City Hall, Newport Beach, December 5, 1932
The City Council of the City-of Newport Beach met in regular
session at 7:30 o'clock P. M. on the above date at the City Council
Chambers of the City of Newport Beach, with Mayor Hilmer in the chair.
The roll was called showing the full Council present.
The minutes of the previous meeting of November 7th were read
and approved as read.
The reports of Heads of Departments were read and on motion of
Councilman Claire, seconded by Councilman Gordon and carried, the reports
were approved and ordered filed.
REPORTS OF SPECIAL COMMITTEES:
City Engineer Patterson presented a report relating to the
cost of dredging a connecting channel between the old County channel
and the channel north of Lido Isle. After considerable discussion
by the Council and citizens it was decided to defer action on the
proposed project for the present and on motion of Councilman Gordon,
seconded by Councilman Ellsworth and carried, the Engineer's-report was
ordered filed.
City Attorney Thompson offered a written tepbrt regarding the
legality of changing the limit of speed allowed motor boats by the
City ordinance. The report was read and on motion of Councilman Claire,
seconded by Councilman Ellsworth and carried the report was ordered filed.
City Attorney Thompson presented a written report concerning
the legality of constructing a bulkhead in front of certain property in
Tract 519, and on motion of Councilman Claire, seconded by Councilman
Garfield and carried, the report was ordered filed.
Councilman Garfield reported on the life guard situation and
it was moved by Councilman Garfield, seconded by Councilman Gordon and
carried that the life guard be dispensed with for the present.
COMMUNICATIONS:
George C. McLeod, Secretary of the Chamber of Commerce,
'
resented a communication asking for the expenditure of the sum of
650 by the City Council from the advertising fund, the same being
approved by Lew H. Wallace, L. L. Isbell, Harry H. Williamson, J. P.
Greeley and other directors of the Chamber, the money requested being
for a Tournament of Roses float, Community Christmas Tree and prize
money for boating events. It was moved by Councilman Claire, seconded
by Councilman Ellsworth and carried that all but the $100 expenditure
for the Christmas tree be denied.
'C. McFarland's communication asking for certain privileges
on the Newport ocean pier for a three year period was considered by
the Council, and it was suggested that should the request be granted
'the lessee also take over the duties now being handled by the City
wharfinger, thus dispensing with the expense of the latter, and on
motion of Councilman Claire, seconded by Councilman Garfield and
carried, the application was referred to City Attorney Thompson with
a request to execute a lease in accordance with the applicant's proposal
and the Council's instructions.
V. A. Tripp made application for a transfer of license for his
electrical business from 21st Street to 2626 West Central Avenue, and on
motion of Councilman Claire, seconded by Councilman Gordon and carried,
the transfer was authorized.
Ruth E. McLain applied for a license to conduct a restaurant
at 302 East Surf Avenue, and on motion of Councilman Claire, seconded
by Councilman Gordon and carried, the permit was granted subject to
the approval of the Health Officer.
The application of H. Kaiser for water service at the inter-
section of the Coast Highway and the County Road near Bay Shore Camp,
was on motion of Councilman Garfield, seconded by.Oouncilman Claire
and carried, denied.
Stanley Blackburn made application for water service at 417
Orange Street, and on motion of Councilman Claire, seconded by Councilman
Gordon and carried, the matter was referred to the Water Committee for
report at the next meeting.

The West Newport Improvement Association presented a letter
requesting the City to clean up the abandonded site of the Orange County
Refinery and the streets adjacent thereto, and on motion of Councilman
Claire, seconded by Councilman Ellsworth and carried the matter was
referred to the City Attorney.
Six applications for permits to purvey liquor if or when
allowable by law, were presented by various applicants and on motion
of Councilman Claire, seconded by Councilman Ellsworth and carried,
the applications were ordered filed.
A petition with numerous signatures was presented to the City
'Council asking aid in furthering certain requests in connection with
the closed Bank of Balboa. The City Attorney ruled that nothing could
be done in the matter, and on motion of Councilman Claire, seconded by
Councilman Gordon and carried, the City_Attorney_was requested to inform
the petitioners accordingly.
The League of California Municipalities presented a communication
asking the City Council to pass a Resolution regarding gas tax allocation,
and on motion of Councilman Claire, seconded by Councilman Garfield,
the resolution which was designated Resolution Nol 771 was adopted by the
following roll call vote, to -wit:
AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.
ABSENT: Councilmen None.
'The American Veteran's Association presented a copy of a
resolution adopted by that organization in which the Corona Del Mar site
for a Veterans Hospital was highly recommended, and on motion of Councilman
Claire, seconded by Councilman Garfield and carried, the City Clerk was
instructed to write to the Veterans Association thanking them for their
cooperation in the matter.'
