M. on Monday, May 25, 1931- AHPROVED: May 25, 1931- Mayor, City o Nei or Beach. l' City Clerk. 31 City Hall, Newport Beach, May 25, 1931. The City Council of the City of Newport Beach met in regular adjourned-session-at-7:3O o'clock P. M. on above date. The meeting was called to order by Mayor Johnson. The roll*was called showing the full Council present. The minutes of the previous meeting were read, correct- ed and approved. The matter of crossings across the Pacific Electric Tracks at 11th and 13th Streets was brought up, and City Engineer Patterson stated the cost was so great that the request had. not been pressed, the cost being about $2,000.00. The crossings were'consider- ed necessary and on motion of Councilman Garfield seconded by Council- man Hilmer and carried, the matter was referred to the Street Committee and Street Supt. to take up with the Otto G. Wildey Co. in an effort to ' obtain the crossings. . Chief of Police Hodgkinson reported that he had secured two pedestrian crossings across the State Highway in the Seashore Colony Tract. The communications were read and acted upon as follows. The application for a pier made by W. P.*True in front of Lot 4, Block °C° Newport Bay Tract was taken up, but as it would extend beyond the bulkhead-line on motion of Councilman Garfield seconded by Councilman Hilmer and carried, the application was denied. The communication from Roy McElrath in regard to the pur- chase by the City of a strip of land which he claimed our reservoir occupied, was considered, and on motion of Councilman Claire seconded by Councilman Garfield and cattied, the City Engineer and City Attorney were instructed to ascertain what property was needed and enter into negotiations for same. On motion of Councilman Claire seconded by Councilman Gar- field and carried, the application of William Elkins for transfer of his license No. 541 from 502 East Bay Avenue to 30th Street was allowed. On motion of Councilman Claire seconded by Councilman Garfield and carried, the application of R. R. Jordan for transfer of his barber shop license No. 237 to B. P. Newman, was allowed. On motion of Councilman Garfield seconded by Councilman Claire and carried, the application of I. A. Smith for transfer of his license No. 111 to T. Mickey Fields was allowed. The application of the Crystal Cleaners laid over from ' last meeting for transfer of their dry cleaning license No. 519 from 609 East Central to 605 East Central, was allowed. On motion of Councilman Claire seconded by Councilman Gar- field and carried, the application of N. E: 2llison for transfer of his license No. 196 to William Street, was allowed. On motion of Councilman Garfield seconded by Councilman Ellsworth and carried, the application of Jack Frederick'for transfer of his barber shop license No. 144 to Morrisey & Eckert, was allowed. On motion of Councilman Garfield seconded,by Oouncilman Ellsworth and carried, the application of H. M. Ferguson for transfer of his real estate license No. 46 from Marine & Balboa Avenue to 114 Agate Street was allowed. On motion of Councilman Hilmer seconded by Councilman Gar- field and carried, the application of H. M. Ferguson for transfer of his Grocery store license to Richard C. Johnson was allowed. (�J 314 � On motion of Councilman Garfield seconded by Councilman Ellsworth and carried, the applications of Jessie A. Preston for license to sell sandwiches at 713 Bay Avenue, was allowed subject.to the approval of the Health Officer. On motion of Councilman Claire seconded by Councilman Gar- field and carried, the application of Bob Keitten for license to operate a portable lunch stand on the streets was denied. On motion of Councilman Garfield seconded by Councilman Claire and carried, the application of A. E. Shields for license to sell extracts, spices and toilet articles without a definite location, . was denied. The affidavit of Geo. C. Hiner attached to the bills paid by him for the construction of a live bait stand on the outer end of the Newport wharf was presented, and on motion of Councilman Ells - ' worth seconded by Councilman Garfield and carried, the same was order- ed filed until such time as bids for the live bait concession are call- ed for. The communication from A. E. De Mott, Chairman of the engineers Section of the School of Public Administration Short Course, calling attention to their program from June 8th to the 13th was con- sidered, and on motion of Councilman Claire seconded by Oouncilman Garfield and carried, the communication was referred to the City Engineer to look into. On motion of Councilman Claire seconded by Councilman Gar- field and carried, the communication.from.G. D. Walker, Director of the University News Bureau to Mayor Johnson enclosing copy of an article they would