on a lot on 33rd Street was
considered, but on motion of Councilman Claire seconded by Councilman
Williamson and carried, the matter was referred to the Building
Inspector for investigation and report.
The communication from the Library trustees asking that
steps be taken for selling the oldlibrary property and the construction
of a new building, was considered, and on motion of Councilman William-
son seconded by Councilman Ellsworth and carried, the old library
property was to be advertised for sale in a display advertisement, and
the Board reserves the right to reject any and all bids; the City also
to have the use of the propertyfor 120 days or until the new building
is ready.
On motion of Councilman Claire seconded by Councilman
Ellsworth and carried, the communications from C. F. Longley, Clifton
J. Platt and Fred E. Burlew in regard to drainage and rubbish dumped
on certain portions of Corona Del Mar, were filed as the matters had

beem attended to by the Street Department.
On motion of Councilman Claire seconded by Councilman
Williamson and carried, the communication from Assemblyman Ted Craig
adknowledging receipt of Resolution No. 486 was filed.
The application of Ace Fowler for license to operate two hot
tamalie wagons to peddle on the streets was considered, and on motion
of Councilman Williamson seconded by Councilman Claire and carried, the
application was denied.
The communication from S. L. Hoke for permission to put some
playground equipment at the ocean end of 15th Street was considered, _..
on motion of Councilman Claire seconded by Councilmani Ellsworth and

carried, the Clerk was instructed to notify him that the ocean front
at that location was privately owned except for a 40 foot street.

On motion of Councilman Ellsworth seconded by Councilman
Claire and carried, the request of Steve Lazaar for transfer of his
peddling license to Henry Wallen was granted.
The leases from the Pacific Electric Railway Company
covering a drain pipe under their tracks at East Newport were con-
sidered, and on motion of Councilman Williamson seconded by Council-
man Hilmer and carried, the Mayor and City Clerk were authorized to
sign the same.
UNFINISHED BUSINESS
This being the time set for opening bids in the matter of a
sale of franchise for a pole line on Central Avenue between Alvarado
and "B" Streets the Board in open session publicly opened, examined
and declared all sealed bids received, the only bid-received being
one from the Pacific Electric Railway Co. in the sum of $10.00. No
one present offering to pay more, on motion of Councilman Claire
seconded by Councilman Hilmer and carried, the bid was accepted and
the franchise sold to the Pacific Electric Railway Company on their bid.
Councilman Harry H. Williamson introduced an ordinance
entitled:
AN ORDINANCE GRANTING PACIFIC ELECTRIC RAILWAY COMPANY, A
CORPORATION, AUTHORITY TOCONSTRUCT AND MAINTAIN POLES AND
WIRES IN CENTRAL AVENUE IN THE CITY OF NEWPORT BEACH.
The Ordinance was read, considered, designated Ordinance
No. 355 and upon motion of Councilman Williamson seconded by Council-
man Ellsworth and carried, the ordinance was passed to the second
reading and referred to the City Attorney.
A copy of the Decree of the Superior Court together with
deed to the Library property was presented by City Attorney Thdmpson
and Councilman Paul B. Ellsworth introduced a Resolution entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH ACCEPTING DEED DATED JANUARY 21, 1929, BETWEEN
J. M. BACKS, COUNTY CLERK, GRANTOR, TO CITY OF NEWPORT
BEACH, GRANTEE.
The Resolution was read, considered, designated RESOLUTION
NO. 487 and upb`n call of the roll passed by the following vote:
AYES, Councilmen Hilmer, Claire, Ellsworth, Williamson,
Johnson.
NOES, Councilmen-None.
ABSENT, Councilmen None.
On motion of Councilman Williamson seconded by Councilman
Claire and carried, the demand of 0. A. Ozenne for refund of taxes
on his boat, and a demand for stamped envelopes for the tax depart-
ment, having been signed and approved by the Finance Committee, were
allowed and warrants to be drawn for same.
The matter of building additional ticket booths on the
Newport pier was considered, and on motion of Councilman Williamson
seconded by Councilman Claire and carried, it was ordered that when-
ever any additional booths are required for the boat owners on either
pier, the Street Committee by authorized to construct them without
any further action from the Board.
The matter of disposing of the old shack near Bitter Point
was discussed, and on motion of Councilman Williamson seconded by
Councilman Claire and carried, the Street Department was instructed
to dispose of it if it can be done without incurring liability on the
part of the City.
This being the time set for continuation of the public
hearing set for January 8th on the zoning ordinance and Map, the
Board proceeded to hear any arguments for or against the same.
Numerous letters had been filed and a number of those present voiced
their sentiments, some wanting certain sections zoned one way and
some another.
After all had been heard that desired, the mass of evidence
was so great the Board deemed it necessary in justice to all to take
more time to go over the facts presented than could be given at this
late hour, and therefore deferred action on same to a later date.
There being no further business on motion of Councilman
Claire seconded by Councilman Williamson and carried, th meeting
was adjourned Sine Die.
