HomeMy WebLinkAbout10/27/1930 - Adjourned Regular Meeting12 58 The Mayor then announced that this was the time and place for hearin; protests or objections against the proposed work or against the proposed district, or against the proposed grades, as set forth in said Resolution of Intention No. 621, and asked if anyone present desired to file any written protests or make any oral objections against the proposed improvement or to the extent of the district to be assessed or the pro- posed grades. No one responded. City Engineer R.L.Patterson requested a delay of one week before ordering the work, and on motion of Councilman Claire, seconded by Council- man Garfield and carried, the hearing in the matter of the improvement of River Avenue and certain other streets and alleys under Resolution of In- tention No. 621 was postponed to the re €ular adjourned meeting on Oc- tober 27th, 1930. It was moved by Councilman Hilmer., seconded by Councilman Claire, and carried, Cancilman Ellsworth not voting, that the City En- ' gineer be instructed and authorized to reconstruct, in accordance with plans and specifications approved by this Council, the bridge at 36th Street over the Rivo Alto. On motion of Councilman Claire, seconded by Councilman Hilmer, and carried, Councilman Ellsworth not voting, the City Engineer and the Building Inspector of the City of Newport Beach were instructed to in- vestigate the building of certain marine railroads by Bob's Boat Shop at 9th Street, as the same was within the prohibited district for such structures, and that they notify said Bob's Boat Shop to cease operations thereon in case of such construction, and report their findings at the next regular meeting. On motion of Councilman Garfield, seconded by Councilman Claire, and carried, Councilman Ellsworth not voting, the City Attorney of the City of Newport Beach was authorized and directed to file an answer in the case of Frank H. Greene vs. City of Newport Beach, now pending in the Superior Court of the State of California, in and for the County of Orange, for the purpose of protecting the City in the filing of a proper bond, and the obtaining from the plaintiff in said action the costs of issuing a new bond. There being no further business, on motion of Councilman Claire, seconded by Councilman Hilmer, and carried, Councilman Ellsworth not voting, the meeting was adjourned to Monday, the 27th day of October, 1930 at the hour of 7 :30 o'clock P.M. n APPROVED: October 27, 1930 Clerk pro tempore City Hall, Newport Beach, October 27,1930 The City Council of the City adjourned session at 7:30 o'clock P.M. called to order by Mayor Johnson. The roll was called showing The ir.inutes of the previous approved. of Newport Beach met in regular on above date. The meeting was the full Council present. meeting were read, corrected -and Councilman Garfield reported that the committee had concluded that the Fire Department should not answer calls outside the city limits as it invalidates our insurance and further they do not consider the city funds should be used to furnish fire protection to outside communities unless a reciprocal agreement exists. The committee :could therefore sug- gest that a resolution by passed instructing the Fire Chief not to answer any calls outside the city except where we have a reciprocal agreement with a community that is in a city or county fire district, excepting only in the case of the Newport Harbor District High.School. The :natter was con- sidered and on motion of Councilman Garfield seconded by Councilman Hilmer and carried, the resolution as stated was adopted. Councilman Claire stated that the committee had stooded Bob Zum- feld from constructing the marine ways in front of pis boat shop as he had no pe-mit for same and it was in a restricted zone. 259 The communications were read and acted upon as follows; The communication from the Service Laundry asking the Council to consider the muter of giving them a cheaper water rate for the Laundry was presented and on motion of Councilman Claire seconded by Councilman Ellsworth and carried, the matter was referred to the water committee for a report at the next meeting. The communication from Major Lanagan calling a nearing on a request to change the bulkhead line around thel0.E.st end of Lido Isle for November 6th in the Council Chamber, was considered, and Councilman Hilmer stated he thought we should be very careful how we gave our per- mission to change the bulkhead lines and thought we should enter a protest against it in this case. On '_iis motion seconded by Councilman Claire and carried, the Chair was instructed to appoint a committee to include the City Engineer, to draw up a letter protesting against granting the request and that the Council be present at the hearing to verbally pro- test against it. The committee appointed was the Committee of the Thole together with the City.Engineer and City