like to have printed, was filed. The communication from Gilbert E. Wilson, Chairman of the Orange County Ooast Commfmities to Mayor Johnson, asking that a good delegation attend their next meeting at Laguna Beach June 6th was pre- sented, and on motion of Councilman Hilmer seconded by Councilman Garfield and carried, the Mayor was requested to attend the meeting if possible. On motion of Counciliian'Garfield seconded by Councilman Hilmer and carried, the communication from the Corona Del Mar Property Owners Assn. in regard to globes being burned out of the Neon Sign along the State Highway, was'filed as the Electrician had already re- placed the globes. , On motion of Councilman Claire seconded by Councilman Hilmer and carried, the resignation of R. E. Baldridge as City Police- man was accepted with regrets, and the City Clerk instructed to notify him to that effect. On motion of Councilman Claire seconded by Councilman Garfield and carried, the communication from Reuel L. Olson calling attention to a book published by him called °The Colorado River Oom- pact ", was referred to the Water Committee with power to purchase the book if they think best to have it. On motion of Councilman Claire seconded by Councilman Ellsworth and carried, the application of D. K: Blue for permission to install an underground gasoline tank at the corner of Coast Blvd. and 30th Street, was granted subject to the approval bf the Fire Chief. On motion of Councilman Claire seconded by Councilman Gar- field and carried, the communication from 0. E. Brown asking that the beach be raked between the pier and "F" Street before the summer crowds come; was referred to the Street Supt. for attention. The communication from H. S. MacKay, Jr. asking that we send a resolution protesting against the Governor signing Assembly Bill No. 4 recently passed, was considered, and on motion of Councilman Ellsworth seconded by Councilman Garfield and carried, the matter was laid on the table to next meeting. The communication from Ingle Carpenter in regard to the drain pipes from tE" Street into the bay being in a dangerous condition, was considered, and on motion of Oouncilman Ellsworth seconded by Council- ' man Garfield and carried, the matter was referred to the Street Supt. for such action as he thinks best. On motion of Councilman Claire seconded by Councilman Gar- field and carried, the communication from Miss Helen Coffin commending the Street Dept. and helpers for the excellent service rendered in the collection of garbage and trash during the street improvement work in West Newport, was referred to the street Supt. On motion of Councilman Garfield seconded by Councilman Ellsworth and carried, the request of Fire Chief Crocker for transfer of funds necessar to complete the year's budget in the Fire and Life Saving Depts. of 985.00, was granted. 315 A communication from the West Newport Improvement Assn. asking that the name of Railroad Avenue in west Newport be changed and suggesting the name of Olubhouse Avenue, was considered,and on motion of Councilman Claire seconded by Councilman Ellsworth and carried, the matter was referred to the City Attorney to draw up a resolution changing the name. UNFINISHED BUSINESS. Orddnance No. 393 repealing license Ordinance No. 361 was brought up for second reading, and on motion of Councilman Claire second- 'ed by Councilman Ellsworth and carried, the Ordinance was laid on the table to next meeting. NEW BUSINESS.. City Attorney Thompson presented an Ordinance prohibiting loud and unusual noises in the City. The.Ordinance was read, considered, designated Ordinance No. 394, and on motion of Councilman Ellsworth seconded by Councilman Garfield and carried, the Ordinance was passed to the second reading. A Corporation Grant Deed dated the 4th day of January, 1929, from the TITLE INSURANCE & TRUST COMPANY, a corporation, to the CITY OF NEWPORT BEACH, a Municipal Corporation, granting to said City of Newport Beach all that certain real property situate in the County of Orange, State of California, and more particularly described as.follows; to -wit: Lots A, B, 01 D, E, F, G, H, I, J, R, L, M, N, 0, P, in Tract No. 907, in the Oity of Newport Beach, Orange County, California, being a subdivision of a portion of Parkinson Island lying within the boundaries of Sections 27, 29, 33 and 34, and Lots 3 and 6 of said Section 29, all in Township 6 South, Range 10 West, S. B. B. & M., known as LIDO ISLE, Newport Bay. SUBJECT to easements, conditions, restrictions and ' rights -of -way of record. WHEREUPON, Councilman A. J. Garfield made a motion, duly seconded by Councilman Hermann Hilmer and carried, that said Quitclaim Deed be accepted by said City of Newport Beach, and the Clerk instructed to record the same forthwith with