On motion of Councilman Hilmer seconded by Councilman Garfield
and carried, the demands which were in proper form and signed and
approved by the Finance Committee, were allowed and warrants to be
drawn for same.
City Engineer Patterson recommended that the Council arrange
a meeting with the Laguna Beach Water Co. and perhaps James Irvine in
regard to the water suits filed against these communities as soon as
possible, but it was decided to hold an informal meeting of the Oouncil,
City Attorney and City Engineer first.
There being no further business on motion of Councilman'
Claire seconded by Councilman Garfield and carried, the meeting ad-
journed to 7:30 o'clock P. 14. on Monday, July 132 1931.

The City Council of the City of Newport Beach met in regular adjourned
session at 7;30 o'clock P.M. on above date. The meeting was called to or-
der by Mayor Johnson.
The roll was called showing the full Council present.
The minutes of the previous meeting were read, corrected and app- '
roved.
City Attorney Thompson presented a written report in regard to the
communication from the Veteran's Welfare Board, and giving it as his
opinion the taxes should be cancelled on Lot 41, .Tract 948, and on motion'
of Councilman Claire seconded by Councilman Garfield and carried, the re-
port was accepted and filed.
Councilman Claire introduced a Resolution directing and instructing
the City Treasurer to cancel the city taxes against Lot 41, Tract 948
but not any special assessments for street improvements. The Resolution
was read, considered, designated RESOLUTION NO. 699, and upon call of
the roll passed by the following vote, to -grit:
AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield,Jonnson.
NOES, Councilmen None.
ABSENT, Councilmen None.

WHEREAS, Pursuant to instructions the City Attorney of the City of
Newport Beach has this day prepared a contract and presented the same for
consideration to the city Council of the City of Newport Beach, in which
said contract the City of Newport Beach grants to Foster and Kleiser '
Company a certain franchise or license to erect, construct and main-
tain a sign board on certain described city property, said license or
franchise being granted upon the express terms, conditions and coven-
ants or said written lease.
NOW, THEREFORE, BE IT RESOLVED; That said contract be, and the
same is hereby approved as written by the City Council of said City of
Newport Beach and the Mayor of said City and the City Clerk or said
City shall, and they are hereby authorized to sign the same on behalf
of said City.

The COM MICATIONS were read and acted upon as follows:
The petition signed by 9 property owners laid over from last
meeting, asking that the grade separation at the Arches be hurried as
much as possible, was again taken up, but as the City Engineer had not
heard from the State Department in regard to what they were willing to
do, on motion of Councilman Garfield seconded by Councilman Claire and
carried, the matter was laid on the table until something definite was
obtained from the State and County.
A communication from C.+l.Glilson complaining of swiiamers in the bay
at Montero Street from 12 to 3 A.M., Was considered, and on motion of
Councilman Garfield seconded by Councilman Hilmer and carried, the matter
was referred to the Police Committee.
The communication from Chas. I1. Wilson referring to the tide and
the public digging the sand from under the sidewalk on Buena Vista Blvd.
was considered, and on motion of Councilman Hilmer seconded by Council-
man Garfield and carried, the matter was referred to the Street Super-
intendent to investigate and remedy.
On motion of Councilman Ellsworth seconded by Councilman Garfield
and carried, the communication from the Wax Department calling a hear-
ing on the application of 17.P.True for permission to construct his pier,
was filed.
On motion of Councilman Garfield seconded by Councilman Hilmer and
carried, the report of City Treasurer Gant on the purchase of four pieces
of property at the County Tax sale July let, was approved and filed.
On motion of Councilman Hilmer seconded by Councilman Ellsworth
and carried, the communication from S.H.Finley, Secretary of the Ilet-
ropolitan Water District, stating that they had referred our application
for annexation to the Metropolitan Water District to their Chief Engin-
eer, General Counsel and Chairman of the Committee on Public Information,
was filed:
UNFINISHED BUSINESS.
The petition of 9 property owners of west Nee -port asking the
installation of 6 lights between Finley Avenue and the River Channel,
Was again taken up and City Engineer Patterson reported that it would
cost the City $199.000 a year for the 6 lights on the basis named by
the Edison Co. which he considered pretty high. He would recommend that
lighting zones be established all over the City to pay for installations
and the City to furnish the -electric energy for same. The matter was
considered and on motion of Councilman Garfield seconded by Councilman
Ellsworth and carried, the matter was laid on the table until Mr.Maskey
could obtain further information from the property owners in the dis-
trict as to whether this would be agreeable to them.
City Engineer Patterson reported that he had repaired the side-
walk complained of by Allen Break at the end of Alvarado Place, and on
motion of Councilman Garfield seconded by Councilman Ellsworth and carr-
ied, the communication from Mr. Break was filed.
NEW BUSINESS.
ITINUTES FOR CONFIRMATI0II OF REPORT AND ANLEYDED ASSESS:.IE17.
The Clerk advised the City'Council that this was the time and place
fixed pursuant to statute and notice given for the hearing in the matter
of the reroort and amended assessment of Assessment No. 2714 for the con-
struction of Sanitary sewers in Central Avenue and certain other streets,
easements and property owned by the City of Newport Beach, as provided