Attorney. The communication from Bob Zumfel"'. asking permission to construct marine ways in front of his boat shop, which is in a prohibited district. for such structures, w4as considered, and on motion of Councilman Garfield seconded by Councilman Hilmer and carried, the communication was referred to the City Attorney for an opinion in the matter. On motion of Councilman Claire seconded by Councilman Garfield and carried, the application of Anna Bobledyke for transfer of her lunch stand license from the Cannery on 28th Street to 2414 Central Avenue, was granted, subject to the approval of the Health Officer. On motion of Councilman Claire seconded by Councilman Ells- worth and carried, the communication from M.E.Tobin, Adjutant of the Disabled American Veterans of the World War, asking permission to con- duct a Forget -me -not sale on our streets on Armistice Day, was referred to the Chief of Police for a recommendation. Treasurer Gant reported that the deed to the ocean frontage given the City by Lew H. Wallace was not received in time to exempt the taxes for last year, and on motion of Councilman Garfield seconded by Councilman Claire and carried, Treasurer Gant was instructed to take care of the bill for taxes from County Auditor Wm.C.Jerome. 1 UNFINISHED BUSINESS City Engineer Patterson requested a delay of 30 days before ordering the work in the matter of the improvement of River Avenue and certain other streets and alleys as contemplated by Resolution of Tn- tention No. 621, on account of allowing the fill to dry out; WHEREUPON Councilman Claire seconded by Councilman Garfield and carried, the hearing in the matter of the improvement of River Avenue and certain other streets end. alleys under Resolution of Intention No. 621, was postponed to the regular meeting on December 1, 1930. City Engineer Patterson reported in regard to furnishing water for the Zar °inski Golf Course on Corona del Mar, that they --;ere not sure of the amount of viater they would use, and the City Engineer was granted additional time to make a complete report. Councilman Ellsworth re orted in regard to the exclusive fish - ing oarge license asked for by Cubbon and McFarland a short time ago, that from the letters received it would appear that most of the cities give exclusive barge privileges, and the Street Committee would recom- mend that they be given one year's exclusive license. On motion of Councilman Ellsworth seconded '.;y Councilman Claire and carried, the re- commendation was accepted and the City Attorney instructed to draw up an exclusive license for one year and present it to this Council. NET BUSI °LESS According to instructions previously given, City Attorney Thompson ,resented an ordinance dedicating a portion of 10th Street for public street rurposes. The Ordinance was read, considered, desig- nated Ordinance No. 390, and on motion of Councilman Claire seconded by Councilman Ellsworth and carried, the Ordinance was passed to the second reading. Councilman Hermann Hilmar introduced a Resolution entitled: ' RESOLUTION RESCINDING AND SETTING ASIDE ACTION OF THE CITY COUNCIL AP'OINTING C.H.CURRIE AND F.S.CURRIE AS THE ENGINEERS TO PREPARE SPECIFICATIONS, AND RESCINDING AND SETTING ASIDE THE ORDER OF SAID COUNCIL DIRECTING THE PREPARATION OF SPECI- FICATIONS IN THE ABOVE ENTITLED :BATTER. The Resolution was read, considered, designated RESOLUTION NO. 636 and upon call of the roll passed by the following vote, to -wit; AYES, Councilmen Hilmar, Claire, Ellsworth, Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilmen None. Councilman Lloyd Claire introduced a Resolution entitled: ORDER A,POINNTING PERSON TO PREPARE AND FURNISH SPECIFICATIONS. The Resolution was read, and upon call of the roll passed AYES, Councilmen Hilmar, NOES, Councilmen None. ABSENT, Councilmen None. considered, designated RESOLUTION NO. 637 by the following vote, to -wit: Claire, Ellsworth, Garfield, Johnson. On motion of Councilman Claire seconde by �'ouncilman Garfield and carried, the City Attorney was instructe to give this Council a complete eport as to the Council's'action n here business is being conduct- ad in a residential zone. Cou- icilman Claire moved that the Harbor Master be appointed to pa- trol the bay front to look after the piers, floats, etc., instead of the Street Department, and that he be paid a straight salary of $150.00 per month beginning November 1, 1930. The motion was seconded by-Councilman Garfield and duly carried. , Street Supt. Patterson presented two application cards from the Southern California Edison Company covering; the electricity to be used for power and lights on Lido Isle, and on motion of Councilman Claire seconded by Councilman Garfield and carried, the Street Supt, was author- ized to sign the applications. There being no further business on motion of Councilman Claire seconded by Councilman Garfield and carried, the meeting adjourned sine die.