the County Recorder of Orange County, California. That said motion was carried by the following vote, to —wit: AYES,000NCILMEN:.Hilmer, Claire, Ellsworth, Garfield, Johnson. NOES,OOUNCILMEN: None. ABSENT,OOUNCILMEN:vNone. The application of W. E. Jewell and R. R. Russell for permission to construct a pier in front of Lots 34 and 35 Tract 884 was presented, and on motion of Councilman Claire seconded by Councilman Garfield and carried, the application was laid on the table for the customary two weeks. On motion of Councilman Claire seconded by Councilman Garfield and carried, the application of H. C. Ross for permission to-construct a pier in front of Lot 5, Block 5, Section 2, Balboa Island, was referred to the City Engineer for the outrtomary two weeks. On motion of Councilman Claire seconded by Oouncilman Garfield and carried, the application of H. H. Benjamin and S. P. Kraemer for permission to construct a pier in front of Lots 11 and 12, Block 15, Balboa East Side,was referred to the City Engineer for the customary two weeks. This being the time set for hearing to show cause why the._dilapidated building located on Lot D between the extended lines of Block A 35 of Corona Del Mar in the City of Newport Beq,ch belonging to Raymond Gleaner, should not be declared a nui- sance and removed. The Mayor inquired for Mr. Gleaner who was not present, but a communication was read from him promising to remove the building right away, and the hearing was postpo±Lad to June let. MINUTES CONCERNING LAFAYETTE AVENUE IMPROVEMENTS. The City Clerk reported that this was the time and place fixed for the hearing of protests or objections against the work, the assessment district or grades described in Reso- lution of Intention No. 683 in the matter of the improvement of Lafayette Avenue and certain other streets, alleys and easement in the City of Newport Beach California, adopted by the City Council of said City on the 4th day of May, 1931- Reference is hereby made to said Resolution of In- tention on file in the office of the City Clerk for a particu- lar description of the work to be done. The Clerk also reported'that the affidavit of publica- tion of the Resolution of Intention and of the posting of the Notice of Improvement as required by law had been made and were on file in the office of the City Clerk. 3 1.9 The Clerk also reported that he had received written protests from Edna R. Storey and others representing 17:10ts in the assessment district. The Mayor then announced that this was the time and place set for the hearing of protests or objections against the proposed work or against the proposed district or against the proposed grades as set forth in the said Resolutioh of Intention No. 653, and asked if anyone present desired to file any written protest or make any oral objections against the proposed improvement or to the extent of the district to be assessed or to the proposed grades. All protestants having been heard, an opportunity having been given to all persons desiring to be heard, and a full, fair and impartial hearing having been granted, and the City Council having before it the diagram of the assessment district and being familiar with the said assessment district, and also having considered all protests filed and having considered the character and nature of the proposed work and the necessity for the same and having considered the matter as to the area of/the property to be assessed for the said improvement repr.esentbd( by the several protestants, Councilman Claire presented the following resolution and moved its adoption: WHEREAS, certain protests have been filed by Edna R. Storey and others protesting against the doing of the work described in Resolution of Intention No. 653 in the matter of the improvement of Lafayette Avenue and certain other streets, alleys and easement in the said City of Newport Beach, and WHEREAS, the City Council has carefully considered all protests or objections, HOW, THEREFORE, BE IT RESOLVED, by this City Council that it does hereby find and determine that the said protests or objections have been made by the owners of less than one -half of the area of the property to be assessed for the said work and improvement as-set forth in the said assessment district in said Resolution of Intention No. 653, and BE IT FURTHER RESOLVED, that each and all of the said protests or objections be, and the same are hereby overruled and denied. ' Said motion was duly seconded by Councilman Ellsworth and upon roll call the same was adopted by the following vote, to -wit: AYES, Councilmen Hilmar, Claire, Ellsworth, Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilmen None. Councilman Hilmar then offered and moved the adoption of RESOLUTION Ordering Work NO. 654 in the matter of the