The City Co,mcil of the City of Newport Beach met in regular
adjourned session at the City Council Chambers of the City of Newport
Beach at 7:30 o'clock P. m. on above date.
The roll was called showing the full Council present.
The minutes of the previous meeting of July 3, 1933 having been
read and approved were duly signed by the members of the Council.
' SPECIAL COMMITTEES None.
STANDING COMMITTEES
Councilman Claire brought up the matter.of the request of certain
operators of games in Balboa wherein they desired an ordinance to be
enacted by the City Council which would compel the closing of such games
at 2 o'clock a. m. A motion was made by Councilman Claire seconded by
Councilman Garfield and carried, instructing the City Attorney to prepare
an ordinance complying with the request.
COMMUNICATIONS
F. W. Babcock's application for a license to-operate riding
devices at 23rd Street and Ocean Front in Newport Beach, was considered
and on motion of Councilman Claire, seconded by Councilman Gordon and
carried the license was granted subject to the approval of the Building
Inspector.
The application of Russell Norton for a license to sell beer at
303 Marine Avenue, Balboa Island was, on motion of Councilman Gordon,
seconded by Councilman Garfield and carried, allowed subject to the usual
regulations.
The application of Prank L. Scott for a.resturant license at
766 State Highway was, on motion of Councilman Garfield, seconded by
Councilman Gordon and carried, allowed subject to the approval of the
' Health Officer.
The application of Waller Kaufman for a restaurant license at
Marine and Park Avenues Balboa Island was, on motion of Councilman Claire,
seconded by Councilman Garfield and carried, allowed subject to the
approval of thelHealth Officer.
It was moved by Councilman Claire, seconded by Councilman
Garfield and carried that F. W. Babcock be permitted to play music
incident to a merry -go -round in accordance with the permit granted for
the same.
Fred E. Burlew presented a letter in which complaint was made
to the unsanitary practices of transient visitors at Corona. Del Mar and
asked the City Council to take steps to remedy the matter by installing
conveniences in that district. On motion of Councilman Garfield, seconded
by Councilman Gordon and carried, the letter was ordered filed.
A petition bearing 22 names of Corona Del Mar residents request-
ing that Antar Deraga be made a member of the Life Guards of the City
was presented, and. on motion of Councilman Ellsworth, seconded by Councilmm
Gordon and carried, the petition was referred to the Fire Committee.
Harbor Master Robinson's communication calling the Council's
attention to certain sand boxes erected on the North Bay Front of Balboa
Island was, on motion of Councilman Claire, seconded by Councilman Gordon
and carried, referred to the City Engineer who was instructed to -Inform those
responsible for the sand boxes to apply to the City Council for permission
to construct same.
F. M. Clark, ,Director of the Balboa School of Swimming and Diving
'in a communication to the City Council asked that a fee of Fifty Dollars
per month be paid for Life Guard service at the City Camp Ground. It was
suggested by Councilman Claire that two days per week from the Life
Saving fund be allocated to the Camp Ground-, and on motion of Councilman
Claire, seconded. by Councilman Garfield and carried, the matter was referred
to the Fire Committee with power to act.
Harold I. Johnson's communication protesting against the removal
of his gasoline pump from the sidewalk at 706 East Bay Avenue was read,
and it was suggested by Councilman Garfield that a stay of 60 days should
be granted those having pumps on City property. A motion was made by
Councilman Claire, seconded by Councilman Gordon and carried, that the
letter from Mr. Johnson be filed.

