Newport Beach, April 10, 1933-
The City Council of the City of Newport Beach met in regular
adjourned session in the City Council Chambers of the City of Newport
Beach at 7:30 p.m. on the above date.
The roll was called showing the full Council present.
The reading of the minutes of the previous meeting of April
3rd was dispensed with.
On motion of Councilman Ellsworth, seconded by Councilman
Garfield and carried, reading of the minutes in the future is dispensed
with, same are to be submitted to each member of the Council for approval,
correction and signing.
COIUUNICATIONS
It was moved by Councilman Claire, seconded by Councilman
Ellsworth and carried, that the communication from the Railroad Commission
of the State of California, granting an extension of one year in the
City's application to construct a crossing at Orange Street, be filed.
The letter from the Harbor Master regarding the removal of
a building used by 'the Fire Department on the Balboa pier to the Washington
Street pier, was on motion of Councilman Claire, seconded by Councilman
Garfield and carried, referred to the City Engineer.
I. H. Wilbrat's application for a license to conduct a meat
market at 704 East Central Avenue, was on motion of Councilman Claire
seconded by Councilman Garfield and carried, allowed subject to the
approval of the Health Officer.
A. J. Charles' application for a license to operate a tamale
and drink stand at 704-2 East Central Avenue, was on motion of Councilman
Ellsworth, seconded by Councilman Garfield and carried, allowed subject
to the approval of the Health Officer.
J. C. McCain's application to conduct-a bakery business in the
Storey Building, was on motion of Councilman Ellsworth, seconded by
Councilman Garfield and carried, allowed subject to the approval of the
Health Officer.
Eight applications for licenses to dispense beer were read and
on motion of Councilman Gordon, seconded by Councilman Garfield and
carried, ordered filed.
UNFINISHED BUSINESS
City Attorney Thompson offered for adoption the Ordinance
amending Ordinance No. 159. The Ordinance was read, considered,
designated Ordinance No. 12 and on . motion of Councilman Claire,
seconded by Councilman Garfield was passed by the following roll call
vote, to —wit:
AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.
ABSENT: Councilmen None.
NEW BUSINESS
It•was moved by Councilman Claire, seconded by Councilman
Garfield and carried that certain demands having been duly audited by the
Finance Committee, be allowed and warrants drawn for same.
It was moved by Councilman Claire, seconded by Councilman
Ellsworth and carried, that the City Clerk be instructed to bill each
owner of a pleasure pier crossing City property for a rental of $5.00
per annum.
It was moved by Councilman Claire, seconded by Councilman
Ellsworth and carried that the Resolution protesting the inclusion of
the City of Newport Beach in a water district as outlined in a certain
bill now before the State Legislature, be signed and the City Clerk
instructed to mail copies of the Resolution to E. E. Campbell of Santa
Ana and also to all members-of the State Legislature representing this
district.
There being no further business to come before the Council,
it was moved by Councilman Ellsworth, seconded by Councilman Claire
and carried that an adjournment be taken Sine Die.

The City Council of the City of Newport Beach met in regular
session at the .City Council Chambers of the City of Newport Beach at
7:30 O'clock P. M. on above date.
The roll was called sharing all members of the Council present.
The minutes of the previous meeting were read, approved and
signed by members of the Council.
The reports of Heads of Departments were read and, on motion
of Councilman Claire, seconded by Councilman Garfield and carried the
reports were ordered filed.
A report from the City Planning Commission in which the zoning
of certain lots on the Bay Front between Montero and Anade for business
purposes was recommended to be denied, andon motion of Councilman
Claire, seconded by Councilman Gordon and carried, the report was
1 ordered filed.
City Engineer Patterson reported on the probable cost of
moving the building from the Balboa Pier to the Washington Street pier
for the use of the Harbor Master, and on motion of Councilman Claire,
seconded by Councilman Garfield and carried the expense was not
authorized and the report was ordered filed.
COMMUNICATIONS..
A letter from Samuel Tustin was read in which the City Council
was requested to zone Lot 33 and of Lot 34, Block.A, East Newport for
recreational purposes or vacate Edgewater Street on which the above
described property faces. It was moved by Councilman Gordon, seconded
by Councilman Garfield and carried that the communication be referred
to the Planning Commission.
George Bauer presented a letter in which was set forth the
reasons for delay in making repairs to his building on Lots 15 & 16
Block 21, Newport Beach, and on motion of Councilman Claire, seconded
by Councilman Garfield and carried the matter was referred to the
Building Inspector.
A communication from J. C. Elliott and E. I. Moore requesting
that the City Council amend the Ordinance prohibiting the sale and
shooting of fireworks within the City limits. The matter was discussed
at length by the Council and the petitioners, and on motion of
Councilman Claire; seconded by Councilman Gordon and carried, the
City Attorney was instructed to prepare an Ordinance in conformity
with the Ordinance in effect in the City of Los Angeles, and specifying
that the shooting 68 fireworks be limited to water fronts only in the
City of Newport Beach.
A letter from the Santa Ana Building & Loan Association
complaining of the restriction contained in the Chimney Ordinance of
this City, was read. It was moved by Councilman Garfield, seconded by
Councilman Ellsworth and carried, that the City Attorney reply to the
letter.
A letter from E. E. Campbell, Chairman of the Santa Ana Basin
Water Rights Protective Association was read, and on motion of
Councilman Claire, seconded by Councilman Garfield and carried the
letter was ordered filed.
