The City Council of the City of Newport Beach met in regular session at the City Council Chambers of-the City of Newport Beach at 7:30 o'clock P. m. on above date, with Mayor Hilmer presiding. The roll was called showing the full Council present. REPORTS OF HEADS OF DEPARTMENTS '. The monthly report of the City Treasurer was read and on motion of Councilman Claire, seconded by Councilman Gordon, the report was accepted, ordered filed. Reading of reports of the other department heads dispensed with and ordered filed. REPORTS OF SPECIAL COMMITTEES None. REPORTS OF STANDING COMMITTEES None. OPENING BIDS On motion of Councilman Claire, seconded by Councilman Garfield and carried, the regular order of business suspended in order to open bids submitted for the purchase of certain City owned real estate in accordance with the advertised notice of sale. The following bids were received: For Lot 8, Block 9, Section 2, Balboa Island, George H. McFarland $97.50; R. E. Woods $176.00. For Lot 9, Block 9, Section 2, Balboa Island; George H. McFarland $75.00. For Lot 15, Block 6, Section 3, Balboa Island; George H. McFarland $112.50; Glenn W. Gardiner $120.00; W. E. Lawrence $226.00. For Lot 8,• Block 12, Section 3, Balboa Island: Harvey D. Pease $230.00; W. E. Lawrence $106.00. The bids were considered and it was resolved by the City Council 'to accept the bid of R. E. Woods of $176.00 for Lot 8, Block 9, Section 2, Balboa Island; W. E. Lawrence of $226.00 for Lot 15, Block 6, Section 3, Balboa Island; Harvey D. Pease of $230.00 for Lot 8, Block 12, Section 3, Balboa Island, by the following roll call vote, to -wit: AYES, COUNCILMEN: Gordon, Claire, Ellsworth, Garfield, Hilmer. NOES, COUNCILMEN: None. ABSENT, COUNCILMEN: None. Resolution No. 809 authorizing the Mayor and City Clerk to sign the deeds conveying the above described property to the successful bidders was adopted by the following roll call vote, to -wit: AYES, COUNCILMEN: Gordon, Claire, Ellsworth, Garfield, Hilmer. NOES, COUNCILMEN: None. ,ABSENT, COUNCILMEN: None. On motion of Councilman Claire, seconded by Councilman Garfield, and carried, the rest of the bids were rejected and the money accompanying same ordered returned to the bidders. On motion of Councilman Claire, seconded by Councilman Garfield and carried, the regular order of business was resumed. The application of C. D. Gates for a permit to operate a lunch stand and fishing tackle business at 100 Main Street,- Balboa, was on motion of Councilman Garfield, seconded by Councilman Claire and carried, allowed subject to the approval of the Health Officer. The application of Effie Rayner for a permit to pick up laundry in the City -for a hand laundry, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, referred to the City Attorney for report at the next meeting. The request of Russell Stroup representing the Newport Beach Welfare Association for ten sacks of City owned beans, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, allowed. The request of the Newport Beach Cooperative Workers Relief Association for ten sacks of City owned beans was on• motion of Councilman Ellsworth, seconded by Councilman Claire and carried, allowed. 24 Cn The application of Reuben Cole to construct a pier and slipsi on the North Channel fronting on Tract 919, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, referred to City Engineer Patterson for report after the customary two weeks time allowed for consideration of same. The application of A. W. Burns for a pier with floats and slips on the North Channel fronting on Tract 919, was on motion of Councilman Claire, seconded by Councilman Garfield and carried, referred to City Engineer Patterson for report, after the customary two weeks allowed for consideration of same. COMMUNICATIONS I A letter from George J. Fowler asking for information regarding the vacation of a certain portion of Bay Avenue was read and on motion of Councilman Garfield, seconded by Councilman Claire and carried, the City Clerk was instructed to reply to same setting forth all the available information respecting the matter. A request from Harold,A. Bartlett for permission to include a Real Estate office in his proposed residence on Lot 189 Block 11, Tract 234, was on motion of Councilman Garfield, seconded by Councilman Ellsworth and carried, denied due to zoning restrictions which do not permit business enterprises in that tract. The City Clerk was instructed to advise Mr. Bartlett to that effect. Chief-of Police Hodgkinson in a letter to the Council advised. in connection with the Orange County Police Radio that the Bosch type of radio receiver had been practically adopted by the County of Orange and various incorporated cities in,the County, also stating that no provision had been made in the police budget.for the purchase of the two short wave receivers for police cars, and one A. C. short wave receiver for the Police Station. On motion of Councilman Ellsworth, seconded by Councilman Gordon and carried,,the matter was referred to the Police Committee and the Finance Committee with power to act. C. F. Dennison requested in a letter that a four -way. stop . sign be ins�alled at 36th Street and Coast Boulevard, calling attention to the probability of accidents at that point. On motion of Councilman Gordon, seconded by Councilman Qt rfield and carried,.the matter was , referred to the Street.Committee for report, whereupon Councilman Ellsworth as Chairman of the Street Committee stated