HomeMy WebLinkAbout01/18/1932 - Adjourned Regular Meeting392 City Hall, Newport Beach, Jan. 18, 1932• The City Council of the City of Newport Beach met in regular adjourned session at 7:30 o'clock P.M. on above date. The meeting was called to order.by Mayor Johnson. The roll was called showing the full Council present. The minutes of the previous meeting of Jan. 4th and of the special meeting of January 11th were read and approved as read. Councilman Garfield reported that at the meeting of the .mater ' Conservation Committee of the Orange County Farm Bureau at Santa Ana, they got organized and he would probably have a more complete report at the next.meeting.- City Engineer Patterson reported that in checking the petition for shaling the alleys on Balboa Island, he found there were 76 signatures of property owners inside the district and 74 outside the district. The estimated cost of the improvement would be about $7600:00 or approximately $14.50 per lot, and the estimated cost of the proceedings up to the passage of the Resolution of Intention would be about $300.00. The matter was considered and on motion of Councilman Claire seconded by Councilman Hilmar and carried, the City Attorney was instructed to draw up a form of card to send to the property owners in the district to ascertain if they want the improvement, and the City Engineer was instructed to mail a card to each property owner in the district. On motion of Councilman Claire seconded by Councilman Garfield and carried, the annual report of Fire Chief Crocker was filed. Councilman Garfield reported that the Realty Board were willing . to equalize the assessments on property in the City for $1600.00, and a letter was read by the Clerk giving the names of those who were willing to undertake the work as follows: A. J. Twist, J. P. Greeley, A. B. Rousselle, H. Cardoza Sloan, W. L. Jordan, Lew H. Wallace, Louis W. Briggs, Harry D. Hyde, Ralph Maskey, Harry H. Williamson, Hal Will Smith, H. M. Lane and J. A. Beek. The matter was considered and on motion of Councilman Claire seconded by Councilman Ellsworth and carried, the ' letter was accepted and ordered filed. On motion of Councilman Claire seconded by Councilman Ellsworth and carried, the City Attorney was instructed to draw up a contract with the above members of the Realty Board with A. J. Twist as Chairman. The communications were read and acted upon as follows: The request of the Rev. William Power, Pastor of the Catholic Church asking permission for David Goldstein to speak from a Broadcasting Car on January 31st was presented, and on motion of.Councilman Hilmer seconded by Councilman Claire and carried, the request was granted. On motion of Councilman Claire seconded by Councilman Hilmer and carried, the communication from the Pacific Coast Building Officials Conference in regard to membership, was filed. The communication from H. L. Sherman asking that the City survey a site for the proposed Veterans Hospital, and also asking that the City agree to furnish 200,000 gallons of water for them per day at a reasonable price in an effort to get the Hospital to locate adjoining Corona Del Mar, was considered, and on motion of Councilman Claire seconded by Councilman Ellsworth and carried, the City Engineer was authorized to make the survey and charge the cost of the same to the advertising fund. On motion of Councilman Hilmer seconded by Councilman Claire and carried, the Clerk was instmoted to inform Mr. Sherman that the City will make the survey as requested, and also will be able to furnish the amount of water suggested at a reasonable price. The communication from the Newport— Balboa Business Men's Assn. asking for $75.00 per month for eleven months or a total of $925.00 for a boat race each month, was considered, and on motion of Councilman Hilmer seconded by Councilman Garfield and carried, the matter was referred to the Advertising Committee. On motion of Councilman Claire seconded by Councilman Hilmer and carried, the request of J. A. Beek for permission to extend the pier landings at Palm and Agate Streets, was referred to the City Engineer for the customary two weeks. Ci 39;)1 UNFINISHED BUSINESS City Attorney Thompson brought up the matter of the Cubbon and McFarland Lease for the boat landing privilege on Newport Pier, which was considered, and on motion of Councilman Claire seconded by Councilman Garfield the City Attorney was instructed to draw up.a lease for one year from the date of the present lease by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield. NOES, Councilman Johnson. ABSENT, Councilman None. The Lease for 200 feet of tidelands to the Newport Harbor Union High School District was taken up for consideration, and Councilman Garfield introduced a Resolution approving the lease as originally written, and authorizing the Mayor and City Clerk to sign and execute the same on behalf of said City. The Resolution was read, considered, designated RESOLUTION NO. 725, and upon call 6f the roll was passed by the following vote, to -wit: AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield Johnson. NOES, Councilmen None. ABSENT, Councilmen None. A QUITCLAIM DEED dated the 11th day of January, 1932, from Mrs. May Berg to the City of Newport Beach, a Municipal Corporation of the sixth -class of Orange County, California, remising, releasing and quitclaiming to said City of Newport Beach, its successors and assigns forever all that certain