HomeMy WebLinkAbout12/09/1929 - Adjourned Regular MeetingI I 163 City Engineer Patterson submitted an offer from the Southern California Edison Company of ;1550.00 for the Diesel engine and equip- ment for same at the pumping plant, and he would recommend that same be accepted; thereupon Councilman Ellsworth introduced a Resolution accepting same. The resolution was read, considered, designated RESOLUTION N0. 552 and upon call of the roll passed by the following vote, to -wit: AYES, Councilmen Hilmer, Claire ,Ellsworth,Williamson,Johnson. NOES, Councilmen None. ABSENT, Councilmen None. The City Engineer also brought up the matter of signing up a contract with the Southern California Edison Company for rower for the new electric motor, and on motion of Councilman Claire seconded by Councilman Williamson and carried, the Water Superintendent was author- ized to enter into a contract with the Southern California Edison Company for the power needed for the new motor. A Deed from the Title Guarantee and Trust Company for a permanent easement and right -of -way for alley, sewer and public utility purposes over certain lots in Blocks 534, 535 and 635 of Canal Section was discussed and on motion of Councilman Ellsworth seconded by Council man Claire and carried, the matter was referred to the City Engineer and City Attorney to make out the necessary papers of acceptance. There being no further business, on motion of Councilman Claire seconded by Councilman Kilmer and carried, the meeting adjourned to 7 :30 o'clock P. M. on Monday, December 9, 1929. Approved December 9, 1929 4/",Z��City Clerk City Hall, Newport Beach, December 9, 1929 The City Council of the City of Newport Beach met in regular adjourned session at 7 :30 o'clock P. M. on above date. The meeting was called to order by Mayor Johnson. The roll was called showing the full Council present. The minutes of the previous meeting were read and approved as read. Councilman Hilmer brought up the .:. atter of the trees on Corona Del iar being in a very unsatisfactory condition, and suggested that a Committee be appointed to investigate same. The matter was cons:_ ered and on motion of Councilman Ellsworth seconded by Councilman Claire and carried, the Chair was instructed to appoint a committee to investigate the condition of the trees and report. The Committee appoint ed is Councilman Hilmer, Stuart Lucas and Gus Wurdinger. Councilman Williamson reported for the Committee of the whole appointed to investigate the condition of the sidewalk on the bay front at East Newport, and they thought the change as suggested would be beneficial. On motion of Councilman Claire seconded by Councilman Williamson and carried, the Chair was instructed to appoint a Committee to draw up the necessary papers in regard to same. The Committee appointed is City Attorney Thompson, City Engineer Patterson and R. H. Summers. City Engineer Patterson had no report as yet on the deeds for the State Highway. The communications were read and acted upon as follows: 164 On motion of Councilman Williamson seconded by Councilman Claire and carried, the communication from the Railroad Com.ission in regard to the hearing on gas rates,.was filed. The request of 17. C. Gow for transfer of the lunch counter license of Steves & Gow to J. W. Focht was considered, and on motion of Councilman Claire seconded by Councilman Williamson and carried, the transfer was allowed. On motion of Councilman Claire seconded by Councilman William- son and carried, the request of E. E. Chase for refund of part of his license on cottages, was referred to the City Attorney for a report. The communication from the Chamber of Commerce recommending that $100.00 be appropriated from the unappropriated advertising fund towards the Christmas expenses at the schoolhouse was considered, and on motion of Councilman Ellsworth seconded by Councilman Hilmar and carried, the amount was allowed. The request of the Palisades Lumber & Supply Company to have 50 feet of the alley back of Lot 1, Block G, Tract 323, Corona Del Mar abandoned, was considered, and on motion of Councilman Williamson seconded by Councilman Claire and carried, the City Engineer was instructed to take the necessary steps for the abandonment of that portion of the alley. On motion of Councilman Claire seconded by Councilman Ells- worth and carried, the communication from the Chamber of Com::erce in regard to the invitation to inspect the Seal Beach City Hall was filed. The communication from the Woman's Civic League inviting the members of the Council to inspect the exhibit of women's work on Tuesday evening at the Rendezvous Ball Room, with.an.idea of making it an annual city event, was considered, and on motion of Councilman Claire seconded by Councilman Ellsworth and carried, the communication was filed. Representatives of the Prudential Insurance Company of Iiuntington Beach explained the group insurance, and the matter. was taken under advisement for future consideration'- NEW BUSINESS. City Attorney Thompson referred to the abandonment proceedings started some time ago of the alley back of the Christian Science Church and Councilman Paul B. Ellsworth introduced a Resolution adopting a map of East Newport. The Resolution was read, considered, designated RESOLUTIOY NO. 553 and upon call of the roll passed by the following vote, to-wit: AYES, Councilmen