NOES, Councilmen None ABSENT, Councilmen None. The matter of filiinE; the vacancy on the Board of Plumbing Examiners caused by the resignation of W. Strain, was considered, and Mayor Johnson annointed William Gerhard on the Board. On motion of Councilman Claire seconded by Councilman Ellsworth and carried, the ap- pointment was approved. On motion of 0,3urcilman Claire seconded by Councilman Garfield and carried, the demands, having been signed and approved by the Finance Committee, were allowed, and warrants to be drawn for same. Joe Szarfinski addressed the City Council in regard to the City furnishing him water for his Golf Course on Corona del Mar and which the Council denied at the last meeting. He stated he had decided to make only a 9 hole course at this time and would only use half the amount of water formerly asked for, and renewing his request on that basis. The matter was considered and on motion of Councilman Ellsworth seconded by Councilman Claire and carried, the matter was referred to the Water Committee and Water Superintendent for a report. There being no further business, on motion of Councilman Claire seconded. by Councilman Ellsworth and carried, the meeting adjourn- ed to 7 :30 o'clock P.M. on Monday, December 8, 1930. Al yor, City � N ti _ ort Beach Approved Dec. 8, 1930 City Clerk City Hall, Newport Beach, Dec. 8, 1930 The City Council of the City of Newport Beach met in reg- ular adjourned session at 7:30 o'clock P.M. on above date. The meet- ing was called to order by Mayor Johnson. The roll was called showing the full Council present. The minutes of the previous meeting were read and approved as read. Councilman Garfield reported for the Water Committee that they were not in favor of furnishing water over the watershed as asked for by Joe Szarfinski„ and on motion of Councilman Claire seconded by Councilman Hilmer and carried, the report was accented and the ap- plication of Mr. Szarfinski was denied. City Attorney Thompson reported that upon investigation the Committee found that it was a new set of marine ways Robert Zumfelde was applying for, and under the circumstances the Board can only deny the application. On motion of Councilman Claire seconded by Council- man Garfield and carried, the application was denied. The communications were read and acted upon as follows. The communication from Mr Waldron, of the Board of Fire Underwriters. stating conditions under which the City might obtain cheaper insurance rates was considered, and on motion of Councilman Claire seconded by Councilman Ellsworth and carried, the communica- tion was referred to the Fire Committee for consideration. The Quit -Claim Deed from the City of Newport Beach to Alec and Anne Bardosa for Lot 12, Block 225, Section A, which they had re- deemed from tax sale was presented, and on motion of Councilman Claire seconded by Councilman Garfield and carried, the Mayor and City Clerk were authorized to execute the deed on behalf of the City of Newport Beach. The communication from Dr. Lilian Baxter suggesting that the 270 City use the Camp Ground money for a sinking fund for beautifying the City, was considered, and on motion of Councilman Claire seconded by Councilman Garfield and carried, the communication was filed. The communication from S. -V. Cortelyou, District Engineer, stating that the California Highway Commission had approved his re- commendations to pay one -half of the cost of the grade separation at the Arches, was considered, and on motion of Councilman Ellsworth seconded by Councilman Garfield and carried, the City Engineer was instructed to prepare the plans and specifications for the grade separation for the Santa Ana - Newport road and State Highway. On motion of Councilman Ellsworth seconded by Councilman Claire and carried, the City Engineer was instructed to arrange another meeting with the Board of Supervisors to consider the matter of grade separation expense. On motion of Councilman Claire seconded by Councilman Gar- field and carried, the communication from S.V.Cortelyou was filed. On motion of Councilman Claire seconded by Councilman Ells- worth and carried, the application of Clark and lott for license to repair mattresses and do upholEtering was allowed. The communication from Councilman Hilmer, Secretary of the Planning Commission, asking that 10 foot set back lines be established on each side of Marine_ Avenue, Balboa Island, between Balboa Avenue and the alley running parallel with the North Bay was considered, and on motion of Councilman Garfield seconded by Councilman Claire and car- ried, the matter was referred to the City Attorney and City Engineer to prepare the proper proceedings for same. The request of J.H.Ecs for renewal of his lease at the Camp Ground, laid over from last meeting, was presehted and discussed, and on motion of Councilman Ellsworth seconded by