improvement of Lafayette Avenue and certain other streets, alleys and easement in the City of Newport Beach, which motion was duly seconded by Councilman Ellsworth and upon roll call the same was adopted by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilmen None. Councilman Claire then offered and moved the adoption of RESOLUTION NO. 655 ordering that the improvement of Lafayette Avenue and certain other streets, alleys and easement shall be done under the direction of the City Engineer instead of the Superintendent of Streets, which motion was duly seconded by douncilman Hilmer and upon roll call the same was adopted by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson. NOES) Councilmen None. ABSENT, Councilmen None. City Engineer Patterson presented plans and specifications for the dredging of the channel.opposite the Newport Harbor Yacht Club, estimating that there would be approximately 27,000 cubic yards of material to be removed at a cost of Six Thousand Seven Hundred Fifty (46;750.00) Oolli2s' . About 10,000 cubic yards of the material could be sold to fill adjacent property for Seven (7cents) Cents per cubic yard. Councilman Claire then offered and moved the adoption of RESOLUTION N0. 656 adopting the specifications and plan, being Plan No- 395, for the dredging and widening of the Channel northerly of the U. S. Bulkhead line between Stations 116 and 117 in the City of Newport Beach, and ordering the City Clerk of said City to invite proposals for doing said work, which motion was duly seconded by 320 Councilman Ellsworth, and upon roll call the same was adopted by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson. NOES, CouncilmeS None. ABSENT, Councilmen None. Councilman Garfield Garfield presented the following Resolution and moved its adoption: WHEREAS, the public interest and convenience require the dredging and widening of the channel northerly of the U. S. Bulk- ' head line between Stations 116 and 117 in order to provide a channel for navigation, ' WHEREAS, the Oity Oouncil has heretofore approved the plans and maps showing the location, extent.and character of said improvement, NOi7, THEREFORE, BE IT RESOLVED, by this City Council that it does hereby authorize the City Engineer to make application to the United States District Engineer's Office at Los Angeles, for an approval of §hid plans and a permit to do said dredging in accordance with the aforesaid plans. Said motion was duly seconded by Councilman Hilmer and upon roll call the same was adopted by the following vote, to -wit: AYES, Oouncilmen Hilmer, Claire; Ellsworth, Garfield, Johnson. NOES, Oouncilmen None. ABSENT, Councilmen None. The City Engineer presented a plan of a bridge over the old Santa Ana River channel to accompany the application for a permit to the United States District Engineer's Office, and on motion of Council- man Garfield seconded by Councilman Claire and carried, the plan was approved. Councilman Claire presented the following Resolution and moved its adoption: WHEREAS, the public interest and convenience requires the construction of a highway bridge and the re- location of the existing railroad bridge across the old channel of the Santa Ana River, approximately 100 feet westerly of U. S. Bulkhead Station ' No. 126.aa shown upon a map of Newport Bay, California, showing harbor lines, approved by the War Department January 18, 1917, in order to provide for a separation of grades at the intersection of the State Highway and Newport Road. WHEREAS, this City Council has heretofore approved the plans and maps showing the location and extent and character of said improvement. NOW, THEREFORE, BE IT RESOLVED, by this City Council that it does hereby authorize the City Engineer to make application to the United States District Engineer's Office at Los Angeles, for approval of said plans and a permit to construct said bridge and re- locate said railroad bridge in accordance with the-aforesaid plans. Said motion was duly seconded by Councilman Ellsworth and upon roll call the same was adopted by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilmen None. A letter from Frank L. and T7. S. Smith of Balboa stating that C. Harold Hopkins had Block B of Bayside Tract surveyed and finds there is a discrepancy of 2 feet, and he had requested the Council to vacate 2 feet off from the westerly side of Washington Street. The same was considered and on motion of Councilman Ellsworth seconded by Councilman Garfield and carried, the matter , was laid on the table to next meeting. Dity Engineer Patterson reported that he had employed Miss Gerdeman in Mary Bellomy Windringer's place at a'salary of $100.00 per month, and on motion of Councilman Claire seconded by Councilman Hilmer and carried, the appointment was approved.
