A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH ORDERING THE SUPERINTENDENT OF STREETS
OF SAID CITY TO PREPARE A REPORT AND AN AMENDED ASSESS -
MENT OF ASSESSMENT NO. 1+05 FOR THE IMPROVEMENT OF
CENTRAL AVENUE AND CERTAIN OTHER STREETS AS PER RESOLU-
TION OF INTENTION NO. 196.
The Resolution was read, considered, designated RESOLUTION
NO. 695, and upon call of the roll passed by the following vote, to -wit:
AYES, Councilmen Claire, Garfield, Johnson.
NOES, Councilmen None.
ABSENT, Councilmen Hilmer and Ellsworth.
Councilman Garfield introduced a Resolution entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE OITY OF
NE17PORT BEACH ORDERING THE SUPERINTENDENT OF STREETS'
OF SAID CITY TO PREPARE A REPORT AND AN AMENDED ASSESS-
MENT OF ASSESSMENT NO. 2714 FOR THE SEWER IMPROVEMENT
IN CENTRAL AVENUE AND CERTAIN OTHER STREETS AS PER
RESOLUTION OF INTENTION NO. 133-
The Resolution was read, considered, designated RESOLUTION
NO. 696, and upon call of the roll passed by the following vote, to -wit:
AYES, Councilmen Claire, Garfield, Johnson.
NOES, Councilmen None.
ABSENT, Councilmen Hilmer and Ellsworth.
On motion of Oouncilman Garfield seconded by Councilman Claire
and carried, Arthur M. Ellis' Office was authorized to carry on all
necessary proceedings in the matter without cost to the City.
There being no further business embodied in the call, on
motion of Councilman Claire seconded by Councilman Garfield and carried,
the meeting adjourned.

City Hall, Newport Beach, June 29, 1931.
The City Oouncil of the City of Newport Beach met in regular
adjourned session at 7:30 o'clock P. M. on above date. The meeting was
called to order by Mayor Johnson.
The roll was called showing the full Council present.
The minutes of the regular meeting of June 15th and the
special meeting of June 23rd were read and approved as read.
City Attorney Thompson presented a written report in regard to
the Fred B. Mills property in East Newport purchased from the City,
stating that inasmuch as the Resolution of abandonment had not been
'recorded at the time Mr. Mills purchased the property from the City and
he would not have purchased it had he known the street was abandoned, he
would adit se re- dedicating the street. On motion of Councilman Claire
seconded by councilman Garfield and carried, the report was accepted and
filed.
On motion of Councilman Claire seconded by Councilman Hilmer
and carried, the City Attorney was instructed to prepare an Ordinance
re- dedicating the street in question.
The report of Building Inspector Nelson in regard to the old
building in West Newport complained of belonging to A. J. Borden, was
read, and Mr. Borden was present and addressed the Council explaining
the cause of the delay in repairing the building, and expected now to
proceed faster with the work. The matter was considered and on motion
of Councilman Olaire seconded by Councilman Garfield and carried, 30

