App oved: City Clerk .00 11101� Mayor of the City of Newport Beach Newport Beach, April 3, 1933- 459 The City Council of the City of Newport Beach met in regular session at 7:30 o'clock p. m. on above date at the City Council Chambers of the City,of Newport Beach, with Mayor Hilmer in the chair. The roll was called showing the full Council present. The minutes of the regular meeting of March 6th and-the the minutes of the.Special meeting of March 23rd were read and approved as read. The reports of Heads of Departments were read and on motion of Councilman Claire, seconded by Councilman Ellsworth and carried, the reports were accepted and ordered filed. City Engineer Patterson presented a detailed report of the damage done by the earthquake of March 10th to the City's utilities, together with estimate of expenditures up to and including March 31, 1933. The report was'read and on motion of Councilman Claire, seconded by Councilman Ellsworth and carried, the same was ordered filed. COMMUNICATIONS A letter from the DepArtment of Public Works of the State of California relative to State aid in making repairs to roads damaged by earthquake, was read, action on same being deferred until the transaction of new business. The City of Signal Hill in a letter to the Council and City Engineer extended an invitation to attend the opening of their Sewage Treatment plant on April 5th, and on motion of Councilman Claire, seconded by Councilman Ellsworth and carried, the same was referred to the Sewer Committee. The letter from the Bureau of Sanitary Engineering regarding projects held up for lack of funds, was on motion of Councilman Claire, seconded by Councilman Gordon andcarried, referred to the City Engineer. Heinz Kaiser's application for renewal of water contract, was on motion of Councilman Garfield, seconded by Councilman Claire and carried, ordered filed. The Los Angeles Athletic Club called attention to damage to bulkhead fronting on their property in Section 5, Balboa Island, and on motion of Councilman Garfield,-seconded by Councilman Gordon and carried, the matter was referred to the City Engineer. A. J. TwiEt presented a letter protesting against any proposed rezoning of East Newport property for business, and on motion of Councilman Claire, seconded by Councilman Gordon and carried the letter was referred to the Planning Commission. Letters from Severen Anderson and G. W. Kitzmiller complaining of certain requirements contained in the 'Chimney Ordinance' were on motion of Councilman Ellsworth, seconded by Councilman Garfield and carried, ordered filed. Catherii-, E. Stow in a letter to the Council asked if the discarded brick from fallen walls and chimneys could not be used to build incinerators on the beach, and it was moved by Councilman Claire, econded by Councilman Ellsworth and carried, that the City Clerk in orm the writer that the City is already maintaining incinerators on the beach. 460 :d Roy J. Lyons of the Balboa Yacht Basin applied for permission to install underground storage tanks for petroleum products and it was moved by Councilman Claire, seconded by Councilman Garfield and carried that the application be allowed subject to approval by the Fire Chief. It was moved by Councilman Claire, seconded by Councilman Garfield and carried that the Mayor be instructed to sign the waiver in favor of Motor Fuels Limited, in connection with the installation by them of certain filling station equipment on City owned property at the Balboa Yacht Basin. A communication from the Fountain Valley Land Owner's Association together with a resolution adopted by that organization protesting against the condition of the Santa Ana Joint Outfall Sewer, was read and on motion of Councilman Garfield, seconded by Councilman Claire and carried, the letter was ordered filed,and, the City Clerk instructed to acknowledge same. J. M. Downen, Superintendent of the Masonic Homes in a letter to the Council asked on what basis the tax refund made to them- was arrived at, and it was moved by Councilman Claire that the City Clerk be instructed to supply the necessary information to the writer. The motion was seconded by Councilman Garfield and carried. The Newport Harbor Fishermen's Protective Association asked the Council in a communication to instruct the City Clerk and other officials to refer all applications for fishing concessions from piers controlled by them to the Association for approval and on motion of Councilman Claire, seconded by- Councilman Gordon and carried, the request was complied with and the letter ordered filed. The League of California Municipalities presented a state- ment for the City's dues in the League and on motion of Councilman Claire seconded by Councilman Garfield and carried, a demand for the amount was allowed and their communication ordered filed. The City of Pasadena in a Resolution expressed their sympathy to this and other cities suffering damage by the earthquake disaster and on motion of Councilman Claire, seconded by Councilman Gordon and carried, the resolution was ordered filed. Fourteen applications for licenses to dispense wine and beer when and if legalized in this City, were presented and on motion of Councilman Garfield, seconded by