City Hall, Newport Beach. Jan. 16, 1933-
The City Council of the City of Newport Beach met in regular
adjourned session at 7:30" o'clock P. M. on the above date at the City
Council Chambers of the City of Newport Beach, with,Mayor Hilmer in the
chair. "
The roll was called showing the full Council present.
The minutes of the previous meeting of January 2nd were read
and approved as read.
' REPORTS OF SPECIAL COMMITTEES:
City Attorney Thompson submitted .a written report respecting
local liquor regulation. The report was read and on motion of Councilman
Gordon, seconded by Councilman Claire and carried, the report was ordered
filed. •
The regular order of business was suspended in order to take
up the matter of outboard motor boat races, Rodney Pantages representing
the Southern California Outboard Motor Boat Association addressed the
Council regarding the holding of an outboard racing event during the
month of -March and asked that special permission be granted in respect
to the muffler ordinance. W. L. Jordan also addressed the Council in
favor of the races being held.
It was moved by Councilman Gordon, seconded by Councilman Claire
"and carried that permission be granted to hold the races under the
existing muffler ordinance.
It was moved by Councilman Gordon, seconded by Councilman
Garfield and carried that the City Attorney render an opinion in regard
to Muffler Ordinance No. 52 at the next meeting. ,
The regular order of business was resumed and the special
report of Councilman Gordon, Chairman of the Police Committee, dealing
with police protection in the Balboa Island and Corona Del Mar District
was read, and on motion of Councilman Claire, seconded by Councilman
Ellsworth and carried, the report was laid on the table.
STANDING COMMITTEES:
The report of the Finance Committee regarding the collection
of City taxes by Orange County was read and on motion of Councilman Claire
seconded by Councilman Gordon and carried, the report was ordered filed.
COMMUNICATIONS:
The application of Glenn Mellott for a restaurant license at
322 Marine Avenue, Balboa Island, was on motion of Councilman Ellsworth,
seconded by Councilman Gordon and carried, allowed subject to approval
by the health officer.
W. A. Henderson's application for permission to install under-
ground storage tanks for gasoline was on motion of Councilman Ellsworth,
seconded by Councilman Claire and carried, allowed subject to the
approval of the Fire Chief.
E. V. S. Pomeroy "presented a letter asking fora reduction in
the contract price of city garbage and on motion of Councilman Claire,
seconded by Councilman Gordon and carried, the letter was ordered filed.
The letter of Edwin M. Williams, Secretary of the Corona Del
Liar Property Owners' Association in reference to certain beach lands
in that district was read and on motion of Councilman Gordon, seconded
by Councilman Garfield and carried, the City Attorney was requested to
assure the Association that suit to recover said beach lams for the
City had not been abandoned.
It was moved by Councilman Gordon, seconded by Councilman
Garfield and carried that the Corona Del Mar Property Owners' Association
I be sent a copy of the action of the City Council in regard to the tide
lands suit.
It was moved by Councilman Claire, seconded by Councilman
Garfield and carried that the appointment of Mrs. Christine Douglas as
City Librarian as indicated in the letter of H. L. Sherman, Chairman of
the Library Board be confirmed.
A communication from R. J. Briscoe regarding the issuance of
Scrip as a medium of exchange was read and,.on motion of Councilman
Garfield, seconded by Councilman Claire and carried the letter was
ordered filed.

.UNFINISHED BUSINESS:
It was moved by Councilman Claire, seconded by Councilman
Ellsworth and carried that the report of the Finance Committee laid on
the table at-the previous meeting be filed.
It was moved by Councilman Garfield, seconded by Councilman
Ellsworth and carried that the report of the Fire, Water & Sewer
Committee, laid on the table at the last meeting, be filed.
. It was moved by Councilman Ellsworth, seconded by Councilman
Garfield and carried that the report of the Street Committee, laid on
the table at the previous meeting, be filed.
It was moved by Councilman Gordon, seconded by Councilman
Claire that Recommendation No. 1 of the Chairman of the Police Committee
be adopted, the motion was lost by the following roll call vote:
AYES: Councilman Gordon
NOES: Councilmen Claire, Ellsworth, Garfield, Hilmer.
ABSENT: Councilmen None.
On motion of Councilman Gordon, seconded by Councilman Claire,
Recommendation No. 2 -A was lost by the following roll call vote:
AYES: Councilman Gordon. •
NOES: Councilmen Claire, Ellsworth, Garfield, Hilmer.
ABSENT: Councilmen None.
On motion of Councilman Gordon, seconded by Councilman Garfield
Recommendation No. 2_B, giving preference to permanent residents and
taxpayers in City employment, was adopted by.the following roll call
vote, to -Flit:
AYES:, Councilman Gordon, Garfield, Hilmer.
NOES: Councilmen Claire, Ellsworth.
ABSENT: Councilmen None.
The adoption of Recommendation No. 2_0 was moved.by Councilman
Gordon, seconded by Councilman Claire and lost by the following roll
call vote:
AYES: Councilman Gordon.
NOES: Councilmen Claire, Ellsworth, Garfield, Hilmer.
ABSENT: Councilmen None.
The adoption of Recommendation No. 2_D was moved by Council-
man Gordon, seconded by Councilman Claire and lost by the following
roll call vote:
AYES: Councilman Gordon.
NOES: Councilmen Claire, Ellsworth, Garfield, Hilmer.
ABSENT: Councilmen None.
Councilman Gordon moved the adoption of Recommendation No. 3
which was seconded by Councilman Garfield and lost by the following
roll call voter
AYES: Councilmen Gordon, Hilmer,
NOES: Councilmen Claire, Ellsworth, Garfield.
ABSENT: Councilmen None.
Councilman Gordon moved the adoption of Recommendation No. 5
which was seconded by Councilman Claire and lost by the following roll
call vote:
AYES: Councilmen Gordon, Hilmer.
NOES: Councilmen Claire, Ellsworth, Garfield.
ABSENT Councilmen None.
On motion of Councilman Ellsworth, seconded by Councilman
Claire and carried, the report of the Chairman of the Police Committee
was ordered filed.
A report submitted by the Chairman of the Police Committee
relating to a wage scale•for police officers, togetherwith other
recommendations was read, and on motion of Councilman Ellsworth,
seconded by Councilman Claire and carried, the same,.-.was ordered filed.

