City Hall, Newport Beach, May 23, 1932•
The City Council of the City of Newport Beach met in regular
adjourned session at.7:30 o'clock P. 11. on above date. The meeting was
called to order by 14ayor Hilmer.
. The roll was called showing all members present excepting
Councilman Garfield.
The minutes of the previous meeting of .Flay 2nd were read and
approved as read.
City Attorney Thompson presented a report in which he ruled
that the City's advertising Fund expenditures were legal and valid and
on motion of Councilman Ellsworth, seconded by Councilman-Claire and
carried, the report was accepted and ordered filed.
A communication from the Railroad Commission of the State of
California regarding a crossing over the tracks of the Pacific Electric
Railway at Orange Street in Seashore Colony Tract was on motion by
Councilman Claire, seconded by Councilman Ellsworth and carried, ordered
filed.
A report by City Engineer Patterson covering in detail the
dredging in the Entrance Channel and recommending the acceptance thereof
was on motion of Councilman Claire, seconded by Councilman Ellsworth and
carried, was accepted by the Council.
Building Inspector Nelson made a report concerning a complaint
filed by Carl F. V. Taylor respecting the State Heusing.Law. The report
was on motion by Councilman Ellsworth, seconded by Councilman Claire and
carried, accepted and ordered filed.
Assistant Harbor Laster Robinson presented a communication,
regarding the use of aquaplanes and the danger attending their use, which
by motion of Councilman Claire, seconded by Councilman Ellsworth and
carried was referred to the Police Committee.
Assistant Harbor Laster Robinson's report suggesting the erection
of an office for the use of the Harbor Bluster at the outer end of the
Washington Street pier, was on motion of Councilman Ellsworth, seconded
by Councilman Claire and carried, referred to the Police Committee.
An application by Hobart O'Howell for employment in any of the
City's departments was on motion of Councilman Claire, seconded by
Councilman Ellsworth and carried, ordered filed.
J. R. Horton's application for a permit to operate an amphbian
airplane from Newport Bay, was on motion of Councilman Claire, seconded by
Councilman Ellsworth and carried, denied.
An application by Ers. Schumacher to operate a tea room at
112 East Bay Avenue was by reason of being out of the business zone, denied
on motion of Councilman Claire, seconded by Councilman Ellsworth and
carried.

An application by Mrs. Aldridge for a license to operate a cafe
in the Plummer cottage at 301 East Bay Ave., was, on motion of Councilman
Claire, seconded by Councilman Gordon and carried allowed subject to the
Health Officer's approval.
A communication from the Corona Del Mar Property Owner's
Association relating to the 1915 Improvement Act was read and on motion
of Councilman Claire, seconded by Councilman Ellsworth and carried the
City Clerk was ordered to notify the Association that a reply to their
communication could not be made until June 15th.
The Newport - Balboa Lerchant's Credit Association presented a
letter asking as to the possibility of paying City employees semi - monthly
and on motion of Councilman Ellsworth, seconded by Councilman Claire and
carried, the inquiry was referred to the Finance Committee for report at
the next meeting.
S. A. Stowell of Corona Del Mar requested that the City install a
water faucet at the foot of Buck Canyon for the benefit of the public
and on motion of Councilman Claire, seconded by Councilman Ellsworth and
carried, was referred to the VTater Superintendent for report at the next
meeting.
A communication from G. IV. Kitzmi'ller respecting the surfacing
of alleys on Balboa Island was read, and iti•was moved by Councilman
Ellsworth, seconded by- Councilman Claire and carried that the communication
be laidon the table for two weeks.
West Coast Knitting Mills of Los Angeles presented a letter in
regard to proposed bathing suit ordinances and it was moved by Councilman
Claire, seconded by Councilman Ellsworth and carried that the communication
be filed.