Councilman Claire and carried, ' the applications were ordered filed. Petitions bearing in excess of 300 names asking that the City Council,submit to the voters the question of whether or not alcoholic liquors shall be licensed in the City of Newport Beach, were presented, whereupon the City Clerk certified that the petitions were sufficient as to the number of names required by law to call the election prayed for in the petitions. It was moved by Councilman Claire, seconded by Councilman Ellsworth.and carried that the petitions and certificate of the Clerk be filed. UNF X SHED BJSINESS The Ordinance amending License Ordinance No. 393 by eliminating Section 21 thereof, came up for final passage. The Ordinance was read, considered, designated Ordinance No; 411 and upon motion of Councilman Claire, seconded by Councilman Ellsworth, the Ordinance was adopted by the following roll call vote, to —wit: AYES: Councilmen, Gordon, Claire, Ellsworth, Garfield, Hilmer. NOES: Councilmen None. ABSENT: Councilmen None. City Engineer Patterson reported on the sidewalk easements on certain property fronting on Edgewater Place, and on motion of Councilman Gordon, seconded by Councilman Claire, and carried, the property owners effected were given until the regular meeting of August 7, 1933 to sign the necessary easements, NEW BUSINESS The monthly demands having been duly audited by the Finance Committee, it was moved by Councilman Claire, seconded by Councilman Garfield and carried, that the same be allowed and warrants ordered drawn for same. 461 Resolutions Numbers 774 to 782 inclusioe, authorizing and directing the Mayor and City Clerk to sign on behalf of the City for the renewal of contracts for furnishing water to certain parties outside the City limits, were presented and . it was moved by Councilman Garfield that the Resolutions be adopted. The motion was duly seconded by Councilman Claire and the Resolutions were passed by the following roll call vote, to -wit: AYES: Councilmen Gordon, Claire, Ellsworth, Garfield. NOES: Councilman Hilmer: ABSENT: Councilmen None. ' City Attorney Thompson presented a Resolution calling for a special election at which two propositions are to be submitted to the people on May 5, 1933, namely: "Shall the sale of alcoholic liquors be licensed in the City of Newport Beach? ", and "Shall Ordinance No. 52 be repealed and a new Ordinance be enacted permitting boats to race with unmuffled engines within the waters of Newport Beach, upon the conditions and restrictions stated in said new proposed Ordinance?" The Resolution was read, considered and designated Resolution No. 783, its adoption was moved by Councilman Garfield, seconded by Councilman Gordon and passed by.the following roll call vote, to -wit: AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer. NOES: Councilmen None. ABSENT: Councilmen None. City Attorney Thompson presented a resolution protesting against the inclusion of the City of Newport Beach in the water district as contained in a certain bill pending in the California Legislature. The Resolution was read, considered, designated Resolution No. 784 and on motion of Councilman Claire, seconded by Councilman Garfield, the same was adopted by the following roll call vote, to -wit: AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer. NOES: Councilmen None. ABSENT: Councilmen None. ' City Attorney Thompson presented a resolution authorizing and directing the Mayor and City Clerk to sign on behalf of the City of Newport Beach an agreement known as ?'Earthquake Relief Agreement No. 6" The adoption of the resolution which was designated Resolution No. 785 .was moved by Councilman Claire, seconded by Councilman Garfield and passed by the following roll call vote, to -wit: AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer. NOES: Councilmen None. ABSENT: Councilmen None. Councilman Ellsworth presented and moved the adoption of a resolution embodying a protest on the part of the City of Newport Beach against the proposed consolidation of grammar schools as outlined in a bill before the California Legislature. The motion was duly seconded by Councilman Claire, and designated Resolution No. 786, was adopted by the following roll call vote, to-wit: AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer. NOES: Councilmen None. ABSENT: Councilmen None. City Attorney Thompson presented for introduction an Ordinance amending Ordinance No. 189. The Ordinance was read, considered, designated Ordinance No. 412 and on motion of Councilman Claire, seconded by Councilman Gordon and carried, passed to a second reading. City Attorney Thompson offered for first reading an Ordinance respecting the use, within the corporate limits of the City of Newport Beach of certain internal combustion engines. The Ordinance was read, considered, designated Ordinance No. 413 and by motion of Councilman Claire, seconded by Councilman Ellsworth and carried the ordinance was passed to the second reading. There being no further business to come before the Council, it was moved by Councilman Claire, seconded by Councilman Ellsworth and carried that an adjournment be taken to 7:30 o'clock p.m. Monday April 10, 1933• Mayor of the City of Newport Beach A rove ^ -
