Crenshaw and Co., Auditors, was referred to the Chairman of the Finance Committee for checking and report. There being no further business, on motion of Councilman Hilmer, seconded by Councilman Claire and carried, the meeting adjourned Sine Die. Mayor, City 0f � ort Beach ' Corrected and approved October 7, 1929 City Clerk City Hall, Newport Beach,.Oct.7,1929 The City Council of the City of Newport Beach met in regular session at 7:30 o'clock P. M. on above date. The meeting was called to order by Mayor Johnson. The roll was called showing all members present.except Councilman Ellsworth. The minutes of the previous meeting were read, corrected and approved. The reports of the heads of the departments were read and on motion of Councilman Claire seconded by Councilman Hilmer and carried, the reports were accepted and filed. On motion of Councilman Hilmer seconded by Councilman Claire and carried, the Clerk was instructed to have the annual report of finances printed. City Attorney Thompson reported that the description of the mosquito abatement District covered the territory as stated at the last meeting, and the City could join with the other communities of the district. A Resolution was thereupon presented consenting to join the District which was read,designated RESOLUTION NO. 532 and upon call of the roll passed contingent upon all other communities within the proposed Distirct joining in same, by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Williamson, iiohnson. NOES, Councilmen None. ABSENT, Councilmen Ellsworth. On motion of Councilman Claire seconded by Councilman Hilmer and carried, the communication from the Secretary of the Interior, Ray Lyman Wilbur, acknowledging the electrical energy desired by the City from the Boulder Dam, was accepted arl filed. H. M. Ferguson reported that the best he could do was an even exchange on the two lots on Balboa Island. The matter was con- sidered and on motion of Councilman Claire.seconded by Councilman Hilmer and carried, the City Attorney was instructed to draw up the necessary papers for the exchange of the lots. Councilman Lloyd Claire, Chairman of the Police Committee, recommended that Ordinance No. 216 be amended to exclude all tents and sun shades on the beach except beach umbrellas. The matter was considered and on motion of Councilman Claire seconded by Councilman Hilmer and carried, the City Attorney was instructed to prepare an ordinance of amendment, 1.43 City Attorney Thompson reported that the property on Balboa Island, corner of Park and Saphire had been sold and the new owner was intending to fix the place up, and on motion of Councilman Claire seconded by Councilman Hilmer and ca "cried, the report was filed. The communications were read and acted upon as follows: The petition for a fire and police station on Balboa Island containing 150 signatures was considered, but as the exchange of lots had not been - consumated as yet, on motion of Councilman Hilmar seconded by Councilman Claire and carried, the petition was filed for future reference. On motion of Councilman Williamson seconded by Councilman Claire and carried, the request of the Orange Councy Tuberculosis Association for a donation was filed. On motion of Councilman Claire seconded by Councilman Hilmer and carried, the communication from the Balboa Island Imorovement Asso- ciation in regard to the old house at the corner of Park and Saphire was filed as it was being taken care of. The communication from Mrs. Grace E. Brooks, Clerk of the school Board, asking that the City take some action in regard to lighting the school yard was considered, and on motion of Councilman Claire seconded by Councilman Williamson and carried, the Council agreed to furnish tRe electric energy for lighting the school yard after the fixtures are installed. The communication from Mrs. Brooks in regard to dirting about 50 x 200 feet of ocean frontage in front of the school house for addi- tional playground equipment was considered, and on motion of Councilman Claire seconded by Councilman Williamson and carried, the request was granted, the work to be done under the supervision of the City Engineer and to conform to grade. On motion of Councilman Hilmar seconded by Councilman Willi-­­- and carried, the communication from Ralph-P. Maskey asking permission to construct curbs along their property west of the Southern Pacific Railroad and north of the Rivo Alto, was referred to the City Engineer for a report. The communication from Ralph P. Maskey referring to the ' dangerous condition of the oil derricks in West Newport and asking that they be declared a nuisance and order removed, was considered, and on motion of Councilman Claire seconded by Councilman Williamson and carried, the matter was referred to the Building Inspector and Fire Chief for a report. On motion of Councilman Hilmer seconded by Councilman Claire and carried, the recommendation of R. L. Patterson that $100.00 be allowed for oainting the Goldenrod Avenue bridge was granted. The communication from Lex H. Wallace accompanying two automobile insurance policies, and the recommendation of R. L. Patterson that the .insurance be carried in the Board Company was considered, and on motion of Councilman Williamson seconded by Councilman Claire and carried, the two policies of Mr. Wallace were accepted and a warrant to be drawn for