HomeMy WebLinkAbout05-05-1932 - Special Meeting416 MINUTES OF SPECIAL MEETING OF CITY COUNCIL OF THE CITY OF NEWPORT BEACH, HELD ON THURSDAY THE 5th DAY OF MAY, 19327 t AT THE HOUR OF THREE O'CLOCK P. M. A special meeting of the City Council of the City of Newport Beach was held pursuant to notice given as required by law, on the 5th day of May, 1932, at the hour of three o'clock p. m. at the Council Chambers of the City Council of the City of Newport Beach. Upon roll call, the following Councilmen answered present: Hermann.Hilmer, George Irving Gordon, Loyd Claire, Paul Ellsworth and A. J. Garfield. Absent, none. The notice pursuant to which the meeting was held was duly read by the Clerk and ordered filed by Mayor Hilmer. The Mayor thereupon asked the City Attorney for an opinion relative to the. present status of Mr. J. A. Gant, in relation to his failure to file a bond within the time required by law. The City Attorney thereupon stated to the City Council that after the giving of said notice for said special meeting, that a duly executed bond had been received by the City, covering Mr. J. A. Gant as City Treasurer of the City of Newport Beach, from the date of his election to that office, and during his term thereof, and that said bond was in form reouired by law, and gave the City the protection required under the City ordinances in relation to the office of City Treasurer . of said City of Newport•Beach; that he, the said City Attorney, had been informed that the delay in filing the bond was caused by the fact that said bond had to be presented to the Eastern office of the Insurance Company for its approval, and to the underwriters of said insurance company for their approval, and that the bond was executed as of the 191h day of April, 1932, and within the time required by law, but through delay in the mails, the same had not reached the City of Newport Beach within ten days after the election of the said J. A. Gant, as City Treasurer of the City of Newport Beach. The City Attorney thereupon gave it as his opinion that J. A. Gant, as the City Treasurer of the City of Newport Beach, had duly qualified as such Treasurer upon his bond being approved by the Mayor of said City. On motion of Councilman Garfield seconded by Councilman Claire and carried, the report of the City Attorney was accepted and ordered filed. On motion of Councilman Claire, seconded by Councilman Garfield and darried, it was ordered that in view of the report of the City Attorney, that no-action should be taken relative to the office of City Treasurer, as he had duly qualified for said office when said bond had been approved by the Mayor of said-City. City Attorney, Roland Thompson, then stated to the City Council that the Hartford Accident and Indemnity Insurance Company' had filed with him a waiver to the effect that any and all claims were by them waived by reason of any supposed defect occasioned by Mr. Gant's alleged failure to file his bond within the time required by law. Whereupon said waiver was duly read by the City Attorney to the City.Council of the City of Newport Beach, and upon motion of Councilman Claire, seconded by Councilman Garfield, and carried, said waiver was accepted and ordered filed as a permanent record of the action of said insurance company relative to said bond. There being no further-business, on motion of Councilman Claire, seconded by Councilman Garfield, and carried, the meeting was adjourned, sine die. Mayor, City of Newport Beach Approved May 23, 1932.