real property'situated in the City of Newport Beach, County. of Orange, State of California, described as follows, to =wit: That portion of Lot 1, Block "N ", Seashore Colony Tract, more particuArly described as follows, to -wit: All that portion of Lot 1, Block 'IV, Seashore Colony Tract, as said Tract is laid out and shown upon a Map recorded in Book 7, page 25 of Miscellaneous Maps,.Records of Orange ' County, California, lying between the northeasterly line of Lot 1 and a line 15 feet southeasterly of and parallel to said northeeasterly line. was presented to the City Council of the City of Newport Beach, California. WHEREUPON, Councilman Claire made a motion duly seconded by Councilman Garfield and carried, that said Quitblaim Deed be accepted by said City of Newport Beach, and the Clerk instructed to record the same forthwith with the County Recorder of the County of Orange, State of California. That said motion was carried by the folowing vote, to -wit: AYES, Councilmen Hilmer, Claire, Ellsworth, Garfield, Johnson. NOES, Councilmen None. ABSENT, Councilmen None. The Map of Tract 665 being a resubdivision of Block B,- Bayside Tract laid over from last meeting, was again taken up and City Attorney Thompson stated that inasmuch as no provision had been made for the sidewalk now existing, he would not recommend its approval, and on motion of Councilman Claire, seconded by Councilman Hilmer and carried, .the report was accepted. On motion of Councilman Hilmer seconded by Councilman-Claire and carried, approval of the Map was. denied and the Clerk to notify Mr. Hopkins of the reason for denial. NEW BUSINESS On motion of Councilman Claire seconded by Councilman Garfield and carried, a number of emergency demands having been signed and approved by the Finance Committee, were allowed_ and warrants to be drawn for same. Councilman Ellsworth atated that the Library Board would like to make some improvements in the nature of a hedge fence around a portion of the Library property, costing about $150400, and on his motion seconded by Councilman Garfield and carried, $150.00 was allowed out of the Park Fund for-that purpose. 394 Councilman Ellsworth also stated they would like to pave with concrete, a strip aft Island and Bay Avenue to widen the sidewalk, and on his motion seconded by Councilman Claire and carried, authority was granted for paving the strip. As there a vacancy on the Planning Commission through the resignation of Councilman Hilmar, Mayor Johnson appointed H. Oardoza Sloan on the Commission to fill the unexpired term of Councilman Hilmar and ending June 30, 1934. On motion of Councilman Garfield seconded by Councilman Ellsworth and carried, the appointment was approved. There being no further business on motion of Councilman Claire, seconded by Councilman Hilmer and carried, the meeting adjourned Sine Die. The City Council of the City of Newport Beach met in regular session at 7:30 o'clock P.,M.. on above date. The meeting was called to order by Mayor' Johnson. The roll . was called showing all members present except Councilman Garfield. The minutes of the previous meeting of January 18th were read, corrected and approved. The reports of the heads of the departments were.read and on motion of Councilman Claire seconded by Councilman.Ellsworth and carried, the reports were accepted and filed. ' Councilman Ellsworth reported for the Advertising Committee on the appropriation for boat races each month, that the Council cannot budget money beyong July 1st,_ and they woud recommend that the Business Mens Assn, apply month by month for the appropriation and also for permission for the race desired each month. On motion of Councilman Hilmer_seconded by Councilman Claire and carried, the report of the Committee was accepted. The report of Building Inspector Nelson on the condition of the house of H. E. Williamson on March lst was read, stating that it was about two- thirds completed, and the completed value of the house would be about $1,;800. This would entitle Mr. Williamson to a refund on $400.00 valuation or $8.40, and on motion of Councilman Claire seconded by Councilman Ellsworth and carried, the Clerk was instructed to notify Mr. Williamson to file a demand for the refund. The communications were read and acted on as follows: The application of Robert E. Burns for permission to construct a pier in front of the Wly 30 ft of, the Ely 60 ft of Lots 8, 9 and 10, Block 25, Balboa East Side was considered, and on motion of Councilman Claire seconded by Councilman Ellsworth and carried, the application was referred to the City Engineer for the customary two weeks. On motion of Councilman Hilmer seconded by Councilman Ellsworth and carried, the request of F. W. Teschke for 60 days extension of time on his contract for.Seashor_e Drive improvements was granted. The communication from Carl Campbell asking permission to sublet a portion of the 90 acres leased from the City, was considered, and on motion of Councilman Claire seconded by Councilman.Ellsworth and carried, the matter was referred to the City Attorney for investigation, and to inform Mr. Campbell that his request would be granted if possible. On motion of Councilman Claire seconded by Councilman Ellsworth and carried, the applications of N. H. Stearns for license to operate a - -hoopie Game in the Balboa Pharmacy and one in Moore's Confectionery Store were granted subject to the approval of the Chief of Police. -e i