that the existing. stop si gne.2 were sufficient and, on motion of Councilman Garfield, ' seconded by Councilman Ellsworth and carried, the report was accepted. On motion of Councilman Ellsworth, seconded by Councilman Claire and carried the letter of Mr. Dennison was ordered filed. , Chief of Police Hodgkinson asked the approval of the Council for the installation of a blinker sign at "B" Street and the terminus of the Pacific Electric Tracks, due to frequent accidents at that point. The City Attorney ruled that the City was not responsible for any existing hazard at that point and, on motion of Councilman Ellsworth, seconded by Councilman Garfield and carried, the communication was ordered filed. Mrs. Carrie A. Hill in a letter to the Council requested that lights be placed along Seashore Drive, and on motion of Councilman Claire, seconded by Councilman Garfield and carried, the City Engineer was instructed to write to Mrs. Hill and advise that other parts of the City had acquired their lighting systems by assessment in their respective districts. On motion of Councilman Garfield, seconded by Councilman Gordon and carried, the regular order of business was suspended in order to allow Harold E., Pomeroy, Field Representative of the League of California Municipalities, to address the Council in reference to the newly formed Southern California League of Municipalities. On motion of Councilman Ellsworth, seconded by Councilman Gordon and carried, the regular order of business was resumed. Edward H. Allen, owner of the Balboa Inn, in a letter to ' the Council complained of the noise occasioned by the shooting gallery across the street, after considerable discussion about the matter, it was moved by Councilman Ellsworth, seconded by Councilman Claire and carried, that the City Attorney prepare an amendment to the City Ordinance, eliminating the licensing of shooting galleries within the City, and that the letter of Mr. Allen's be filed. • A communication from the' Secretary of the Chamber of Commerce referred to a request from the Newport Harbor Baseball Club for financial aid in the amount of fifteen dollars per month, and on motion of Councilman Claire, seconded by Councilman Garfield and carried, the request was granted, the money to be derived from the advertising fund. 25 On motion of Councilman Ellsworth, seconded by Councilman Claire and carried the communication from the Chamber of Commerce was ordered filed. A letter'fr6m Dr, Webster J. Daly expressing his appreciation for the courteous help rendered by Harbor Master Robinson in recovering his boat from parties attempting to steal same, was on-motion of Councilman Claire, seconded by Councilman Garfield and carried, referred to the Hdrb6r Master. Attorney Oscar B. Olson filed a claim on behalf of Andrew J. Lenox for alleged injuries sustained by his client while confined in the City jail on a drunk and disorderly charge. On advise of City ' Attorney Thompson, it was moved by Councilman Claire, seconded by Councilman Garfield and carried, that the claim be rejected. Lura A. Schofield, President of the Corona Del Mar Property Owners Association in a letter addressed to C. A. Pullen in which the latter was asked to appear and represent the Association at the Council Meeting in the matter of removal of the telephone mileage charge for telephone subscribers of the Corona Del Mar District, and the reopening and improving the road from Pacific Drive to Ocean Boulevard. On motion of Councilman Gordon, seconded by Councilman Claire and carried, that the Mayor appoint a committee to work with the City Attorney in regard to taking up the matter of rates with the Telephone Company. Whereupon Mayor Hilmer appointed Councilman Gordon and C. A. Pullen as a committee. It was moved by Councilman Claire, seconded by Councilman Garfield and carried, that the City Attorney write to the "owners of Block "D" in Corona Del Mar in reference to the dedication of a street from Pacific Drive to Ocean Boulevard, the City Attorney 'to be assisted by other City officials as directed by him. A communication from W. E. Hinshaw, President of the Los Angeles County League of Municipalities was read, and on motion of Councilman Claire, seconded by-Councilman Gordon and carried, the letter was ordered filed. A letter from George A. Barrows, Secretary of the General Contractors Association of Orange County relating to amount of bids required of contractors was read, and on motion of Councilman Ellsworth, ' seconded by Councilman Gordon and carried, the letter was ordered filed. F.. A. Baughan, Secretary of the Southern California League of Municipalities presented various communications which on motion of Councilman Claire, seconded by Councilman Garfield and carried, were .ordered filed. A statement from A. H. Abel, Secretary & Treasurer of the Pacific and Far East Ports, for dues for 1933 and 1934, was on motion of Councilman Claire, seconded by Councilman Gordon and carried, ordered filed. NEW BUSINESS The monthly demands having been duly audited by the Finance Committee were on motion of Councilman Claire, seconded by Councilman Garfield and carried, allowed and warrants drdered drawn for same. City Engineer Patterson presented an easement from the Southern Pacific Railway Company for installation of storm drain at 57th Street, and on motion of Councilman Claire, seconded by Councilman Garfield and carried, the Mayor and City Clerk were authorized to sign same for the City.