The Chairman of the Police Committee presented a report
regarding the department of Harbor Master and in reference to certain
recommendations made by the 'Citizens Committee ".' The report was read
and on motion of Councilman Ellsworth, seconded by Councilman Claire
and carried, the report was ordered filed.
NEW BUSINESS:
City Attorney Thompson brought up the matter of the Fishing
Barge concession. Considerable discussion followed 'and upon a motion
by Councilman Claire, that C. E. McFarland be granted the concession
on the two ocean piers, and that an agreement be entered into with the
City for the duration of one, year. TeWl e motion was duly seconded by
Councilman Garfield and a Reaolution,� bfereto, after being considered
and designated Resolution No. 773, was adopted by the following roll
call vote, to —wit:
AYES: Councilmen Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilman Gordon.
ABSENT: Councilmen None.
Councilman Claire, Chairman of the Finance Committee,
requested a ruling from the City Attorney regarding the solvency of
certain funds of the City deposited 'in the-closed banks, whereupon the
City Attorney advised that the funds were amply secured by collateral
and the bond of the City Treasurer._
A Grant Deed from J. E. Binkley and N. F. Binkley to the
City of Newport Beach for street purposes, for the Easterl ten (10)
feet of Lots.Fifteen (15) and Sixteen (16) in Block One (1}, Section
Four (4) 'Balboa Island' was approved by the City Attorney, whereupon
Councilman Claire made a motion, duly seconded by Councilman Ellsworth
and carried, that said Grant Deed be accepted by said City of Newport
Beach, and the Clerk instructed to record the same forthwitfClt e County
Recorder of the County of Orange, State of California.
The said motion was carried by the following vote, to —wit:
AYES: Councilmen: Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.
ABSENT: Councilmen None.

meeting thereof held on the 16th day of January 1933.

A Grant Deed from J. L. Parks and Belle C. Parks, granting
to the City of Newport Beach for street purposes the Westerly ten (10)
feet of Lots Seventeen (17) and Eighteen (18) in Block Two (2) of
Section Four (4) '3.:.lboa Island' was approved by City Attorney Thompson,
whereupon Councilman Claire made a motion, duly seconded by Councilman
Garfield and carried, that said Grant Deed be accepted by said City
of Newport Beach, and the Clerk instructed to record same forthwith
with the County Recorder of the County of Orange, State of California.
That said motion was carried by the following vote, to —wit:
AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.
ABSENT; Councilmen None.

Mayor Hilmer brought up the matter of certain easements along
Edgewater Place in the Balboa Bayside Tract and it was moved by
Councilman Claire, seconded by Councilman Gordon and carried that the
City Engineer furnish the City Attorney with a description of the
property involved; the property owners to furnish the proper easements
by March 1st or remove fences build on city property.
City Engineer Patterson recommended the part time employment
of H. L. Connelly on the sewer system, and on motion of Councilman
Garfield, seconded by Councilman Ellsworth and carried, the same was
approved.
Demands No. 1385 to 1392 inclusive, having been duly audited
by the Finance Committee were on motion of Councilman Claire, seconded
by Councilman Garfield and carried, allowed and warrants ordered drawn
for same.
There -being no further business-to come before the Council
it was moved by Councilman Ellsworth, seconded by Councilman Claire
and carried that an adjournment be taken Sine Die.

The City Council of the City of Newport Beach met in
regular session at 7:30 o'clock P. M. on the above date at the City
Council Chambers of the City of Newport Beach, Mayor Hilmer
presiding.
The .roll was called showing the full Council present.
The minutes of the previous meeting of January 16th were
read and approved as read.
The reports of Department Heads were read and on motion of
Councilman Claire, seconded by Councilman Garfield and carried,
the reports were accepted and ordered filed.
SPECIAL COML:ITTEES:
City Attorney Thompson presented a report on the 'Muffler
Ordinance' and on motion of Councilman Ellsworth, seconded by
Councilman_ Garfield and carried, the report was ordered filed.
City Auditor Gant presented a letter in regard to certain
amendments to the City Tax Ordinance in order to conform with
existing and proposed State tax legislation. It was moved by
Councilman Claire, seconded by Councilman Gordon and carried, that
the letter be referred to the City Attorney, who advised delaying
the proposed amendments until after the adjournment of the State
Legislature, which would enable the City to incorporate in the
Ordinance any changes made by that body
City Treasurer Gant presented a communication from
J. A. Beek relative to the payment of a 2% of the gross receipts
from the Tidelands Lease, and on-motion of Councilman Claire,
seconded by Councilman Garfield and carried, the letter was ordered
filed.
Harwood Clark et al in a letter to the Council asked for
permission to engage,in the business of renting and repairing
bicycles. It was moved by Councilman Claire, seconded by Councilman
Ellsworth and carried that the City Clerk inform the applicants that
a general business license would be the only requirement for their
line of business.