F. C. Hezmalhalch, City Clerk of Fullerton, in a letter to the
City Council extended the appreciation of the City of Fullerton for the
.cooperation of this City in the Armistice Day celebration and it was
moved by Councilman Gordon, seconded by Councilman Garfield and carried,
that the letter be filed.
'J. A. Beekts communication in relation to certain tide lands
lease, was on motion of Councilman Ellsworth, seconded by Councilman
Gordon and carried, referred to the Finance Committee with a request to
ascertain auditing costs in connection therewith.
Wesley L. Nutten, Jr. presented a letter to the City Council
protesting against the proposed speed course on the north Lido Isle
channel, and on motion of Councilman Gordon, seconded by Councilman Claire
and carried, the City Clerk was instructed to inform Mr. Nutten that
no action'has been taken towards establishing such a speed course and no
stch action is anticipated.
John M. Downen representing the Masonic Homes of California
presented a request for tax refund on the Balboa Island Masonic Home
for children, a charitable institution. It was moved by Councilman
Ellsworth, seconded by Councilman Garfield and carried that the matter
be "referred to the City Attorney,and the.01ty Assessor with instructions
to render a report at the next meeting.
Letters from 0. E. Brown and S. L. Marlow protesting any
further reductions in wages for city employees were read andron motion of
Councilman Claire, seconded by Councilman Ellsworth and carried the letters
were ordered filed.
Deeds to strips of land ten feet in width from Lots 15 and 16
Block 1.Section 4 and Lots 17 and 18 Block 2 Section 4, Balboa Island
the same being contingent to the adoption of Ordinance No. 406, were
presented, and on motion of Councilman Garfield, seconded by Councilman
Gordon and carried the deeds were accepted subject to description approval
by the City Engineer which will place the ordinance in line for adoption.
UNFINISHED BUSINESS:
Ordinance No. 405, known as the Plaster Ordinance, came up for
final passage and on motion of Councilman Claire, seconded by, Councilman
Gordon, the ordinance was, after being duly considered, adopted by the
following Poll call vote, to -wit:
AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.
ABSENT: Councilmen None.

Certain tax protests in which refunds were requested due to
erroneous assessments were on motion of Councilman Garfield, seconded by
Councilman Claire and carried, allowed.
A resolution establishing a per diem wage scale and substituting
Ordinance No. 766 was introduced and_ after being read, considered and
designated Resolution No. 772, was on motion of Councilman Garfield,
seconded by Councilman Gordon, adopted by the following roll call vote,
to —wit:
AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.
ABSENT: Councilmen None.
The monthly demands having been duly audited by the Finance
Committee, were on motion of Councilman Claire; seconded by Councilman
Garfield and carried, allowed and warrants ordered drawn for same.
A demand for the salary of Walter Deal, deceased, on advise
of the City Attorney to hold same up pending the appointment of an
Administrator, was on motion,of Councilman Claire, seconded by Councilman
Ellsworth, carried.
City Attorney Thompson asked for a week in which to report
on the matter of Peterson Bros. contract with the City, and on motion 6f
Councilman Gordon, seconded by Councilman Ellsworth and carried, the
time was granted.
It was moved by Councilman Claire, seconded by Councilman
Ellsworth and carried that the matter of tax refund asked for in behalf
of Dewey, Frederick & McCormick on Lot 86, Block A, East Newport, be
referred to the City Attorney for report at the next meeting.
Proposed amendments to the present water ordinance were presented
and after due consideration the ordinance was designated Ordinance No.
409 and on motion of Councilman Claire, seconded by Councilman Ellsworth
and carried, was passed to the second reading.
Street Superintendent Patterson reported on the Corona Del Mar
tree upkeep and recommended that J. J. Mustard be employed temporarily
to care for the trees at $4.00 per day and it was moved by Councilman
Claire, seconded by Councilman Ellsworth and carried that the Street
Superintendent's recommendation be approved.
Certain equipment needed in caring for the Corona Del Mar
trees and lawns and owned by Peterson Bros. was on recommendation
of the City Engineer ordered purchased for the sum of $115.95, the '
motion approving same being made by Councilman Claire, seconded by
Councilman Ellsworth and carried.
Three surety bonds in favor of the City of Newport Beach
on behalf of three employees in the tax and lixense departments were,
after approval by the City Attorney as to form, on motion of Councilman
Ellsworth, seconded by Councilman Claire and carried, accepted.
Councilman Gordon made a motion that all City. employe -es:as•nshown
upon Resolution No. 772 be placed on a five day average per week basis.
The motion was seconded by Councilman Claire, and carried.
There being no further business to come before the Council
it was moved by Councilman Claire; seconded by Councilman Gordon that
an adjournment be taken to Monday December 12th at 7:30 o'clock p. m.