Councilman Hilmer and carried, the request for renewal was denied. On motion of Councilman Garfield seconded by Councilman Hil- mer and carried, the Street Committee was instructed to make a report on the cost of new pipe and fixtures for the Camp Ground, and also what the present fixtures can be purchased for, and with power.to act in regard to which ever would be most advantageous to the City. UNFINISHED BUSINESS. None. NEW BUSINESS. MINUTES IN RE CONFIRMATION OF ASSESSMENT FOR THE IMPROVIPMENT OF CHANNEL PLACE AND CERTAIN OTHER STREETS, ALLEYS AND EASEMENTS IN THE CITY OF NEWPORT BEACH. The Clerk advised the Council that this was the time and place fixed pursuant to statute and notice given for the hearing in the mat- ter of the assessment for the improvement of Channel Palce and certain other streets, alleys and easements in the City of Newport Beach, as contemplated by Resolution of Intention No. 558, adopted by the City Council on the 16th day of December, 1929. The Clerk also informed the Council that affidavits of the posting and publication of the Notice of Filing Assessment were on file in his offics` ;Wif'2 to the day set for the hearing, by Earl Fuliner, Ray Lyon, John Cross, H.M.Lane, Geo. E. %uebel, H.E.Williamson and Geo.Adamson, E. Jerome, H.O.Barrett, Chas. E. Barrett, P. Gough, William Walters, W.H.Paisons, protesting against the acceptance of the work on account of the condi- tion of the banks or slopes. The Clerk then read each of said protests to the Council. The Mayor then asked if there were any interested persons present desiring to be heard in the matter of said assessment. No one responded. The City Engineer explained the reason for the unneveness of the banks and stated that in many cases the top of the bank was back of the property line, which resulted in an uneven appearance. General discussion followed by the Council and during which Mr. Ralph P. Maskey, representing the largest property owner in the district, addressed the Council and stated that they were satisfied that the Contractor had done a good job and that they were satisfied with the work. WHEREUPON it was moved by Councilman Garfield that all appeals or ob- jections be denied, which motion was seconded by Councilman Ellsworth �r and that certain written appeals or objections had been filed in his office 271 and carried by the following vote, to-wit: AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilmen None. All interested persons having been given full opportunity to show cause why said assessment should not be confirmed and all appeals or objections presented having been heard and fully consider- ed, and the Council being satisfied that the work or improvement had been done insubstantial compliance with the requirements of the con- ' tract,-and also being satisfied with the correctness of the assess- ment and diagram filed by the Superintendent of Streets,. it was moved by Councilman Garfield that the assessment with the diagram attached be confirmed and approved and the Superintendent of Streets of the City of Newport Beach shall forthwith attach a warrant to said assessment in the-manner provided by statute, bearing the date of this order or confirmation by the City Council. Which motion being duly seconded by Councilman Calire, was carried by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilmen None. A Subdivision Map of Tract-No. 969, being the Ocean Front Lots A and B in front.of the Newport Bay Tract, was presented and considered, but on motion of Councilman Claire seconded by Council- man Garfield and carried, the Council refused to approve the Map. The plans for a float, ramp and dolphin piles for F.E.Lewis and float and ramp for Victor Fleming in front of Tract 756, to the United States District Engineer, to accompany the application for a permit to construct the same were presented and considered, and on motion of Councilman Ellsworth seconded by Councilman Claire and carried, the Council decided not to offer any objections to the con- struction of same. On motion of Councilman Claire seconded by Councilman Gar- ' field and carried, the City Engineer was instructed to Ret all the corresponr.ence together pertaining to the new sewage disposal plant. On motion of Councilman Claire seconded by Councilman Gar- field and carried, the 5 emergency demands, having been signed and _approved by the Finance Committee, were allowed and warrants to be drawn for the same. Some discussion was had in regard to the City Engineer drawing up plans for work to be brought before the Council, and on mo- tion of Councilman Hilmer seconded by Councilman Claire the City En- gineer was instructed not to do any private work without first bring- ing the matter before the Council, by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Garfield. NOES, Councilmen Ellsworth and Johnson. ABSENT. Councilmen None.