in Resolution of Intention No. 133 adopted by the Board of Trust-
ees (now City Council) of said City on the 6th day of July,1920,
and that an affidavit of the publication of the notice of filing
said amended assessment was on file in his office.
The Mayor asked if there were any interested persons desiring
to be heard in the matter. No written protests had been received,
but R.S.Briggs, appeared before the Council and made verbal objec-
tion to the report and amended assessment.
All interested persons having been given full opportunity to
Scs. show cause why said report and amended assessment should not be con -
-� ,(-firme and al being satisfied with the correctness of said report
and amended a ss essment, thereupon Councilman Claire moved that said
re_oort and amended assessment be approved and confirmed and that the
Street Superintendent note opposite the original Assessment No.2714
the fact that it had been displaced by the said amended assessment
and confirmed by the City Council July 13, 1931. Whtbh motion was
seconded by Councilman Garfield and carried by the following vote,
to -wit:
AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson.
NOES, Councilmen None.
ABSENT, Councilmen None.
The Clerk advised the City Council that this was the time and

No. 196 adopted by the Board of Trustees (now City Council) of said

lication of the notice of filing said amended assessment was on file
in his office.
The Mayor asked if there were any interested persons desiring
to be heard in the matter. No written or verbal objections were
offered.
All interested persons having been given full opportunity to
show cause why said report and amended assessment should not be
confirmed and all objections presented having been heard and fully
considered, and the Council being satisfied with the correctness
of the said report and amended assessment, thereupon Councilman
Claire moved that said report and amended assessment be approved
and confirmed and that the Street Superintendent note opposite the
original assessment No. 1405 the fact that it had been displaced
by the said amended assessment and confirmed by the City Council
July 13, 1931. Which motion was seconded by Councilman Garfield
and carried by the following vote, to -wit:
AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield�Johnson.
NOES, Councilmen None.
ABSENT, Councilmen None.
City Attorney Thomason presented an Ordinance re- dedicating a
portion of First Street in East Newroort. The Ordinance was read,
considered, designated Ordinance No. 396, and upon motion of Coun-
cilman Claire, seconded by Councilman Ellsworth and carried, the

Ordinance was passed to the second reading.
City Attorney presented a trritten report giving the status of
the various Superior Court cases in which the City of Newport Beach
is a party, and on motion of Councilman Claire seconded by Councilman
Garfield and carried the report was accepted and filed.
On motion of Councilman Claire seconded by Councilman Hilmer and
carried, the demand of Bill Couvert for a portion of his salary omitted
at the last meeting, was alloi7ed and warrant to be drawn for same.
There being no further business on motion of Councilman Garfield
seconded by Councilman Hilmer and carried, the meeting adjourned '
to 7:30 o'clock P.M. on Monday, July 20, 1931
