Newport Beach, October 2, 1933
The City Council of the City of Newport Beach met in regular
session in the City Council Chambers of the City of Newport Beach at
7:30 p. m. on above date with Mayor Hilmer in the-chair.
The roll was called showing the full Council present.
REPORTS OF HEADS OF DEPARTMENTS
The reports of Heads of Departments were read, and on motion
of Councilman Ellsworth, seconded by Councilman Garfield and carried,
the reports were accepted as read and ordered filed.
REPORTS OF SPECIAL COMMITTEES: None.
REPORTS OF STANDING COMMITTEES: None.
On motion of Councilman Ellsworth, seconded by Councilman
Garfield and carried, the regular order of business was suspended to
open bids submitted for the purchase of certain City owned property.
On motion of Councilman Gordon, seconded by Councilman
Ellsworth and carried the action to suspend the regular order of business
was rescinded.
COMD'.UNICATIONS:
George C. Hiner, in a letter to the Council asked for a reduction
in rental for certain privileges on the Newport pier for the ensuing year,
and on motion of Councilman Claire, seconded by Councilman Ellsworth and
carried, the communication was laid on the table.
The application of H. C. Mower to construct a pleasure pier
fronting Lot 15,•Block 8, Section 1 Balboa Island, was'on motion of
Councilman CTaiie, seconded by Councilman_ Ellsworth and-carried, referred
to the City Engineer for approval._ '.
Fritz %arge in a letter to the Council commended the efficiency
of-Life Guard Baker and on motion of Councilman Claire, seconded by
Councilman Garfield and carried, the letter was ordered filed.
P. V. Moffat in a letter to the Council expressed his
appreciation of the efficiency and kindness of Harbor Master Robinson,
and on motion of Councilman Garfield, seconded by Councilman Gordon
and carried, the letter was ordered filed.
W. L. Jordan's communication soliciting a portion of the
insurance carried on the City's automobiles, was on motion of Councilman
Ellsworth, seconded by Councilman Garfield and carried, laid on the table.
On motion of Councilman Ellsworth, seconded by Councilman
Claire, and carried, the automobile insurance carried by the City was
equally allocated to Lew H. Wallace, H. H. Williamson and W. L. Jordan.
The notice of cancellation of the lease and order to vacate
served on Joe Elliott regarding certain City owned property in Block
9, Balboa Tract, -was read and on motion of Councilman Ellsworth, seconded
by Councilman Claire and carried, the same was ordered filed.
The communication from 17m. R. Law concerning a pump was presented
after being laid on the table from the previous meeting, together with
the reply to same by the City Engineer, and on motion of Councilman
Claire, seconded by Councilman Garfield and carried, the same was ordered
filed.
UNFINISHED BUSINESS None.
NEW BUSINESS
The monthly demands having been duly audited by the Finance
Committee, were on motion of Councilman Claire, seconded by Councilman
Ellsworth and carried, allowed and warrants ordered drawn for same.
An Ordinance relating to the temporary remission of penalties
on deliquent taxes was read and considered and on motion of Councilman
Ellsworth, seconded by Councilman Gordon and carried the Ordinance was
declared an urgency measure, and to take effect immediately upon the
publication thereof.

The Ordinance dealing with deliquent taxes and the payment
thereof in installments was presented for passage and was designated
Ordinance No. 421, the adoption of which was moved by Councilman Claire
and was passed by the following roll call vote, to -wit:
AYES: Councilmen Gordon, Claire, Ellsworth, Garfield, Hilmer.
NOES: Councilmen None.
ABSENT: Councilmen None.
OPENING BIDS
Various bids having been received for the purchase of City
owned property were opened and on motion of Councilman Claire, seconded
by Councilman Ellsworth and carried, the bid of Esther Edmonds of
$209.50 for Lots jl and 32, Block 16, Section j, Balboa Island being
the highest bid was accepted by the Council.
On motion of Councilman Claire, seconded by Councilman
Ellsworth and carried, all the other bids were rejected.
City Attorney Thompson presented a complaint to Quiet Title
on certain properties within the City of Newport Beach, and on motion
of Councilman Ellsworth, seconded by Councilman Claire, and carried
the Mayor was instructed to sign the complaint and the City Attorney
to proceed with the suit to quiet title.
The claim of Lollie Fenelon for $25.00 for a doctor bill due
to her hand having been broken occasioned by a defective plank in the
boardwalk, was on motion of Councilman Claire, seconded by Councilman
Ellsworth and carried, allowed.
It was moved by Councilman Gordon, seconded by Councilman
Garfield and carried that the City Engineer and the City Attorney
take the necessary steps to protect the City against liability on account
of the boardwalk.
Mr. Frost of the Edison Company addressed the Council relative
to the installation of poles and wires for the new feeder line into the
Sub - Station, and on motion of Councilman Ellsworth, seconded by
Councilman Claire and carried, the request was granted..
' The demand of Mollie Fenelon for $25.00 for doctor's fees,
was on motion of Councilman Claire, seconded by Councilman Ellsworth
and carried, allowed subject to the signed waiver as to further claims.
ADJOJRNMENT:
There being no further business to come before the Council,
on motion of Councilman Ellsworth, seconded by Councilman Claire and
carried, an adjournment was taken Sine Die.

RESOLUTION NO. 7992f AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE AND DELIVER A DEED TO LOTS 31 AND 32, BLOCK 16, SECTION 32
BALBOA ISLAND, IN FAVOR OF ESTHER EDMONDS, WAS PASSED BY THE FOLLOWING
ROLL CALL VOTE, TO WIT:
AYES, COUNCILMEN: GORDON, CLAIRE, ELLSWORTH, GARFIELD, HILMER.
NOES, COUNCILMEN: NONE.
ABSENT, COUNCILMEN: NONE.
