The City Council of the City of Newport Beach met in re-
gular adjourned session at 7:30 o'clock P.M. on above date. The meet-
ing was called.to order by Mayor Johnson.
The roll was called showing the full Council present.
The minutes of the previous meetings of August 10th and 12th
were read and approved as read.
City Engineer Patterson was granted more time to report on the
communication of F.J.Moran in regard to exchange of trees on Corona
Del Mar.
The communications were read and acted upon as follows:
A letter from R.A.Wattson together with a petition asking
that the bulkhead and sidewalk along the north bay front between ,
Park Avenue and Emerald Avenue be replaced, was considered, and on
motion of Councilman Claire seconded by Councilman Garfield and
carried, the letter was ordered filed and the petition was referred
to Councilman Hilmar for investigation and report at the next meet-
ing.
On motion of Councilman Claire seconded.by Councilman Ells-
worth and carried, the application of Emma J. Alexander for permit to
construct a pier in front of Lots 508 and 509, Tract 907, was laid on
the table for the customary two weeks.
The communication from H.M.Mc Collum making some suggestions
which he thought would be for the good of Balboa Island was considered,
and on motion of Councilman Garfield seconded by Councilman Claire
and carried, the communication was referred to the Street Committee
for any action they deem necessary.
On motion of Councilman Claire seconded by Councilman Gar-
field and carried, the communication from the Corona Del Mar Property
Owners Association complaining of automobiles parking on the west ramp
between Fernleaf and Dahlia Avenue, was referred to the Police Depart-
ment to look into.
On motion of Councilman Garfield seconded by Councilman
Hilmer and carried, the petition from 10 property owners in Block 15,
Balboa East Side Addition asking that Block 15 be rezoned to restrict
the property to single family residences, was referred to the Street
Committee for report.
A letter from J.W.Jagd complaining of the odor from the '
sump hole near Bitter Point Dam, was considered, and on motion of
Councilman Garfield seconded by Councilman Claire and carried, the
communication was referred to the Street Superintendent to reply to.
On motion of Councilman. Hilmer seconded by Councilman Gar-
field and carried; the City Clerk was instructed to reply to the
communication from the Nuoil Company stating that the Council has no
intention of amending Ordinance No. 372.
On motion of Councilman Garfield seconded by Councilman
Claire and carried, the request of Fire Chief Crocker for permission
to attend the Convention of the Pacific Coast Assn. of Fire Chiefs
at San Diego, with expenses not to exceed $35.00 was granted.
A communication from the Chamber of Commerce asking if
some legislation could not be enacted whereby the large number of
peddlers and solicitors could not be eliminated from making them-
selves a nuisance in the City was taken up, but the City Clerk
stated that nearly all of them were disabled War Veterans and could
not be prohibited from peddling. On motion of Councilman Hilmer
seconded by Councilman Garfield and carried, the matter was referred
to the Police Department to be on the lookout for some who might be
peddling without a license.
A communication from Louis Block of the Dept. of Industrial
Relations asking the progress made on four improvement jobs contem-
plated some time ago was considered, and on motion of Councilman Claire
seconded by Councilman Garfield:.and carried, the Clerk was instructed
to notify them that all the work enumerated by them was completed '
except the sewage disposal plant which would not be completed for
some time in the future.

NEW BUSINESS.
Councilman Claire introduced a Resolution condemning cer-
tain real property for water reservoir storage purposes. The Resolu-
tion was read, considered, designated RESOLUTION NO. 703, and upon
call of the roll passed by the following vote, to -wit:
AYES, Councilmen Hilmar, Claire, Ellsworth, Garfield,Johnson.
NOES, Councilmen None.
ABSENT, Councilmen None.
14INUTES FOR HEARING ON ASSESSMENT FOR THE IM-
PROVEMENT OF LAFAYETTE AVENUE AND CERTAIN OTHER
STREETS, ALLEYS AND EASEMENT.
The Clerk advised the Council that this was the time and
place fixed pursuant to statute and notice given for the hearing in
the matter of the assessment for the improvement of Lafayette Avenue
and certain other streets, alleys and easement within the City of
Newport Beach, initiated by Resolution of Intention No 653, passed
and adopted on the 4th day of May, 1931.
The Clerk also informed the Council that affidavit of the
posting and publication of the notices of filing of the assessment
were on file in his office and that he had received no written appeals
or objedtions.
The Mayor then asked if there were any interested persons
present desiring to be heard in the matter of the said assessments.
None responded,
All interested persons having been given full opportunity
to show cause why said assessment should not be confirmed, and all
appeals or objections having been heard and fully considered, and
the Council being satisfied that the work or improvement had been done
in a substantial compliance with the requirements of the contract,
and also being satisfied with the correctness of the assessment and
diagram filed by the Superintendent of Streets, it was moved by
Councilman Garfield that the assessment with the diagram attached be
confirmed and approved and the Superintendent of Streets of the City
of Newport Beach shall forthwith attach a warrant to said assessment
in the manner provided by statute bearing the date of this order or
confirmation by the City Council, which motion being duly seconded
by Councilman Claire was carried by the following vote, to -wit:
AYES, Councilman Hilmer, Claire, Ellsworth, Garfield, Johnson.
NOES, Councilmen None.
ABSENT, Councilmen None.