same. On.motion of Councilman Claire seconded by Councilman Hilmar and carried, the communication from the Newport Harbor Chamber of Commerce in regard to a pile marker being knocked down at the harbor entrance, was referred to the Harbor Master for a report. On motion of Councilman Williamson seconded by Councilman Claia�c and carried, the request of Mrs. Nellie Dyson for permissionto place a. sign across the sidewalk in front'of her place, was denied. A petition signed by property otim ers in West Newport covering over 400 lots asking that an assessment district be formed fordredging the waterways and pool, was considered, and on motion of Councilman ' Claire seconded by Councilman Hilmer and carried, the petition was granted and the City Attorney was instructed to draw up the necessary papers to start the proceedings at the next meeting. On motion of Councilman Claire seconded by Councilman Williamson and carried, the former motion referring the communication of Ralph P. Idas::ey for )ermission to construct curbs along their property, to the City Engineer for a report, was rescinded: On motion of Councilman Claire seconded by Councilman William- son and carried, the official grades for the work asked for by Mr. Maskey were to be established by the City Engineer in accorance with the petition and they be permitted to proceed with the work contemplated, the same to be done under the direct supervision of the City Engineer, and before any work is dore they deposit with the City,Engineer the sum of $125.00 to cover the survey and expense of supervision, and if there is any balance left the same to be returned to them. 144 The communication from the Ner:port Beach Exchange Club asking that the City donate funds for the benefit of the %woort Beach Hospital, was considered, but as the City cannot useAfunds that way, on motion of Councilman Hilmer seconded by Councilman Claire and carried, the communication was filed. On motion of Councilman Williamson seconded by Councilman Claire and carried, the request of the Newport Harbor Chamber of Commerce for advertising expenditures from October 15th to November 15th amounting to $750.00 was allowed. NEW BUSINESS. On motion of Councilman Williamson seconded by Councilman Claire and carried, the demands having been signed and approved by the Finance Committee, were allowed and warrants to be drawn for same. City Attorney Thompson referred to a fire prevention and gasoline ordinance he was preparing which was quite lengthy, and thought a committee should be appointed to look it over. On motion of Councilman Claire and seconded by Councilman Williamson and carried, the Chair was instructed to appoint a committee for that purpose. The committee appointed is Councilman Hilmer, Fire Chief Crocker, Building Inspector Fenelon and City Attorney Thompson. Councilman Williamson introduced an ordinance entitled: AN ORDINANCE OF THE CITY OF NEWPORT BEACH RESTRIDTING BUSINESS, COMMERCE, INDUSTRY AND TRADES TO CERTAIN ZONES WITHIN A DESIGNATED PORTION OF SAID CITY, AND PRESCRIBING THE PENALTY FOR THE VIOLATION OF THE PROVISIONS HEREOF. The ordinance was read, considered, designated Ordinance No. 367 and on motion of Councilman Williamson seconded by Councilman Claire and carried, the Ordinance was passed to the second reading. City Attorney Thompson presented a Grant Deed for rights -of- way for street purposes only, in Lot K, Tract 518, and on motion of Councilman Williamson seconded by Councilman Hilmer, it was resolved by the Board of Trustees of the City of Newport Beach, Orange County, California, that the deed from First Trust and Savings Bank of Pasadena, to the City of Newport Beach, dated July 17,1929, be and the same is hereby accepted and ordered recorded in the office of the Councy Recorder of Orange County, California, by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Will iamson, Johnson. NOES, Councilmen None. ABSENT, Councilman Ellsworth. On motion of Councilman Williamson seconded by Councilman Claire and carried, the request of Mayor Johnson for leave of absence to November let with permission to leave the State, was granted. On motion of Councilman Claire seconded by Councilman Hilmer and carried, Councilman-Williamson was appointed Acting Mayor daring Mayor Johnson's absence. Mr. Lew H. Wallace stated that Mr. Archibald of Santa Ana was in Washington, D. C. and he understood by paying his actual expenses we could get him to stay a little longer and he would try and get the Government to match the $200,000.00 for which we were calling a bond election for harbor development. The matter was considered carefully and on motion of Councilman Claire seconded by Councilman Hilmer and carried, the sum of $200.00 was allowed for that purpose, and Councilman Williamson, Lew H. Wallace and L. 17. Briggs were appointed to look into the matter with power to act. H.L. Sherman brought up the matter of the imperfect title to the American Legion property and stated the title company refused to make a report on the title. The matter was discussed and on motion of Councilman Claire seconded by Councilman Hilmer and carried, it was referred to the City Engineer and City Attorney for a report. There being no further business, on motion of Councilman Claire seconded by Councilman Hilmer and carried, the meeting adjourned to 7:30 o'clock P. M. on Monday, October 14, 1923.