Stephen B. Dexter of the Heirs Research and Recovery Bureau,
presented a letter to the Council dealing with certain tidelands location,
the letter was read and on motion of Councilman Claire, seconded by
Councilman Gordon and carried, the same was ordered filed.
A letter from the State Association of California Architects
was read and on motion of Councilman Ellsworth, seconded by Councilman
Claire and carried the letter was referred to the Building Inspector.
UNFINISHED BUSINESS
A petition bearing in excess of 400 names, together with '
several letters protesting the ban placed on peddling wagons was
presented to the Council and considerable discussion was had concerning
the matter. A motion was made by Councilman Ellsworth, seconded by
Councilman Gordon and carried, that the City Attorney be instructed to
prepare an Ordinance to control the situation and setting a tentative .
license fee of $12.00 per annum.
On motion of Councilman Ellsworth an Ordinance amending license
Ordinance No. 393 was Introduced for first reading, the motion was duly
seconded by Councilman Gordon and carried.
On motion of Councilman Claire, seconded. by Councilman.Gordon
and carried, the letters and petitions pertaining to the peddling wagons
were ordered filed.
City Engineer Patterson presented a letter and demand from
Peterson Bros. regarding the balance due them in connection with the
maintenance of trees and parks at Corona Del Mar and, on motion of
Councilman Ellsworth, seconded by Councilman Gordon and carried, the
City Clerk was instructed to write to Peterson Bros. informing them
that.the fund from which these payments are made is still in the red
and it would be impossible for the City to pay anything at this time.
R. L. Butcher of the Sierra Service Organization submitted a
proposal to the Council to recover certain funds due the City'on a
basis of a fee representing one -third of the amount recovered and asked
that a resolution be adopted by the Council confirming acceptance of
same. On motion of Councilman Claire, seconded by Councilman Gordon
and carried, the City Attorney was instructed to prepare the resolution ,
to be presented at the next meeting of the Council.
NEW BUSINESS
On motion of Councilman Claire, seconded by Councilman Garfield
and carried, the demand of the Chamber of Commerce amounting to One Hundred
Dollars was allowed to be charged to Budget Account No. 360 -B, and warrant
to be drawn for same.
The amendment to the Tax Ordinance came up for .final passage,
the Ordinance was read, considered, deblared to be an urgency measure
and designated Ordinance No. 417, whereupon a motion for its adoption
was made by Councilman Claire, and the Ordinance was adopted by the
following roll call vote, to -wit:
AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.
ABSENT: Councilmen None.
The amendment to Zoning Ordinances No. 204 and No. 367 was
presented for final passage. The Ordinance was read, considered,
designated Ordinance No. 419 and on motion of Councilman Claire, the
Ordinance was adopted by the following roll call vote, to -wit:
AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.
ABSENT: Councilmen None. '
City Engineer Patterson presented credit memorandas respecting
certain uncollectable water accounts and on motion of Councilman Claire,
seconded by Councilman Garfield and carried, a resolution was adopted
authorizing the writing off of the uncollectable accounts.
The term of a member of the Library Board having expired
Mayor Hilmer with the unanimous approval of the Council appointed
Mrs. Herman Hilmer as a member of the Library Board to succeed herself.

ADJOURNMENT
There being no further business to come before the Council
a motion was made by Councilman Claire,, seconded by Councilman Gordon
and carried that an adjournment be taken to July 17, 1933 at 7:30
o'clock p. m.

The City Council of the City of Newport Beach met in regular
adjourned session in the Council Chambers of the City of Newport Beach
at 7:30 o'clock p. m. on above date with Mayor Hilmer in the Chair.
The roll was called showing the full Council present.
The minutes of the previous meeting were read, approved and
signed by the members of the Council.
' SPECIAL COMMITTEES
Councilman Garfield reporting on the request of residents of
Corona Del Mar for additional life guard service for the district
advised the Council that the budget allowance would not permit the
necessary expenditure and on motion of Councilman Gordon, seconded by
Councilman Claire and carried, the report was accepted.
STANDING COMMITTEES None.
COMMUNICATIONS
A communication concerning sand boxes on the Balboa.Island
Bay Front was read and discussed and on motiom of Councilman Garfield,
seconded by Councilman Gordon and carried, the matter was laid on the
table pending further information.
The best Newport Yacht Club applied for permission to hold
motor boat and swimming races around Newport Island on Sunday July
30th and on motion of Councilman Claire, seconded by Councilman Gordon
and carried, the request was granted.
The Southern California Outboard Association asked for
permission to hold unmuffled outboard motor boat races in the Upper
County Channel between 9 a. m. and 5 P. m. August 6, 1933 and on motion
' of Councilman Garfield, seconded by Councilman Gordon and carried, the,
request was allowed.
Russell B.. Garmong, Commander of the Compton Chapter of D. A. V.
asked for permission for them to hold their annual picnic on the beach
near 20th Street, Newport Beach, including the shooting of fireworks,
and on motion of Councilman Claire, seconded by Councilman Gordon and
carried, the request was allowed subject to proper supervision.
A letter from a Seismological Society was read and on motion
of Councilman Claire, seconded by Councilman Garfield and carried, the
letter was referred to the Building Inspector.
