City Hall, Newport Beach, Feb. 4, 1929
The City Council of the City of Newport Beach met in regular
session at 7:30 o'clock P. M. on above date. The meeting was called
to order by Mayor.Johnson.
The roll was called showing the full Council present.
The minutes of the previous meeting were read and approved
as read.
The reports of the heads of the departments were read and on
motion of Councilman Claire seconded by Councilman Ellsworth and
carried, the reports were accepted and filed.
Councilman Williamson reported for the Airport Committee
that they would recommend that about 1800 feet of City property north
of the County Channel, be used for an airport for land and sea planes,
and that the Street Superintendent be instructed to obtain clay and
gravel from the adjoining cliffs for surfacing same from time to time
as the department finances will permit.
On motion of Councilman Ellsworth seconded by Councilman
Claire and carried, the report was accepted and approved, and the City
Engineer was instructed to give an estimate of the cost of graveling
from the adjoining cliffs, and the City Attorney was instructed to
see the Lido Isle people in regard to moving their landing up to the
of the proposed airport landing, and to report on same as soon as
possible.
More time was granted Councilman Hilmer on the Grand Canal
bulkhead, and CityEngineer Patterson to report on the tree - planting
on Corona Del Mar.
The communications were read and acted upon as follows:
The communication from Fire Chief Crocker declaring the Louis
F. De Kay oil wells in West Newport a nuisance and a menace to life and
property, was considered, and on motion of Councilman Hilmer seconded
by Councilman Claire and carried, the City Attorney was instructed to
take the necessary steps to abatd the nuisance.
The communication from Chief of Police Hodgkinson asking for
' legal advice on the Vending Machine Ordinance pertaining to penny
vending machines as used in a penny arcade, was discussed, and on
motion of Councilman Hilmer seconded by Councilman Claire and carried,
the City Attorney was instructed to report on the status of the request
at the next meeting.
On motion of Councilman Claire seconded by Councilman
Williamson and carried, the telegram from Freeman, Smith & Camp Co.
in regard to the harbor bonds talked of, was filed.
On motion of Councilman Williamson seconded by Councilman
Ellsworth and carried, the request of C. F. Mc Neilly for transfer
of his lunch counter license to Mrs. John L. Stephens, was granted.
UNFINISHED BUSINESS
ORDINANCE NO. 355, entitled:
AN ORDINANCE GRANTING PACIFIC ELECTRIC RAILWAY COMPANY,
A CORPORATION, AUTHORITY TO CONSTRUCT AND MAINTAIN POLES
AND WIRES IN CENTRAL AVENUE IN THE CITY OF NEWPORT BEACH
came up for final passage, was read, considered, and upon
call of the roll passed by the following vote:
AYES, Councilmen, Hilmer, Claire, Ellsworth, Williamson,
Johnson.
NOES, Councilmen None.
ABSENT, Councilmen None.
This being the time for hearing protests against vacating
certain streets on Newport Heights, continued from January 7, 1929 by
request of the La Habra Valley Land & Water Company, and as they were
not ready at this time to go ahead, the hearing was continued to
March 4, 1929.
City Attorney Thompson reported that the bond attorneys had
rEC used to pass the bonds of Municipal Improvement District No. 6 on
account of the ballot used not conforming to the Ordinance.
Mr. Redfield of Redfield, Van Evers, & Co. who purchased the
bonds was present and stated they wanted the bonds and made the City
an offer for them and also offering to assist in getting up the new
proceedings. The matter was considered but the Council desired a few
days time to look into the proposition, and Mr. Redfield therefore
granted one week's time on his offer.

City Attorney Thompson presented an Ordinance, entitled:
AN ORDINANCE OF THE CITY OF NEWPORT BEACH BY THE CITY
COUNCIL AS THE LEGISLATIVE BODY THEREOF, REPEALING
ORDINANCE OF INTENTION N0. 333 OF THE SAID CITY OF
NEWPORT BEACH, AND ALL PROCEEDINGS HAD AND TAKEN THERE-
UNDER, AND ALSO REPEALING ORDINANCE N0.342 OF SAID CITY
OF NEWPORT BEACH AND ALL PROCEEDINGS HAD AND TAKEN
THEREUNDER, AND VACATING, ANNULLING, SETTING ASIDE AND
ABANDONING ALL PROCEEDINGS HAD OR TAKEN RELATIVE TO
MUNICIPAL IMPROVEMENT DISTRICT NO. 6 OF SAID CITY OF
NEWPORT BEACH.
The Ordinance was read, considered, designated Ordinance
No.356 and on motion of Councilman Hilmer seconded by Councilman
Claire and carried, the ordinance was passed to the second reading.
On motion of Councilman Ellsworth seconded by Councilman
Claire and carried, the City Engineer and City Attorney were
instructed to get in touch with the Pacific Electric Railway Co.
and inform them of the situation in regard to the bonds and new
proceedings to be started, and request their promp co- operation in
every way possible.,
NEW BUSINESS
On motion of Councilman Williamson seconded by Councilman
Ellsworth and carried, the demands having been signed and approved
by the Finance Committee, were allowed and warrants to be drawn for
same.
There being no further business on motion of Councilman
Claire seconded by Councilman Hilmer and carried, the meeting
adjourned to 7:30 o'clock P. M. on Monday, February 11, 1929•

adjourned session at 7:30 o'clockP. M. on above date. The meeting
was called to order by Mayor Johnson.
The roll was called showing all members present except Council-
man Ellsworth.
The minutes of the previous meeting were read and approved as
read.
City Engineer Patterson reported that the Committee had not
been able to get together on the tree - planting matter as yet; and he was
granted more time onsame, and he was also granted more time onthe airport
landing matter.
City Attorney Thompson reported that Fire Chief Crocker advised
himthat Mr. De Kay had ten men at work cleaning up around his oil wells,
and he thought everything would be cleaned up satisfactorily very soon.
City Engineer Patterson reportedthat he had taken up the matter
of improvement of the alley along the Pacific Electric tracks in West
Newport up with their engineer, but as the matter had to be taken up with
the Manager, D. W. Pontius, he would suggest that a committee of one be
appointed to see him. The matter was considered and as it was to be a
condemnation prodeeding it was thought advisable to have additional names
on the petition, and the committee were instructed to that effect.
The communications were read and acted upon as follows:
The communication from Major C. P Gross stating that the Chief
of Engineers declined to undertake any further action in regard to removal
of the Boat "Muriel" from the harbor entrance was considered,and on motion
of Councilman Claire seconded by Councilman Hilmer and carried,the
communication was filed.
