HomeMy WebLinkAbout08/10/1931 - Adjourned Regular Meetingk 34 5 City Hall, Newport Beach, August 10, 1931 The City Council of the City of Newport Beach met in regular adjourned session at 7:30 o'clock P.M. on above date. The meeting was called to order by'Mayor Johnson. The roll was called showing all members present except Council- man Ellsworth. The minutes of the previous meeting were read and approved. Councilman Garfield was granted additional time to report on the new sewer location matter. City Engineer Patterson reported that he had closed off the street end on Balboa Island complained of by Julian Van Duesen. City Engineer Patterson was not ready to report on the re- placement of trees for F.J.Moran on Corona Del Mar and was granted more time. City Attorney Thompson reported that he would not recommend a refund of the taxes paid by L.J.Ozenne on his automobile. He also reported that upon examination of Ordinance No. 4 of the City appointing standing committees, that one member was all that was required except on the Finance Committee. The communications were read and acted upon as follows: The communication from the Newport Harbor Outboard Association asking permission to hold boat races on the bay seven days each year without restrictions of speed and mufflers, was considered, and on mo- tion of Councilman Claire seconded by Councilman Hilmer and carried, the City Clerk was instructed to notify them that the Council could grant permission for the races but the Ordinance requires the use of mufflers. The communication from the Nuoil Company asking the City to allow them to drill for oil and operate a refinery in the city with- out paying any tax or license and to be furnished water free, was con- sidered, and on motion of Councilman Claire seconded by Councilman Hil- mer and carried, the City Clerk was instructed to send them a copy of the Ordinance prohibiting drilling, and notify them that the Council passed the ordinance and expected to enforce it. UNFINISHED BUSINESS. ' ORDINANCE N0. 397, entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEW- PORT BEACH GRANTING TO THE SOUTHERN PACIFIC RAIL- ROAD COMPANY CERTAIN PRIVILEGES, came up for final passage, was considered, and upon the roll being called was passed by the following vote, to -wit: AYES, Councilmen Hilmer, Claire,Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilmen Ellsworth. NEW BUSINESS. A Quitclaim deed dated the 10th day of June, 1931, from the WILSHIRE OIL COMPANY, Inc., a Corporation, to the City of Newport Beach, a Municipal Corporation, remising, releasing and quitclaiming to the City of Newport Beach all of its right, title and interest in and to a sixty (60) foot easement situated in the County of Orange, State of California, and more particularly described as follows, to -wit: The 60 foot easement as assigned to the Wilshire Oil Company, Inc. by the La Habra Valley Land and Water Company, January 23:,: 1931, and recorded in Book 468 page 499 of Official Records, Records of said Orange County, across the parcel of land in Lot 172, Block 1 of Irvine's Subdivision as shown on map recorded in ' Book 1, page 88 of Miscellaneous Record Maps, Records of said Orange County, as described in deed recorded in Deed Book 403, page 137, Records of said Orange County, was presented to the City Council of the City of Newport Beach, Cal- ifornia. WHEREUPON, Councilman Lloyd Claire made a motion duly seconded by Councilman A.J.Garfield and carried, that said Deed of Easement be accepted by said City of Newport Beach, and the Clerk instructed to re- cord the same with the County Recorder of Orange County, California. That said motion was carried by the following vote, to -wit: AYES, Councilmen Hilmar, Claire, Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilmen Ellsworth. 346 City Attorney Thompson presented a notice of suit filed -4 against the City of Newport Beach by 0. Eliason for $75,000.00 for destruction of -the Boat Muriel, and on motion of Councilman Garfield seconded by Councilman Claire and carried, the City Attorney was auth- orized to defend the City in the action. MINUTES FOR HEARING ON ASSESSMENT FOR THE IMPROVEMENT OF RIVER AVENUE. The Clerk advised the Council that this was the time and place fixed pursuant to statute and notice given for the hearing in the matter of the assessment for the improvement of River Avenue ' and certain other streets, alleys and easements within the City of Newport Beach, initiated by Resolution of Intention No. 621, passed and adopted on the 15th day of September, 1930. . The Clerk also informed the Council that affidavit of the posting and publication of the notices of filing of the assessment were on file in his office and that he had received no written appeals or objections. The Mayor then asked if there were shy interested persons present desiring.to be heard in the matter of the said assessment, but no one responded. All interested persons having been given full opportunity to show cause why said assessment should not be confirmed, and all appeals or objections presented having been heard and fully considered, and the Council being satisfied that the work or improvement had been done in a substantial compliance with the requirements of .the con- tract and also being satisfied as to the correctness of the assessment and diagram filed by the Superintendent of Streets, it was moved by Councilman Claire that the assessment with the diagram attached be con- firmed and approved, and the Superintendent of Streets of the City of Newport Beach shall forwith attach.a warrant to said assessment in the manner provided by statute bearing the date of this order or confirm ation by the City Council, which motion being duly seconded by Council- man Garfield was carried by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Garfield, Johnson. NOES, Councilmen None. ' ABSENT, Councilman Ellsworth. The Assessment diagram prepared by the City Engineer for the improvement of Lafayette Avenue and certain other streets, alleys and easement as contemplated by Resolution of Intention No. 683, was presented, WHEREUPON, Councilman Garfield moved that the assessment diagram for the improvement of Lafayette Avenue and certain other streets, alleys and easement as contemplated by Resolution of Inten- tion No. 683 be approved, which motion was seconded by Councilman Claire and carried by the following vote, to -wit: AYES, Councilmen, Hilmar, Claire, Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilman Ellsworth. The specifications covering the live bait concession on the Newport -pier were considered, and on motion of Councilmen Claire seconded by Councilman Garfield, the specifications were approved and the City Clerk instructed to advertise for bids on same by the following vote, to -wit: AYES, Councilmen Hilmar, Claire, Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilmen Ellsworth. City Engineer Patterson presented a tentative map of Tract ' NO-564, being a reversion to acreage of Tract 492 Zick Place, Costa Mesa and recommended its approval. On motion of Councilman Garfield seconded by Councilman Hilmer and carried, the map was approved. There being no further business on motion of Councilman Claire seconded by Councilman Garfield and carried, the meeting adjourned to 12 o'clock M. on Wednesday, August 12, 1931. , „ APPROVED, August 24, 1931. ,City Clerk.