days extension of time was granted Mr. Borden, and the Building Inspector
was instructed to make a report at that time what progress had been made.
The communications were read and acted upon as follows:
The claim of the Veterans Wellfare Board for refund of taxes
to be levied against Lot 41, Tract 948 was considered, and on motion
of Councilman Ellsworth seconded by Councilman Claire and carried, the
matter was referred to the City*Attoiney and Finance Committee.
The application of Philip Lelif covering a hot dog stand on
the Newport pier laid over from last meeting, was &ghin taken up and
the applicant not -being present or represented, on motion of Council-
man Claire seconded by Councilman Hilmer and carried, the application was
denied.
On motion of Councilman Hilmer seconded by Councilman Gar-
field and carried, Miss Marion Turner was reappointed at a salary of
$125.00 per month.
On motion of Councilman Garfield seconded by Councilman
Claire and carried, the communication from the Board of Fire Under-
writers giving the Acceptance Tests"of the two fire trucks recently
purchased, was filed.
The communication from T. W. Neale complaining of the old
auto bodies dumped on the vacant lot adjoining his on Corona Del Mar,
was considered and on motion of Councilman Claire seconded by Council-
man Garfield and 'carried, the communication was referred to the Street
Superintendent for attention.
The report'of M. S. Robinson on the communication of G. E.
Halderman in regard to the boat anchored in front of his property, was
considered, and on motion of Councilman Claire seconded by Councilman
Garfield and carried, the report was accepted and filed.
'On motion of Councilman Claire seconded by Councilman
Ellsworth and carried, the communication from the Harbor Master in
regard to the condition of the County Dock, was filed.
On motion of Councilman Garfield seconded by Councilman
Claire and carried, the request of Campbell & Hooper for license to
operate a pool and billiard hall and card tables at Balboa, was granted.
On motion of Councilman Claire seconded by Councilman
Garfield and carried, the application of E. J. O'Donnell for disabled
Veterans license to sell Ice Cream was denied.
The application of Benjamin & Kraemer for permission to
construct a pier in front of lots 11 and 12, Block 151 Balboa East
Side was presented, and on motion of Councilman Garfield seconded by
Councilman Ellsworth and carried, the same was.allowed.
On motion of Councilman Claire seconded by Councilman
Garfield and carried, the contract with Foster & Kleiser for a sign
board, was referred to the City Attorney for a report at the next
meeting. _
The communication from Prentiss Shafer that only 1 hour
parking be allowed on °B" Street northerly of Central Avenue, was
considered, and on motion of Councilman Claire seconded by Council-
man Ellsworth and carried, the communication was referred to the
Police Committee.
On motion of Councilman Hilmar seconded by Councilman
Garfield and carried, the communication from the Corona Del Mar Prop-
erty Owners Association in regard to the quiet title suit for beach
frontage to be filed, was referred to the City_Attorney for.reply.
On motion of Councilman Garfield seconded by Councilman
Hilmer and carried, the communication from Geo. E. Rogers asking
that parking be allowed only on one side of Bay View Avenue, was
referred to the Police Committee.
On motion of Councilman Ellsworth seconded by Councilman
Garfield and carried, the communication from Hal Will Smith.and Alex
R. McGregor asking for various regulations on Balboa Island, was
referred to the Police Committee.
A Map of Tract No. 590 being a subdivision of Lot 73 of
Newport Heights, from the Orange County Planning Commission, was
presented for approval, and on motion of Councilman Hilmar seconded.
by Councilman Garfield and carried, the tentative map was approved.
On motion of Councilman Hilmer seconded by Councilman
Ellsworth and carried, the letter of R. L. Patterson accompanying the
Map was filed.
The communication from City Engineer Patterson accompanied
by a list of employees in his departments which he asked to have con-
firmed, was considered, and on motion of Councilman Claire_ seconded
by Councilman Garfield and carried, the list was approved with the
understanding that the salaries can be changed at any time.
A communication from City Engineer Patterson stating that
the Newport Beach Boat Builders had completed their dredging contract

according to the plans and specifications and recommended that the
work be accepted. On motion of Councilman Claire seconded by Council-
man Garfield and carried, the work of dredging was accepted.
On motion of Councilman Hilmer seconded by Councilman
Garfield and carried, the letter of City Engineer Patterson was filed.
On motion of Councilman Garfield seconded by Councilman
Hilmer and carried, the communication from Major Lanagan approving the
plans for a bridge across Newport Bay, was filed.
UNFINISHED BUSINESS.
The petition accompanied by numerous protests against renew -
ing the Orange County Refining Co. license, numbering 463 lots in all,
were considered, and the letter from the West Newport Improvement
Association was read. City Attorney Thompson read-an opinion which he
had prepared to the effect that as the Refinery had not been declared
officially to be a nuisance, the Council would not be justified in
denying them a license. Mr. Maskey asked that the Secretary of the
West Newport Improvement Association be permitted to read the Ordinance
regulating the Refinery, which was granted. Mr. Maskey, Mr. C. S.
Welch and others spoke of the damaging effect of the Refinery and Dr.
Richter spoke in favor of it. After considerable discussion in regard
to the matter on motion of Councilman Claire seconded by Councilman
Ellsworth and carried, the petition and letters in regard to same were
ordered filed.
On motion of Councilman•Olaire seconded by Councilman Garfield
and carried, the report of the City Attorney was filed.
NEW BUSINESS.
Councilman Claire presented a report of the Police Committee
recommending the permanent appointment of Walter Dyson and J. H. Summers
as patrolmen at.a salary of 4135.00 per month, and permanent employment
of H. L. Hatcher as Clerk at a salary of $125.00 per month, and on
motion of Councilman Claire seconded by Councilman Ellsworth and carried,
the appointments as made were approved, and authority was also given to
hire special officers at 65.00 per day or $125.00 per month for a
limited period.
The Clerk notified the Council that this was the time and
place fixed pursuant to Notice Inviting Bids for bonds to obtain
immediate possession in the matter of Acquisition and Improvement District
No. 1 of the City of Newport Beach, and also reported that no bids had
been received in said matter.
After some consideration on motion of Councilman Claire
seconded by Councilman Ellsworth and carried, the Clerk was instructed
to re- advertise for bids for bonds to obtain immediate possession in
Acquisition and Improvement District No. 1 of the City of Newport Beach,
said bids to be opened August 3, 1931.
On motion of Councilman Claire seconded by Councilman Garfield
and carried, the City Auditor was instructed to prepare a complete
financial report of Acquisition and Improvement District No. 1 of the
City of Newport Beach for prospective buyers of the bonds.
A letter from S. V. Cortelyou, District U. S. Engineer to
R. L. Patterson accompanied by a map showing a change in grades desired
by the State preparatory to the time the new State Highway grade is
constructed, which was considered and on motion of Councilman Garfield
seconded by Councilman Ellsworth and carried, the grades as outlined
were approved.
On motion of Councilman Garfield seconded by Councilman Hilmer
and carried, the letter andplan accompanying was ordered filed.
' Mayor Johnson stated it was necessary for him to make some
appointments at this time. He appointed V. A. Tripp as Master
Electrician, and on motion of Councilman Garfield seconded by Councilman
Ellsworth and carried, the appointment was confirmed.
He also appointed Percy N. Pellett as Journeyman Electrician,
and on motion of Councilman Garfield seconded by Councilman Claire and
carried, the appointment was confirmed.
He then appointed Roy Shafer as Journeyman Plumber, and on
motion of Councilman Claire seconded by Councilman Garfield and carried,
the appointment was confirmed.
Mayor Johnson then stated that the term of office of two
members of the Library Board was about expired, and he reappointed H. L.
Sherman for a three year term expiring June 30, 1934. On motion of
Councilman Claire seconded by Councilman Garfield and carried, the
appointment was confirmed.

