City Hall, Newport Beach, August 18, 1930
The City Council of the City of Newport Beach met in regular
adjourned session at 7 :30 o'clock P.M. on above date. The meeting was
called to order by Mayor Johnson.
The roll was called showing the full Council present.
The minutes of the previous meeting were read and approved as
read.'
Councilman Hilmer stated the Telephone Co. had applied to the
Year Department for permission to lay a'cable across the entrance channel,
but the City Engineer had telephoned and got a postponement of the hear - ,
ing until next Friday. He thought the cables should be confined to one
location and not allowed to be placed indiscriminately across the bay.
On his motion seconded by Councilman Claire and carried, the Chair was
instructed to appoint a committee to confer with the Telephone Company,
and if necessary to enter a protest at the hearing next Friday. The
Committee appointed is Councilman Hilmer and City Engineer Patterson.
Councilman Ellsworth reported that the bridge on nest Coast
Blvd, was in fair shape now and they would recommend that no work be
done on same until after the summer season.
City Engineer Patterson reported that a flood light at the
end of 21st Place would not be practical, and he had suggested to Mr.
Carson that they use one string of lights down through there which they
thought would be satisfactory. The Engineer was authorized to install
the string of lights as designated.
The communications were read and acted upon as follows:
The netition of Cubbons and McFarland asking exclusive privi-
leges for their barges was considered, and on motion of Councilman Ells-
worth seconded by Councilman Garfield and carried, the matter was laid
on the table until the regular meeting in October, and the Clerk was in-
structed to get information from the Clerks of the coast towns between
Santa Barbara and San Diego as to how they handle the barges.
On motion of Councilman Claire seconded by Councilman Gar-
field and carried, the request of Fire Chief Crocker for permission to
attend the Fire Chiefs Convention at Oakland'Sept. let to the 5th, was
granted with expenses allowed not to exceed $100.00.
The communication from the Builders Exchange asking the Council ,
to pass an Oxdl,nance to prohibit moving old buildings into the City with-
out a thorough inspection by the Building Inspector was considered, and
on motion of Councilman Claire seconded by Councilman Garfield and car-
ried, the matter was laid on the table until next meeting and the City
Attorney instructed to confer further with the Builders Exchange in re-
gard to same.
On motion of Councilman Ellsworth seconded by Councilman Claire
and carried, the application of Marcus C. Smith for permit to construct
a pier on Lot 7 of Bay Island, was referred to the City Engineer for
the customary two weeks.
On motion of Councilman Claire seconded by Councilman Garfield
and carried, the request of the Chamber of Commerce for an appropriation
of $250.00 for the Street Dance at Newport Beach Sept. 6th was allowed.
The communication from the Chamber of Commerce asking that a
Committee be appointed to act in conjunction with't he committee appointed-
by them to make a survey and recommendation in regard to anchorage and
other harbor facilities was considered, and on motion of Councilman Claire
seconded by Councilman Ellsworth and carried, the Chair was instructed to
appoint a committee as requested. The.committee appointed is: City En-
gineer Patterson, Harbor Master Robinson and Councilmen Claire and Garfield.
On motion of Councilman Claire seconded by Councilman Garfield
and carried, the petition with 14 signatures commending the Board for pro-
hibiting the promiscuous shooting of fireworks was filed.
On motion of Councilman Garfield seconded by Councilman Claire
and carried, the communication with 15 signatures commending the Coundl
for enforcing the Ordinance limiting speed boats on the bay, was .filed.
On motion of Councilman Claire seconded by Councilman Hilmer
and carried, the communication from the Pacific Coast Association of Fire
Chiefs in regard to their Convention was filed.
The communication from H.Y,.Davis of Burma, India, asking if the
Council would not consider putting in a gravel walk along the bluff park-
way on Corona del Mar between Marguerite St, and Dahlia Avenue, was con-
sidered, and on motion of Councilman Garfield seconded by Councilman Ells -
worth and carried, the communication was laid on the table until next
meeting.