Hilmer, Claire ,Ellsworth,Williamson,Johnson. NOES,Councilmen None. ABSENT, Councilmen None. Councilman Lloyd Claire introduced a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DECLARING THEIR INTENTION TO ORDER THE CLOSING UP AND ABANDONMENT OF.A CERTAIN PORTION OF THAT CERTAIN TEN (10) FOOT ALLEY AND EXTENDING NORTHERLY AND SOUTHERLY THROUGH BLOCK 1; DECLARING IT TO BE FOR THE PUBLIC INTEREST AND CONVENIENCE AND FIXING THE TIME AND PLACE FOR HEARING OBJECTIONS TO SAID PROPOSED ABANDOPIMENT. The Resolution was read, considered, designated RESOLUTION NO. 554 and upon call of the roll passed by the following vote, to -wit: AYES, Councilmen Hilmer, Claire ,Ellsworth,lVilliamson,Johnson. NOES, Councilmen None. ABSENT, Councilmen None. A Deed dated the 9th day of December, 1929, from the Orange County Improvement Association, a California Corporation, to the City of Newport Beach, a Municipal Corporation of the State of California, granting the right of way and easement for a public water way or high- way and all incidents thereto, over the following parcel of land: That certain parcel of land bounded on the North by the ordinary high tide line of the Pacific Ocean in Newport Bay (designated as the "South Line ") as established by Court decree, Case No. 23686, of the Superior Court of the State of California, in and for the County of Orange; bounded on the South by a continuous line, being the Northerly lines and prolongations thereof of Blocks 441, 539, 638, 637 and 636, of Canal Section, as recorded in Book 4, page 98 of Miscellaneous Maps, records of Orange County, California; bounded on the East by the Westerly line of the property (100 feet in width) of the Southern Pacific Railroad Company; bounded on the West by the Northwesterly prolongation of the Southwesterly line of Block 340 of saidCanal Section to said line of ordinary high tide. was presented to the City Council of the City of Newport Beach, California Whereupon, Councilman Ellsworth made a motion, duly seconded by Councilman Claire and carried, that said Deed be accepted by said City of Newport Beach, and the Clerk instructed to record the same forthwith with the County Recorder of the County of Orange, State of California. A Deed dated the 9th day of December, 1929, from the Orange County Improvement Association, a California Corporation, to the City of Newport Beach, a Municipal Corporation of the Stateof California, granting the right of way and easement for a public water way or highway and all incidents thereto over the following parcel of land: That certain 100 foot water way known as the "Rivo Alto" for its entire length, as laid out and shown on a map of canal Section, recorded in Book 4, page 98, Miscellaneous Maps, records of Orange County, California, and the northwesterly prolongation of the said Rivo Alto to the ordinary high tide line of the Pacific Ocean (designated "South Line ") in Newport Bay, as established by case No. 23686 of the Superior Court of the State of California, in and for the County of Orange, and over that certain 100 foot water way known as the "Rialto ", for its entire 166 length, as laid out and shown upon a map of Canal Section, recorded in Book 4, page 98, of Miscellaneous Maps, Records of Orange County, California, and the Northeasterly prolongation of the said Rialto to the ordinary hi�h tide line of the Pacific Ocean (designated "South Line ") in Newport Bay, as established by Case No. 23686 of the Superior Court of the State of California, in and for Orange County. was presented to the City Council of the City of Newport Beach, California. Whereupon, Councilman Hilmer made a motion, duly seconded by Councilman Williamson and carried, that said Deed by accepted by said City of Newport Beach, and the Clerk instructed to record the same forthwith with the County Recorder of the County of Orange, State of California. That said motion was carried by the following vote, to -wit: AYES, Councilmen Kilmer, Claire, Ellsworth, Williamson, Johnso n. NOES, Councilmen None. ABSENT, Councilmen None. The matter of ownership of the old swimming pool at ?".est Newport was considered and it was intimated that the Orange County Improvement Association were willing to deed same to the City. On motion of Councilman Williamson seconded by Councilman Claire and carried, the City Attorney was instructed to obtain title to the swimming pool. There being no further business on motion of Councilman Williamson seconded by Councilman Claire and carried, the meeting adjourned to 7:30 o'clock P. M. on Monday, December 16, 1929. Councilman Hilmer reported that he understood that Mr. Peterson would be down soon to remedy the tree conditions on Corona Del lar, therefore no further action was taken. City Engineer Patterson stated he had no report on the sidewalk on the bay front at Balboa as he had to survey it first. City Attorney Thompson reported that inasmuch as E. E. Chace had paid his license under protest, the Council would be justified in returning the difference between what he paid and what the amended ordinance calls for. Councilman Williamson thereupon introduced a resolution refunding same. The resolution was read, considered, designated RESOLUTION NO. 555 and upon call of the roll passed by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Ellsworth, Williamson, Johnson. NOES, Councilmen None. ABSENT, Councilmen None.