He also reappointed Margaret R. Burlingame for a three year
term expiring June 30, 1934, and on motion of Councilman Claire second-
ed by Councilman Garfield and carried, the appointment was confirmed.
City Attorney Thompson stated the City was involved in the
suit for taking water outside the Santa Ana River Basin, and it would
be necessary for some one to appear for the City. On motion of Council-
man Claire seconded by Councilman Garfield and carried, the City
Attorney was authorized to appear and defend the City in the case.
On motion of Councilman Claire seconded by Councilman Gar-
field and carried, the budget for the coming year as supplied by the
City Auditor, was approved.
There being no further business on motion of Councilman
Claire seconded by Councilman Garfield and carried, the meeting
adjourned Sine Die.

The City Council of the City of.Newport Beach met in
regular session at 7:30 o'clock P. M. on above date. The meeting was
called to order by Mayor Johnson.
The roll was called showing the full Council present.
The minutes of the previous meeting were read and approved
as read.
The reports of the heads of the departments were read and
on motion of Councilman Claire seconded by Councilman Ellsworth and
carried, the reports were accepted and-filed.
City Attorney Thompson was given more time to report on
the taxes of the Veterans Welfare Board and the Foster and Kleiser
contract.
Councilman Claire reported that the signs for the speedway
on Balboa Island would cost about $100.00, and he was given more time
to investigate it further.
.Tlye communications were read and acted upon as follows:
The application of Mrs. Roger Goodan for a permit to construct
a pier in front of Lot 20 of Bay Island was.considered, and on motion
of Councilman Claire seconded by Councilman Hilmer and carried, the.
application was laid on the table for two weeks, and the City Engineer
instructed to notify her that the Council could not grant.her a permit
to exceed 50 feet in length.
A communication from City Engineer Patterson stating that
Harry Friedman had completed the aeration tank in accordance with the
plans and specifications and recommended that the work be accepted, was
presented, and on motion of Councilman Garfield seconded by Councilman
Ellsworth and carried, the.work was accepted and the communication
filed.
On motion of Councilman Hilmer seconded by Councilman Gar-
field and carried, the communications from the L. A. Herald and
L. A. Record in regard to allowing the newsboys to call out their
papers, seas filed.
On motion of Councilman Claire seconded by Councilman
Ellsworth and carried, the invitation of the Long Beach Chamber of
Commerce to the dedication of Hathaway Avenue as a portion of the
State Highway System, was filed.
The petition signed by 9 property owners of Rest Newport
asking that 6 lights be installed between Club House Avenue and the
Rialto which would cost approximately $2.72 per lamp for installation
and yearly maintenance, was considered, and.on motion Of Councilman
Ellsworth seconded by Councilman Garfield and carried, the matter was