The communication from the Balboa yacht Club complaining
of odor coming from a standpipe in the alley near their property,
was considered and it was thought by raising the standpipe higher it
might overcome it. On motion of Councilman Claire seconded by Coun-
cilman Garfield and carried, the matter was referred to the Street
Superintendent for attention.
On motion of Councilman Claire seconded by Councilman Hil-
mer and carried, the recommendation of Water Supt. Patterson that
Hobart.Ohowell be placed on a straight salary of $140.00 per month
was approved.
On motion of Councilman Hilmer seconded by Councilman Claire
and carried, the complaint of James Mitchell of the ravenous mos-
quitos in the west end of town, was referred to the City Attorney for
a reply.
The communication from John Sherrod Harris complaining of the
conditions caused by a drain pine near their bathhouse, was considered,
and on motion of Councilman Ellsworth seconded by Councilman Garfield
and carried, the matter was referred to the City Engineer for a report
at the next meeting.
On motion of Councilman Garfield seconded by Councilman
Claire and carried, the communication from Ralph P. Vaskey asking that
34th St. between Railroad Avenue and the Southern Pacific right -of -way
be vacated was laid on the table until the next meeting.
UNFINISHED BUSINESS.
ORDINANCE NO. 386, entitled:
ORDINANCE NO. 111 OF THE CITY OF NEWPORT BEACH IS
HEREBY AMENDED BY ADDING TWO SECTIONS THERETO, TO BE
KNOWN AS SECTION 1 a AND SECTION 1 b.
The Ordinance was read, considered, and on call of the roll
passed by the following vote, to -wit:
AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson.
NOES, Councilmen None.
ABSENT, Councilmen None..
NEW BUSINESS.
City Attorney Thompson presented an Ordinance amending Or-
dinance No. 345 of the City of Newport Beach concerning the parking of
automobiles by adding two sections thereto to be known as Sections
35a and 35b.
The Ordinance was considered, designated Ordinance No. 387,
and on motion of Councilman Claire seconded by Councilman Garfield and
carried, the Ordinance was passed to the second reading.
Pursuant to instructions heretofore given by the City Council
of the City of Newport Beach, California, the City Engineer presented
Plat No. 378 showing the exterior boundaries of the assessment dis-
trict for the improvement contemplated in Acquisition and Improvement
District ?o. 1 of the City of Newport Beach; also Plan No. 376 con-
,. sisting of two sheets numbered 1 and 2, for consideration. After dis-
cussing same the City Engineer recommended that the said Plat No. 378
of the assessment district and the said Plan No. 376 consisting.of
two sheets, be approved.
Whereupon Councilman Claire moved that the said Plat No. 378
of the assessment district and the said Plan No. 376 consisting of
two sheets numbered 1 and 2, be. approved; which motion was duly se-
conded by Councilman Garfield and upon call of the roll carried by the
following vote, to -wit:
AYES; Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson.
NOES, Councilmen None.

Un moti n of Councilman Hilmer seconded by Councilman Claire
and carried, the 4 emergency demands No. 383, 544, 545 and 546, having
been signed and approved by the Finance Committee, were allo•.:ied and war-
rants to be drawn for same.
Harry J. Bell presented a verbal nomplaint of a nuisance and
'fire menace on the lot adjoining him, being 209'- 19th St, belonging to
Jack ':'ardesich. The matter was considered and. on motion of Councilman
Claire seconded by Councilman Ellsworth and carried, the matter was re-
ferred to the Fire Chief 1dr investigation and report at the next meeting.
City Engineer Patterson stated he was going to need some 4"
pipe for the Water Department soon, and he had a chance to purchase 400
feet at a very cheap price if taken at once, and he had purchased same.

On motion of Councilman Ellsworth seconded by Councilman Hilmar and
carried, the emergency action of the City Engineer was approved. -�
There being no further business on motion of Councilman Claire
seconded by Councilman Ellsworth and carried, the meeting adjourned
Sine Die.

The City Council of the City of Newport Beach met in regular
session at 7:30 o'clock P.M. on above date. The meeting was called to
order by Mayor Johnson.
The roll was called showing the full Council present.
The minutes of the previous meeting were read and approved as
read.
The reports of the heads of the departments were read and on
motion of Councilman Claire seconded by Councilman Ellsworth and carriecl
the reports were accepted and filed..
Councilman Hilmer reported that the Telephone Comnany might be
given permission to lay a cable across the channel entrance from N Street '
to Pacific Drive providing they take out the cable to Balboa Island.
The Committee did not enter a protest at the Year Department - hearing as
they found out the City had jurisdiction over it. No action was taken
at this time.
City Attorney Thompson stated he had not prepared an ordinance
requiring the Buildirg Inspector to inspect all buildings before they are
moved into the -City as asked for by the Builders Exchange as he had
not received any instructions to do so from: -the Council. On motion of
Councilman Claire seconded by Councilman Garfield and carried, the City
Attorney was instructed to prepare an Ordinance along the lines suggested
by the Builders Exchange.
City Engineer Patterson stated the drain pipe co mnlained of by
John Sherrod- Harris would be taken care of before the winter rains
started.
The communications were read and acted upon as follows:
A petition containing 102 signatures asking that the Council
form an assessment district for the overhead crossing at the Arches was
considered, but inasmuch as the amount of property represented by the
signatures was not stated, on motion of Councilman Claire seconded by
Councilman Ellsworth and carried, the petition was laid on the table
until next meeting and the Clerk instructed to check the petition as to
the number of lots represented.
The communication from Ralph P. Maskey laid over from last meet-
ing asking the abandonment of a portion of 64th Street , was again taken up,
and on motion of Councilman Claire seconded by Councilman Garfield and '
carried, the City Attorney was instructed to prepare the necessary
papers for abandonment upon poomr description furnished by the City En-
gineer.
On motion of Councilman Ellsworth seconded by Councilman Garfield
and carried, the communication from H.;!.Davis in regard to a :ravelled
v:alk along the bluff on Corona del Mar, was laid on the table until the
regular meeting in January.
On motion of Councilman Claire seconded by Councilman Garfield
and carried, the application of Marcus C. Smith for permit to construct
a vier in front of Lot 7, Bay Island, was allowed.
On motion of Councilman Claire seconded by Councilman Garfield
and carried, the communication from the President of the Los Angeles
Councilman Claire offered and moved the adoption of Resolu-
tion No. 616 being a Resolution approving specifications in the matter
of ACQUISITION AND IMPROVEMENT DISTRICT NO.1 of the City of Newport
Beach. Which motion was duly seconded by Councilman Garfield and upon
call of the roll the said Resolution was adopted by the following vote,
to -wit:
AYES, Councilmen Hilmer., Claire, Ellsworth, Garfield, Johnson.
NOES, Councilmen None.
ABSENT, Councilmen None.