The communication of the Orange County Farm Bureau extending an
invitation to the City Council to attend a picnic in honor of the President
and Directors of the American Farm Bureau Federation at Irvine Park on
Lay 24th was read. It was moved by Councilman Claire, seconded by
Councilman Gordon and carried that the letter be filed.
It was moved by Councilman Claire, seconded by Councilman
Ellsworth, and carried that the City Engineer's report of the Entrance
Channel dredging be filed.
A communication of the Joint Tax Committee of the Orange County
Realty Boards and Orange County Farm Bureau was read and on motion of
Councilman Claire, seconded by Councilman Ellsworth and carried, that the '
letter be filed.
The application of George A. Rogers for a permit to construct
a pleasure pier fronting on Lot 108, Block A, East Newport was up for
re- consideration and on motion of Councilman Claire, seconded by
Councilman Ellsworth and carried, the application was laid over for two
weeks.
The application of Roy Lyons for permission to construct a slip
on the northerly side of the North Bay Channel Balboa Island was on
motion of Councilman Claire, seconded by Councilman Ellsworth and carried,
laid over for a report at the next meeting.
It was moved by Councilman Gordon, seconded by Councilman Claire
and carried that the surety bonds of Chief of Police Hodgkinson be
accepted and filed.
UNFINISHED BUSINESS
Ordinance No. 401 relating to 'Transient Merchants' came up for
final passage and oral communications against the ordinance were presented
by W. L. Jordon, J. P. Greeley, Sam Stieffel and H. M. Lane and on motion
of Councilman Claire, seconded by Councilman Ellsworth the ordinance was
defeated by the following roll call vote:
AYES: Councilmen None.
NOES: Councilmen Gordon, Claire, Ellsworth and Hilmer.
ABSENT: Councilman Garfield.
Ordinance No. 402, known as the 'Tile and Marble Ordinance'
was presented for final passage and on motion of Councilman'Claire,
seconded by Councilman Gordon and carried it was voted to eliminate the
paragraph pertaining to examinations and the ordinance will be presented
for final passage at the next meeting of the Council.
Ordinance No. 403, known as the !Plaster Ordinance' came up for
final passage, the ordinance was read, considered, and on motion of
Councilman Claire, seconded by Councilman Gordon was passed by the
following roll call vote:
AYES: Councilmen Gordon, Claire, Ellsworth and Hilmer.
NOES: Councilmen None.
ABSENT: Councilman Garfield.
Ordinance No. 405, known as the 'Chimney Ordinance' was presented
for final passage and after being read and oonsidered was on motion of
Councilman Claire, seconded by Councilman Gordon adopted by the following
roll call vote.
AYES: Councilmen Gordon, Claire, Ellsworth and Hilmer.
NOES: Councilmen None.
ABSENT: Councilman Garfield.
Ordinance No. 404, respecting Plumbers Bonds was effered for
final passage, the ordinance being read and considered failed to pass on
a motion of Councilman Claire, seconded by Councilman Ellsworth and
the following roll call vote:
AYES: Councilmen None.
NOES: Councilmen Gordon, Claire,' Ellsworth and Hilmer.
ABSENT: Councilman Garfield.
The application of C. A. Neighbors to build a pleasure pier
extending into the Bay from the easterly 30 feet of Lots S, 9, 14 and
11, Block 25, Balboa Eastside Subdivision was on motion by Councilman
Claire, seconded by Councilman Ellsworth and carried, laid on the taole
for two weeks.

NEW BUSINESS
Itwas moved by Councilman Claire, seconded by Councilman
Ellsworth that the demands which had been duly signed and approved by
the Finance Committee be allowed and warrants' authorized to be drawn
for same.
City Attorney Thompson presented several legal documents in
which the City of Newport Beach is plaintiff vs. Derby Shaw et al in an
action to quiet title on certain lots or lands and on motion of
Councilman Claire, seconded by Councilman Ellsworth and carried, the
Mayor was instructed to sign the various complaints.
City Engineer Patterson presented the post cards which had been
' received regarding the improvements of alleys on Balboa Island. There
were 153 against the improvement, S$ for the improvement and 14 which
stated that the improvements were already in. It was moved by Councilman
Claire, seconded by Councilman Ellsworth and carried that the Engineer's
report be accepted and the City Clerk was instructed to notify the
original circulator of the petition askin` that the improvements be
made to the effect that the work had been protested out.
City Engineer Patterson presented plans and estimates for the
riprapping of the East Jetty and on motion of Councilman Ellsworth,
seconded by Councilman Claire, Resolution No. 743 adopting said plans
and specifications and instructing the City Clerk to advertise for bids
for work was carried by the following roll call vote:
AYES: Councilmen Gordon, Claire, Ellsworth and Hilmer.
NOES: Councilmen None.
ABSENT: Councilman Garfield.
Engineer Patterson presented Resolution No. 744 setting up
the scale of wages for the work to be performed in connection with the
East Jetty and on motion of Councilman Ellsworth, seconded by Councilman
Claire the same was adopted by the following roll call vote, to -Wit:
AYES: Councilmen Gordon, Claire,-Ellsworth and Hilmer.
NOES: Councilmen None.
ABSENT: Councilman Garfield.
It was moved by Councilman Claire, seconded by Councilman
1 Ellsworth and carried that the letter from the Southern Pacific Company
detailing the cost to the City for fixing up Orange Street be filed.
BUDGET
Councilman Claire presented the tentative budget fixing wages
of the City employees, and other expenditures, as fixed by the Finance
Committee and it was adopted on motion of Councilman Ellsworth, seconded
by Councilman Claire and carried by the following roll call vote:
.AYES: Councilmen Claire, Ellsworth, and Hilmer.
NOES: Councilman Gordon.
ABSENT: Councilman Garfield.
It was moved by Councilman Claire, seconded by Councilman
Ellsworth, and carried, that thec ;fice of Harbor Master be vacated.
On motion by Councilman,.n.seccnded by Councilman Ellsworth
and carried, M. S. Robinson was appointed Harbor Piaster at a salary
of One Hundred and Forty Dollars per month.
It was moved by Councilman Gordon, seconded by Councilman
Claire and carried that the Finance Oommittee make a report as to the
cost of a year book containing the financial transactions of the City.
Mr. Pritchard from the University of Southern California
addressed the Council about the summer school term from June 13th to
June 19th for City Employees.
There being no further business to come before the Council it
was moved by Councilman Claire, seconded by Councilman Ellsworth, that
an adjournment be taken to the next regular meeting of June 6, 1932•