City Engineer Patterson presented a map of Tract NO. 464,
being.a reversion to acreage of a subdivision of Blocks 10 and 11 of
Tract 27, Boulevaxd Addition to Newport Heights, which was discussed
and on motion of Councilman Hilmar seconded by Councilman Garfield and
carried, the matter was laid on the table to next meeting.
City Engineer Patterson presented a map showing a proposed
exchange of alleys from 61st Street to the west Citg limits as well as
vacating a strip off from Ocean Avenue to enable the ocean front Lots
to have access to their property from the alley, was considered, and
on motion of Councilman Garfield seconded by Councilman Hilmar and
carried, authority was granted the City Engineer to go ahead with the
vacatio1% proceedings as contemplated.
City Engineer Patterson stated the Pacific Electric Rail-
way Co. had given permission for crossings across their right -of -way
at 46th Street and at Orange Street. The matter was considered and
on motion of Councilman Claire seconded by Councilman Garfield and
carried, the City Attorney was instructed to make application to the
Railroad Commission for the two crossings designated.
On motion of Councilman Claire seconded by Councilman Hilmer
and carried, the two demands cashed at the First National Bank for em-
ployees discharged, were allowed and warrants to be drawn for same.

On motion of Councilman Hilmer seconded by Councilman
Claire and carried, the request of City Engineer Patterson for one
weeks vacation was granted.
J.K.Smith verbally addressed the Council in regard to the
condition of the barge at the Washington Street Wharf and he offered
to put a 24$60 ft. barge in place of it if the Council would give him
permission-to do so. The matter was discussed and on motion of Council-
man Claire seconded by Councilman Garfield and carried, City Engineer
Patterson was instructed to investigate Mr. Smith's offer and if he'thought
it advisable to have it installed.
J.P.Greeley verbally addressed the Council in regard to the
grade separation at the Arches, and thought something should be done
about it as soon as possible. The matter was discussed for some '
time, but inasmuch as there was a new law making improvement work
much more difficult and expensive, no action was taken at this time.
There being no further business on motion of Councilman
Claire seconded by Councilman Ellsworth and carried, the meeting ad-
journed Sine Die. n

The City Council of the City of Newport Beach met in reg-
ular session at 7:30 o'clock P.M. on above date. The meeting was
called to order by Mayor Johnson.
The roll was called showing the full Council present.
The minutes of the previous meeting of Aug. 24th, were read
and approved as read.
The reports of the heads of departments were read and on
motion of Councilman Claire seconded by Councilman Ellsworth and carried,
the reports were accepted and filed.
Councilman Hilmer reported in regard to the bulkhead between
Park and Emerald Avenue, Balboa Island, that he would recommend that
no permanent repairs be put in at this time as sooner or later more
bulkhead will have to be put in around the Island. Councilman Hilmer
was granted additional time to report on the cost of temporary repairs
needed for this location.
City Engineer Patterson was granted additional time to report
on the tree replacement on Corona Del Max.
Councilman Ellsworth was given more time to report onthe
advisability of re -zoing Block 15, Balboa East Side addition.
Councilman Ellsworth reported that he did not think the
J.K.Smith barge would be practical to use at the Washington Street
wharf, and there was objection to the barges being anchored in the
channel by those in the vicinity. No action was taken in regard to
a permit.
The communications were read and acted upon as follows:
The Auditors report of R.D.Crenshaw & Co. was read and on ,
motion of councilman Hilmer seconded by Councilman Claire and carried,
the report was ordered filed, and one copy to be given to the Chairman
of the Finance Committee for his purusal.
The communication from the N.H.Chamber of Commerce requesting
that-$1OO.00 be appropriated from the unappropriated advertising fund
towards the expense of the trip of Skipper Bill Lyon of the Newport
Harbor Star Fleet to Long Island, New York to compete in races, was con-
sidered, and on motion of Councilman Ellsworth seconded by Councilman
Garfield and carried, the request was granted.
On motion of Councilman Hilmer seconded by Councilman Ells-
worth and carried, the request of the Chamber of Commerce for transfer
of $250.00 from the Natal Day Celebration account to other advertising,
entertainments, etc. was granted.
